officials blocked the roads to investigate a body found in the middle of the road. we now think that person took her own life. it happened just after 3:00 this morning on the saratoga avenue off ramp from northbound 280. again, this off ramp has been reopened. >> new this morning, a suspected drunk driver is under arrest accused of slamming his car into several businesses overnight. look at the damage here to the front of the honda civic he was driving, the front is gone, debris scattered. the crash happen affidavit midnight on san pablo avenue. investigators say the car damaged several businesses, trees, garbage cans and benches. no one was injured. the driver was booked on charges of dui, hit and run and resisting arrest. >> a bay area high school says it will do more to make students safer after a second transgendered student was allegedly attacked. bob joins us live.

this attack happened in a bathroom. >> correct. that is significant because this is one of the first if not the first case of violence since a new california law gave them -- the attack took place at the high school a. 15-year-old student a female who identifies a male says three boys forced her into a stall, locked the door and then she says physically and sexually attacked her. the school notified her parents, she was taken to the hospital. there have been no arrests because the victim did not get a good look at her assailants and the high school don't have security cameras outside the bathroom. that's something the board wants to change. police are counting on high schoolers to be high schoolers that they will talk and gossip and that eventually the identity of these three attackers will come out. >> we do know that the attackers made disparaging remarks against the victims, which is adding to the sexual assault investigation and is also being made a hate

crime. >> we're horrified by what happened. it's terrible that any student on this campus would have to be subjected to that kind of criminal conduct. >> as we mentioned this is the same school under scrutiny for a fight between a trand gender student and three girls. you are looking at cell phone video. she was bullied for weeks and asked for help from the vice principal. police say that gut zbut the one who influence the first punch in that fight and charge heard with misdemeanor battery. 200,000 people signed an online petition demanding that the charges be dropped. last month the teen agreed to take part 18 school empathy program f. she complete this is charges could be dropped. >> thank you so much, bob. developing news out of you crane. secretary of state john kerry is in kiev where he will show his support for you crane. this amid what he called an earlier russian invasion. as he arrived the obama

television channel broadcast a photo of one of the witnesses, a court order guarantees privacy to witnesses who request it. pistorius is accused of killing his girlfriend reeva steenkamp. this morning her moth aer speakg out about the trial. >> a vigil will be held to remember 14-year-old jenna betty hit and killed by a train in martinez on sunday. betty an eighth-grader was reportedly sitting on the tracks with her boyfriend when a train approached the two. her boyfriend ran one direction, she ran the other. the girl dropped her cell phone on the tracks and went back to retrieve it. tonight's vigil will be at 6:30. >> happening today, menlo park's facebook could get rein late to hire a city police officer to work the campus. christie smith joins us live at facebook headquarters with

details. >> reporter: good morning to you. we're talking about a sworn menlo park police officer wearing a uniform and riding around in a marked police car and working out after substation that happens to be around the corner. at a cost of 2 hun thousand dollars a year. what you probably won't see though is this officer riding around doing traffic stops and writing tickets. according to the merc likely work on what they call school safety, truancy and helping businesses improve safety and do things like conducting safety drills at those businesses. the pay comes with another offer, that's to pay $200,000 more on top of everything to upgrade a new substation in -- it's expected to open later this month. the crime rate in that area is actually higher than other parts

beautiful san jose. this is what we expect throughout your afternoon. about 62 degrees, you're going to see clouds throughout day and you could get caught under one of those showers. but today temperatures are going to be close to 70 degrees out in the tri-valley, 66 degrees in the south bay. we're going to keep this it's the it's theic river going. the showers will continue to stream in, they are going to be light. then a storm system on the way as we head throughout tomorrow night into thursday so i'll time that out in my next report and tell whaut means for tahoe. maybe you want to get up there. let's check your drive. you got to work for the weekend. >> we'll work getting three as well. as far as possibility there is a mist, a little drizzle at the bay bridge toll plaza. but you see the lights, the metering lights are on, the cash lanes to the right are the issue. we'll slow those speeds.

