6:01 am
both fires burning steps away from one another at the intersection of seventh and c streets not far from the hayward loop. christie smith has been live at the scene all morning. christie, investigators, are they saying the fires are linked? >> reporter: at this point they say there is no reason to believe that but i did speak with neighbors who say they can't believe that they were just rocked out of sleep for a fire here, that calmed down, they were able to go back into their apartment and then hours later another fire broke out in a building behind the first apartment in a carport. neighbors say they heard horns going off and smell what had they thought was an electrical fire. nine cars damaged or destroyed. i spoke with dana who got his car out, drove right past those flames. >> looked out the window and this whole shed is in flames. so that was just stunning to me.
6:02 am
like five hours ago the apartment across was in flames. so i'm still shocked because i'm new to california. >> reporter: on that same block seventh and c earlier about 11:00 a fire broke out in an upstairs apartment. a man, woman and 3-year-old inside, the flames blocked the door. so basically they had to toss the 3-year-old out the window, 20 feet down to an aunt who was able to catch him. they followed behind. >> scary. fire, fire, then all of a sudden i see the red on the top of the roof. it was terrible. the people jumped out the window. >> reporter: i wanted to show you that baby. this is him, this is actually maurice we were told. this little guy who went out the window. he's doing good. the family back to take a look at their apartment. we're going to talk with them in a little bit. but what we're hearing at this point is that they don't think that these were related.
6:03 am
they think that this one actually started in the kitchen, the other they aren't sure but they tell me they have arson investigators on the way. reporting live in hayward, christie smith, "today in the bay." >> boy, that is cool to see him. just fine. that's great. >> let's go to bob live at a house fire in san jose. this one investigators are saying this is now a crime scene. >> reporter: very suspicious to them. good morning. this home burned, started around 3:45 this morning, within roughly the past hour they put up the yellow tape because the arson investigators said there is something that isn't right. they are declaring this a crime scene. this is based on information that the arson investigator gleaned from the two people burned in this fire. they are in the hospital. on the way out here they stopped by the hospital, the investigator, interviewed the people. whatever it is that they told them, made them believe the arson investigator, believe that this was suspicious, possibly an
6:04 am
intentional act so that's why they have the tape up and it's now a crime scene. this started a little before 4:00 this morning. you can see in this cell phone video shot by a neighbor how big the fire was. confined mainly to the back left corner of the house. the fire department tells us there was an outside structure, a shed or some sort of structure, that collapsed and caused a lot of damage to the home inside where this man and woman were and they were severely burned. they were able to escape but severely burned. the fire department telling us that the bars on the window and the door might have hindered their escape. they do have emergency release latches but for whatever reason the man and woman did not activate them. they escaped through the garage which might have been the longer way out which might have exposed them to more smoke and flame. >> they came running out the garage, screaming, yelled call
6:05 am
the fire department. >> reporter: what condition were they in? >> they weren't that bad. they were still walking. one of them was holding their arm and crying. >> reporter: after the fact, the captain of the fire department tells us they did suffer serious burns where they were first, second or third, didn't get into it but serious. they are in the hospital where they have the arson investigator has spoke within them. whatever they told that investigator, led the investigator and the fire department to believe that this fire is suspicious. possibly arson. hence the reason why this home here on aetna way is now a crime scene. bob redell, "today in the bay." >> thank you, bob. also happening today, the bay area case that got national attention will be the focus of a new law aimed at protecting victims of cyber bullying. senator jim bell will introduce audrey's law named after audrey

peggy. the san jose fire department arson investigator has declared this a crime scene saying it's possibly arson. something suspicious. what that is they won't tell us. there were a man and woman in this house when the fire started before 4:00 this morning who have been seriously burned. the arson investigators did speak to the victims at the hospital, whatever information the investigator got from them led them to say hey, we've got to declare this a crime scene. you have sjpd guarding the scene. this fire started around 3:45 this morning. you see in this cell phone video by a neighbor confined to a back left corner. there was an exterior structure as well, could have been a shed or something, fire department hasn't told us what, but that became fully involved, collapsed and severely damaged the home inside. the fire got so big that the fire department had to call for backup, calling for a second alarm. the bars on the windows,
6:48 am
security bars, and the front door might have slowed the escape for this man and woman. the bars have emergency release latches that let them get out but whatever reason they didn't activate those and escaped through the garage which might have been the longer way out, might have exposed them to more smoke and flame. >> activate the latch. common thing in fires? >> yeah. quite a bit of smoke when we arrived so the victims may have been disoriented, unable to find the latches. there were latches on every bedroom window. so the easiest way out probably the garage door. >> reporter: next door neighbors saw the man and woman running out of the garage door, said the woman was crying, possibly suffering a purn on her arm. not clear where the burns are on the man but again, fire department says they were serious burns, clearly serious enough they had to be taken to the hospital where as i mentioned the arson investigator has spoken with them and

valleys, low 70s, same for the east bay and for the south bay. a good mix of low to mid 70s and this kicks off our warming trend as we head through the weekend more sunshine, and warmer temperatures. in fact we're going up a couple degrees for saturday and then we cool off just a bit for a few locations on sunday. but you'll notice the tri-valley the warmest, 73 for tomorrow, 74 for sunday. you find the north bay, 73 for tomorrow. but 67 on sunday. so a good mix of a little -- of everything in fact as we head through sunday night. the reason that the north bay cools is because we're tracking rain. sunday afternoon that's when we start to see the first raindrops reappear at the coast and for the north bay, you'll notice the system, though, it's not going to affect everybody. we may just only see this rain for points like the coast and northward. really from the golden gate bring north. you'll find even in the south bay it's hard to get some of this rain down on the valley floor, but i do think if we get any shower activity sunday into

monday it would be about .1 inch, maybe a quarter inch in the north bay. a quick update on the el nino. climate prediction center has now issued el nino watch as we head through fall and winter of this year. it's because of this warming pool of water that's sitting off the coast of south america. when you get that warming water, that's when the el nino watch goes into effect. and here's the thing about el nino. even if we do get an el nino we could be looking at a dry year. you go back to 1976-77 we had a weak el nino and one of our strongest droughts across the bay area so. we would need a very strong el nino to establish itself and the way that you measure the strength is how warm those temperatures get off the coast. and that's what we'll be watching. in fact, the strongest el ninos, four of six of those we had more rainfall so this is something we need. the strong el nino, the stronger it is the better chance our rain will go as we head to the fall and winter of this year.
