>> it's not due to the weather today but there is a power pole and live wires reported for san jose. we'll let you know how it affects 101. >> a live look along the embarcadero. it's thursday, march 13th, this is "today in the bay." a very good thursday morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm peggy bunker. we do begin with breaking news after a suspected drunk driver facing serious charges this morning, police say he plowed into a crowd of people at a popular music festival in texas. two people were killed, more than two dozen hurt. bob redell joins us in studio with the latest on this deadly crash. bob. >> good morning to you. police in austin say the driver faces not charges of vehicular manslaughter but capital murder. two charges of that. a witness videotaped the scene

moments after the drunk driver drove through a crowd of people. you can see people in this shot here hunched over the injured trying to help them, in one instance performing chest compressions on an individual trying to bring that person back to life. police say just prior to this they tried to pull this driver over for what was a traffic violation. instead he sped off down a one way, turned on red river street which had been shut down for the festival. it was crowded with people leaving. he plowed through knocking people down like bowling pins according to one witness. the two killed were a man and woman, the driver hit a cab, came to a symptom, tried to run away according to police but they tased him and took him into custody. >> cannot stop a person who decides that rather than face potential drunk driver charges decides to flee at a high rate of speed, go around a uniformed

officer forcing him to run out of the way, then at a high rate of speed total disregard for human life. that's why we will be charging direct filing two counts of capital murder on this individual. >> they will also file 23 counts of aggravated assault for the 23 people he hit, five of them critically hurt. >> terrible news there. thank you so much. >> it is 5:02. the hoses are back on a construction site in mission bay neighborhood. christie smith joins us live near what used to be a 9-story structure. how is it looking this morning? >> good morning. i spoke with one battalion chief who tells me up until about an hour ago they were actually spraying water on this. it got calm and then in the last couple minutes we noticed that a fireman was back up on one of the ladders this morning, so what they say is that hot spots continue to flare up so they have three engine companies out

here. ladder trucks, no demolition going on at this hour but this building is now knocked down to two stories. after demolition crews worked to push the burning building basically into itself to prevent collapse on the street after that mission bay fire tore through it on tuesday. huge fire. the chronicle now reporting that during that five-alarm fire firefighters had to tap into the city's emergency backup water supply because the regular hydrants and mains they might use during a fire couldn't provide enough pressure for the 90 engines and trucks that responded to the scene. what's left still very hot. >> the material gets buried and no matter how much water we put on top we can't get like our roof fell in. it's going to smolder away. >> reporter: neighbors were allowed to spend the night while the fire burned.

it was too dangerous. last night some of them got word they could actually return, very relieved to hear that. investigators are still looking at pinpointing a cause. of course one of the things that's been discussed is welding as a possible cause but at this point they say you can just look at it and see the reason it's too danger tuesday enter the building. reporting live, christie smith, "today in the bay." >> san jose police are looking through hours of surveillance video in hopes of finding the men accused of kidnapping a woman at gunpoint while she was responding to abad on craigslist. this happened in the parking lot of a target store in san jose. the woman does want to remain anonymous. she agreed to meet person selling iphones on craiglist. she says two men pulled out a gun, kitt kidnapped her and took her to a bank to withdraw cash. they took her back to target, made her call a friend to bring

money. the friend showed up and gave the then thousands of dollars. >> police need your help finding a hit and run driver. the suspect slammed into a motorcyclist tuesday afternoon on stone ridge drive. the 45-year-old victim expected to survive. the suspect with a black pickup and tinted rear window. it also had a fiberglass bed cover. >> good morning to you. >> good morning. we saw a beautiful day across the bay yesterday, in fact, same thing today. lots of sunshine and temperatures similar to where we were yesterday. you'll notice 40s and 50s, outside in the south bay, 50 degrees. 71 by 1:00 so. a warm day. not only for the valleys but san francisco. yesterday airport managed to get up to 73, i think downtown we'll be at 71 and even at the

airports 73 today. so similar to yesterday. you can see the east bay cam shaking around. pollen levels maxed out. everything really in full bloom because of all of the rain a couple weeks ago. from no rain, it will be sunny all day long. 76 in los gatos, san mateo at 72, palo alto 76. outer richmond at 70 degrees, even embarcadero at 72. north bay, santa rosa, napa 78. oakland 76, the tri-valley mid 70s there. the other thing i want to leave with you as we were talking about the potential for 80s this weekend, perfect beach weather to talk about. we'll explain coming up in a bit. how are the roads? >> you know, we're looking pretty good. it's very early. this is the stretch of 101 north of 680. we see the on ramp, folks with the merng as well as one of the