we'll look at the maps on the approach. slowing a little through the berkeley area. west 80 shows the build. west 580 coming through out of the maze. heavier than it was yesterday. now a slower drive but at least a crash. you have build from hercules, 4 down through san pablo and approaching golden gate field off of the richmond/san rafael bridge no. problems off the san rafael side. we had it new big deal a half hour ago but over the hours of that to they got there, there were a series of crashes now. this on eastbound 380 away from 280 off the connector, that's not heavily traveled but if that is the way you wake your way keep in find there are crashing lights. you mitt be down a lane or to. three miner injury crashes. north 880, a minor trash as

plaza. the build is on, metering lights are on. look at the misty conditions it's not rainy but it's slick so a crash on the peninsula we're tracking. >> thanks, mike. here are today's top stories. suspected drunk driver under arrest accused of slamming his car into several businesses overnight. this happened on san pablo avenue near the el cerrito b.a.r.t. station. no one was hurt. >> a busy off ramp in san jose is back open in time for the morning commute. the chp blocked off the saratoga avenue off ramp from northbound 280 to investigate a body in the road. authorities say it appears the woman took her own life. >> president obama just released his budget for the next fiscal year, the nearly $4 trillion plan aims to cut taxes for millions of working americans and increase credit for middle class families. >> supporters of a bottled water

ban rallying ahead of a crucial vote by san francisco's board of supervisors. the rally which includes a blind taste test of tap water versus bottled water brands will be this afternoon on the steps of city hall before the board starts voting on the ban. the proposal would outlaw bottled water sales on city property starting in october for indoor events, then 2016 for outdoor events. it calls for more drinking fountains and water bottle refilling stations. >> men's warehouse could be close to a merge wer joseph a. bank. the two companies are exchanging confidential information and could reach deal later this week. joseph a. bank turned down men's warehouse before. the back and forth started in october when joseph a. bank made a fwid buy. >> kroger apparently approached safeway about buying up some of its stores. safeway has said it's

considering a deal to plan to sell all of its stores. it's in talk with a private equity firm that also owns albertson's. by buying some of the stores kroger could help avoid antitrust issues in markets like the bay area where albertson stores exist. >> a new jersey teen is suing her parents claiming they threw her out of the home when she turned 18. rachel wants her parents to pay for her private school tuition and wants to force theme pay for college. the parents say their daughter left in october because she didn't want to follow rules or their curfew. she has been living with her best friend's family. the best friend's father is funding the lawsuit. they will be in court today. >> my house my rules i believe how that rhyme goes. >> paying the bills here. but you never know. there are two sides to every story. >> always is. you know what i mean. that's what we're here for, to

tallying up maybe a quarter inch, maybe 3/10. san francisco you're fair game. maybe a inch. we'll talk about that story out maf rin county. right now let's see if we've got good stories to tell in the traffic department. here is mike. >> good morning. the traffic and the weather are tied together. we're looking so far no problems as far as the weather goes. look at that. you can't see the green or the blue that we typically see with fog and clouds. pretty typical traffic tuesday. a lighter than normal from the flow of traffic but a couple of spots. look at this for the north bay. north 101 starting to see restoration of slowing. 87 the same thing. 280 north, the interchange there, we did have a fender bender. everything off the roadway, that's starting to show a slowdown. and north 85 the earlier so down has cleared so that's in flux.

to the bay bridge toll plaza. a crash cleared at richmond parkway. smooth through berkeley as the volume starts to build. 880 and 580 slow a bit toward the area. and look at the concern as the live look shows you there is water on the lens, on the roadway, and it is kicking up. i've seen a lot of water heading through the area. slick conditions, it's one of the examples. it's mist and drizzle. not really rain. we'll get to you the rest of the maps. looking here toward 280 coming off at 380 eastbound, we had a series of three minor injury crash, all out of the roadway but a distraction going on so. chp calling it a sigalert and whatever the case mild slowing, that's not heavily traveled f. you are over 101 watch for the activity for the next 15 to 20 minutes. the rest smooth, the dumbarton moving nicely. a live look toward the san mateo

bridge. a smoog flow westbound. low clouds hover but not a problem on the high rise, that peninsula moves between san mateo and the south bay. >> thank you, mike. >> light on the discovery of gold coin found in the sierra. >> a couple you remember found the coin from the 1800s while walking on their property and the total worth about $10 million. a historian tells the san francisco fronical those coins may actually be from a gold heist at the turn of the gentry. the san francisco mint was robbed more than a century ago, the stolen money never recovered. trout says because many of the discovered coins were in minute condition and largely in order they could be from the heist. he also thinks the robbery was an inside job. >> i wonder how that might change things for the couple.

