we give you the seven-day forecast at the bottom of the screen throughout all of my reports. i can tell you the active time frame you want to keep in mind is between noon and 6:00 p.m. we're going to see strong wind, in addition to that wind heavy downpours. i want to show you here is our area of low pressure right now moving into the pacific northwest dropping into northern california. down here you see this additional flow of moisture. that is what we call the atmospheric river. so heavy rain at times for today. and also unstable air mass coming our way. so it's the best chance for thunderstorms that i witnessed any time so far this year. we'll talk about that coming up. back to you and the rest of the top stories of the day. >> thank you. this morning suspended state senator leland yee is heading back to federal court in san francisco. today in the bay's christie smith is joining us live by yee's home. he's been laying low. >> reporter: yes, he has. leland yee is charged with seven

federal felonies, and many feel is straight out of hollywood. many of the charges have to do with public corruption. we did speak with one legal expert who said that sometimes these type of charges can be very difficult to prove. that there's actually nothing illegal about giving money to politician's campaign expecting to influence that person. that it's also not illegal for a politician to take into account the wishes of a contributor. there are also accusations of coordinating a cash for guns scheme but that legal expert says the problem is when there is a blatant and clear exchange of money for political favors. >> the latin phrase is quid pro quo. they have to prove that the money was given in exchange for an explicit promise by the public official to do certain official acts. >> reporter: he used the case of former san jose mayor ron gonzalez as an example. he was indicted on bribery but a

judge later dismissed that saying there was no indication that a crime had actually occurred. he says for yee prosecutors will have to prove intent, that audio and video evidence will really be key here, and that the defense will likely argue that the fbi entrapped him. he is due back in federal court to discuss security arrangements this morning after he was freed on $500,000 bond. reporting live in san francisco, christie smith, "today in the bay." >> we'll have continuing coverage of the senator's court appearance. you can get details on what happened in the courtroom during our newscast at 11:00, until then find our updates on our website, nbcbayarea.com. >> nine days after a massive mudslide in washington state, crews will be back out this morning looking for dozens of people still missing. 30 people are still unaccounted for. 21 confirmed dead. that number will rise to 25 once

crews recover the four bodies they know are in the debris. officials say the mud is so high they expect to be digging well into the summer. work has been slow because of the rain that continues to fall. >> more disappointment in the search for the missing malaysian airlines flight. australian officials say orange objects spotted by a search plane turned out to be fishing equipment. australia says it will continue to search for the boeing 777 that vanished march 8 with 239 people on board. ten planes and ten ships are scouring an area the size of poland off the west coast of australia. >> a bay area hospital is warning patients that they may have been exposed to a variety of diseases including hiv and hepatitis. the california's campus sent out letters to 200 patients. the san francisco hospital warns that instruments used to examine the lungs and digestive tracks in july 2010 and february of this year failed to undergo a

final step in the sterilization process. patients are told to test for hiv, hepatitis and tb, the state department of health is investigating. the hospital says it has fixed the problem and brought in a doctor to evaluate the situation. >> it is deadline day for people to sign up for health insurance. chase cain is in the newsroom with what you need to know. >> one of our producers brought me an update that the federal health care website health care gott gov is experiencing problems this morning. people are going to the site and getting error messages due to the heavy amount of traffic of people racing to beat the deadline now less than 19 hours away you have only until midnight tonight to sign up for health care. the good news is that you do have a couple of weeks on the other side of that, until april 15 to sign up. sorry to finish the application, if you start that sign-up process today. we already have more than 1.1 million in the state who have

signed up for health care through covered california but that leaves nearly 2 million people in the state without health insurance and many may be racing to start that application today. there is a fine, at least $95 if you do not begin that application today, but there is one other concern for anyone who has waited until last minute. >> do not wait until 11:59 on monday to try to enroll and use the system. there's going to be a lot of people. if the everybody does that the system will not be able to handle that flood where everyone tries to enroll at the last minute. so, make sure you enroll now, as soon as you possibly -- >> that interview was from saturday so then they were forecasting problems for today which seems at least on the federal website is happening. if you want live and in person help there are two events today. the first is at the oakland asian cultural center on ninth street and oakland. and the second event at the bay

