good tuesday morning to you. it's 4:30. i'm scott mcgrew. >> i'm peggy bunker in for laura garcia-cannon. we start by taking you outside bright and early as we get a live look across the bay area at san francisco, palo alto, also san jose. you can see there are clouds and a few wet roads as the rain did move through the bay area overnight. time to check in with meteorologist christina loren to see what we can expect as we head out the door on this tuesday. >> good morning, peggy, scott, everybody at home. the showers right now are clearing out of the area. throughout day you want to bring that umbrella. we're fair game for hit or miss

spotty cells to move on shore. then we get another round of rain as we head through tomorrow night. a lot to talk about, and some good news, we have made a difference in one part of the bay area when it comes to that drought. we're going to talk about that. let's check your drive and say good morning to mike inouye. >> that rain made a difference in all parts of the area as far as the drive. we're looking here lonely shot for some of these drivers northbound toward us but you see the sheen on the roadway, slicker conditions and we'll watch the off ramps. a serious situation we have here, in the middle of the screen i showed you north 280 toward us. you saw how wet the road was. a big concern if you travel northbound toward saratoga avenue, the off ramp is closed now and bob is heading out toward the off ramp because of reports of a body found on the roadway. we don't have details. the coroner will be out there. saratoga avenue, i would say avoid that off ramp.

we will follow this. this is a curious story, a tragic story. we'll find out more as the morning continues. another issue around the bay, we talked about the wet roads. you see the water drying up, puddling and there is ponding as well at the parking lot. keep that in mind especially off freeways at freeway speeds. we'll watch for spin-outs. >> developing now in the last ten minutes secretary of state john kerry landed in ukraine to show the united states support for the country's government there. it comes russian president putin spoke to the media for the first time since the crisis. he says he is not invading you crane, he is helping. putin rejected the united states' threat to punish russia with sanctions. he says he has the right to protect russians in the ukraine and told reporters he hopes that russia will not have to use force in eastern you crane where a vast majority of people there

are ethnic russians. but in the southern area of crimea troops fired warning shots as 300 ukrainian soldiers demanded their jobs back. this is the first report of gun fire in this conflict. the ukrainian troops previously manned the air base, now controlled by russians. about a dozen russian soldiers warned the ukrainians who did not appear armed, to stay back, commanders from both sides eventually spoke. nobody was hurt. putin pulled back thousands of troops from ukrainian border today t russians say those troops have been on practice maneuvers. many ukrainians thought they were preparing to strike. a bay area high school is promising to make changes after a second transgendered teen was allegedly attacked in four months. the latest attack happened in a boys bathroom. the victim a 15-year-old female

who ifs as male says he was attracted by three teen boys who physically and sexually assaulted him, one of the first cases of violence since a new law gave transgendered students the right to choose which restroom to use. >> we know the attackers made disparaging remarks against the victim which is adding to the sexual assault investigation and made a hate crime. >> consequences for this behavior in that you will be expelled, you will be punished, and we'll ask that you are prosecuted to the fullest extent of the law. you can't assault students no matter who they are. >> investigators have not made arrests. hurk you lease high does not have cameras but that will change. this is the same school that is under scrutiny for how it handled a fight between a transgendered student and three girls. this is cell phone video from last year. she had been bullied for weeks and asked for help from the vice principal. police say gutierrez threw the first punch and charge heard

with misdemeanor battery. 200,000 people signed an online petition demanding the charge bs dropped. last month teen agreed to take part in a program and if she completes the program charges could be dropped. >> a woman is hoping that social media can help people find who attacked her husband outsaid their home -- it happened on saturday. shawna says there was a teenage drinking, loud music, cars blocking the street and driveway. her hus asked the group to quiet down. he was attacked and left with broken bones, a bloody face and brain injury. >> and some kid decided to just come at him from behind and beat him. and you know, that's just shameful. it's shame on him. really. >> the 71-year-old has been in intensive care since the attack. the family tells us he is alert and talking. his step-daughter posted about

the attack on facebook hoping someone could lead them to who did it. so far it's shared more than 1200 times. >> more police officers are patrolling near the santa clara university campus after four people were robbed at gunpoint on or around the campus. we learned more about the attacked. the first saturday morning where a student was robbed. 15 minutes late area few blocks away two students and a friend were robbed. one was attacked. >> one of the victims was knocked to the ground and subsequently struck in the face with the weapon. >> i think people have a sioux falls sense of safety. it's a gorgeous campus. people feel safe but there is some safety issues. >> all of the victims reported a similar looking suspect. they urge people to walk in pairs at night and to be aware of surroundings. >> the san jose counts considering giving the police department more money to deal with burglaries and theft. one man says his business was

broken into twice in the same morning. and when his alarm company called police they didn't come. ed own as computer service shop. surveillance video from a few weeks ago show as burglar ransacking his store leaving, then coming back an hour and a half later. >> at home in bed with my family, you know, i expect the police to help protect the business in our community that helps raise tax funds and keeps everything going. >> officers say a majority of the alarm calls they get are false alarms. >> the campus police officer who shot a man in the back near san jose state university says that the suspect was trying to attack his partner with a saw. according to the "mercury news," officer fritz van der hook and sergeant mike santos approached the suspect antonio guzman. guzman was carrying a 12-inch drywall saw when he refused to put it down van der hook tried to tase him but the taser

misfired or missed and guzman reportedly went after him. the president of sjsu says santos behind the suspect shot guzman to protect his partner. the two officers were wearing cameras but have not said what or if anything the videos show. >> a candlelight vigil tonight to remember jenna betty, hit and killed by a train in martinez on sunday. betty an eighth-grader was reportedly sitting on the tracks with her boyfriend when a train approached. her boyfriend ran one way, she ran the other. a witness told investigators the girl dropped her cell phone, went back to get it and that's when she was hit. the vigil will be held at 6:30. >> 4:38 now a look at the microclimate forecast for you. we take you live to the south bay and san jose and see a look he twinkling lights. christina checking tine see if we're going to get more rain. there has been quite a bit lately. >> it really is good news.

