i'm peggy bunker. >> i'm laura garcia-cannon. we are following a couple of developing international stories this morning. family members of missing malaysian airline passengers are removed from a meeting. first, the russian flag flying above the navy headquarters in the crimean capital. but not all ukrainians are giving up. "today in the bay's" chase cain digging into both stories. >> the first soldier has died in the conflict surrounding crimea, that happened as a group of soldiers stormed a ukrainian military office near the crimean capital. clearly tensions are rising in that region. also overnight a group of russian military and militia seized the headquarters of the ukrainian navy though they forced their way in through the front gate, reportedly no shots fired and no one hurt. the white house continues to use language suggesting there will be repercussions for the russian government, and vice president biden remains in eastern europe

working with nato allies. we have major developments with the missing plane in malaysia. that's the sound of a family member thrown out of a press conference in kuala lumpur after she protested, saying that the malaysian government is lying about what happened to the plane. understandably the families frustrated. frustration growing as the story continues to change. now, malaysian officials say when the co-pilot said the final words "all right, good night" to air traffic control the plane made a turn offcourse and the flight simulator taken from the pilot's home had data which had been deleted weeks before the missing flight. we do not know what the data was or who deleted it, but it's certainly raising suspicion about the pilot's involvement as authorities continue investigating everyone on board. >> all passengers, crew, and staff handling the aircraft are

being investigated. we are sharing all information relevant to the case with all relevant international investigative agencies that require it. we have received passengers' background check apart from ukraine and russia, which had nationals on board. >> it's full circle with ukraine and russia, being two that haven't provided background checks yet. the search for the boeing jet continues with 26 countries involved scouring a massive area. the core focusing on the southern route into the indian ocean west of australia. laura, you have to wonder what's going on. story changes every day. >> mystery remains, where is it? thank you. san jose police are looking for answers after the city's ninth homicide of the year. the body of a man found inside the home on eppling road monday. the man was shot. there was a marijuana grow operation inside the home.

no word if there's a connection to the homicide. 5:03. there will be a public hearing in sacramento today to address crude oil shipments to the state. many of which are coming to the bay area. a joint public hearing by two committees address emergency response procedures to rail accidents, especially when crude oil is involved. lawmakers are concerned about something that happened in quebec will happen here. last july a train carrying crude oil derailed and exploded, killing 47 people. california reportedly received more than 1 million barrels of crude oil by train in december. there are four oil refineries in contra costa county and a fifth in benicia. san jose appears to be at a crossroads in a quest to transform itself into a good downtown to a great one. a nonprofit made up of bay area businesses and government leaders. it's advising the city to approve high density housing and office buildings downtown.

the group says the key to the city's survival is getting more people into a sparsely populated urban core. the housing should be near future b.a.r.t. stations and transit hubs. there are 39,000 jobs in the downtown area dpicompared to 380 in oakland. have you checked your lotto ticket? people rushed out to pick up their tickets last night. >> i didn't get the meganumber. someone in the bay area matched 5 out of 6 numbers. 33, 51, with a meg dpa baaball . big winners from florida and maryland with $400 million jackpot. the san bruno winner matched 5 of 6. sales went up with the size of the jackpot, as it grew. the latest bay area millionaire last month, someone won $425 million powerball jackpot in milpitas. yesterday officials told me it was still unclaimed. in december, winning megamillions ticket purchased at a gift shop in san jose. retailer gets a cut, too. one of those millionaire made here signs, hoping to talk with the retailer when they come in later this morning. reporting live in san bruno, christie smith, "today in the bay." >> chp is teaming up with caltrans for the don't trash california campaign. workers will be along several bay area freeways picking up

it's going to be fantastic. part of the reason, winds are moving offshore. you see all of the arrows. what we're expecting today, clear conditions, dry north wind going to pick up. offshore flow going to boost temperatures 10 to 15 degrees above average for this time of year. as we head into tonight, high clouds near sunset. and that's at 7:20. it's going to be really pretty tonight. high cirrus clouds able to get into the ridge of high pressure. 77 in south bay. peninsula at 77. 75 east bay. san francisco, 70s as well. mike, that means more people on bikes, foot traffic and motorcyclists will come out as well when the weather's this nice. what else are you watching. >> first, great warning. smaller vehicles like two-wheel bike or motorcycle watch out, tougher to see in the mirror and glancing to the side. better weather means smaller vehicles. that's a tough issue sometimes. toward oakland, though, and that's a smooth drive on this live shot.

