it was scary. fire, fire, then all of a sudden i see the top of the roof. it was terrible and the people jumped out the window. >> a 3-year-old boy thrown out of a second story window to escape flames in the east bay. good morning to you. i'm scott mcgrew. >> i'm peggy bunker. laura garcia-cannon has the morning off. fire broke out at a hayward apartment complex on seventh and c streets. >> christie smith is near the scene. christie, how is the boy? >> reporter: you know, amazingly he was thrown from a window but all things considered he is

doing pretty good. if you look at the front door of this apartment you can see it's scorched and why this family had to do what they did. we're talking about a 20-foot drop from a burning building. a 3-year-old thrown to safety. his aunt caught him on the ground. he was taken to the hospital to be checked out and thanks to their quick thinking he is okay this morning. this fire in a second story apartment building on seventh and c streets in hayward started last night around 11:00. when firefighters arrived what they say is that several rooms in this single apartment were burning. a man, a woman, a little boy up there, well, this family had to think fast. threw the baby, a neighbor says she heard everyone screaming and firefighters say this escape for all three happened fast. >> we had two adults prior to our arrival jump from the second story window and both transported to edens. injuries are not known as of now. >> reporter: the man and woman

were transported to the hospital to be checked out as well. their conditions not known. through all of this the fire was contained to this one apartment. the red cross was called out because about a dozen others residents were impacted with water damage and power was cut. the fire started in the kitchen but the exact cause is unknown. through it all quite a bit of damage to this one small apartment if you look at the windows and doors, that door being boarded up. that baby, all things considered being thrown from a window, pretty good this morning. live in hayward, christie smith, "today in the bay." >> astonishing. thank you. >> also breaking news to tell you about in san jose where firefighters have called for backup to help with an out-of-control house fire in aetna way and capital expressway. bob redell just arrived on the scene. bob, we heard of at least a couple people hurt. >> reporter: yes.

seriously burned. good morning to you, peggy. a man and woman here at this home behind me, this fire started around quarter to 4, you can see this fire is now out thanks to sjfc. they had to call for backup making this a two-alarm fire. when they arrived both those people had been able to get out on their own, the fire department tells us one reason they might have been burned and not get out as fast as you can see there are bars on the house. they had to be cut down. that might have slowed their escape whether they were coming out through a window or the front door which has a gate in front. that part is unknown. fire department tells us that when they arrived it was fully involved, it appears the fire started in the rear of the house. there is an outside structure there that was fully involved. that structure collapsed, might have been a shed or something like that.

it's not clear if that's where it started or where it spread to but again, two people seriously burned, captain thompson, even though they were able to get out on their own and they were walking and talking, that doesn't necessarily mean that these injuries are not life threatening. too early to tell. of course he's not at the emergency room. he said it's a case you can have people seriously burned walking and talking. reporting live in san jose, bob redell, "today in the bay." >> bob, thank you. >> turning to our microclimate forecast, let's take a live look out at the peninsula right now and palo alto, it looks rather quiet. mike will be pleased. let's check out how things are shaping up for the weather with anthony slaughter. >> good morning, guys. you saw we don't have a lot of fog even in palo alto and san francisco we're fog-free. clear visibility is going to mean for a beautiful sunshine for today and a warming trend. we're going to be warmer than we were yesterday. in fact, in san francisco

mid-60s will do it for daytime highs. elsewhere a little cloud cover overhead. all because of that cold front that moved through yesterday and cleared out the atmosphere. through the day today, temperatures very warm, in fact, we're about 5 degrees above average today. 71 will do it for the south bay, 70s for the east bay, and also for the north bay. elsewhere, san francisco and the peninsula back in the mid to upper 60s so. overall comfortable. this sets the stage for warm weather into the weekend. we'll talk about that coming up in a bit. >> good morning. wake up fully before you hit that road because there were reports of a wrong way driver. started at the bay bridge toll plaza you see traffic is now clear and moving smoothly toward the toll plaza. the original incident reports something happened past the toll plaza. we see the span between the toll plaza on the left and the metering lights and this is clear. then the update from chp. a smooth drive on the approach off of the berkeley curve. you see the slowing, that was a

clue. northbound 880 got a traffic break traveling from fifth up toward 980. a traffic break, then sounds like chp had to ram the car to stop them going down 880. the traffic break t lanes should be open shortly. right now all of the flashing lights, a big disturbance for the southbound side and of course closing the lanes in the northbound side for a couple more minutes. we'll track this. you should still head toward the area from what i hear they expect it to clear. that's the issue for the commute. the rest of the bay looking pretty good as you can see from the green. >> thank you. happening today, a south bay lawmaker unveiling new legislation in response to a bay area case that got national attention. state senator jim bell who represents saratoga will introduce audrey's law named after audrey pot t high school student who committed suicide after she was sexually assaulted at a party by three classmates. pictures of the assault were

