>> hey, good morning to you. we always talk about averages in the weather department. and funny thing about here in the bay area this year, 2014 so far is we have yet to hit anything average. we're going back from one extreme to another. temperatures this morning mostly in the 40s. we're headed toward near record warmth today, a touch cooler for tomorrow. and then we're talking about record rainfall in the bay area. potentially six feet of snowfall at least on the way to tahoe. so we're going to tap back into the atmospheric river. make sure you're ready for the changes. dress for the 70s today and tomorrow and then pull out the umbrella. we'll time out the showers coming up. back to you, scott, laura, and the top stories of the day. >> it's 5:01. city of san jose faced with a huge homeless problem, considering housing some of the population in empty motel rooms getting them off the street hopefully back on their feet. peggy bunker joins us in the

studio. how would it work? >> isn't this an interesting idea, laura. getting homeless off the streets putting them up in empty hotel or motel rooms. it sounds extreme, maybe expensive but it's what the council will discuss in hopes of helping one of the biggest homeless populations in the country, those here in san jose. the number of homeless here sitting under about 4800 people. at the root of the problem, expensive housing and landlord's ability to grant or deny a lease. two-thirds say yes, it's the expensive rent. that's the reason they are on the street. right now studio apartment in san jose will cost about $1100 a month. a full time minimum wage job pays $1600 before taxes. we're talking about housing eating up your entire earnings. motel owner told the "mercury news" i love this idea.

i have no objection to that at all. i'd rather have full than empty. so here's how it would work. vouchers would be give tune the homeless to use at the motels where they would receive discounted rooms for 25 to $40 a day, the same other es dents such as san jose state students and local restaurants cooks pay to live there. they stay for possibly up to five years providing steady income for motel owners who can't get asking price of 80 to $90 on a regular basis. the homeless population in san jose grew by 16% in 2013, in fact, three people died in december while out on the street in that cold month. the city will discuss the plan today, it could be implemented as early as this summer. >> going to be a lot of controversy with that. >> first responders from the bay area and across the state will be in fresno to pay their respects to the two chp officers killed in the line of duty. a memorial service for brian law and juan gonzalez will be held

at the save mart center. last monday the men were headed to the scene after crash on highway 99 near fresno when their cruiser flipped. law and gonzalez have ties to the bay area. law began his chp career in oakland, gonzalez worked at the chp office in san jose. >> it's 5:04. hundreds of untested rape kits are about to be fast tracked hopefully clearing out a backlog in alameda county. the district attorney is shipping themthe east coast. the move follows a recent audit of alameda county revealing 1900 untested rape kits. new legislation is addressing the back log. it would set time limits for unprocessed evidence across california. >> stanford university will soon stop selling tobacco products. christie smith live at stanford with the reason behind the change. good morning. >> reporter: good morning to you, scott. we've been walking around the union this morning and there aren't many ashtray stands set

up. we only found one place this morning that suggests that it would be an okay place to smoke here. but this request came at the request of stanford university that the two vendors that do sell cigarettes stop selling them here by march 1. the university already has a smoke-free environment policy. that bans smoking in classes, offices, enclosed buildings and resident halls, to smoke outside you basically have to be at least 30 feet away or more from any building. stanford says that it is an advocate for health and well being and tobacco sales, basically go against that. so this includes any tobacco products, we're talking about chewing tobacco, all the way down to ecigarettes. the school of medicine has been smoke-free since 2007. this expected to take effect by

march 1. reporting live at stanford university, christie smith, "today in the bay." >> thank you much. >> 5:05. pg&e crews say downed wires caused several thousand in san francisco to lose power. it affected more than 66,000 customers in the richmond district. it began after 10:00, power has been restored to most people in the area now. pg&e wires were hanging down in that area, but they don't know what knocked them down. >> let's check in with christina loren. she has got a fabulous monday forecast. >> you know, i think it's a fabulous forecast all week because temperatures are going to be comfortable today, tomorrow, and then when things change, it's in a dlaex we need. that is more precipitation for our reservoirs and especially the snowback. it's the snowpack that is important when it comes to this drought. we need it. hey, even if we do get out of the drought, i say hey, we still want to conserve water as often