the south bay will be packed with movie lovers for the annual cinequest festival. >> it kicks off tonight among the stars lining the red carpet, our own christina loren right there, she'll be emceeing the event. it begins with a showing of the drama "the grand seduction." camera 12 and the san jose rep and the california theater will be showing about 200 movies over the next two weeks. >> well, purple, green, gold, plenty of beads today is mardi gras. and in new orleans the party already in full swing. >> jay gray joins us live on bourbon street with all of the sights and sounds g. morning. >> reporter: good morning, scott, peggy. and we're starting to get rain here, we expected it. the temperatures a bit cooler than they normally are. it's not scaring any one off. they expect to be like any mardi

gras. just wet. and once the parades roll, we get a little later into the day, i think a lot of the people that are part of mardi gras may not even know it's raining so they have that going for them i guess. it has been a busy time. it's been a great time as i talked about for business. they expect to make close to $500 million so vital to the economy of this city. it's something that every year they wonder and worry is this year going to be different. they suffered a lot after katrina. mardi gras built back and has come quite party again. we saw people out until all hours of the morning. it's going to reset and happen again right now what's going on is the street crews are coming through cleaning things up, pushing things out of the way. then the delivery trucks, restocking and getting ready to make a mess. mardi gras, fatted to, it's the

the apple cfo announces he's going to retire. radio shack announces it will close 1100 stores. it's tuesday, march 4th, this is "today in the bay." >> good morning to you. i'm scott mcgrew. >> i'm peggy bunker in for laura. now to a developing story in ukraine, russian troops fired warning shots into the air, this as ukrainian soldiers marched toward them. ukrainian soldiers chanted, carrying the ukrainian flag and marched at the air base in crimea. no one was injured but tensions are flaring and now the united states is taking a stand. danielle leigh joins us live in washington, d.c. secretary of state john kerry just landed in kiev as we are watching the situation there get even more tense.

>> reporter: hi, peggy, good morning. secretary of state john kerry is meeting with acting president in ukraine, and he's going to be talking to him about some of the promises things the u.s. wants to do to help you crane, among those $1 billion in loans, that is going to have to be approved by congress and president obama is asking congress to do that immediately. also help with upcoming elections and also tech help for the central bank, trying to deal with some of the corruption happening in ukraine. this all as u.s. is upping the pressure on russia telling russia to pull troops out of crimea, not looking like that's going to happen. vladamir putin did speak to the media, he said that ukraine's government is illegitimate, he said that he plans to stay the course, he will use force if necessary put a last resort and hi primary purpose is protecting russian nationals in the region.

he is saying if the u.s. or other western country were to impose sanction there is would be consequences to face on the back end so. there's no sign that he's backing down and it's looking like this crisis is going to continue. john kerry hoping to defuse some of that speaking with leaders trying to get a diplomatic compromise and solution. danielle leave. wegy, back to you. >> thanks for the latest. federal investigators looking into claims that gang members from los angeles are fighting on the front lines of the syrian civil war t investigation after a youtube video showing two men shooting rifles and wearing military fatigues, those men claim to belong to two l.a. street games and kim to be in syria. facebook posts by one of the men shows a possible affiliation with fighters that man claims to have been desort ported. >> checking in on the forecast,

as we take a live look at san jose and san francisco. a tail of two cities. heavy fog. >> good morning. top of the morning to you. 6:32 now. the sun starting to make an appearance. that's what's going to keep our temperatures at about a 5-degree of separation rule. san francisco at 54 degrees. nearly uniform conditions. but later on we're going to hit the mid to upper 60s. in san francisco where it's a good idea to keep the jacket and that umbrella throughout your tuesday. we keep rain showers in the mix, as we head throughout today keep that umbrella with you for tomorrow as well. i have such good news this morning, the reservoir in marin county is overflowing at this point because the last two strong systems that provided almost two feet of rain. all of that goes into the

reservoir. look at this. 6 billion gallons added since january 1. that's what the atmosphere river can do. that's a 50% increase in the water level. now we have three over floi flowing. at one point we thought we were going to have to mandatory restrictio restrictions. everywhere else we need to conserve and we've got long way to go but that's raet news and more rain on the way. the rich moisture returns, that shower activity will move into the south bay thursday morning. i'll tell you how much more we expect coming up. right now let's check your drive. >> the above ground rainfall that's what we have, a mist at least but the rain not at the berkeley curve. the wet roads are the case caused by the early mist and drizzle. we'll look at the toll plaza as

well. heading to this pout spot and you see there is still lens. that's pretty good for traffic tuesday. let's look at our maps with slick conditions. we want you to lower the speeds. the speeds show you moving nicely down the upper east shore freeway. 24 and 580, showing the green action for 580 up toward the maze we have a bit of slowing as you approach that maze. as well as fort 880. lower the speeds as you hit those curves. 880 slows as the volume increases coming off of the castro valley y, this is tuesday, expect a heavier flow. it's looking pleasant through dublin, 580. not a lot of problems. slowing for pleasanton to sunol. 84 typical build, livermore. northbound around soing the

slowdown to the south bay. over here we've had a crash on the shoulder northbound 280. i'm going to say the slow lane must be blocked. this is extra slowing than we expect to see if no lanes were blocked. from bird up to season. >> 6:36. starting today extra security at the shark tank. the new measures will be in place for san jose sharks games today through the stanley cup playoffs. people will be subspekt to screening, wand skreeng and pat downs. plus only small purses and bags will be allowed. we should point out some of those measures are already in place but spectators are now being asked to arrive 1 fwif minutes earlier. >> the twist in the oscar pistorius case as his victim's mother publicly speaks out for the first time.