captured on cell phone camera. the boys served 30 to 45 days in juvenile hall for the crime. bell says the proposed law is aimed at deterring bully, cyber bullying and sexual assault that led to the suicide. it would make it easier for prosecutors to charge underage suspects as adults and that could include potential prison time. >> also happening today, the funeral for the 14-year-old martinez girl hit and killed by a train on sunday. jenna betty was walking with a friend near the tracks in the afternoon when the train approached. she dropped her cell phone and was lunging for it on the tracks when the train hit her. tuesday, more than 1,000 people showed up to a memorial. she was remembered as a star soccer player who made friends easily. >> two san jose men face a laundry list of charges accused of robbing so many stores in a short period of time investigators nicknamed them the can't stop won't stop ban ditds. we're learning how police did

stop the pair. >> one body westbound through the backyard. he went over the fence. >> the two are suspected of robbing 20 liquor stores and markets in a two-month span. the crime spree came to an end after a chase caught on a sheriff's helicopter camera. it happened last week but police just released this video. details of the arrest as well, in one of the crimes one of the suspects is accused of firing a warning shot into the roof of a corner store in san jose. but the can't stop won't stop bandits last suspected crime was robbing a liquor store. >> he had like a mask on only i can see the guy, then he said just walk inside, give me the money, give me the money. >> police think the gun used in many of the robberies had been stolen in a home burglary. investigators trying to figure out if three men arrested for

several robberies at a bingo hall in santa clara are also connected to other crimes in the south bay. two of the men were arrested wednesday night, a third taken into custody yesterday. police say on wednesday the men held up a worker at the aqua mays bingo hall. two weeks ago outside the center the men allegedly pistol whipped a woman and stole her purse. the three face assault and robbery charges among other charges. getting a look at our microclimate forecast, and taking a look at san francisco, and the bay bridge, we're going to talk about that later. also look at san jose, you can see a little bit i don't know if it's fog or haze. we turn it over to anthony slaughter. >> i'll break it down. you don't have to worry about it. >> you do it. >> we don't have fog, actually. we have haze, air quality not the best but as we head through the day we're going to get plenty of sunshine and that's going to be the highlight today.

look at these numbers. talking 70s today and this just sets the stage for what's to come. in fact, look at what we're going to watch through the next couple of days. you'll find on the temperature trend for the south bay, we're going to look at temperatures that are going to soar into the weekend, in fact, you'll notice our average in san jose around 66 degrees. we're going to be at 71 today, 73 for tomorrow. we cool off just a bit for sunday as the next storm system starts to make its approach. monday more cloud cover and shower activity. keep that in mind. enjoy the weekend, but once we hit sunday night and monday, showers return. look at this, by tuesday, i mean we don't stay cold very often. we're back in the 70s, so we get a little bit of rain, we cool off a little as we head into monday and tuesday. then we're back up there. you'll notice your microclimate forecast today, every place very close to 70. san jose right there, gilroy at 73, san mateo 66. san francisco, you'll be warm, 66 degrees for the pacific heights area, north bay, east bay and tri-valley all again

upper 60s to low 70s. we do have rain in the forecast. we'll detail that coming up in a little while. let's talk about the drive. >> we turn over to the coliseum northbound with the taillights. the nimitz moves smoothly here, you expect this volume for 441 in the morning. a look at the map north of there, flew downtown, move until you reach about fifth, that's where they said the chp the they, they run a traffic break. we had red, traffic stopping for a couple of minutes up toward 980. chp has not give at any all clear yet. they did say the lanes should reopen. and we do see the traffic going from red to orange that means speeds are starting to pick up. we'll jump to the live look across foster city. a smooth drive from the high rise to the peninsula side no. problems for the volume. and a beautiful view. look at the pavement so that's beautiful to me. over to you. >> right. not too much traffic. thank you. >> you're the traffic reporter. still ahead, safeway stores

you may have noticed, though, last night bay lights went dark. take a look what that looked like. this is about 7:00 last night. out. right there. they went dark for about ten minutes to mark the display's first anniversary. organizers are trying to raise $12 million to run the light sculpture. tonight there will be a bike party ride across the new span. nice. i prefer it lit up. we now know the officer who will patrol the neighborhood around facebook headquarters. meet officer mary ferguson dixon. she will work out of the new substation in the bell haven community. the city council approved the company's offer tuesday night to pay $600,000 over three years for the full-time police officer. the veteran will patrol around the facebook campus, also work with schools and businesses to create public safety plans and conduct emergency drills. she starts her new job april 1.