area rescue mission on mcdonald avenue in richmond. both of those begin at 2:00 p.m. and you will need to bring a photo i.d., proof of address, proof of income and proof of citizenship. and the good news for those who are still signing up is that at least four out of five people who have already gotten insurance through covered california are eligible for the subsidies to help bring the cost down. again, the advice is that you need to start this now because apparently we are already having problems with the website. >> all right. and chase, to dumb it down for me further, california use covered california, the other states use health care.org. >> correct but you can use healthcare.gov to sign up. that's an happen. but in california you can use the state's site which so far we're not hearing about problems with that site. >> all right. chase cain, thank you much. >> weekend rain caused an old problem at oakland's coliseum to bub tool the surface. look that the video posted by

the a's third-base coach. rain pour there had during the game, ultimately canceled the game. the showers and the toilets started to back up. you can see water here bubbling in the showers and the toilets. it's not the first time the a's have seen the problem is back during last season's playoff push, players reported sewage backing up in the clubhouse. a couple of players took to twitter to make jokes. josh tweeted back in oakland sewage problems in the clubhouse. yep, we are back baby. >> the a's open their season tonight at oakland coliseum. meteorologist christina loren, looking at that baseball forecast. chance of sewage. >> you know, we don't usually have good results when it rains this heavily out here in o.co coliseum. i can tell you, if you're a fan, you bought a ticket, you're going to try. make sure you have your rain

gear ready to go. but i will say right now there's going to ab30% to 40% chance of a rain-out. wait till you show you what's coming. temperatures in the 40s and 50s, it's chilly to start and we're going to stay in the 50s so you need your jacket about all day. 59 the forecast high for the south bay, same for the peninsula, 57 for the east bay and san francisco, and we're only going to hit about 54 in the north bay where we expect the heaviest rainfall. first of all let me time out this front. we stop the clock at lunch time. showers draped to the north of san francisco especially the west side. as we head throughout day all this activity is going to come in quickly and along with it very gusty wind. i stop the clock at 2:00 p.m. not a lot of movement from that front heavy rainfall up in the north bay for a consecutive four to five hours. we could pick up over an inch of rain over the course of today. 5:00 p.m., look at this.

the front is going to come in vertically, really impacting the peninsula. all the way up and down marin and sonoma county. this is when it's going to be active. between about 12:00 and 5:00 p.m., all the way to 6:00 p.m. we have a chance of strong thunderstorms right here in the bay area. we don't typically see the pattern. because it's moist out there, we've got humid air coming up from the south. that's going to collide with this cold air mass coming in from the gulf of alaska t two create instability and you get those thunderstorms. by friday at 2:00 a.m. a little break, but there is more rain on the way toward the end of the week. and every time i check the long term models we're looking out 15 days, storm chances every day through the month of april. looking very good. so better late than never, mike. we need the rain. we're still in a drought and we'll take every drop in the bucket we can accumulate. >> for sure. to my kids, we still have to turn off the water when you

brush your teeth. don't take such long showers. you guys are just messing around. west 580, that was a personal note, at tassajara, the earlier stall has cleared from the shoulder. a few more cars in toward and out of livermore. i'll show you west 580. we have -- that's with the camera was. not a lot of activity. the traffic has restored back to the area of livermore and pleasanton. we had road crews that has cleared. west 580 shows slowing toward north flynn. there was a big rig blocking a lane. that's moved to the shoulder but a slower drive approaching and off of that 205 and 580 merge all the way back out of the altamont pass. the build is coming west 580 and the tri-valley according to schedule. the maze and the approach no problems, at speed approaching the bay bridge toll plaza. the commute you pig your path and you have a green flow f. you don't the yellow means you're down to 60 miles per hour. not a western right now. we'll track it.