>> good morning to you. it's 6:39. the sun is up as we take a look over san jose. and the fairmont hotel and the tech museum in the corner. happy, happy tuesday to you. >> a dramatic twist as day two of the murder trial surrounding olympian oscar pistorius came to a sudden halt. the judge is ordering an ves ga into claims a south african television station was broadcasting a photo of one of the witnesses without her consent. the station was using live audio of michelle burger along with her picture. last week the judge ruled that parts of the trial could be shown to the public but only witnesses who requested privacy would not be shown. burger said she heard a woman screaming and then four gun shotds the morning that reeva steenkamp was killed. pistorius says he thought that steenkamp was an intruder when he shot her through the bathroom door.

dublin, san francisco. low clouds. good morning. >> good morning. a little soupy out there this morning. >> winter schedule. >> it's a good thing. our hills finally starting to turn green. that's a complety and welcome sight. that's going to continue to be the face because we are sleeping rain in the forecast. temperatures are mostly in the 50s. with the rain in the forecast it's a good time to check out this cinequest starts in san jose tonight is opening night. and you can get out there and see some of these movies for as little as $5. there are some short films you can take the kids in, get out 18 half hour's time. 63 degrees at 4:00 p.m. i'll be live for tonight's 5 and 6:00 broadcasts here on nbc bay area. maybe you can't make it out there. 66 degrees in the south bay, 64 along the peninsula, you won't be working it out all day long. you need it from time to time.

temperatures overall comfortable. 68 in the east bay. try that on for size. not bad as we get into the first week of march. a couple weeks from the official kickoff of spring. we're going to keep the rain chances going for a few more days. the next significant schans -- we stop the clock, you can see most of the yellow north of the bay area as the atmospheric deliver starts to lift to the north. we're going to get a pretty good amount of shower activity. maybe 3/10 inch. additional inch on the way to the north bay, then another round of rain as we head through sunday into monday. overall i'm not seeing any major changes as far as a big ridge of high pressure. this is going to be the seat up for the next couple weeks. we need that rain. this is a good story. let's check on your drive, see if you've got good stories to tell.

here is mike inouye. at least he's fun. >> there you go. might not be a good story but try to make it sun. i mean this is traffic tuesday. here is north 101. we see it slowing, let's look at the map. i call it traffic tuesday. we expect the heaviest volume all week it's not so bad right now. looking at north 101 to kick win the speed, into the 50s with the orange and north 87 north of capital expressway. this is about 10 minutes later than we typically see this. north 28 has been a problem forward the interchange. it sticks around because the volume continues to build out of downtown san jose for north 280 off 87 and heading up to the 17 interchange. once you pass by you're fine up to the saratoga off ramp which opened. good flow into and out of the area. a smooth drive across the dumbarton bridge, san mateo bridge, the peninsula 101 and 280 moving smoothly at the limit. not a major problem. we'll look at the san mateo

bridge, foster city approach because from time to time we've seen low clouds but you see an easy drive off of the east bay off of the high rise. look at that the low clouds not a problem. visibility is great on this side of the bay. we travel across the area slowing off of the castro valley y, typical for south 880. a smooth flow for the try valley. there you negotiation a little build through pleasanton. and that's not unusual. this is unusual. it's unusually light for a tuesday. that's good news. a slower drive off 4, concord areas, south 680 toward walnut creek. you have your backup, the metering lights are on. back to you. >> mike, thank you. the campus police officer who shot a man near san jose state university says he had to pull the trigger before the suspect attacked his partner with a saw.

officer van der hook and sergeant santos approached the suspect antonio guzman last week, guzman was carrying a 12-inch drywall saw and refused to put it down. van der hook tried to tase him but it either misfired or missed and guzman reportedly went after van der hook. the president of san jose state university says santos who was standing behind the suspect shot guzman in the back to protect his partner. the two officers were wearing cameras on their unforms but haven't said what. >> the san jose council could decide whether to give more money for burglaries. one man says his business was broken in twice in one morning. when his alarm company called they didn't show up. ed own as service shop. video show as burglar ransacking the shop, leaving only to return a half hour later. >> at home in bed with my family, you know, i expect the