as we can because our usage here impacts what they have available in the central valley. i'm talking about our farmers. 45 degrees in san francisco, east bay at 42, and feels good when do you something to help somebody else. hey, turn the water faucet off, 10% earlier than usual and you're doing snag is going to help the state of california. 69 in san francisco, east bay at 73 degrees today. you can't beat that. south bay at 74 degrees. and we're still going to get into the winter-like pattern throughout the day. so abundant sunshine, warm temperatures. that rain is moving in and once it does we're going to be in that pattern for over five to six days. maybe over a full week of rain in the forecast. i'm going to talk about that. right now mike is back and the kids are back in school. >> so now my kids are happier because their friends also have to go to school. we're looking over toward the east bay. this is the tri-valley i should

say. west 58 into dublin. a few more cars but a smooth drive here. part of that reason why it's lighter is because folks were held up. here this is where folks were held up. we had car broken down. sounded like a flat tire. maybe had the slow lane. still it's rippling back into the altamont pass. approaching the bay bridge, across the richmond/san rafael bridge the speeds in the north bay on the other side, south 101 and west 37, the commute is in the green as far as the speeds go. a quick look at the peninsula. a live shot shows you i didn't put that in there. i did. there you go. 101 to palo alto. no problems. that's good stuff heading south with the headlights. back to you. >> thank you. this morning the dalai lama wraps up his bay area visit with a trip to the south bay. hundreds come to see him speak.

he is expected to be greeted by dozens of protesters as well. bob is live with more on the dalai lama's visit. good morning. >> reporter: good morning. the dalai lama we're talking about a few hours from now will speak to what's going to be a sold out crowd here at santa clara university. about three values, business, ethics and compassion, how silicon valley can empraise those three values in its quest to make money. this is a third and final day in the bay area. he arrived friday, spoke on saturday, dedicated tibetan community center yesterday and spoke at berkeley high, how to achieve happiness through compassion and selflessness. there were dozens of protesters and more expected. they are buddhists like the dalai lama but they expect to a different sect that his holiness rejects because of its history

of hostility. should they believe he holds that history against them and as a result subjected them to persecution. >> this is an absolute outrage. the dalai lama has an opinion, he is free to teach anything he wants but once that opinion is imposed on other people then it becomes religious discrimination. >> if you let compassionate life 100% sure go to heaven. >> that was his holiness responding to a question from the audience about what happens to us after death. he said if you lead a meaningful compassionate life you will go to heaven. he did take several questions. he will answer from students at santa clara. these are questions that students submitted on social media. again he will speak here on campus, the speech is supposed to last an hour and a half

a year, the bureau of real estate has accused the broker of corporations fraud making misrepresentations on investments and dishonest dealing. nearly a dozen people have come forward claiming that coyle invested their money into properties he then sold without their knowledge. tonight the latest development in the case against coyle and not only do they catch up with him, so does the investigative unit. >> we accused, in this case, w.b. coyle and his corporations, really the most egregious violations. >> you want to explain to your investors if they are going to get their money back? you want to say anything sir? >> tonight at 11:00, tony also explains how the bureau of real estate enforced its strictest penalty against coyle and how investors may get some of the money back. >> you crane's acting interior minister issued a warrant for the arrest of ousted president

victor yanukovych. dozens of people were killed, hundreds hurt in clashes between protesters and police. yesterday yanukovych relinqui relinquished his detail and drove off. calls are mounting to put him on trial after his tumtous presidency. the violence in part responsible for a spike in gas prices. morgan brennan is live at cnbc world headquarters. good morning. >> good morning. new industry survey shows gas prices rising nearly 12 cents in the past two weeks to a national average of $3.41 a gallon. in san francisco gas is averaging $3.83 a gallon, and in san jose it's $3.76 a gallon. the spike comes as oil prices rise in response to heightened concern over the recent violent unrest in ukraine, venezuela and south sudan. apple says it will issue a

