a very good tuesday morning to you. thanks for joining us. i'm laura garcia-cannon. >> and i'm scott mcgrew. we're going to start with breaking news, a civilian who managed to get in the world's largest naval yard on a u.s. destroyer wrestled a gun away from a security guard and used it to shoot a sailor aboard the "uss mahan." the man was later gunned down. the sailor died at the scene. naval station norfolk briefly locked down. that has been lifted. officials will not say what led to the shooting. they are trying to figure out how the suspect got on base to pier number one. civilians are supposed to be escorted or have a pass to get into the air station. they are also additional guards at each one of the docks. >> more breaking news, this time in fremont. the coroner heading to a deadly

crash where an alleged drunk driver slammed into a motorcyclist. the collision happened earlier this morning at decoto road and fremont boulevard. christie joins us live where several streets remain blocked off. certainly going to affect the commute. good morning. >> reporter: yes, good morning to you. i've been speaking with investigators, they are getting a clearer picture of how this deadly accident unfolded. what they tell me a driver in a mini cooper ran this red light here at decoto road and hit a motorcyclist, and they also believe that driver had been drinking. on the street way down there, that's where the car ended up. but across this fremont bank parking lot, that's where the motorcycle ended up. so quite a hit. a horrible collision. police say at about with 1:00 this morning it was a taco bell employee that noticed a driver

in that mooney cooper was acting belligerent in the drive-through. that employee called police who then caught wake-up the driver down the road near fremont boulevard and decoto road. that's when they say he had already hit the man on the motorcycle and then crashed his car. >> immediately began running eastbound into an empty field north of the fremont bank. the arriving officer gave chase and fairly quickly took that suspect into custody. the vehicle also caught on fire from the collision of the utility pole. >> reporter: that pole is going to need to be fixed as well. what happened is that a passerby in another car waved down police and let them know there was a victim on the side of the road. that's where they found the motorcyclist deceased. the driver arrested, 23-year-old alexander yaun out of

emeryville. at this intersection there is a red light camera. i wondered if that may have captured the accident. they say the vehicles were going the opposite way so the camera would not have been tripped so probably did not capture the accident. this is a big intersection. it has been closed since the accident and they tell me 9:00 at the earliest it would reopen. probably much later. for more how to get around this i turn it over to mike. >> behind christie you see fremont bank, getting you located. we'll take to you the map. she says past 9:00 when this is closing we're looking at midday. a lot of traffic. in the morning folks come from the peninsula. across the bridge eastbound 84 f. you are doing that get off at the first off ramp fast toll plaza and on paseo padre or thornton or south past the seen. back toward fremont boulevard or

city streets and you can revout there. the closure is here. i did drive through the area this morning, you are closed before you get there around the nursery for folks who drive the area. a note for folks using the dumbarton express, you have to reroute for a few blocks. keep that in mind. here for traffic tuesday a heavier volume of traffic. early slowing, a little heavier but it's still a traffic -- the dublin interchange, a smooth drive for south 680 and north 680. here is the south bay with speeds close to the limit from 101. northbound 87, that's unusual for this time of day. no incidents reported yet. i'm going to give a refresh on our chp report. nothing for downtown san jose. 101 we have a crash reported on oakland road. we'll give you a wider look. a live look at the bay bridge

toll plaza. the backup, we should have metering lights on. these were turned on less than five minutes ago. slow off of the maze and off of the east shore freeway. and oakland on the approach north 880 smooth fast coliseum. looks like it's cleared as you approach highway 24. back to you. >> thanks so much. new this morning people with loved ones on the missing flight marched in beijing today, claiming the malaysian authorities and airlines officials lied to them. they want to see proof the plane crashed. and now china is backing them up demanding malaysia turn over the satellite data that supposedly shows the set went down in the southern part of the ocean. crews are not searching for the wreckage as bad weather is keeping planes grounded at least 24 hours.

several satellites have spotted debris floating in that part of the ocean. >> a developing story as the around the clock search for mud slight survivors continues. now california search and rescue responders are headed to the area north of seattle to the town of oso, a small community where everyone knows each other. peggy bunker joins us with mere. >> this is my home state. i know about the area. boy, lots of predictions. we're going to show you what's going on. president obama declaring a state of emergency on monday and this is why. look at the scene here. after declaring that state of emergency that means that now rescuers from morgan hill, sunnyvale and wood side are now going to be heading to that scene. searchers say they cannot work fast enough to work through miles of mud. yesterday eight bodies were found bringing the death toll to

