. happy 4:30 in the morning. i'm scott mcgrew. >> i'm peggy bunker. let's take you outside this morning. live look at bay bridge toll plaza, san mateo bridge, south bay at san jose right now tracking another round of wet weather headed our way. we'll be talking to christina loren here in a quick moment. but first, happening now, major problem with the morning commute. a large stretch of b.a.r.t. track is closed this morning service between south hayward and fremont shut down after a person was hit and killed by a train heading to richmond. investigators are not released too many details about the

person. they don't know why he or she was on the tracks in the first place. there were riders on the train at the time, none were injured. the south hayward station is closed but there's a shuttle between union city and fremont. limited service from san francisco from i bay fair. christie smith will update on the situation in the next half hour. >> it will affect your commute. mike inouye. >> first, admission, it is a bit confusing because stations, closures and links and not lining up. we talked about the link between fremont and union city. how you get to south hayward and hayward? we're not sure on that. christie will be on scene. volume for 880, your alternate to the b.a.r.t. lines now, you see how light traffic flow is. look at map, from fremont at bottom of the screen, thornton station up past this arrow toward the south hayward station around highway 92, south of

there. that's the area blocked off. hayward station, end of the line for the b.a.r.t. system, you have to take freeway or buses if they link up to the east bay. hayward north, jump on it the b.a.r.t. line. no delays for that part of the system. trains are linked in and a lot of the -- a couple of lines go through the area, so they will be affected for service. so far traffic on 880 and 580 clear. that is your alternate to drive across the bay. those lines are going along there b.a.r.t. lines for 24 and east shore freeway, moving smoothly. bay bridge, traffic, no problem heading from oakland once you get to that portion into san francisco. that's good stuff. talking about the weather as well, finding alternate transportation. >> right now getting off easy this morning. good morning to you, mike. i know those delays are going to keep some people from coming into work on time here at nbc bay area. yes, patience this morning.

a live report from mountain view about prmg netanyahu's visit. the family of a woman found dead in a stairwell at san francisco general hospital is suing the city. lynne spalding's family plans to announce details in a news conference this morning. the 57-year-old disappeared from her hospital bed in september, later found dead in a stairwell two weeks later. her family's seekingen unspecified amount of money from the sheriff's department, also citing medical maltrack. the transgender teen attacked by three students could face charges himself. yesterday, police say they found self-inconsistencies in the alleged victim's story, then he admitted the whole thing was a lie. the student claimed he was physically and sexually assaulted by three male teens in a bathroom at hercules high school. investigators may charge the

15-year-old with filing i false report. police found a teen who attacked a 71-year-old man. the 16-year-old arrested yesterday. he pushed michael mora down a hill after he asked a group of teenagers to move cars. dozens of teens in a nearby house party and several cars were blocking the street and sideway. he had emergency brain surgery and is still in the high school. heavy hearts, many attended an emotional memorial for their 14-year-old classmate who was hit and killed by a train over the weekend. ♪ only the good die young >> more than 1,000 people showed up to a candlelight memorial for jenna betti. walking on the train tracks sunday, a train approached, jenna dropped the her cell phone, lunging towards it on the track to pick it up and was hit. among the first to speak at

memorial, jenna's sister julia. >> having gained one of the most beautiful angels ever, now she's in a better place and is protected by god. >> i would give anything to see you one more time to hear your voice and hear your laugh. >> jenna betti was remembered as a star soccer player who made friends easily. the funeral for the eighth grader is scheduled for friday. investigators hope to release pictures of the people who broke into an elderly woman's nome dublin and tied her up. the 80-year-old woman was asleep when three people broke into the home, tying her up, demand cash. they got away with an unknown amount. the woman wasn't hurt but the home invasion robbery and other recent crimes are forcing the police department to hold a community meeting. it will take place at dublin city hall, 100 civic plaza. police looking for this man who walked a lottery machine right out of the store right in

front of a surveillance camera. found a few hours after break-in, several blocks away. one person appeared in the video, police think it took multiple people to pull off the heist since the machine is big and heavy. california lottery flagged number of suspected tickets and the tickets are traceable. if the thief tries to cash in on a winning ticket, they would not be able to do so. >> turn towards microclimate forecast as the bay area braces for more wet weather. live look at baeembarcadero, looking clear. traffic beginning to build. it's going to be a crazy traffic day. let's talk to christina about the weather. >> good morning. everybody at home, right now, our dry period. we'll have showers returning as of this afternoon. it depends on where you're waking up with us. uniform, temperatures mid-50s, 55 everywhere except here in the south bay where we're at 54. as we head through this afternoon, anticipating, depends

where you live, as to timing of the showers in your neighborhood. in the south bay, rain moves in after 4:00 p.m. for the peninsula and the east bay. that's going to move in after 3:00 p.m. so you want to have that umbrella handy in san francisco in the north bay where showers arrived earliest. after 2:00 p.m. in san francisco, 1:00 p.m. in north bay, an inch, half of an inch possible in the south xwa. do have that umbrella with you. overall, weather's not big story, it's traffic. mike inouye. >> good morning. first, the update. it's not a lot of traffic but there are a couple of issues. this will disrupt your morning if you ride the rails. peninsula, a new crash. 92 getting off the san mateo bridge on the foster city side, light volume here and take you to the maps where 92 comes toward 101 in that direction and it's a smooth flow of traffic. left side of the screen you see a crash southbound 280 crystal springs, reported of one lane blocked by couple of cars, one which spun out and hit the