there's more on the way as early as wednesday night. but today's going to be mostly dry. you can see for the most part we're starting to dry out along the east shoe. a couple of pockets of flashes. the hit or miss on and off showers and as we head throughout the next couple days we're going to keep that moisture plume entering into the bay area. as a result we're going to keep the chances for rain going, not just for this wednesday system, we've got another one on the way as we head throughout this weekend which is such good news. 55 in the east bay. 56 to kick off the day along the peninsula. it's mild to start. which means we're going to hit the 60s later on this afternoon. with a few light showers we want to you keep your umbrella handy just in case. don't want you caught without it. as we head throughout tonight into tomorrow, we start to get a little more moisture. but the main event, the next main event i should say our next weathermaker arrives throughout wednesday evening. you can see here we've got quite a bit of moisture that's going

to continue into thursday. potentially adding another half inch right here in san jose. so we'll talk about what we're expecting for this weekend, after all, it's a traffic tuesday but you might be thinking about the weekend like us already. here is mike inouye. >> traffic tuesday or not i'm always thinking about the weekend. we're looking here, talking about the moisture in the air, yes, i know we're getting through that but the roads aren't dry and neither is the air. look at this view from emeryville. we turn it toward the bay bridge. we see the incline in the foreground and in the background we see the western span the willie l. brown portion into san francisco. can't see it because of low clouds. slick conditions, misty roadways but no problems at the toll plaza t map shows no delays, a slight slowing up the incline we typically see. there are road crews blocking one lane westbound doing work as they continue to finish everything. the roadway is done. you're okay to drive over it as you know. smoother drive into the south bay. northbound 880 at dixon landing

road we sound like almost all of the cars are gone. we had a crash on the northbound side on the shoulder but the flashing lights were a distraction. sounds like almost everybody is gone from the scene so expect just that distraction. it's out of lanes and stay to the left as you pass north of 237. also an issue north 280, saratoga avenue t off ramp to the southbound direction of saratoga, looping around under the freeway, that off ramp is closed right now. or going to be closed in short notice because of a body found on the off ramp. bob redell is getting more details. he'll bring that in a live report. the rest of the south bay is moving. the freeways themselves are okay. looking toward palo alto, a smooth drive 101, the sheen on the road, slick conditions so be careful so. far no spin-outs reported. >> thanks, mike. >> still ahead t former head of the naacp returning home.

welcome back. time now 4:44. on your tuesday morning, as we take you live to oakland. supporters of a bottled water ban are rallying ahead of a vote. that rally which includes a blind taste test will be held this afternoon on the steps of city hall before the council starts voting on the ban at 2:00. the proposal would outlaw all bottled water sales on city property that would start in october for indoor events in 2016 it would be extended to outdoor events. it calls for more drinking fountains and refilling stations. city leaders will decide on facebook's offer to pay $200,000 per year for a full time officer. that officer would work out of the city's bell haven substation. last summer leaders approve add 3 year lease for the substation,

area. you might find slick conditions. it's damp throughout so keep that in mind as you make your way out the front door you don't want to go racing out there. 55 in the east bay, south bay at 54. we're starting out nice and mild. easily going to hit the 60s throughout the day so. this is what you can expect as we get into tuesday. we'll see a nice commute. mostly cloudy. a little fog at the coast. hit or miss showers and then by tonight mostly cloudy conditions return with a few isolated showers. we bring in the chance for rain yet again as we head throughout tomorrow night. and we have quite a bit of moisture on the way. over about a 24-hour period. we stop the clock for you. showers coming in. wednesday at 11:00 p.m. starting to get moisture down here in san jose. and we'll keep it coming through the weekend as well. don't want you to forget to spring forward as we head throughout this sunday. that's right. the dreaded time change. definitely going to make a difference in our sleeping. we lose that hour of sleep.

back to you right now, scott and peggy. >> thank you so much. federal officials are investigating a deadly plane crash near lake tahoe. a woman died and her husband was badly injured when their single engine plane went down in rugged terrain about six miles southeast of the truckee tahoe airport. the couple is from tahoe city. both the faa and fits fits are combing through the wreckage to see what caused the crash. >> day two of the murder trial around olympian oscar miss tor eighty came to a halt this morning. the judge is now ordering an investigation into claims a south african television channel was broadcasting a photo of a witness without her consent. the station was broadcasting live audio of michelle berger's testimony along with the photograph just last week a judge ruled parts of the trial could be shown to the public but witnesses who requested privacy would not be shown. berger, pistorius' neighbor, told judge she heard a woman