looking good. it's looking promising for showers as well so. a little something for everybody. especially our farmers who need it for their livelihood. rain is on the way and a lot of it. right now we're focusing on the warming trend that's going to linger. in fact, today we'll cool a couple degrees. if you liked yesterday a couple degrees warmer today, a couple degrees cooler tomorrow. temperatures are chilly, mostly clear to start the day. the sunrise is going to occur at 6:49 this morning. throughout the day today, temperatures will be comfortable because of this clear start to the day, offshore flow and high pressure bringing the numbers up toward record levels yet again. hazy sunshine, we're going to see a little haze, our air quality does tend to suffer with this offshore flow pattern. by this evening spectacular. you can get out to the beach, about 71 in santa cruz. 5:56 is your sunset. our days are getting longer, temperatures getting warmer. as i said that pineapple express is coming back, we're about 48

hours away from our first showers returning to the bay area. bottom of the screen, once we're in the thick of it we're going to keep the shower chances going for the next five, maybe seven days. here's what we're looking at. through tomorrow temps tumble a touch, and then they really crash as we get into wednesday. today and tomorrow great for activities. wednesday we'll lose 5 to 10 degrees, and rain moves in. so let's time that out. help you get outdoor you have to on wednesday. we stop the clock for you. you are fair game until about 10:00 a.m. when the front arrives. mostly impacting the peninsula. once these systems start coming in we're going to stay rainy all the way through 9:00 a.m. friday. and then we keep this pattern going, staying in that atmospheric river all the way through sunday. so basically you want to make indoor plans starting on wednesday all the way through sunday. we'll have breaks of sunshine as the system gets closer to us i'll be able to time it out better. let's see how we're doing on your roads.

here is mike. >> relative on a monday t the standards are lower. looking to the rest of the bay, a smooth drive along the peninsula side. let's focus here where we see the build of traffic and the colors other than green. this is west 580 off 205 out of the central valley. a couple of incidents. one for 580 at grant line road. lanes are cleared but westbound your commute we have a big rig on the shoulder, that is a distraction, adding to slowing, in toward the almost valley we had a car broken down. it's on the shoulder but again, activity, distraction a little slowing and now the build for the dublin interchange and 84 through livermore not a big surprise. heading to the castro valley y, a smooth drive. speeds a tiny bit dipping. peninsula smooth as well. down to or from the south bay. the northbound routes no slowing yet. we'll see it here, north of 680

off when the vehicle went over an embankment and rolled about 200 feet. emergency responders found him pinned beneath a piece of the tractor and declared him dead at the scene. >> new details this morning on an accident involving an amtrak train and a car in fremont. that happened last night on dusterbury way when firefighters arrived one person was already out of the car, the other person trapped inside unconscious. firefighters were able to get the person out, both taken to the hospital with major injuries. we haven't been told if there are passengers on the train or why the car was on the tracks in the first place. >> the san jose city council considering a plan to get the homeless population off the streets, and into local motels. peggy bunker joins us with a look at the new controversial plan. >> good morning. 4800 people, that's how many homeless are on the street in san jose. santa clara county is fifth in the country for its large homeless population lind new

york, l.a., seattle and san diego so it's a problem. one that the san jose city council is looking to motels to help solve. a survey found that those on the street say it's expensive, housing that has put them out there, they cannot afford to rent a home or apartment. right now a studio apartment in san jose costs about $1100 per month. a full time minimum wage job pays $1600 a month before taxes. that means the minimum wage worker would spend their entire paycheck on rent with nothing left to live on. hotel owners and motel owners are struggling with empty rooms, they say this idea is not half bad. motel owner told the "mercury news" i love the idea, i have no objection to this. i'd rather have a full motel than an empty one. vouchers would be give tune the homeless to use at the participating motels where they receive discounted rooms for 20 to $40 a day. pay 35% of their income toward

the room. other low income residents have similar deals such as students and restaurant workers. the homeless would be able to stay possibly up to five years providing steady income for the motels who can't get the 80 to $90 they ask for on a regular basis. this is not a new idea. a similar program is in in place in san francisco where the homeless have been living in studio rooms. they pulled about 9,000 homeless off the street with that program. >> interesting to see. thanks, peggy. >> the dalai lama heads to the south bay, he is set to speak at santa clara university. bob redell is live on campus. not everybody is happy with his holiness. >> reporter: good morning. there is a small group of protesters that may or may not show up this morning, from a rival sect of buddhism. they are going to be outnumbered by those excited for the dalai lama's visit.