guardrail, block the off-ramp and part of the fast lane. rest of the traffic around the bay area on the road, that's moving smoothly. things will be different if this lasts more than a few minutes, which it sounds like it will. this is closure of the stations south of the hayward station. hayward is open, end of the line for the b.a.r.t. system. south hayward, union city, fremont closed. traveling north from fremont, that's where the arrow is, use 880 as alternate. a bus bridge in place between fremont and union city but a gap in coverage as far as the announcement from b.a.r.t. between the union city line and hayward station. christie smith heading out to the scene to see how you continue up to oakland. you see how far that is on the maps and that's a concern for riders through the area. rest of the b.a.r.t. system follows highway 24shg ea waway freeways. we'll continue to track that through the east bay. limited service from bayfair to san francisco now. we'll look toward san rafael

families at 10:00. and follow up now, san francisco one major step closer to approving one of the strictest bans on bottled water in the country. the board of supervisors passed the ban. the change will take place in october. starting 20016 extending to large outdoor events. the ban must be approved by the board one more time before sent to mayor ed lee's desk. menlo park giving a thumbs up to facebook's offer to pay for a police officer. the city council unanimously accepted the offer. it will pay 500,000 for the officer based at bellhaven neighborhood substation. the officer will work with schools and large companies like facebook to develop response plans for catastrophic emergencies. >> most feared one, obviously, active shooter. that's what we developed

different than emergency response calls. these are type of tactical responses for those operations. the contract between the city and facebook says the company will have no control over the officer whatsoever. this will be the first time a police officer has been paid by a private company, first time in the nation, in fact. tesla motors expects growth overseas to increase so much the company plans to open two dozen service centers and stores in europe and asia. according to a statement yesterday, the carmaker will introduce right hand drive versions of the model s in the uk and open more than 30 new stores in britain. europeans buy fewer cars, in many cases it's easier to sell cars in europe than america where there are restrictions on companies selling their own companies without going through a dealer. tesla plans to bill a huge battery factory in the united states. changes this morning to force more people to soon up for a yahoo! i.d.

for that and the news before the bell, let's turn to courtney reagan live at cnbc world headquarters. good morning. >> good morning. futures flat, slightly lower this morning following tuesday's big market rally. investors able to put aside their fears with the crisis in ukraine for a day. the best day of the year in fact for the dow and s&p 500. s&p closing at i knew hishg tgh. data on private sector job growth and the nation's services sector. dow jumping 227 points to 16,395. nasdaq up 74 to 4351. gm's ceo says the automaker sorry for the recall of 1.4 million vehicles involving air bags that don't deploy due to faulty ignition switches. gm is aware of 31 crashes and 13 deaths. gm engineers have known about the issue since 2004 but kept using the switches until late

how much sleep? >> i got a good solid 4 1/2. i'll tell you, i took two hours to watch the forecast maps because we have a weather coming in. that's something i don't like to let my guard down for at any time. i've been devoted to getting the forecast right, i can't bail out now. 55, wonderful to get to wake up with you guys, too. 72 later on in the east bay. a nice day out there. warm conditions. that's room temperature, 5, 10 degrees above average for this time of year. as we head throughout the afternoon, it's going to be a bizarre day. showers coming in are coming from the subtropical latitude. it's warm, moist air mass, muggy out there. you want to grab your umbrella. wool see shower activity as of 1:00 p.m. up in the north bay. stop that clock for you, get into the 4:00 hour, showers to north of san jose but moving in quickly. but at that point, you are pulling out your umbrella from san francisco south to palo alto. between 4:00 p.m. and 8:00 p.m.,

shower arrive in the south bay. we'll get four to five steady hours of rainfall before everything high tails it out of here tomorrow morning. good news is this is not our last chance for rain. every time i check, we keep that atmospheric river going and that's good news because that means we'll keep adding to tallies and our rainfall totals will keep creeping up. that means we'll take a dent out of the drought which, by the way, we've got a good story to tell out of the north bay later on. so this is what we're expecting out of your microclimate. keep showers going, san jose, san francisco, today, tomorrow, friday, saturday two great days to get outdoors. rain returns sunday. check your drive. could be a rough one. i'm going to send it back to you, peggy and scott. >> thanks so much. great job last night into. in new york, opening statements under way in the trial of bin laden's son-in-law, abu ghaith charged with conspiring to kill americans

after the terror attacks. prosecutors say abu ghaith used his role as al qaeda's spokesperson to announce more attacks on the u.s. and they said it will be more devastating than 9/11. he's the highest ranking al qaeda figure to face trial on u.s. soil. if convicted he could spend the rest of his life in prison. chief defense lawyer in the trial of oscar pistorius says first witnesses to testify tailored storied to match one another's. the witnesses, married couple who live next door to pistorius, heard a woman cream and gunshots the night that reeva steenkamp was killed. the defense says there were differences two the statements give tonight police and the testimony in court pistorius claimed he thought steenkamp was an intruder. prosecutors say it was on purpose. authorities are sifting through rubble after an explosion demolished ten homes in new jersey. this happened 30 miles northeast

welcome back. live look at absolutely beautiful western span of the bay bridge. glowing there. those are 25,000 shimmering lights, could be sticking around much longer than expected. today organizers are expecting to announce a plan to raise $12 million in donations to keep the lights shining unt2026. l.e.d. lights installed one year ago today as part of a two-year exhibit. tomorrow night the exhibit will go dark for ten minutes to illustrate what the waterfront looked like if the lights were to disappear. also, actor, john travelton?