surface streets on ramp. we'll look at the map. north of that camera as you get on the freeway at mckee southbound 101 at mckee road reports of the power pole knocked down. chp arrived but doing a shift change so we're not able to get an update. we'll find out whether those are an issue on the side of the road. so far we haven't heard anything about that. smooth through the rest of the bay. and on the bridges. a nice green drive with our speeds in the upper 50s, close to 60 and above. the dublin area looks nice for a live shot. there is 580 westbound with headlights, picking up the volume but not an issue ot of the altamont pass. back to you. >> thank you so much. new developments on that missing malaysian plane. reports that the boeing 777 kept

at 5:10 now, back to the new developments on the missing malaysian plane. we're getting new reports about the boeing 777. chase cain has been following from the newsroom. what is the latest? >> there are reports from "the wall street journal" both boeing and rolls-royce continued to receive information for four hours after it went missing and the plane continued to fly for four hours but malaysian authorities are refuting those reports. check out this map. we're talking about a 2200 nautical mile radius that the plane could have kept flying, that means it could have made it to places far away as beijing or even australia. but again malaysian authorities call those inaccurate. chinese media release a satellite image of what they say could be the plane's debris in the water. so far no one has been able to actually find that and verify if it was in fact part of the plane

but that being released from the chinese media and malaysian authorities not happy about that. the search continues for this plane nearing six days since it went missing. china, vietnam, malaysia and the united states are all involved in the search. while they look for pieces of the plane there are counter terrorism investigators also trying to figure out if something may have been -- if terrorism may have been involved in what happened f. someone may have intentionally turned off the tracking systems, then tried to divert the plane elsewhere. there are just too many questions and too few answers. malaysian authorities did hold a press conference to refute a lot of the information that's out there. >> i would like to respond to these reports suggesting that the aircraft may have continued flying for some time after the last contact. airlines will confirm those reports are inaccurate. the last transmission from the aircraft was at 0107 which indicates that everything was

normal. >> reporter: again, it is boeing and rolls-royce t manufacturer of the engines, who say they continued to receive reports about every 30 minutes or so from the plane and the engine, sort of a thing they have with all of their planes to make sure they are functioning properly. officially no one from the two companies is commenting on the records so seems that there could be still a lot more to come. >> the mystery around this plane incredible. thank you so much. >> it's 5:13. new details, firefighters in new york say a seventh person has been found dead following an explosion that flattened two new york city apartment buildings. more than 60 people were hurt, about five unaccounted for at this hour. investigators say the explosion was triggered by a gas leak yesterday morning in east harlem. it shattered window as block away, cast a plume of smoke and sent people running in the street. the blast happened about 15 minutes after someone reported smelling gas in the area.

southbound 101. a vehicle hit the power pole, it's on the shoulder. live wires are reported initially. making a shift change, we'll get more communication from them so. far we will urge to you watch out. that truck theft scene. the wires are still there. the rest of the south bay a pretty good drive. north 87 showing a slowdown. a little slower now, no incidents, no big volume so we'll track that. we'll move to the tri-valley. travel toward the dublin interchange moves smoothly. westbound 580 out of the altamont pass. by the time you get in the heart of livermore you're back up in the upper 50s and at the speed limit. get you more speeds, east bay looking good for northbound 880 at the top. 580 through oakland the same and south 880 toward the san mateo bridge. on the foster city size.

good morning to you. thank you for joining us. i'm peggy bunker. >> i'm laura garcia-cannon. we have an update to breaking news, several people in critical condition this morning after suspected drunk driver plowed into a crowd at a popular music festival in texas. two were killed before officers used a stun gun to stop the suspect. bob joins us with the latest. >> good morning. the two people a man and woman are dead, 22 people hurt, five of them in critical condition. this was the scene moments after it happened. 12:30 local time in austin seen through the lens of an eye witness. you can see them lying on the street as others try to help. at least one instance performing cpr. police in austin say moments before this they tried to pull over this driver, he sped away, heading the wrong direction down a one-way road then turned on red river street which had been blocked off for the festival,