the light rails recruited due to police activity near st. james park. there are going to be delays because of that. toward the peninsula, smooth drive for 101 and 280. oscar pistorius trial is postponed. before the trial is adjourned a gun expert took the stand. he says reeva steenkamp was in the bathroom facing the closed door when hit by the first of bullets fired at her by pistorius. steenkamp fell back on to a magazine holder. one bullet missed her, she was hit in the hip, arm and head as expert went into graphic detail. pistorius put his fingers in his ears in an attempt to block out testimony. >> the fight over kim kardashian and kanye west's engagement video will play out in court. a judge set a trial date in the

lawsuit filed by the couple against youtube founder chad hurley who you see on the right. hurley recorded west's proposal last year and released it on its website. lawyers for kardashian and west say hurley signed a confidentiality agreement barring him from releasing the video. no word on how much the couple's seeking in damages but lawyers say hurley could end up paying millions. right now, 5:11. changes coming to your neighborhood starbucks. researchers finally figured out why dark chocolate is so good for you.

tri-valley. 77 is comfortable. next five days, peak warmth today, tomorrow, then drop off a touch as we get into that weekend. holding off on showers until tuesday into wednesday on next week. let me give you a preview of what the models are hinting at the this point. right now looks like we could pick upwards of 3 inches of rainfall between tuesday and thursday of next week. that's a good sign because it's still days out. when the models bring storm systems in heavily about seven days out, i can tell you now, that's a promising sign. so this looks good for next week. we'll keep you updated. mike's tracking the drive. good morning. >> good morning. looking over here toward the flow of traffic. this is no surprise for 101 through san jose. let me show you the south bay map. overall look around the bay, green all over the place. slowing for the tri-valley. but i want to draw your attention to san jose. road crews not a concern. st. james park, light rail is disrupted through the area. police investigation in full now

no major problems for the north bay or peninsula. >> thank you so much. 5:21. breaking news out of downtown san jose. police investigating the city's tenth homicide of the year. officers arrived at intersection of second and john streets before 3:00 this morning. after reports there of a person down. when they arrived they found a man's body. police are still on scene investigating right now. chase cain is headed at this moment. we will have a live report coming up shortly. a new study out finds women are far more likely to contract alzheimer's than men. the alzheimer's association says 1 in 6 women over age 65 will get alzheimer's compared to 1 inform 11 men. the study points out women in 60s twice as likely to develop alzheimer's in that life as they are to develop breast cancer. multiple studies about the benefits of dark chocolate but now researchers at louisiana state university say they've figured out and why it's so good for us. compounds in the chocolate

51, with a megaball number of 7. 5 of the 6 numbers matched here at huntington liquors in san bruno. it's a small, tucked away location. odds of matching all numbers, though, 1 in 259 million but somehow, two people did do that for the $400 million megamillions jackpot in florida at a convenience store on merit island and also in maryland, apparently someone picked those numbers by hand. those were special numbers to them. i do have calls into the california lottery to try to get more information on this jackpot, the jackpot winner and how much the retailer will get for selling this. but not bad for a day's work. reporting live in san bruno, christie smith, "today in the bay." >> not bad at all. thank you. 5:32. a developing story, strong video out of malaysia as families forcibly removed from a news conference for holding up a sign

calling malaysia airlines a liar. you can see her grief and anguish. that woman was among other family members of missing passengers who demanded answer and the troou. ma labor shaps defensb files were delighted from the home flight simulator from the pilot. the pilot is considered innocent until proven guilty of wrongdoing. crimea's self-defense force stormed a headquarters taking control and raising a russian flag without resistance at all. a.p. reporter made it inside and said he saw ukrainian troops packing up and leaving. the ukraine government has authorized its soldiers to shoot to kill its pro-russian forces threaten their lives. this comes after a ukrainian soldier was killed when pro-russian protesters and troops stormed a facility in

crimea. the militia man was also killed joe biden visiting countries neighboring russia, calling the annexation of crimea a land grab and promising the u.s. will step up land patrol over estonia, latvia, lithuania. >> they will be costs elsewhere in the world. >> yesterday president putin said he was not interested in other parts of ukraine. officers shot and killed a pacific man who stabbed a s.w.a.t. team member following a six-hour stand-off. police went to the house yesterday afternoon because family members said the man armed with an ax acting erratically. s.w.a.t. team was called out when the man would not come out. after waiting six hours they tossed a flash bang grenade and rushed the house. he stabbed a s.w.a.t. team member with a knife, several