back to you guys. >> thank you. people in southern california feeling aftershocks after friday night's very large earthquake, an elementary school in brea will be closed as officials try to determine the extent of damage. it's possible classes will be canceled for the rest of the week. several dozen apartments and homes in fullerton have been evacuated because of severe structural damage. the 5.1 magnitude earthquake hit about 25 miles south of downtown los angeles. >> one after the other. so many aftershocks. 5:12 on your monday morning where you can get a free cup of coffee today. >> plus, apple versus samsung, round three. the two smart phone giants go head to head 18 courtroom why this could pull another tech giant into the mix.

well, the latest bout between apple and samsung will play out in a san jose courtroom. jury selection starts today. apple accusing samsung of copying its ideas, samsung file add counterclaim saying apple stole two of its ideas and put them in the iphone and ipad. if this sounds familiar it is. less than two years ago a jury ruled samsung infringed on apple patents and ordered samsung to pay nearly $1 billion. samsung is in the process of appealing that ruling and for now it's still allowed to sell products which use the technology. this latest court case deals with newer phones and tablets. apple argues samsung stole the technology. it also claims samsung copied the slide to unlock feature and

it's demanding samsung pay almost $2 billion in royalties. samsung says apple stole the wireless technology system that speeds up sending and receiving data. if apple is found guilty it would owe samsung about $6 million. but the real play for apple here is against google because some of the features apple is suing samsung over really belong to google's android system. if apple wins google may need to make changes to android affecting more than a billion devices. late apple co-founder steve jobs a critic of android before he died he told his biographer android is a knock-off of the iphone and he was willing to fight a thermonuclear war to kill it. google is not a defendant in this case it starts today some of its executives will likely be asked to testify. for a look at the other stories making business headline we turn to hampton pearson. good morning.

>> how you doing, scott. first we do have futures which are higher, as the markets really come off a mixed week. the nasdaq was dragged lower by tech names like facebook and twitter, as well as the biotech sectors that managed a small game. the dow and the nasdaq are poised to snap their winning streak. look for manufacturing and fed chair janet yellen speaking to a conference in chicago. the dow rising 58 friday to close at 16,323 t nasdaq edging up 4 points to close at 4155. caterpillar is set to defend its income tax practices this week. a senate subcommittee is hauling the company in on tuesday to explain strategies it uses to shrink its corporate tax bill. at issue caterpillar's

>> speaking of scott i notice that you're low down there. >> i'm a little low. >> i'll get you a warm-up after this. call me la verne. 5:18 now, you know what, it's going to be one of those days where you want to just bring your umbrella and your patience with you. this morning we're not expecting a lot of activity but by this afternoon the evening commute could be downright rough. could be very slow. we have a lot of wind, a lot of rain coming in simultaneously. and in addition to that thunderstorms which we don't typically see in the bay area until the springtime. this is not incredibly unusual but the chance for severe weather in the bay area, only comes up about three to four times per year on average. today is one of those days you don't want to leave the forecast. stay tuned all day long. we'll be on line. i'll post on my facebook page and yes, even in the radio, take mike and i with you. too many to name. san francisco right now shows you the embarcadero.

it's clear so we don't have a lot of fog to report. in fact, it's really calm out there, the calm before the storm. temperatures today are going to be chilly all day as the cold air wushs in with that storm system. this is what we're working with in terms of wind. the wind is going to pick up before the rain for most cities. i stop the clock at 3:00 p.m., gusty wind all across the bay area. on the key you get the warmer colors, that's fierce wind gusts 30 to 40 miles per hour in san jose, more toward 50 miles per hour santa cruz mountains. as we head throughout the second half of the day showers really start to move in, we expect decent activity. the heavier stuff here in the south bay by about 5:00 p.m. i wanted to show you futurecast. it brings the front in vertically. that means it's going to come in all at once and as a result that's when we really have the instability, our atmosphere, best chance of thunderstorms right now looks like between about 3:00 and 5:00, rain mostly