busted through and plowed into the crowd of people leaving a concert, a club. he struck several of them including that man and woman who happened to be on a moped, both died at the scene. >> i seen two bodies up in the air, i see one on the windshield, and one on the grille of the car and i looked at them from that point on and that point on he never stopped. kept hitting bodies, you could see them flying like bowling ball pins. >> the driver struck a cab, crashed, tried to run but police caught up with him, they shocked him with a taser and placed him under arrest. they do believe he had been drinking. he faces two charges, not of vehicular manslaughter but capital murder along with 23 counts of aggravated assault. >> you know, so many from the bay area go to south by southwest, do they have any i.d. on some of the injuries? >> not on the injured, not on

the man and woman and not on the suspected drunk driver. we can learn more later, there is a news conference for 8:30 our time. >> thanks, bob. >> to incredible developments in the search for the missing malaysian plane. the country's defense minister is denying a new report saying that engine data from the jet shows they may have kept flying for hours after its last communication. chase has been following this story. this new report adds to the mystery saying this plane could have been going on for some time. >> it is a mystery because one theory is the plane crashed and has not been able to have been found. but then of course the other is that terrorism may be involved. this latest report raises those suspicions. both boeing and rolls-royce t manufacturer of the engine, continued to receive information from the plane for about four hours after the plane reportedly went missing that means it could

have flown additional 2200 nautical miles possibly reaching beijing, even australia so. now the search area could be significant. chinese media released images just yesterday that they supposedly took on sunday showing what they believe to be debris from the plane floating in the water, vietnam says they searched that area and found nothing but possibly they may search again given these pictures. the search does continue and a wide area with vietnam, china,a malaysia, involved in the search. terrorism officials looking into the possibility that maybe someone may have been on board who turned off the communication equipment and allowed the plane to fly on for several hours somewhere else and may be on the ground. also reports saying that malaysia police searched the home of one of the pilots. the transport minister denied

that. >> reports suggesting that the malaysian police searched the home of the crew are not true. police have issued a statement to that effect. >> reporter: the chinese and vietnamese officials sort of upset with the way militia has been handling the search, they are refuting the reports that the plane may have flown some four hours before it went missing. both boeing and rolls-royce kept getting those updates and showed that the plane was still flying. we'll stay on top of this and see what comes of this report. >> a plane of that size to go off the page. thanks for the latest. >> oakland police added extra patrols in hopes of catching the man who inappropriately touched two young girls at separate elementary schools, this is a look of the man.

6 feet tall with a rash or birth mark. those happened on different days. the man got into a program, at world academy on friday, and touched a 7-year-old girl. police think the same man grabbed and touched a girl at think college now elementary school a few weeks earlier. >> police issue a warning after a high school student in mountain view overdosed on a powerful new drug. the high school district sent e-mails to parents about a student who was found unconscious on the stevens creek trail monday. police say he had taken a drug called d.o.c., a synthetic drug that mimics am fete mins and lsd, they hope the incident leads to an honest discussion about drugs. >> topics like this have come up and we're pretty open about that conversation. >> i talked to my grandson and he was telling me how dangerous

it is. >> the e-mails from my daughter and to my husband and we're going to talk about that. >> the student who overdosed is recovering and is currently in stable condition. >> lawyers for aldon smith will be in court but it is unlikely the 49ers defensive star will make an appearance. the judge is expected to seat date for smith's preliminary hearing. he faces weapons charges after police found three illegal assault rifles. smith was arrested on suspicion of driving under the influence. the judge could set a date for that charge today. >> at 5:36, checking in with meteorologist anthony slaughter. i hear we're getting toasty. >> yes. in time for the weekend. talking about with beach weather. you wouldn't know that if we can't get the rain we might as well get 70s and 80s. what you can see from our live

camera. no fog to report of this morning and temperatures are going to warm even by noon into the 60s, by this afternoon san francisco one of the only places that will still be in the upper 60s. but everywhere else we're talking about a good mix of 70s. san francisco you'll get at 71 for a bit, then back in the 60s. everywhere else a long stretch of 70s. topping out near 80 degrees, even the try valley and toward the north bay. the other thing to keep in mind, pollen levels off the chart. today and will all week so keep that in mind. even myself not a huge allergy sufferer but still dealing with it this week. keep that in mind. the other thing that's good to see the sunshine and temperatures in the 70s and 80s for places like gilroy at 80, 77 san jose, san mateo at 72, palo alto 76 degrees, the outer richmond in 70, embarcadero at

