good morning everyone. thank you for joining us. i'm scott mcgrew. >> i'm peggy bunker in for laura this morning. we begin with developing news out of you crane. secretary john kerry has landed in kiev. senior officials tell nbc news that the u.s. is offering a billion dollars in loan guarantees to help you crane out because reef duesed energy supplies. the u.s. is also offering help with free and fair elections, the conflict escalated when hundreds of ukrainian troops approached a dozen russians at an air force base in crimea. the ukrainian troops manned an air base now controlled by russian troops b. a dozen russian soldiers warned the ukrainians to stay back. commanders from both sides eventually spoke. smo one was hurt. in the past hour russian

president putin spoke publicly about the crisis. he says that the country is ready to use all means to protect russians in ukraine but hope people do not have to use force in the eastern part of the country. >> a bay area high school says it will do more to protect students after a second transgendered teen was allegedly attacked in four months. the latest attack happened in a boys bathroom at hercules high school. the victim a 15-year-old female who identifies as male says she was attacked by three teen boys who physically and sexually assaulted him. it is the latest case of violence since california gave transgender students the freedom to choose what restroom they use. investigators have not made arrests. hercules high doesn't have security cameras but officials say they will look into it. >> pleasanton police are looking for two gun men who robbed a liquor store.

the two walked into express liquors on first street yesterday morning, demand money from the employee's wallet and cell phone. they believe the suspects ran to an art center where a getaway vehicle was waiting. police released this video of the suspects, one wearing ing iy hoody. police need help identifying a burglary suspect. this man tried to break into a home. he was caught on home surveillance. he's also associated with the gold suv spotted in the area f. you have information call fremont police. >> a follow-up for braking news yesterday a fremont 4-year-old fighting for her life this morning after a head-on collision that injured her and her mother and another driver. the collision happened at osgood road. investigators say both the mother and the other driver may have been drinking.

they say just before the crash the car the mother was driving swerved into oncoming traffic. the young girl was seriously injured. in part because her car seat was not properly installed. it will be up to the district attorney to decide if the driver involved in a crash that killed a pedestrian will be charged. the the collision happened before 6:00 yesterday morning on washington boulevard near olive avenue in fremont. officers say the driver was on his way to work hen he hit and killed an elderly woman crossing the street in the crosswalk. the driver stopped and called the mess. he was not arrested. >> we should find out today if menlo park will greenlight a plan to let facebook hire one of the city's police officers. christie smith joins us live by facebook headquarters with all of the details. good morning. >> reporter: good morning to you. this sounds generous, this officer would work near facebook headquarters and basically facebook saying they would fund

this officer for three years, possibly five years. and what this officer would do is focus on school safety and truancy and helping businesses in the area improve their safety. businesses like facebook. you would see this officer in a uniform, not necessarily writing tickets and patrolling. if the city council goes ahead and approves this, an existing officer would probably slide into this new substation and a new officer be hired later. according to a recent study bell haven has higher crime rates so it would be a kb fit. facebook also is building a west campus nearby and pledging to pay $200,000 to help overhaul this new substation. city council going to consider this whole thing this evening. christie smith, "today in the bay." >> thank you. >> 5:05, let's check in with

christina loren this morning with a look at the forecast. good morning. >> good morning. tracking a few light showers, getting you started on a tuesday morning. it's a traffic tuesday so stick around. mike is going to be in in a moment. cinequest opening night, san jose's own premiere, it's going to be one of the best theatrical experiences you can enjoy in the area with your family. it's basically an awesome film festival in our own back yard. i want to talk about a little bit of a dent we're putting in the drought. up in marine county we were counting on having those mandatory water restrictions but because of the 20 inches of rainfall we've accumulated over february no longer will that be the case. we found that out yesterday though we're still urging people to conserver. so this morning a little shower activity, not a lot coming down. everything is light. throughout day this is going to start to clear out. we'll get a couple of dry hours

from time to time you'll see showers moving in hit or miss but not looking damp all day long. 68 in the east bay. wait till i show you when the heavier rainfall returns. first here's mike and your drive. >> we're talking about drizzly conditions many part of the bay wet. i zoomed in. this is what i do between our reports, i zoom in to the pavement to see if it's wet. we don't see the water kicking up but watch those off ramps. the camera there where the arrow is, north thereof since i moved it. we're looking at smooth drive, continuing to follow this, the closure of the off ramp from northbound 280 because of that body. we're getting more coming up. we know that the freeway moves smoothly. the off ramp blocks from the southbound direction of saratoga avenue. you can't go north, it's about a

block away and get back up on our way. approaching mission boulevard big rig reported on the shoulder. the flashing lights might be a distraction. typical pattern there and the tri-valley for 580 west out of the altamont pass at the limit toward the pub lin interchange. good news. toward the east shore freeway, camera shows you the glowing lights. there is enough mist to be a problem. send it back to you. >> thanks, mike. >> 5:08. the famous ellen picture selfie at the oscars, the center of the controversy. >> could those gold coins found in the sierra be the result of a heist. this happened nearly 100 years ago. ♪