between 12:00 and 6:00. those are the times we're watching today. we'll get another round tomorrow. you'll notice on the seven-day forecast we're not out of it by any means. more rain on the way, we'll talk about totals coming up. here's mike and the drive. >> thanks for giving the shout out to our radio friends. star 1013 and the bay, i don't want to -- don blue and marcus d, we're looking northbound 101, everybody is our friend and everybody is moving smoothly. picking up a few more. a look at the map we don't have a concern for the south bay or any other parts around the perimeter of the bay. 101, 880, we'll focus on those in a second. over here in the east bay coming into the tri-valley i should say we have a slowdown approaching north flynn. the earlier stall cleared, then that turned into a situation there was a crash in the backup, now three cars on the shoulder causing more slowing out of the altamont pass. past that and into livermore we see volume build toward 84 t the closure has cleared.

a smoother flow, also toward value a see diswhere you see the slowing. not a big concern. a typical pattern for monday closer to the bay as we talked about with. 880 and 101 on either side at the limit. the red and yellow you see here this is a slowdown for ashby avenue through the city streets approaching cal over there, not a concern toward the bay bridge toll plaza. this live like and you see the traffic moves across the span into and out of the city. >> thank you so much. new this morning, hundreds of rounds fired into the waters between north and south korea. the south opened fire after north korea announced it would conduct live fire drills. no shells hit land. south korea evacuated five islands in the area as a precaution. it's also conducting training drills with the u.s. military this morning, experts say since the shots were fired into the sea it shows neither side wants this to escalate into war.

>> some california lawmakers want stricter accountability for those who care for children. the move to change laws governing day care prompted by our investigation last month. we exposed a broken system that leaves parents in the dark when it comes to getting information about daycare. now state lawmakers are speaking out, there are two different bills that would improve and update the current system. one law would require more frequent inspection of daycare facilities. the other would require that inspection information be posted on line so the parents can find it. >> at the end of the day we have a responsibility to our community. we follow common sense that we should have as much information as possible for parents to make an informed decision. >> one of the proposed bills made it through an assembly committee, a public committee hearing street hear the other bill before the human services committee next m. coming up tonight at 11:00 we'll talk to

welcome back. barry bonds guest starred as a giants special instructor during spring training. he is now headed to pittsburgh for the pirates' opening day. the home run king started his career as a pirate but left a lot of hurt feelings when he used free agency to sign a record contract with the giants. the pirates didn't return to the playoffs until just last year, that's 21 years after bonds left town. bonds will present andrew mckuch within the national league mvp award mending a few fences there. >> some bay area women who did their part in the second world

kind of a one-two punch. first the wind, then the very heavy rain. and i want to show you the totals here in a moment. your temperatures, though, mostly in the 40s and 50s headed to the 50s, that's it for today. you need your umbrella. make sure you are ready for a cold day, upper 50s. cool for the bay area. we stop the clock between now and thursday, we're talking about really significant rainfall totals on the way to the bay area. most of this coming from today's storm alone. we're expecting an inch in the north bay from today, an inch in san francisco down to the south bay. 3/4 inch. as you know that's very, very high total for just a 12-hour period so. we're going to time out the wind, count on that to play a factor for today. then we shift our gears. thunderstorms definitely possible as well. that could be probably something that could be severe in parts of the bay area. everythings out just right. right now back to you, scott, peggy and the rest of the top

stories of the day. >> christie smith joins us live. she has details of the legal battle. good morning. >> reporter: good morning to you. these charges against leland yee certainly sound overwhelming. an illegal weapon scheme, public corruption. one legal analyst we spoke with said charges like these are difficult to prove. we shot video of the 65-year-old politician leaving his san francisco home friday, the day he was suspended as senator. that analyst says there's actually nothing illegal about with giving money to a politician's campaign, expecting some influence. he said it's also not illegal for a politician to take into account the wishes of their contributors. the snag, though, is if there is a blatant exchange of money for political favors. the defense, though, may argue that the fbi entrapped yee.