this morning russian troops continue to patrol ukraine's southern peninsula as u.s. lawmakers travel to kiev, we're also days away from a crucial vote to determine if crimea will join russia. tracie potts is live on capitol hill with the latest efforts to find a peaceful solution. if they can. good morning to you. >> reporter: if they can, good morning, peggy. that is one question that we don't have the answer to this morning because the u.s. and other european nations are saying that they will not recognize nice whatever the outcome of the seat. the ukrainian prime minister is here in the u.s. after meeting with president obama after making his case on capitol hill he heads to the united nations, where he will again try to urge other countries to essentially help get russia out of his back yard. here on capitol hill we learned that eight lawmakers led by senator john mccain of arizona

are headed to kiev today, they want to try strengthen ties between congress and the new government, congress holds the purse strings to a billion-dollar loan guarantee to ukraine, something that lawmakers have yet to be able to finalize. there are differences on capitol hill. meantime, on the other side of the ocean, russia is still sending troops into the region just this morning russian president putin said that russia has not caused the problems in ukraine. >> pretty amazing. thank you so much, tracie. >> 5:43. fire crews remain on the scene of the construction site fire at the mission bay neighborhood looking for flare-ups. christie smith joins us live from the scene. you talked to a firefighter? >> reporter: yes, good morning, spoke with the battalion chief. they did see some small flare-ups but overall things looking pretty good. they have three engine companies

keeping an eye on it from the ladder trucks. you can see one of the firefighters standing way up there with a bird's-eye view. the demolition and cleanup on hold. the battalion chief has called when they might be coming up but he thinks at daybreak after the massive fire on tuesday, demolition crews worked on pushing the building into itself to prevent collapse into the street. the battalion chief says the walls they were most concerned with on the north and south side have been pushed in. so that's a relief. here is michael thompson this morning. >> assuming the next stage is going to be they are going to knock down more parts of the wall which is going to expose more, give us more access so what we're doing is waiting for the sun to come up. construction crew to come back. we have three ladder pipes and

right now people are basically sending somebody up to the top about every 15 or 20 minutes. if they see hot spots they are going to knock it out. >> no one in the apartment were allowed to spend the night while the fire raged on. yesterday they got word they could return. the chronicle reports that crews happened with the backup water supply because the regular system couldn't provide enough for the trucks and engines on scene. demand very low right now, they are trying to conserve water. the chief says they are looking for a cause but focusing as it has been reported on welding. they say it's too unstable to get inside. i wanted to show you they are saying at the highest point here there are about four stories left down to two at the lowest point so quite a bit of work, a lot of demolition work to be done. christie smith, "today in the bay." >> thank you very much, christie. as you well know it's been about

36 hours since the fire started. the crews are still there walking to the battalion chief. about half of the 300 firefighters were needed to battle the flames along with a high pressure water system. fourth between channel and mission bay north still close and there is no word when it will rep. checking in with anthony slaughter here to talk about some balmy temperatures headed our direction. and also before we do that talking about tourist who is want to head to alcatraz. we'll find out. they want to see the rock, however, lately the weather has forced the national park service to close alcatraz for the third time since 2006. rough waters and high winds made it difficult to land ferries. >> some of the winds, people say they witness heard of winds like that.

little bit from where they will be today. and even more for saturday and sunday. looks like by sunday we'll have peak warming, 86 in the south bay. east bay and the north bay as well. cooler at the coast still really unusual. that's going to continue through sunday. another system starting to approach the coastline will bring more clouds and a chance for showers toward tuesday night into wednesday. you can see how the system approaches. we're not going for a huge amount of rain but a little bit of raindrops is good news. you know what, if you can't get the rain, get the 70s and 80s for beach weather. let's talk to mike. >> feast or famine in weather. it's either great or horrible according to the way people talk to me about traffic. this is a smooth flow. westbound 580 through dublin.

not having a problem here. the maps show you it is slowing approaching the dublin interchange. a little bit more of slowdown than we see. we'll watch this pattern, it should sort itself out. we should see slowing for 680 over the next half hour as most make the merge. also others head over to castro valley which is not a problem right now. 24 moves out of walnut creek, here the east shore freeway. that's moving fine. looking at slowing approaching san pablo, typical off highway 4. westbound 80 reports one lane blocked by a stalled vehicle. hopefully that will move quickly. we see slowing developing as the traffic builds and the incident adds. here's the south bay. i'll get awe hook at the bay
