the second in just the past 48 hours. the man was found in the middle of the street near intersection of north second and east st. john's street near st. james park. >> chase cain live near the park in downtown area. investigators saying the man was stabbed to death? >> reporter: that's apparently what they're saying at this hour. we just talked to a man who found this person in the street and he said it was very clear that the man had not been hit by a car, something happened to his stomach. he also said it looked like the man was standing on the sidewalk on st. johns street -- as soon as the bus passes we'll zoom in -- a lot of transit activity in the area. there's an impact there. we're talking about second street at st. john. that's where the man was apparently, according to the witness on the sidewalk, shot or stabbed and then fell into the street. there was a lot of blood around. man who found the body, believed

to be 20, 30 years old. it happened before 3:00, that's when the body was found. san jose police got out here and they agreed that this appears to be a homicide of some sort. but they're not saying a lot about the man or the circumstances, even how long he may have been there. those are all questions that they will have to answer this morning. we are waiting to talk to someone from san jose police here in the next 45 minutes or so. so we can bring you better update here later in the hour. peggy and laura? >> we'll look forward to that as you continue to gather information. new video of a watery mess in the east bay. take a look at this here. a geyser, water gushing dozens of feet into the air causing problems for drivers in san leandro. a car took out a fire hydrant in front of the honda dealership on marina boulevard near 880. cars are allowed to drive through the area as crews continue to clean up that mess. 6:02. firefighters evacuated several

team people from overnight house fire. that started on the second floor deck, damaging one side of the home. eight adults, five cats and a dog have been left with nowhere to live. the red cross helped the people and pets find some place to stay. one person was taken to the hospital for a minor injury. it happened near intersection of monterey boulevard and el verano way. officials believe the fire started by accident. 6:03. it not the jackpot but someone in the bay area got 5 out of 6 megamillions correct in last night's drawing good for $2 million. i don't play the lottery but starting to think i should. >> if you don't play, you can't win. christie smith joins us live by the san bruno liquor store where the ticket was sold. not bad for a dollar investment. >> reporter: not at all. huntington liquors here in san bruno. talk about good fortune.

police activity. chase cains is investigating that, tenth homicide of the year. no problem for the freeways. following major developments in two stories. capturing international attention, the first in crimea, where forces stormed a ukrainian naval base. the other happening now in malaysia, families of missing passengers were just removed by force from a press briefing room. >> you can hear the heartbreak, see her anguish in her face. that woman among other family members who demanded answer and truth. they held up a sign calling malaysia airlines a liar. malaysia's defense minister says files were deleted last month from the home flight simulator belonging to the pilot. investigators are working to get the file back but the pilot is

considered innocent until proven guilty. storming a navy headquarters, taking control and raising a russian flag. a.p. reporter saw troops packing up and leaving. authorized shoot to kill if pro-russian forces threaten their lives. a ukrainian soldier was killed when pro-russian protesters and trooped stormed a military facility in crimea. the ukrainian militia man was also killed vice president biden visiting countries neighboring russia, calling the annexation of crimea a land grab and prom it'sing the u.s. will step up patrols. 6:10. strange noise and sudden drop from the sky. investigators try to figure out what caused a helicopter to go down.

go on. spoon me. mixim - from the ehrmann family. it's love, your way. homicide investigators on the scene of san jose's tenth homicide of the year. police found a man lying face-down in the streets surrounded by blood. he had been stabbed. this happened early this morning next to st. james park. san jose city council not supporting a plan to name the winchester domes a historical place. the commission will make a decision on the distinction next month. a developer wants to knock the domes down to make way for new business and housing. in malaysia, a heartbreaking scene as families of missing passengers on board flight 370 dragged out of a press briefing room. this in woman forcibly removed after she held up a sign at the meeting calling malaysian airlines liars. 6:13. coverage of the deadly

helicopter crash in seat that killed a pilot and television news photographer. this morning, federal investigators are on the scene combing through the wreckage, trying to piece together what happened. "today in the bay's" live near the crash site close to the seattle space needle. it's going to take months to pinpoint the cause of the crash. >> reporter: correct. now we're waiting and standing by for an ntsb update some time this morning. in the meantime, a memorial growing here at fisher plaza for the victims of the crash. we're going to see a preliminary report in the next five days but that full report of what caused the chopper to go down in flames could take up to a year. the latest on the investigation, right now the badly damaged chopper is at a secure hangar at the auburn airport where the investigation will take place. ntsb tells us its primary goal to get hold of surveillance video of the crash and looking into maintenance records. chopper went down next to the

if you wanted to head up with the fresh powder, higher elevations, head up to the upper mountain but we could accumulate maybe 6 inches of powder tuesday into wednesday. this morning temperatures are chilly. 46 in the peninsula. 47 in the south bay. 36 degrees in the north bay. four degrees away from freezing here. you might watch out for a little bit of black ice over local bridges and overpasses but it's dry. chances unlikely. take it easy. we don't want anybody any unnecessary accidents. 71 san francisco. 77 south bay. i.e., it's going to be beautiful. tomorrow, the first day of spring. and conditions will be comfortable. 79 in san jose tomorrow. san francisco's at 72. and then notice, numbers are starting to drop off, as that pattern changes. storm track returns. and that means rain is on the way. and even though it's still days out, our futurecast models are bringing in some pretty substantial rain chances.