after the crash witnesses say they saw two women run off from the scene. the sign on the building says joey and pat's bakery. we're told that the owner lives on the property next door. this happened at the corner of 21st and folsom. they are waiting for crews to shore up the building before they can tow the car. the government's health care website is up and running, it was down briefly for extended maintenance for the deadline. chase cain joins us now with the latest. it is a big day for health care. >> it is. a lot of people racing toward that deadline. that means things have been dice we the federal website. it appears to be working but we're going to keep a check on that. the good news in california is that you can enroll at covered ca.com. that at least for the moment does not appear to have problems. more than a third of people without health insurance in california have signed up for health care so far. for those who do not enroll there will be penalties at least

$95 or could be 1% of your income. you pay that when you file your taxes next year. to avoid fines you have to start your application today, then you'll be given another two weeks to finish that application. >> we are having people enrolling far beyond what our projections were. we thought we were going to have about 830, 840,000 people coming in by the end of march. we are already at 1.1 million. so that's a lot of people coming in to get health insurance. that 840,000 is on the high side, so we are doing really well as far as enrollment. but with that comes a little bit of the pain of trying to get everybody through. >> that pain has been experienced today with problems there with the federal website. if you have waited and you need help there are two events where you can get in person help. the first at the oakland asian cultural sthcenter on ninth ande

round of heavy rain. if your kids play sports in the afternoon you might plan on a rain-out for today. a lot of baseball games that will probably be canceled. east bay at 51, 48 in the south bay, the big question mark is will one of those baseball games be the home opener for our a's. we're going to have to find out as we head throughout day it does not look g. i can tell you right now 40% shot of a rain-out or at least a rain delay. 57 degrees in the east bay, it's going to be pretty cool all day. we're in the 50s now, in the 50s later. heading out monday this is what you can expect. cold and cloudy start. the breeze will build. gusty wind. if you are concerned about the wind the time frame you want to worry about is between 10:00 a.m. and 4:00 p.m. it is going to be blustery today. so sustained winds, 25 to 30 miles per hour. gusting upwards of 50 miles per hour. that's strong wind for us in the bay area. if it's the rain that you're

concerned abou this is the time frame to consider. 12 to 7:00 p.m., then the winds relax throughout the second half of the evening, overnight they should return to calm conditions. we're going to see heavy rain, local flooding possible, we'll have timing coming up for you and we'll talk about with what's in store for tahoe out of this system. with more rain on the way late in the week. first, here is mike inouye. >> good morning. over toward oakland where traffic flows nicely for 880 t nimitz northbound with the taillights, fast coliseum, hope opener for the a's is today. hoping that it continues because of the weather. we're watching and also we'll watch for crowds before and after the game. here we look at the maps a smooth drive from the bottom of the screen, the red on the screen, it's heading past cal, the surface street you expect that. folks are slowing down on the major artery. westbound 580 also a major artery out of the altamont pass. the earlier stall and crash

5:41. new progress in the crisis in ukraine. the secretary of state says russia is continuing diplomacy though not pledging to pull back troops yet. tracie potts is live with the latest from the overnight developments. good morning. >> reporter: good morning. take a look all of this is coming from a meeting between secretary of state john kerry and his russian counterpart that happened in paris. after that they didn't agree on much other than they will continue talking. the u.s. says that the troops that built up along the border have got to go away before they move forward with figuring out what to do with this crisis in ukraine. russia says their normal operations, troops that are normally in the area and the 40,000 or so we've counted there aren't going anywhere soon. despite celebrations that we've seen the last couple days in crimea, there is also a lot of concern about whether or not russia may be trying to push

through into other areas. the bottom line not a lot of progress but the doors are still open. they are still talking, and, russia is now saying that they will not necessarily recognize the new government of ukraine but that that government needs to be involved in the process. that's a step forward because initially russia didn't even recognize that new government as legitimate. >> that's right. thank you for the latest. >> australian officials say a cluster of orange objects spotted which a search plane over the indian ocean turned out to be fishing equipment. that plane was one of several hunting for a trace of flight 370. today more than 10 planes and 10 ships scouring the ocean. an australian war ship carrying a u.s. device that detects pings from flight recorders is slowly making its way to the area. expands about 100,000 square miles. the trip could take four days.