[ male announcer ] switch to u-verse and add a wireless receiver today. ♪ 5:11. we begin with breaking news. chp investigating a body found on a busy south bay freeway. they blocked off the saratoga off ramp. bob is there just arriving on scene. bob, the coroner is there as well. this is a very busy highly traveled area. >> reporter: it is. fortunately, this is taking place before the commute is really picking up so i don't anticipate this having a tremendous impact on your way in to work this morning. the coroner is on the scene, we're on the northbound 280 southbound saratoga off ramp. the body is there under the overpass. you see the van and i spoke with

chp, they expect to have the body removed and this section reopened possibly in the next 20 minutes so by 5:30 this morning. the call came in from a few drivers passing by. this is like around 3:15. they reported the body in the middle of the freeway. speaking with chp it's the body after woman. they don't know how old, who she is of course, but believe she might have jumped from the overpass and probably also hit by at least one car. they are calling that possible suicide and possible hit and run. whoever would have hit her did not stop. they don't have debris on the road but they have evidence that indicates she was hit by at least one car. what they have been doing is reaching out to the drivers who called 911. they are able to do a reverse phone search with the call log calling them, talking to them and probably send officers out to look at their cars to see if they might have been the drivers who hit her. again, a woman found dead after 3:00 this morning under the

saratoga avenue overpass. this is off the off ramp of northbound 280. they should the street open in the next 20 minutes. reporting live here along 280, bob redell, "today in the bay." >> bob, thanks very much. >> 5:13. men's warehouse could be close to a merger with joseph a. bank, one consultant says the two companies are exchanging confidential information, could reach a deal later this week. joseph a. bank turned down men's warehouse before, the back and forth started in october when joseph a. bank made a bid to buy men's warehouse. meanwhile, kroger has apparently approached pleasanton based safeway about buying up some of its stores. safeway has said it's considering a plan to sell all the stores. it's in talks with a private equity company that also owns

albertson's. buying up some of the safeway kroger could help avoid antitrust efforts in markets where albert son's exists. >> the president sent copies of his budget to capitol hill giving lawmakers a chance to see what he envisions for the future of america. courtney reagan live at cnbc head quarters with the details. good morning. >> good morning, scott. again president obama releasing his fiscal 2015 budget, the nearly $4 trillion plan dropped earlier proposals to reduce future social security benefits, it aims to cut taxes for more than 13 million working americans and increase credit for middle class families to cover child care and college costs. the plan is not expected to gain much traction in congress. >> futures sharply higher after stocks suffered their worst day in a month monday. the crisis in ukraine over145dowing personal income and spending. oil prices are down on news that

temperatures today are comfortable. it's going to feel like a late spring afternoon. hit in the upper 60s about everywhere. and the showers are clearing out of here as we speak. so, this is what we're working with throughout the day. temperatures right now mostly in the 50s, pretty mild out there. as we head throughout day you will notice the fog especially until about 9:00 a.m., maybe 10:00 a.m. in san francisco. we expect flight delays. overall keep the umbrella with you. temperatures comfortable but we keep the hit or miss showers going. you could be caught under a stray shower. that's when we expect some of this history to high tail it out of here. it kurns as early as tomorrow evening at 7:00 p.m. look at this. we're bringing back the yellows and for the most part this moisture is going to stay in the north bay until thursday morning. then here in the south bay where we need it we get more rain. and we could be tallying up additional quarter inch to a half inch of rainfall. we're looking good there. we stop the clock friday at 2:00