crash. major impact to the drive. coming in out of livermore and tri-valley, looking standard. westbound 580 approaching 680, no big whoop. southbound 680 start the build out of pleasanton into sunol. speeds coming down into the upper 50s. smooth drive into the south bay. south bay, light volume. northbound routes not a problem. bus flow around st. james park because of the murder that's being investigated. chase cain continues on the scene. you cannot drive through st. james park but light rail will not stop there but take your light rail between japan town and civic center. a bit of a slowdown north of 680 on northbound 101. 101 in the north bay, southbound directions your commute building up the company as you travel southbound. curves at terra linda, earlier issue with a deer hit and moved to the side of the roadway. all traffic smoothly navato in central san rafael.

pronounced dead at scene. no one has been arrested. investigators have not released information about the suspect. it's the city's tenth homicide of the year. somebody found the man in the road near the intersection of north second and east st. johns streets, that's near st. james park and called 911. "today in the bay" chase cain live getting an update. 6:31, new this morning, toyota set to pay a billion dollars to settle a criminal investigation into sudden acceleration of its vehicles. "today in the bay's" tracie potts joins us live in washington. investigation triggered by a deadly crash five years ago that happened here in california. >> in san diego, it was a very difficult crash. and that's one of the reasons why toyota has been and continues to put out so much money. take a look, a billion dollars with this settlement, reportedly. still waiting on details from the federal government. they've paid out over $1.5 billion to owners.

in 2012 a $17 million fine and operate pli $16 million fine two years earlier for failing to provide safety reports, delays in providing the safety reports. talking about the california accident which kicked off all of the concern about these stuck brake pedals, happened august 20009. four people killed. at the time, toyota blamed it on faulty floor mats, but we later learned there was an acceleration problem, rapid acceleration and more and more reports about this. now it look like today the justice department is going to announce that in exchange for no prosecution, toyota will pay another billion dollars we'll wait to see if those already paid are eligible for that. >> one to follow. that toyota settlement could provide a blueprint for authorities pursuing a similar case, this one against general motors. gm announced two recalls taft

failed address safety problems during the past decade. prosecutors are questioning whether or not gm misled federal regulators how serious the problem was. more than 1.5 million cars recalled due to ignition switch problems. most of the recalled cars are in the u.s. that issue linked to 12 deaths and 31 crashes. dealers receive replacement switches april 7th. the ceo of general motors admits the recall came too late but the company's not acceptable liability. city council wants to investigate whether fracking played a role in the moderate california earthquake. fracking involves breaking apart rock deep under ground with pressurized liquid and some linked it with swarms of earthquakes in california, arkansas, ohio. l.a. council members pointed out a fracking operation close to the epicenter of monday's quake. oil and gas companies say, the technique is safe. 6:33 now. time to check in on the forecast

6:44 wednesday. update to breaking news. any minute now police in san jose will give an update on the tenth homicide of the year. hours ago, a man found stabbed to death in the middle of street near intersection of north second and east st. john street. >> chase cain live near st. james park in the downtown area. >> reporter: as you mentioned, hopefully in the next five minutes we're supposed to hear from san jose police. we can tell you we talked to the man who found the body in the street, right at the edge of the sidewalk on st. john's street near second street. he told us it looked like the man had been on the sidewalk, possibly stabbed on the sidewalk, and fell into the street. he said the man was lying

into the air causing problems for drivers in san leandro. a car took out a fire hydrant in front of the honda dealership on marina boulevard near 880. the water causing minor flooding. cars slowly allowed to drive through as crews clean up the mess. firefighters evacuated several people from an overnight house in san francisco. now this fire started on the second floor deck and damaged one side. a few blocks away from the city college of san francisco where the house is located. eight adults, five cats, and a dog had to be displaced. red cross helped to find people and their pets places to stay. one person was taken to the hospital for a minor injury. officers shot and killed a pacific ma who stabbed a s.w.a.t. team member. police went to the house yesterday afternoon because family members said the man was armed and with an ax and acting erratic. the s.w.a.t. team was called out when the man would not come out.