14. 176 are still reported missing. with that mud slide hitting four days ago it's possible they are now on a recovery mission. >> we were able to secure national guard assistance in the form of a northwest person search and extraction team. that team is en route here. they will assist with our search and rescue. very technical expertise. >> the red cross says up to 60 homes have been impacted. some were hit so hard they were pushed across the highway. cars driving through cot consumed. residents say entire families, some with small children are missing. 176 are on the list, some of the names could be repeats so prapts the missing list will get smaller. the piece of earth that moved. 600 feet tall, so big we're learning. it registered twice on the seismograph.

jose. >> it's funny to be so excited but boy, we need. this could be a great one if it clicks. >> yeah. we're hoping it turns into the super soaker that the atmosphere river can only provide. that comes into play into the weekend. so you want to keep that in mind. probably a good weekend to make those indoor plans. i don't think anybody is that bummed out about the rain. we're in a serious drought and we really need it. 39 degrees, mostly clear up in santa rosa. we do have showers just to the north of sonoma county. this front looks like it's going to come in vertically. it's going to hit just about everybody at the same time. this is what we're anticipating. showers moving in by about 10:47, 9:46 in napa. 9:12 this morning in santa rosa. have your jacket and umbrella ready. 64 degrees, showers in the south bay, rain at times along the

peninsula. periods of rain in san francisco and the north bay where we expect the heaviest rainfall throughout the day today. and temperatures will be about 10, even 15 degrees cooler than yesterday with this rain coming in. we have rain cooled air. 59 degrees in the east bay. on and off showers. and this is just a projection of what we expect through friday with more rain on the way. saturday into sunday. hopefully we'll accumulate up to three inches. maybe more. looking more toward 1 to 2 inches. 2 to 3:00 and maybe half inch to an inch in san jose. we'll tell what you this means for tahoe in my next report. back to you. >> hopefully lots of snow. still ahead, burglary suspects on the loose after a woman uses an app to spot them breaking into her home. the police standoff that kept a neighborhood up all night. >> is this creepy clown just a

>>. >> today's top stories. authorities say the civilian who shot and killed a sailor aboard the "uss mahan" wrestled the gun away from a security guard. the suspect later gunned down by security forces. the shooting happened late last night at naval station norfolk. >> no word when a busy fremont intersection will reopen as police gather evidence from a deadly overnight crash. authorities say a 23-year-old man was driving drunk when he led police on a short chase near fremont boulevard and decoto

road. he hit and killed a motorcyclist before slamming into a pole. >> we learned the prosecution has rested in its case in the oscar pistorius murder trial. court is adjourned until friday so the defense can speak with witnesses. pistorius said he shot and killed his girlfriend by accident thinking she was an intruder in his house. police in palo alto looking for at least two people who broke into a woman's home managed to get away before a s.w.a.t. team got inside. the s.w.a.t. team thought it had the men holed up in a home in ames avenue near ross road for several hours. bob redell is live in palo alto. police have left the neighborhood but the burglars still on the loose. >> reporter: they did actively look for them but did sus spent that search before midnight. there could eventually be an arrest because they do have video images of the two individuals. this was the scene last night.

you can see s.w.a.t. surrounding this home on ames avenue. you can hear them in the background ordering the people to come out, not realizing that the people were, in fact, already gone. after several hours s.w.a.t. eventual hi made entry in the house to make that discovery. the suspect s had escaped a. mother was returning back home from errands, she had her baby and another adult relative. she noticed that the back door was forced open. on the phone with 911 she heard a door slam. she turned to technology to confirm that yes, her house had been burglarized. she looked on her smart phone and was able to access her in-home surveillance vem. there was video. it shows two strangers in a bedroom. then it cuts out as one of the suspects cuts the power. police thought video they were looking at was a live feed,

hence the call to swat. saying hey, we have a live feed. it wasn't until later they realized it was a recording after the standoff that they did look for these individuals but as i mentions no arrests. reporting live in palo alto, bob redell. >>6: >>6:17. the u.s. navy will soon knock on the doors of 1,000 homes on treasure island to test for dangerous levels of radiation. that comes after radioactive items were found buried under ground. one of those fragments was found in catherine's front yard. she happens to be president and founder of the treasure island health network and pushing the navy to clean up the island for years. she is a little leery about its latest offer to do the test. >> will any of our citizens be allowed the follow them through their own homes? will we receive all of the data