a.m. a great day to get out. on fray if you can that's when we expect the most sunshine. i.e. that very important vitamin d., through wednesday the 70s return, san jose warm tomorrow as we get into thursday t showers really start to pick up especially in the morning. they are going to clear out thursday afternoon. friday, brilliant sunshine, then on saturday we start to cloud up again with more rain on the way. we'll talk about that coming up. good morning to mike inouye. >> and good morning, christina and glowing lights in many parts of the bay. the road itself is not wet, this is 58 o. look at these cars coming in to dublin out of the livermore area. look at the map. even though there are all of those cars things are moving smoothly. your typical slowing shows up for the dublin grade as you travel east out of castro valley. a little holdup here, west

approaching we have reports of a crash that may involve as many as four vehicles. this is what's causing a backup approaching north livermore, spring town over to airway lighter for the time being so we'll track this. actually providing a break for many of our viewers closest to the dublin interchange. into the bay bridge toll plaza no real problems there. we'll look over live crams, how things are shaping up. this is the birkly curve. i wanted to show you the glow from the light. between our rooftop camera that you're looking from and to the maze there are low clouds. the clouds are drifting there as they tend to do. some drizzly conditions and the yellow showing up, coming up for the future for the north bay still glowing, still slick in many spots. you are still at the limit. that's good news for your southbound commute. we'll end looking at the south

bay and a smooth flow northbound except for the 28 off ramp. still closed heading to the southbound direction. >> mike, thank you so much. the judge in the murt trial of oscar pistorius is ordering an investigation into claims a south african television panel broadcast a witness. they were broadcasting live audio along with a photograph. last week a judge ruled parts could be shown to the public but witness who is requested privacy would not be shown. yesterday the neighbor told the judge she heard a woman screaming and four gun shots rang out. the morning of that reeva steenkamp was killed. her mother was in court and told why it was important to be there. >> i wanted to see oscar face-to-face, and that he would know that i was there. i can't explain why but that is the reason. >> you can watch the full interview with reeva steenkamp's

mother coming up on the "today" show. >> gold coins in the sierra, a northern california couple found the coins from the 1800s while walking on their own property. the total is worth about $10 million. historian jack trout tells the "san francisco chronicle" those coins may be loot from a gold heist. the san francisco mint was robbed more than a century ago. the stolen money never recovered because so men of the coins were in mint condition they could be from the heist. they think the robbery was an inside job. you >> wonder if that going to change the money that these people would zbhet. >> interesting question. >> could change things up. >> it's not just tuesday, it is fat tuesday. >> tens of thousands of people are on the streets of nerls celebrating mardi gras. >> plus f you missed the tonight

most of what you see and the parade will roll later t parade right now are the street cleaners, the bulldozers trying to push away the mess t delivery trucks moving in, restocking everything here along bourbon street. they come back and make the messenger tonight as they wrap up the carnival season here. it's a good carnival season. you talk to the hotels, restaurants. everybody says that they are doing real well, that the crowds are here and that's important because one thing that's different this year is the weather. it's chilly here in the 30s, we expect rain to start late morning and continue through the early evening. so, there was concern that might cause problems as far as crowds are concerned. that has not been the case. that's very good news because this annual party means close to a half billion with a b, dollars for the city. it's vital for the economy here. looks like it's going to be a great mardi gras in the

you can see the damage to his honda civic there. the car's front end gone, debris everywhere. police say the crash happened after midnight on san pablo avenue near el cerrito b.a.r.t. station. investigators say the car damaged several businesses, benches, nobody hurt. the 25-year-old driver was booked into jail on charges of dui, hit and run, and resisting arrest. >> a bay area high school is promising to make changes after a second transgendered teen was allegedly attacked in four months. the latest happened in a boys bathroom at hercules high school. the victim a 15-year-old who identifies as a male says he was attacked by three teen boy who is physically and sexually assaulted him. it's one of the first cases of violence since a new california law gave transgendered students the freedom to choose which bathroom they use. >> the attacker made disparaging remarks which is adding to the

sexual assault investigation, also being made a hate crime. >> kongss for this behavior and that you will be expelled, you will be punished and we'll ask that you are prosecuted to the fullest extent of the law. you can't assault students on campus no matter who they are. >> investigators have not made arrests so far. hercules high does not have security cameras. organizers say that will change. this is the same school that is under scrutiny for how it handled this, a fight between a transgendered student and three girls. this video is of the fight taken last year. jules says she had been bullied for weeks and asked for help. gutierrez threw the first punch and police charged her with misdemeanor battery. 200,000 people signed demanding the charges be dropped. the teen agreed to take part in a school empa think program. >> more police officers than usual are patrolling near the

santa clara university campus after four people were robbed at gunpoint on or around campus. we've learned more about the weekend attacks, the first happened saturday morning in a campus parking lot. a student robbed at gunpoint. 15 minutes later a few blocks away two students and a friend are robbed, one pushed to the ground and attacked. >> one of the victims was knocked to the ground and subsequently struck in the face with the weapon. >> i think people have a false sense of safety in santa clara. at this university it's a gorgeous campus so people feel safe here but thehere obviouslys some issue. >> all victims report add similar looking suspect. they urge people to walk in pairs and be aware. >> the city council is considering giving the police department more money to deal with burglaries and thefts. the resolution would add a steex the charter requiring at least