he will be speaking in a few hours, to 4,000 people, at 10:00, specifically speaking about business ethics and compassion. we are here in silicon valley. this is the third day in the bay area, arrived friday, spoke to a crowd on saturday and yesterday you're looking at now to a sold-out crowd at berkeley high. to give people there advice how to achieve happiness through compassion he answered questions from the audience. how does one get into heaven? in case you wonder his holiness recommends leading a meaningful and compassionate life. he will answer questions that students here submitted prior via social media. >> they are excited to hear what he has to say about the business in silicon valley because we are located right in the middle of the silicon valley. a lot of our students work for the businesses here. in order to hear about how we can be compassionate people in

>> let's check in. a rainy forecast if you get far enough into the week. >> speaking of stub hub you can get preseason giants games on stub hub. they are already available, first game is this week. we'll look at the forecast for that coming up. and yaerks it's going to be a warm day here and very warm out in scottsdale, arizona. we'll tell what you our giants are going to be playing in for today. 45 in san francisco. 42 degrees, good morning to you in the east bay. south bay is waking up at 44 degrees, it's cold enough for a coat. something that you can peel off later on today. by 11:00 we're looking at temperatures in the 70s. low 70s. at 11:00 a.m. up to 74 today at 2:00 p.m. in the south bay, 69 degrees is the forecasted high in san francisco. it's hard to beat this time of year. you'll see from this live picture of san rafael this morning. we're not working with a lot of fog. that's good news. the sun's going to be out right off the bat. sunshine means warm temperatures. near record levels in the south bay one of the warmest regions,

about 73 degrees, comfortable in san jose. along the peninsula not quite as warm but still room temperature readings in belmont and palo alto, 71 degrees. mid to upper 60s today, right at the immediate coast, comfortable in san francisco. if you live in the north bay what a rebound in store for you from the 30s to the 70s. 73 degrees in santa rosa. east bay comfortable conditions, patchy fog possible on the east shore. the only place we're watching for it. so far haven't heard from mike about that but we're going to keep tabs on it. 70 degrees in walnut creek. 76 in livermore. yes, then these numbers crash. they are going to dive as we led to the next couple days. you'll notice that on your seven-day forecast. rain coming in. i'll show you how much where you live and what this means for tahoe in my next report as promised, here is mike inouye. >> looking at the bottom, the gray cloud with the dots. we're watching for all of the cars, you see that.

a smooth drive but slower right now north of 680 for northbound 101. the map will show you where i circled where the camera is, we have seen the yellow come in, gone now, in and out, as the volume builds. this is the first burst. recover a bit over the next 20 minutes and kick in again after 6:00. a smoother drive throughout the south bay commute through palo alto, between san antonio and shoreline, a smoother drive but you lose a lane or two a. live look shows you north of there out of mountain view with headlights. you're at the limit all the way into and out of san francisco and san mateo. this shows you the backup for the cash lanes starting especially off of the berkeley curve. got a good volume but at speed into emeryville. back to the desk. >> thank you much. this morning b.a.r.t. trains running again in concord after a train derailed friday night. while more work does need to be

hurt last week in clashes between protesters and police. this morning you crane's acting interior minister issued a warrant for the arrest of the ousted president, something we're keeping an eye on. big crowds there again this morning. >> it's 5:42. governor brown will be among the thousands of people attending a memorial service for two chp officers killed responding to a crash near fresno. juan gonzalez and brian law died last monday when their cruiser flipped on the way to a crash on highway 99. both men used to live and work in the bay area. law started his highway patrol career in oakland and gonzalez worked in san jose before being transferred to fresno. this morning's service 10:00 at the save mart center in fresno. >> since governor brown will be in fresno he is missing the national governors meeting in washington. the president who dined with the governorers last night urging them to team up for what he calls a year of action. tracie potts live on capitol

