i'm peggy bunker. >> i'm laura garcia-cannon. investigators say a suspected drunk driver tried to run away from police after plowing into a crowd of people at a music festival in texas. officers had to use a stun gun to catch him. good morning, bob. >> good morning. two are dead, 23 people hurt, five critically. i want to show you what the scene looked like moments after this happened. several people on the ground, you can see them lying on the street as others tried to help them, you can see them performing cpr. police in austin say moments before they tried to pull over the driver for a violation he sped away the wrong direction on a one-way road, then turned onto red river in austin which had been blocked off for the south by southwest music fest. he plowed into the crowd leaving a concert at the time at the mohawk club.

he struck several of them including a man and woman who had been on a moped. both of them died at the scene. >> bodies up in the air. one on the windshield, one on the grille of the car. from that point on he never stopped. you could see them flying like bowling ball pins. >> the driver struck a cab, came to a stop, tried to run but police shocked him with a stun gun. austin police believe the man had been drinking. they say he faces two charges of not vehicular manslaughter but capital murder and 23 counts of aggravated assault. >> thank you very much, bob. one we'll continue to follow. >> taking a live look outside right now at san francisco. you can see there is still wind to contend with at 4:32. checking in with anthony

in the lanes, not a big problem but the traffic slowed because it's very light. it's 4:34. we look at the wider shot you see the green around the bay. you are pretty much at the speed limit. we'll talk about construction blocking in the south bay. back to you ladies. >> thanks so much. new developments on the missing malaysians plane a. new report says the boeing 777 continued to fly for four hours after it dropped off the radar. the "wall street journal" says officials are looking into whether a pilot or passenger diverted the plane and also turned off the jetliner's transponders to avoid detection. the paper says it got this from a quote well placed source that is tracking the investigation. the report also says investigators are looking into data that is automatically downloaded and sent to the ground from the plane's engines. however, at a news conference a few hours ago malaysian officials called that report

inaccurate. >> demolition crews will be back in san francisco tearing down the site burned in a massive fire. demolition of the mission bay building began yesterday. the fire broke out tuesday. they hope tearing down the shell will prevent it from collapsing in the street. crews warned neighbors got the all clear to go home. >> happy that mine was enough away where i'm safe and have a place to stay tonight. >> very grateful to firemen, did a great job. >> not everyone was so lucky. some people who had windows blown out by the heat from fire cannot go home. they are talking about finding new places to stay while the mop-up continues. the cause of the fire is under investigation but officials are looking into whether welding work had anything to do with starting the fire. >> it's about 36 hours since the fire started and crews still mopping up. about half of the city's 300

firefighters were needed to battle the flames along with a high pressure water system. fourth street is still closed. there is no word on when it will reopen. oakland police added extra patrols in hopes of catching a man who inappropriately touched two young girls at separate schools. look at the man they are looking for, he is described as 6 feet tall with a rash or birth mark on his forehead. both incidents happened about 4:00 in the afternoon on different days. investigators say the man got into an after school program at world academy elementary school on friday and that's where he touched a 7-year-old girl. police think the same man grabbed and touched a 6-year-old at an after school program at think college now elementary school a few weeks earlier. >> police are issuing a warning for parents on the peninsula this morning, a high school student overdosed on a new drug. earlier this week the mountain view los altos high school sent e-mails to parents about a

student found unconscious on a trail on monday. police say he had taken doc, it's a synthetic drug that mimics amphetamines and lsd. officials and police hope the incident leads to an honest discussion about drugs. >> topics like this have come up in our family. we're pretty open about that conversation. >> talked to my grandson and he was telling me how dangerous it is. >> i sent several e-mails to my daughter and my husband and we going to talk about that. >> the student who overdosed is recovering and is in stable condition. >> lawyers for aldon smith will be in court but it's unlikely the 49ers star will make an appearance. a judge is expected to set a date for preliminary hearing. he faces several weapons charges after deputies reportedly found three illegal assault rifles in his home in 2012. smith was also arrested last year on suspicion of driving under the influence. the judge could set a date for

that charge today. smith missed five games to go to rehab. >> a report found children's hospital in oakland was in compliance with medical standards while training mcmath. the only problem the report found was the patient's medical records were not always entered into electronic data bases before surgery. the hospital responded saying not all staff members knew how to use the medical records system in part because it was only implemented a month before jahi was admitted. they documented everything on paper. the attorney for the family says the report only shows doctors covering for other doctors. the family moved her to an undisclosed location in january. >> new this morning a magnitude 4.4 earthquake hit central california the epicenter in the south of lone pine. it struck past 7:00 last night so. far no word of injuries or

got sick in court again today after lawyers accidentally flashed photos of reeva steenkamp's body on the floor and her bloody face while they were scrolling through pictures. his lawyers showed a picture of his legs and socks in an effort to prove he was wearing those legs when he beat down the door to his girlfriend. they say marks prove that he was not wearing his prosthetics. >> u.s. lawmakers travel today days before a crucial street determine if southern ukraine will join russia. troops continue in the crimea peninsula. they have taken over gas fields and the rail system is next. in washington, ukraine's prime minister made the rounds on capitol hill and sat down with president obama to discuss ukraine's future. on sunday crimea will vote whether to break offal from ukraine and join russia.

the prime minister is willing to negotiate but first troops must go. >> a new twist in the gm switches, the automaker revealing it knew about the problems two years earlier than thought. bertha coombs live with the newest information. good morning. >> good morning. revelations keep coming. general motors now says that the first sign of that ignition switch problem that led to the recall came back in 2001, that's three years earlier than previously disclosed. the issue has been linked to a dozen deaths and in documents released wednesday gm said it only recently discovered a record of that 2001 incident. gm redesigned ignition switches on newer vehicles but did not replace the older ones saying it would have cost too much to fix the problem. the futures are pointing to a higher start after mixed session for the markets on wednesday. the nasdaq up for the first time

talking about summer-like weather. even in san francisco where we are used to fog and cloudy skies, fog fee this morning and winds, light today so you can take advantage of outdoor water activity. chilly this morning and 40s and 50s, but later on this afternoon we'll see daytime highs again rival that of what we should be in the summer. we're talking 78 in the south bay, east bay, valley, same situation, even in the north bay close to 80 degrees for today. i want to give you a heads up a. good temperature trend if you will of what we're looking at into the next few days. friday back to the 80s in the south bay but saturday and sunday, some of our warmest days in time for the weekend. by sunday south bay we could look at temperatures 4 degrees shy of 90 degrees. unbelievable. look at monday, a cooler system coming in up against the coastline that will offer showers and maybe thunderstorms as we head toward tuesday and wednesday. everybody thinking about the

lane allowing solo drivers to pay a toll to use the carpool lanes. cupertino wrote a letter expressing its concern saying it would discourage carpooling. >> the san jose unified school district will hold its final meeting as it looks at how to spend its bond money, asking parents how to use the money from the bond of 2012. the meeting will start at 6:30 at pioneer high school in san jose. the last of six community meetings on that issue. >> it's 4:50. today we're going to get an update how the south bay plans to manage the fans to watch the 49ers. officials hosting a community open house to address traffic, parking and public safety concerns. it starts tonight at 6:00 at the community center of sunnyvale. levi stadium opens in august. >> looking forward to that. 4:50 on thursday.