40% of the city's total general fund to go to police and other public safety costs. the san jose police force is stretched in this. one says his company was broken into twice. hen his company called police officer desire not come. the shoe shows a burglar. >> facebook could get approval to hire a city police officer to a parole near come pus. christie joins us with details g. morning. >> reporter: good morning, scott and peggy. sounds generous, facebook is offering to pay for one full time menlo park police offer and even pay for a service station which happens to be near facebook headquarters at a cost of about $200,000 a year and they are talking about funding this for at least three years, possibly five years.

this police officer would focus oun truancy and look into helping businesses run safety drills for say a fire or intruder. according to the america, the chances that you would see this officer patrolling are pretty slim. they would focus on those things. if approved by the city council an exsirsing office would move into this position, then another officer might be hired. it has a higher crime rate. sounds like a good fit. the timing is right because facebook is building a new west campus near the station. the city would have to pay for training and also the patrol car. >> thank you much. >> 5:35. let's check in with meteorologist christina loren. get a look at today. >> how are you?

>> good so far. fat tuesday. >> fat tuesday, we're going big this morning. jazz hands, that's about as crazy as i'm going to get. 54 degrees in san jose and 55, not a bad way to start is the the day in oak downtown. temperaturewise it's going to be comfortable. looking pretty good. we do have a few spray showers we're going to keep in the forecast so keep your umbrella with you, keep it in the car. we continue to see that stream of moisture coming to the bay area. these flashes of green. pesky showers but something you don't want to get caught under offguard. we're here to let you know what's coming. there is more rainfall in the forecast as well. the great noose, keep that in mind. 6 tate forecasted high in the east bay. the peninsula about 64 degrees, 66 in the south bay. and i want to give you a picture what if we are expecting. as we get into tuesday.

pass. still have reports of the fast lane being blocked. this is a distraction and you have an easier drive now because of that through dublin and the dublin interchange for westbound 580. south 680 not a problem. the northbound route for the south bay t arrow points to the commute direction 101 with the slowing naft scene. up to 880, as well as approaching the 280 interchange for north 280. reminder we have reopened the saratoga avenue ramp after the activity. >> 5:38. the bay area city looking to do away with small flc bodies of water. >> secretary of state john kerry has arrived in kiev to talk with the interim government. we'll have a live report with the latest coming up next.

developments in ukraine about an hour ago secretary of state john kerry landed in kiev rein enforcing u.s. support for ukraine's new government. danielle leigh is live on capitol hill, the u.s. is pledging money to help you crane. >> reporter: peggy, that's true. $1 billion in loans of course congress is going to have to approve that. they are also saying they are going to help with elections and technical help for ukraine's bank. corruption has been a big issue. that's what the u.s. is promising to do. they are trying to stabilize you crane, help the government really form. and also get the economy back on track. that's one of the big developments that we saw early this morning. also russian president vladamir putin spoke. he is drawing a hard line not indicating he is going to back down any time soon. he calls the government illegitimate, he also says that if necessary he will use force, he says his prime goal here is protecting russian nationals and crimea and he believes that this is where he needs to be.

he is not indicating she going to pull the thousands of troops out at this time. that's going to lead to ongo tension. the u.s. wants russia to pull out and u.s. and other western allies are now threatening and upping the threats for sanctions if russia doesn't comply but putin is pushing back saying look, you put sanctions on us there will be consequences for you as well. it's something to watch and see what kinds of progress actually unfold. live in washington, danielle leigh, back to you, peggy and scott. >> all eyes on you crane. thank you so much. the secretary of state john kerry took a detour on the way to kiev. while the plane was refueling in new york he went to the hospital to see his daughter alexandra and her baby girl. this is kerry's fifth grandchild. the girl has not been named yet. >> california needs to be prepared for the worst, that's the message from state water officials who will hold a conference to talk about the drought. it will be at mcclellan park.