hill and tracie, the one issue, creating more jobs. >> reporter: exactly. democrats and republicans say they need more jobs back home and that's part what if the president will likely talk to them about when he invites the governors back to the white house. they were there last night. the president made some comments about working together without congress on things where they can make a change like getting rid of some regulations, making it easier for innovation to happen. but there are other things that the president cannot do without congress. for example, he can't raise the minimum wage and democratic governors are pushing him to do just that. some are already doing it in their own states. so we've got that meeting happening today and also western state governors are meeting separately with the president today about weather and the huge impact of wildfires and the drought this year. as you said, california's governor won't be there because he is at home dealing with the drought. >> thank you very much, tracie.

>> smokers will soon have a tough time finding a place to buy cigarettes at stanford. christie smith live at the university. christie, tobacco products being snuffed out all over campus. >> reporter: good morning. the university is saying it has been considering doing this for some time, that it's an advocate for health and well being and the sales of cigarettes aren't consistent with that message. so, starting very soon the two retailers here on campus that do sell cigarettes, the union and also the gas station, on the other side of campus, they will end the sale of all tobacco products. this gives stanford smoke-free environment policy the ban that it has in place. it applies to classrooms, offices, buildings and all facilities. you can't even smoke outside during organized athletic events if you are close by. smokers have to go more than 30 feet away from the nearest building outside to smoke.

sun rise is at 6:49 as we head throughout this afternoon, comfortable conditions. beautiful, lots of sunshine out there. and near-record temperatures. right now the time is 5:45. and i want to tell you a little about what we're expecting. sunset at 5:56 p.m. you'll notice beautiful, beautiful colors throughout tonight. a little haze in our atmosphere. temperatures today are going to end up in the 60s and 70s. 73 in the east bay, we do have quite a bit of rainfall on the way starting on wednesday. so we'll time this out for you, stop the clock at about 11:00 a.m. showers moving along the peninsula and into the north bay. i'll continue and show you how much we expect. let's check your drive. >> take a look, we'll start with the overall view of the bay. as you expect on this monday this time of day we're not seeing a lot of issues except most of the green, then right over there, the orange and yellow that's kicking in. this is west 580. had a lot of trouble out of the altamont pass, a couple of

incidents, now that's unleashing a little more traffic flow that was held up. helding to the dublin interchange, typical pattern, though, a little slow for west 580 toward dublin and we're looking toward 84 as well. 680 moves smoothly. any traffic heading to the castro valley yt san may t dumbarton bridge sorted out after earlier traffic, a bit of a volume burst, then a smooth flow toward the peninsula at speed for 101 as well as 280 through san mateo and palo alto and those areas. looking at a smooth drive, look at the live picture. coming across the flat section you see the headlight section across the flat section, and then the high rise over toward the peninsula. we're building the volume. no real slowing yet. a live look across the bay at the bay bridge where we have all of these lanes starting to kick in. the last i checked chp did not have metering lights on. this may have just happened in the last 90 seconds.

we see a backup. we'll check that. slowing for the berkeley curve. a smooth flow across the bay. we have these lights eastbound, crews clearing and also look at the low clouds touching the tops of these towers so though it's not an issue we're watching it as this low cloud drifts around. back to you. >> thank you, mike. the three men who reportedly forced their way into a concord home and tied up an elderly woman and her grandson are still on the run this morning. police say at least two of the men had guns when they pushed their way into a home near highlands park not far from clayton. a senator happens to live next door and he said the woman and her grandson escaped and ran to his house for help. >> she was out front, shaking, and he was of course very stressed out as any of us would be after being middle of the afternoon in an upper middle income neighborhood, having somebody come into their house