in a timely fashion? is the threshold actually the threshold it should be? >> the u.s. save says there are no known health as erds on the island but decided to do the testing to tease concerns of people living there. >> let's check the forecast. a live look at the bay bridge from our camera in emeryville. looks clear for now. christina says lots of rain on the way. >> yeah. potentially as you head into spring we might accumulate more rainfall than we did for all of winter. it wasn't bad. you have to remember the last three weeks have been dry, but before that we had some pretty decent storm systems rolling through the bay area. we're going to make up more of our averages as we head throughout day today. tomorrow all the way through next monday even tuesday. we're tracking showers for you. i can tell you right now hopefully we'll be able to make up significant averages when it comes to our rainfall totals for this time of year. we've had three abnormally dry years, that's why we're in the

drought. it's going to take a lot of rain to pull us out. i want to show you the front here it is. it's moving kind of slowly which is good news because it's going to be mostly dry. mostly cloudy, a few north bay showers. that rain will spread to the south by mid morning. by about 11:00 to noon we expect our first activity in the south bay. intermittent shower, they are going to continue into the evening and could abrough commute home so maybe your signature other is late. it could be because of the rain. on and off showers, the peninsula at 64, periods of rain on the way to san francisco. we'll see intermittent showers in the east bay. the closer to the coast line the heavier the rainfall for you today. because that front is coming in vertically. 64 in the north bay, trile valley at 63. the next five days we're keeping the showers in the forecast. let me give you a preview what we expect out of this.

up in tahoe. we stop this clock for you on friday. not even adding to the tab what we expect into this weekend and look at this. just about two feet of fresh powder that only mother nature can provide. we'll see even higher snowfall totals in the higher elindications. we're not done with ski season. let's check your drive. >> looking to the south bay, we have north 101 with the build starting now, i got to be honest, traffic tuesday not looking so bad. we'll look at the map. north of this camera shot a crash. it moved quickly to the shoulder. we have a slow drive north 87 north from capital to kertner. that's the only slowing. now 101 north of capitol expressway and north of 87 so we'll see that build over the

next 20 minutes. we'll track that. we're looking toward fremont with the continued closure. the debris field, deadly crash, keep that intersection closed with the investigation which continues much of the morning. slowing here as well. this is 84, on the dumb parten bridge at 880. use paseo padre, that will get you past the scene. over from peninsula find slowing as well. you want to use that first off ramp. the second will get crowded. you have to hit city streets. the rest of the east bay according to schedule. a little slowing for 880. the stretch between the south bay and the city, the east shore drive in the green zone. you have metering lights on. all lanes when we have them

stacked up but we see movement for the fast track lanes. the 101 not a big deal. we expect tuesday to show a heavier traffic flow down to the scene in a few minutes. >> all right, mike. thank you. well, a creepy clown has been making headlines for haunting staten island. though now it looks like maybe the clown was just trolling the internet. four staten island men posted pictures of this miss steer yaus clown, word spread, had its own cash tag. most taken at night bought local comedian able to get view of a day time sighting. >> staten islands, i'm used to clowns. >> "the new york post" reports the four men including the comedian we heard from are all linked to a local film company.

three extreme skydivers now under arrest accused of pair a shooting off the tallest skyscraper. >> what a fall. this is video posted in youtube showing the jump which happened last fall at 1 world trade center tower in new york city. the three base jumpers and suspected accomplice turned themselves in to police yesterday. an official tells our sister station in new york one of the suspects is an iron worker who worked at the trade center. he apparently used his work access to get the jumpers into the building. the jumpers then got up to the tower through a gap in the fence. that jump is just one in a series of dare devil stunts at the tower a. week ago a teen told police he got through a gap in a fence when he slipped past a sleeping security guard and spent two hours alone at the top. the 16-year-old was not caught until he made his way down. he is due back in court next month. time now 6:26.

still trying to get in. we've got about another block or so here lined up hoping they may be able to get in and hear these arguments which start as you said in about 30 minutes. a lot of interest in this high profile case. hobby lobby an arts and crafts company own by devout southern baptists will tell court that providing certain contraceptives violates their religious belief. >> they don't abandon their constitutional freedoms just because they are trying to earn a living. >> reporter: the affordable care act requires companies with more than 50 employees to provide free contraceptive as part of health insurance. the court must consider whether denies those violates their rights. churches and nonprofits like hospitals or schools run by religious groups are already exempt from providing contraceptives, the court will decide if for profit companies should get the same exemption.