it will cover a variety of problems including recycling, salts and contaminants. officials say the water supply is dwindling the threat of contamination increases at the same time. the two-day conference will focus on ground water resources and what communities can do to make it through the drought. >> supporters of a bottled water ban are rallying ahead after vote by san francisco council. the rally which includes a blind taste test will be held this afternoon on the steps of city hall before the council starts voting at about 2:00. the ban proposal would be outlawing bottled water sales on stit property starting in october for indoor events, then in 2016 it would include outdoor events. the proposal kaul calls for more drinking fountains and bottle refilling stations. >> movie lovers will head to the south bay to kick off the cinequest festival. >> it gets under way in downtown

temperatures in the 50s, i want to take you into the afternoon hour by lunch time today, 62 degrees in san francisco. this is where you want to keep your jacket close to you all day long. that's around the coast, around the inner bay. you can ditch that jacket later on, 66 degrees in the south bay. 64 along the peninsula and you hit 68 degrees in the tri-val y tri-valley. we'll see sunshine throughout the day. you want to keep that umbrella with you because in addition to clouds we're still going to have stray showers moving in. just as we're seeing now nothing heavy, nothing that's even enough to get your roadway slick this morning. but still we haven't had much after drying out period so. travel cautiously and this is what we're looking toward. 9:00 a.m. showers intensify. not much, they are going to be spotty but by wednesday night look at what comes. another storm system riding the atmospheric river bringing in the moisture potentially and into the north bay, a half inch in san francisco, and maybe a

quarter inch here in the south bay. as we head between wednesday night into thursday morning. you can see a lot of this is going to come through while you're sleeping. we'll have kind of a damp commute on thursday. so keep that in mind. tomorrow looks okay, thursday could be rough, then friday is your day to get outdoors. brilliant sunshine returns. this is what we're looking for as far as totals go. definitely going to see the higher totals to the north. ukiah, going to range closer to an inch. this is really good. great sign. especially for farmers. you know what i talk about. you come from an agricultural family, don't you. >> only the industrial side, as far as the home plants we kill them but yes, we raise flowers professionally. that's a weird situation but that's the way it works with us. over here looking at 880. this is the way it works for this track. we see the build-up. looking at the high street off ramp. it's clear there is a disabled van but reported for the

southbound side flashing lights but they are moving. we don't see problems for the freeway so the nim sits clear, watch the southbound 880, high street off ramp. did it pop up on our reports for the map a. little slowing through the area so that may have been presenting a problem on the other side of our view. your commute direction for north 880, west 580 to the toll plaza moves smoothly. out of the east shore freeway out of the maze to the toll plaza we'll give you the live look as more cars hit the roadway the water hits the lens so there is must mist and drizzle. you can see the rooster tail coming off so the water is kicking off on the cars behind. then at the toll plaza and kicking on to the windshield you have to use the windshield wipers. visibility can be tough. at the maps, around the east bay, smooth through the dublin interchange. folks are held up here approaching, that looks like it's cleared from the fast lane

and we're starting to see these cars heading to dublin. more traffic the next 20 minutes. heading to southbound 680. northbound routes slowing for 101 from 680 to 880. we saw 85 with an early burst, they come back as well as north 87. this is the time 6:00 approach when things build up around the bay. saratoga avenue the off ramp reopened after earlier police activity and from the south bay to north bay we look at the conditions. close to the limit but slick at times. back to you. >> mike, thank you. day two of the murder trial surrounding olympian oscar pistorius came to a dramatic halt t judge ordering an investigation into claims that south african station was broadcasting a picture of a witness without her consent. last week a judge ruled that parts of the trial could be shown to the public but witnesses that requested would not be shown.

to make out that's individual moving lights in motion, that's east shore freeway. the glow an issue for folks. i've seen folks kicking up water at the toll plaza. there is dampness there. looking at maps, that's the flow where the arrow s. starting to slow a bit toward university avenue and the commute direction because of that volume of traffic. visibility on the road is all right as far as the flow of traffic. we have a crash reported west 80 at richmond parkway. slowing from hercules into san pablo to richmond, that's commute direction. that's adding to the slowing approaching el sobrante. not a big deal yet. the san mateo bridge, moves nicely westbound with the taillights away from us and here you have a clear view, you can make out the high-rise approaching the peninsula side. the peninsula has no delays. >> mike, thank you. >> a high school senior sues her parents saying they threw her out but they say she's the one who didn't stick to her curfew.