rarely see in the bay area. that is what we call the ingredients for strong thunderstorm formation. we have the chance for it today. the reason why, we have two different air masses colliding as we head throughout day. we've got this southerly flow, the subtropical flow, the atmospheric river colliding with this cold mass. you see the spotty clouds around the center of low pressure. the two come together and we have a dangerous scenario for the second- of the day. we could see strong thunderstorms. we've had tornado warnings in the central valley for the past couple days. today there is a higher chance for tornadic rotation in the sacramento valley and the central valley than what we have in the bay area. there is a very slight chance for that even right here. temperatures now are mostly in the 40s and 50s. there is a cold air mass overhead when we ramp up to 54 in the north bay, 57 in san francisco and 59 degrees for us in san jose.

this futurecast is looking for the strongest wind gust. by about with 2:00 that wind is going to be fierce for most of the bay area. we bring in the heaviest dew points between about 2:00 and 6:00, we could see a rough drive home from work. this is what we're going to talk about in my next report, who has the best chance to see thunderstorms. i want to give you a preview of what this storm system going to bring to lake tahoe. hook at these totals. additional 1 1/2 feet from this system alone with more rain and snow. we'll talk about that coming up. here is mike inouye. >> watching the map, i watch to see what color blue canyon was, it was blue so that's a good forecast. we have the green lights, all the cash lanes and fast track lanes are open. but we do have slowing for the cash lanes. you see streaming through the middle of them, you have those fast track lanes a good advantage. we'll look at the map and see the approach down the east shore freeway. no big delay, slowing starts and

that's westbound as you approach berkeley. an easy drive. right around cal, ashby avenue, the major surface street shows the red. in the south bay slowing north 101 from 680 up to 880. we saw a burst of traffic. there was a cluster here from 680 and got a big caravan moving north but that started to sort itself out. back to the maps, the rest of the traffic around the bay, heading over to slow spots here approaching the dublin. typical through the trivalley and traffic held up behind a crash, three cars involved, they moved to the shoulder but kind of held up out of the altamont pass. north of the dumbarton bridge on ever side you are starting toward the bay bridge because of the volume it's starting to build. >> thank you much. general motors under scrutiny after the automaker failed to take action on faulty ignition switches linked to 13 deaths.

gm's part supplier says the company approved the faulty switches in 2002 even though they knew they did not meet specifications. the house is going to hold a hearing tomorrow where gm's ceo will testify. >> the pentagon is beefing up cyber security and it hopes to have 6,000 cyber pros by 2016. defense secretary chuck hagel says the plan is to more than triple the nation's cyber security staff. the defense agency says it's needed to protect national security. the federal trade commission says that fan dango and credit karma exposed information including social security numbers through its app. the two apps did have security holes but have been fixed. both claim they are unaware of breaches. >> jury selection begins today

an iconic building. >> that's right last night san jose century dome theaters showed its final film. it was a good one. the crowd watched "raiders of the lost ark," symbolic because the film actually opened at century 21 in 1981. the owners of the valuable land which sits across from santa that row they want to use it for development. there is a push to preserve the oldest. >> we don't expect you to preserve all of them but could you see to preserve one of them and re-imagine it into something innovative and exciting. >> i'm here to say good-bye to the rest of my youth. i worked here for a few years in high school and been seeing movies here since i was knee high to a grasshopper. now they are tearing it down. breaks my heart. >> some officials will meet to consider declaring it historic.

the first pitch at 6:40. >> a live look outside right now at the home of the oakland a's. tonight thousands of fans will pour into o.co to watch the green and gold kick off the season tonight against the indians. sunny gray will take the mound for oakland. first pitch at 7:05. fans heading to o.co might notice changes. there is new food, such as polynesian bowls, 20 different micro and craft brews. the ballpark has been repainted, dug outs remodeled. the press box has been outfitted with new tvs. the coliseum authority made the changes over the off season in hopes of enhancing the overall experience. however, one thing appears to be the same. rain from over the weekend caused the toilets and showers in the clubhouse to back up. the players have dealt with similar issues previously.