>> people have religion, belief, morality. companies do not. >> advocates argue it's a slippery slope. >> we could see religious businesses trying to exempt themselves from laws that require equal treatment for gay and lesbian couples. >> issues the court may address in today's arguments. and those issues may also include the cost of all this, not the cost of providing the coverage but the cost of not providing the coverage because laura, hobby lobby, the larger of the two companies has calculated the fines for not providing the coverage would be $475 million a year. >> that's a hefty price. thank you. in fact, employees here in the bay area could be affected as well. hobby lobby has locations in morgan hill and antioch, it plans to open another location in dublin and one in concord in may. >> santa clara university was

francisco. it will be there at about 10:02. we expect showers to move into santa rosa. 8:31, napa your steady rain at 9:0018 with all of the rainfall spreading to the south throughout the day. it's going to be mostly cloudy for the first part of the day, and then we are going to see changes really kick in. if you have outdoor activities that you need to take care of, maybe getting the mail, walking the dog, you want to get it done early. that rain is going to spread to the south, then the intermittent showers continue for your evening commute. and i can see mike, he's concerned this could impact your evening commute. then tomorrow morning is when it will impact your morning drive. we stop that clock on futurecast, heavy bouts of rain moving in, still at that point on the dry side in san jose. not for long. we have steady rain on the way for wednesday, a little break for the first part of thursday, then this weekend we're talking about that atmospheric river. i'm going to show you what this means for where you live and

where we could pick up three, four, additional inches of rain over the course of about 12 hours, maybe 24 hours. it depends on how long that maintains. cool stuff, science coming up. first let's check your drive. here is mike inouye. >> like you told folks i'm concerned because the rain coming in will affect actually the later morning commute into the evening so. that will be an issue. also an investigation we'll talk about. northbound 101 at san jose moves pretty smoothly. look at the map north of that 101/680 we see slowing up toward the crash. that's on the shoulder but enough of a distroox cause slowing. another crash not causing problems but we see unusually slow drive north 87 from capital expressway up to curtner. it's causing a slowdown all the way into downtown. that will cause more slowing 101 and 85. looking to the closure, the investigation which continues, fremont boulevard at decoto

road. close to the -- a crash between a car and motorcycle. with the closure we see slowing now off of the dumbarton bridge eastbound highway 84 slow as you pass the ardwood exit. get off before you get there. the first exit off the bridge, and get you around that scene. heading to the bridge, use paseo padre or thornton back over to 84 and the toll plaza without any problem. moving through the rest of the bay. the traffic tuesday build coming through the tri-valley, slowing 580 and south 680. live look at oakland, the build north 880 approaching 23, reports of a garbage truck had a fire. it should be off to the shoulder. looking at the bay bridge toll plaza. there is your backup for the cash lanes and the fast track. back to you. >> thank you. today the santa clara county board of supervisors will consider cracking down on elect

chronic cigarettes. are you allowed to smoke e-cigarette in places it's illegal to smoke a regular cigarette? the county will consider whether e-cigarettes should be banned from county vehicles. more than 40 cities in california have placed restrictions on e-cigarettes. >> supervisors look at a proposal banning smoking in condos and apartments. it prohibits smoking within 30 feet of the complexes. including decks and patios. the ban would not affect hotels and hin law units. >> blow torches breaking apart the wreckage a day after a train derails. new concerns the operator may have dosed off moments before the crash. >> one of the biggest shipping channels still shut down a. massive cleanup effort under way.

authorities in texas hope to reopen one of the world's busiest shipping channels sometime today. right now crews are working to try to clean up quarter size tar walls washed ashore in galveston bay. saturday a barge and ship collided spilling 170,000 gallons of oil in the channel. it happened near the peak of the shore bird migration season. officials are setting off booms to try to scare the birds fromp all of the oil slick beaches. >> crews will use torches to cut

a commuter train apart a day after it derailed at o'hare international airport. the train plowed across a platform, smashed its way up an escalator, early yesterday morning injuring more than 30 people. the president of the chicago transit authority union says it's possible the train operator dozed off shortly before the crash. >> she said she was extremely tired, i didn't go into an in-depth conversation with her but it has been reported that she has nodded off. >> the union president says there are safety measures in place that should have stopped or slowed the train even if the operator did fall asleep. federal investigators will interview the operator today. >> 6:41. coming up, updates to two stories including a deadly shooting at the largest naval base. how the suspect managed to grab a gun away from a security guard. >> a motorcyclist killed, a driver in cuffs, a busy

6:44, breaking news, a civilian suspect was shot dead by security forces aboard the and shot a at naval station uad sailor.

the sailor also died at the scene. the base was briefly locked down but has been lifted. officials still trying to figure out how the suspect got on the base, and all the way to pier 1 where the destroyer was docked. civilians are supposed to be escorted or have a pass to get into naval station norfolk. >> they can go to work today, yes. we're not keeping them from going to work. it will be a trying day for those sailors for sure. >> investigators have not said what led up to the shooting. >> more breaking news, this time in fremont, one of the city's busiest intersections remains shut down this morning after a deadly crash. it happened earlier this morning when police say a drunk driver slammed into a motorcyclist near the intersection of decoto road and fremont boulevard. christie smith joins us live at the scene where there is debris scattered everywhere.