>> there is wortry price of groceries could go up after a massive merger between two chains. the parent of albert sons bought safeway for more than $8 billion in cash and stock. with the purchase albertsons will operate more than 2400 stores and compete against kroger which has 2600. san francisco state university professor mark says some stores could close and prices could spike. >> they will probably close some stores, they are going to have to cut some costs. they are spending $8 billion on this acquisition so they have to get some of that back right away. >> consumer watchdog groups believe both companies may have to lay off employees. both companies denying stores will close. >> in about 45 minutes the u.s. department of labor will release unemployment numbers for february. for that and the rest of the news before the bell let's turn

to seema mody live at cnbc world headquarters. good morning. >> good morning, scott. futures a touch higher after stocks mostly positive thursday. the s&p 500 at a record high. investors awaiting the news, the february jobs report out before the opening bell. setting the bar low as they expect hiring was again impacted by winter weather. unemployment to have ticked down to 6.5%. the dow rising 61, nasdaq slipping by 5. american household wealth jumping mostly due to the stock market and rising home values. household wealth measures real estate, bank account and other assets minus mortgages, credit cards and other debt. the irs says the average tax refund this year is more than $3,000. surveys show most americans plan to use the cash to pay down debt but get this, younger people are

more likely to spend their refund on shopping or going out. the irs also says most people are doing their own taxes and are e-filing which i thought was interesting. >> all right. thank you kindly. >> i agree, refund, shoe money. that's what you use it for. extra gift you weren't expecting. >> that is so true. shoe money, car money, bill, whatever you have. it's like the greatest time of the year. next to christmas of course. let's talk about your forecast for today. and what you're going to find is very warm temperatures. we're going to be about 5 degrees above average across the bay. low 70s for the south bay, peninsula, close to that. even in the east bay near 70, the tri-valley will be the warmest in the low 70s. even in the north bay lots of sunshine for today. and again, temperatures in the 70s. this is going to continue as we head through the weekend. tomorrow will be the warmest of the day. in fact, the north bay will climb back to mid-70s, even san francisco close to that. so a beautiful day out at the

park i would imagine. sunday, though, here's the thing. clouds will start to push back up against the coast. san francisco will cool a bit, even the north bay will cool as our next chance of rain starts to push back in the picture. showing you the times you'll notice 7:30 on sunday, cold front lines up off the coast of california. this system is going to have more energy to the north. we're going to get clipped by this so don't expect a lot of rain even where it does fall. you'll notice it's going to come in overnight but again we'll get the rain overnight, wake up monday morning with just a few lingering showers. but you'll notice again a lot of that heavy stuff stays to our north, over toward tahoe they may pick up a couple more feet. but we're going to get clipped. keep that in mind into monday. it does look like the next couple days will be comfortable. so do enjoy that. leave you with this. it doesn't beat yours.

>> poppy butter. that's right. i like my name. i'm thinking about changing it. did you value patrick could sign a law outlawing upskirting. we heard about this when the bill was rushed through yesterday. one day after the supreme court ruled a man who took a picture up a woman's skirt on a trolley did not break the law. the court says that the voyeurism law was not broken because the women were dressed and in public. the law would make it a misdemeanor to secretly photograph a person's privates in public. >> also ex-girlfriend of oscar pistorius says he carried a gun with him as quote all time. the former girlfriend is the latest witness to testify in the courtroom. she claims the relationship with pistorius ended because he cheated on her with reeva steenkamp the girlfriend he shot to death. the witness says when she and pistorius dated he always had that gun on his person. she says he even fired a shot out of a car sun roof after they were pulled over for speeding.

pistorius said he thought that steenkamp was an intruder that he shot and killed her. prosecutors say it was on purpose. >> a stanford track star is the first active division 1a athlete stewing the ncaa over concussion. according to a lawsuit filed wednesday the three-time all-american who is not this person, suffered a head injury as a member of the track team and needs medical monitoring. he is represented by a firm which also represents retired nfl players in similar cases. >> he's known as one of the many heroes on flight 93 that tried to overtake the plane from hijackers. now his story is on the screen. >> the film festival featured a documentary we told you about, mark bingham fought one public

battle in the air above pennsylvania, a private one at home as well. >> while many are familiar with his 9/11 story they may not know he was a star rugby play they're came out and said he was gay. a majority of the film was shot by him. the documentary also shows his mother alice who has carried on her son's legacy of surge and tolerance. >> i was bowled over. i have a feeling it's going to hit me like that every time. it's so close to home. >> she must be very proud. the documentary called "the rugby player" airs again tomorrow. >> a celebrity sighting last night's sharks game. >> and shark territory, san jose moves smoothly for 101 here but i'll update you on the effect of the fire not far from the freeway.

a familiar face dropped the ceremonial puck at the shark tank. >> that's right. take a look. figure skater and san jose's own polina edmunds did the honors. as for the game it was a thriller. the sharks down by a goal in the third, brent burns ties it up.