officers opened fire killing the man. a man accused of setting more than a dozen fires is expected to enter a plea today. patrick brennan set 13 fires, causing $6 million in damage. fires include a five-alarm warehouse fire and six houses with people inside. mayor reed and city council honored several people credited with helping to kratch brennan. they organized neighborhood watches, posted flyers and turned in video during the string of arsons. san jose's one major step closer to moving homeless off the streets and into hotels and motels. voted to take a closer look at pilot program that would give rooms to people with housing vouchers who cannot find a place to live because housing in the area is too high. it will add kitchenettes to 100 rooms. a lot of details to be worked out including which nonprofit would run the program, which

motels would participate and how much this would cost in total. council will revisit the plan in two months. mountain view city council will not move forward with futuristic pod car projects for now. leaders want more time to research the driverless cars that would run on rails 20 feet above the ground before dedicating money or resources to it. sky tran was hoping mountain view would dedicate $750,000 to the project. richmond could have the highest minimum wage in the entire state. city council's voted to raise the minimum wage to 12.30. a second vote will take place next month. then crease would span three years and make it the highest minimum wage in the country. richmond's wage is at 8 an hour. it decided it had the authority to make that decision on its own. san francisco cracking down on e-cigarettes. the board of supervisors has unanimously approved a plan to ban electronic cigarettes from

bars, restaurants and businesses. it will basically treat the products like the traditional cigarette. the board will vote again next week for final approval. the ban could become law as soon as next month. and 5:36 now. on your wednesday morning checking in with meteorologist christina loren. getting a look at forecast. >> you know, it's the last day of winter, peggy and laura. kick off spring tomorrow. it's going to be pretty warm today, i can tell you that off the bat. getting winter-like readings. final day, 45 in concord. 57 oakland. look at this, fallen into the upper 30s in livermore. and it's a chilly start right on the ocean, 41 degrees down in half moon bay. if you're heading outdoors this wednesday, this is what you can expect on your way to work. mostly clear, chilly to start. dress in layers. afternoon temperatures are going to warm 10 to 15 degrees above average. by 10:00, 11:00, you can probably peel off your first layer across the bay area. microclimates are going to be very warm.

equipment pull over to the shoulder to the construct zone. they cleared the area but that's going to disrupt you a little bit. we'll show you west 580, the same area marked with the arrow, you see slowing. dra crash on the right, that's north of 5 0. another crash 680 past 580 moving to the shoulder. you see the shift in the yellow, slowing north of the interchange. here, where we have the flooding reworthed in the northbound 880 getting on at marina boulevard. the reason why there was a concern. this in geyser, a car took out a hydrant in the area by the honda dealership toward the freeway. there's the on-ramp and flooding. you see the lane, at least one is open, but more may be as they turned off the hydrant. so a soggy commute on to the freeway but it's open near the marina auto mall and shops on the other side of the roadway. back to the map. talk about the south bay.

>> reporter: so far they are not saying how this man died. they are just saying, though, he was found face-down in the street, this is st. john's street at first where we are. looking a block down near second street and st. john, a couple of san jose police cars, lights off, but on the other side of there, that's where the man was found face-down in the street before 3:00 a.m. this morning. they're saying it does not look like the man was hit by a car. instead, it looks like this man was killed. they are investigating it as a homicide. you see actually a vta light rail train moving through the shot there, they just told us that the train service as you see is moving as normal. they are not stopping at st. john. they also say bus service impact in the area. but as for the homicide investigation, san jose police say they're not sure if the man was shot or if he may have been stabbed. they just found a lot of blood around this man. adult male, that's all of the information they're giving us.

this is close to the park which is known to have a rather large transient population, not sure if at all that may have factored into what happened here. but homicide detectives on the scene, trying to see what they can figure out about this tenth homicide so far of the year in san jose. of course, we'll keep you updated all morning. >> thank you. >> 5:44 now. toyota reported reached $1 billion settlement ending a criminal probe into how the automaker handled case of sudden acceleration. this would be the largest fine against an automaker. the issue gained national attention in 2009 when a california highway pa tralman and his family were kill when their lexus ran off the highway at 120 miles per hour. toyota will avoid criminal charges if it's showing it's making improvements. the drought caused some food prices to spike and exer. s say it's about to get worse.

resistant plants. >> good morning. >> our area is particularly well suited for that. >> absolutely. i mean we are -- california is one of the five mediterranean regions of the swoworld have a similar climate. we can take plants from south wes western australia, california, and grow them and grow them well. there are thousands to choose from. >> how much water do you save percentage wise. >> on a garden like this 50% to 60% of water. this garden here has storm water retention that so storm water basins collect rainwater and it's put in semi permable paving so the water goes through to the ground and doesn't drain off and stored under the semi permable