good morning. >> reporter: good morning to you. at least 100 yards of debris. what police are telling us that driver was taken to the hospital for a blood test but they are fairly confident that he was under the influence when they say he blew right through a red light and hit a motorcyclist. the street is here but if steve can pan over you see how far this cyclist was knocked near a stop sign in the distance. that's where investigators are walking around after a horrible collision at fremont and decoto road. the driver in a mini cooper hit a man on a motorcycle, crashed into a pole, that caught fire. they say he got out of his car and ran from police on foot who finally were able to make the arrest. they say it was a fast food employee that was the fires notice something wrong when the driver showed up in the drive-through in the car acting strangely before the fatal

wreck. >> the employee at taco bell said we have a patron in our drive-through, he's very belligerent, appears intoxicated so they were alerting us to that. we put that out over the air and an officer in the area got to the area fairly quickly and saw what he believed to be the suspect vehicle. >> reporter: the police say they arrested 23-year-old alexander yaun on suspicion of driving under the influence with more charges to follow. what happened after they arrested him is that a passerby waved police over and told them there was a victim here in the road. that's where we are this morning and again, investigators are combing through everything, probably waiting for a little bit of daylight so they can see which should happen soon. it's a busy intersection and that it won't be open until some time after 9:00 this morning.

reporting live in fremont, christie smith, "today in the bay." >> christie, thank you. let's bring in mike inouye. about traffic in that area. >> christie smith in the background she had that shot of fremont bank, there is also a gas station nearby, a number of restaurants and a convenience store i think it's a walgreen's. that's a heavenry traveled onto and off and that will be a major impact. the bay. there are some slowing going on in the tri-valley. i want to zoom in. fremont boulevard, decoto, this is a problem getting off the dumbarton bridge to the intersection. that's closed so you want to get off and probably take paseo padre. thornton to the south will get you away from the freeway or from the surface streets toward the dumb bart everyone dridge as you stay away from fremont boulevard. this will affect folks taking

nobody hurt. >> police looking for at least two burglaries following a six-hour standoff. they thought they had the men holed up in a home near ross road. bob is live in palo alto. the owner was able to watch the burglary happen on her smart phone? >> saw video of the two suspects in her home. so did police but there was confusion over that smart phone video. police thinking it was a live feed, hence the stand-off. >> that was police last night surrounding this woman's home on ames avenue ordering the suspects out of the house, after several hours s.w.a.t. made entry to discover the suspects were not inside. they had escaped before the first officer arrived. the mother was returning home from errands with her baby and

another adult relative. she noticed that the back door was forced open. while on the phone with 911 she heard the door slam in her home, she turned to a 21st century piece of technology to confirm that yes, her house had been burglarized. >> she then used her smart phone to check her video surveillance system in her home, and was able to see what she thought were two individuals whom she did not recognize in her home. >> the smart phone video shows two strangers in a bedroom. one of the suspects cuts power to her system. police thought the video they were watching was a live feed. that's why they called s.w.a.t. it wasn't until later they realized it was a recording of what happened right after the standoff police did search for the suspect. they had an active search in the surrounding area. they did call off the search just before midnight.

bob redell, "today in the bay." >> thank you. new this morning a 74-year-old woman is waking up a free woman after serving more than three decades behind bars for a murder she did not commit. our camera is there when mary virginia jones also known as mother mary was released. in 1981, jones drove a friend to a crime scene. he murdered a drug dealer. mother mary was convicted of first-degree murder for taking part. she served 32 years but prosecutors and law students say she did that at gunpoint and that should have been considered. finally yesterday a judge set aside that conviction. >> i'm so thankful and so grateful. words can never express how i feel. >> she says it was her faith in god that kept her going. she hooks forward to being with her family and to full time ministry. >> rain expected in the forecast

for an already agonizing situation in washington state. california search and rescue teams are headed in hopes of recovering victims. responders head to the town of oso north of seattle. peggy bunker joins us with more. >> reporter: good morning. it is an agonizing situation for sure. it was a sunny saturday morning, many sleeping in. the rural town of oso, if you look at this picture we can show you this aerial t the land slide pushed it down the hill a mile wide. you can see it flows in front of the town all the way on 530. this used to be a highway. this mud is about 20 feet deep. cars that were on the highway, those were blew into pieces left behind only tires. taking a live look outside at
