>> i'm peggy bunker. this morning 49ers linebacker aldon smith is out on bail after arrested at l.a.x. for reportedly yelling the word bomb inside terminal one. christie smith is outside the stadium in santa clara with what the team is saying this morning. we all know, christie, can't do that at the airport. >> the 49ers are basically expressing disappointment this morning, and also reserve judgment until all the facts are in on this. aldon smith posted bail and posted bail around 7:00 last night and arrested at l.a.x. terminal one in front of dozens of people. as you can imagine, quite a scene. tmz sports was the first to report footage taking smith into custody. on that tape he said he did nuther wrong but police are telling a different story, saying he became belligerent after being selected for a second checkpoint security

screening. they say he claimed to have a bomb and appeared to have been drinking. the latest arrest for smith who was arrested in september on a dui charge, his second such arrest recently and his fourth run in with the law in more than two years. one employee told us by phone he witnessed the confrontation at l.a.x. >> i could hear him saying bomb. and then i looked and i noticed who it was and he was taking money out of his pocket and throwing it on the ground and telling everybody that he was going to be all right. he was going to be all right. >> you would think he would get his act together after getting caug. >> 49ers released a statement "we are disappointed to learn of the incident today involving aldon smith. as this is a pending legal matter and we are still gathering all tpertinent facts.

it could delay his ongoing cases here in santa clara county." reporting live, christie smith, "today in the bay". aldon smith is not the only 49er with a run in. colin kaepernick, no charges have been filed. a woman woke up in a hospital bed earlier this month and she told police that the last thing she remembers is smoking pot and drinking with kaepernick and two other football players. once again, however, no charges have been filed in that situation. 49ers cornerback chris culliver appeared in court on friday where he pled not guilty to a felony and two misdemeanors from an alleged hit and run incident that took place last month. 5:03, pleasanton police say a woman accused of stabbing a jack in the box employee over the weekend is behind bars. officers say 31 jasmine pulled

something out of her purse and started stabbing a man around 4:00 when the wounded employee who has been treated and released from the hospital pulled the fire alarm. they arrested her an hour later and booked her on attempted murder. they found the body of a woman who disappeared last month. magdalena glinkowski disappeared after going on a hike. the search was called off and a tip from a jogger over the weekend narrowed down the search area and search teams did find her body on saturday morning. no word yet on how she died. san jose firefighters keeping a close watch at the gutted remains of kntv old studio that caught fire yesterday afternoon. the building, over on park avenue near downtown san jose has been abandoned for the past several years. since we moved out. but firefighters say homeless people were living inside. live where fire crews spent the night looking for flare ups. hard to believe to see it go. >> we actually just spoke to a man who lived inside this building, as you mentioned. it had been abandoned for a number of years. there were 27, 28 transients living inside that structure, which had been our old tv, studio here in san jose. the fire department will look into what role, if any, the people had in this fire, if any. it was a large fire. fire department called for a fifth alarm and they needed so much water, they had to call the water company to increase the pressure. people were inside at the time. through interviews the fire department believes that everyone did get out okay and based on what they found inside, it appears these people really made themselves at home inside our old tv station. >> there were motorcycles inside being pulled out and i did see a

barbecue grill and a whole eelaborate set up inside the building. >> we presume, we believe the fire department will do another search inside the building and later today once the sun comes up just to make sure that everyone did get out okay. they are still out here because there's a lot of heat in there and over the past hour that we have been out here you have seen some smoke and some flames. we want to make sure that doesn't flare up and become anything bigger than it is. again, reporting live here at the old tv studios, bob redell "today in the bay." kntv opened its doors on park avenue way back in 1995 leading to a long history covering news in the south bay. for many former and current employees seeing that building come down this way is hard to take. >> sad to see it come down. for the san jose a's to come, for any of us who spent a considerable portion of our lives there. >> maggie spent many years on

the anchor desk and eventually met her husband inside that building. the city of san jose owns the land and wants to build a major league baseball field in its place. livermore police need your help tracking down a wrereckles driver who managed to evade officers. a silver minivan blowing through a stop sign. just before that, it had crossed over the double yellow lines to pass another vehicle. police tried to stop the minivan, but the driver sped off. officers say the same vehicle and officer was spotted driving recklessly in the area. the drought not just hitting california's water supply but the budget. california will hire more than 300 seasonal firefighters a month earlier than normal. cal fire has battled almost 900 fires totaling 200 acres. well, 5:07 right now. getting going here on a monday

morning, let's check in with christina loren looking at that forecast and the moon, we took a look outside. it was just beautiful, christina. >> it's really, really pretty out there. unfortunately, low clouds coming in for tonight, it's not going to be as visible, unfortunately as we head throughout tonight and tomorrow morning. crystal clear out there right now and the actual eclipse takes place tonight. but just about full out there. it is almost distracting how bright that moon is. as we head throughout the next couple hours, you'll be able to see it. then that moon, yeah, you won't find a hint of it by about 7:30 a.m. but, hey, wait until tonight. you might just be able to see it. 69 degrees in san francisco and south bay today at 81 degrees, that's a toasty day for us and 78 degrees in the north bay. typically this time of year we see temperatures in the mid 60s. so, definitely above average. we're going to see those numbers drop off as we head throughout the week. we do have some fog to show you,

especially up in the north bay and down to a quarter mile visibility down in santa rosa. low clouds and that fog will not cause a big distraction for you on the highways, except for in places like gilroy or santa rosa. otherwise, let me show you what to expect for today. patchy low clouds. all the way through about 7:30. we'll clear you out by about 10:30. partial clearing at the coast, as well. and a nice, warm day as a result. 81 degrees in the south bay and peninsula today at 79 degrees and 69 degrees and intervals of sunshine in san francisco and overall those temper whiches are going to drop off. if you're looking for the warmth and maybe hit the beach, nice out there for today. changes coming your way. let's check your drive, here's anthony slaughter. >> a few accidents have just cleared from the chp report. that's good news. right now you can see coming through the altamont pass. lots of cars. things are moving and that's some good news.

welcome back, everyone. 5:13. google facing a new legal battle against online book retailers. the author's deal has filed a federal appeal in its lawsuit that argues google is violating copyright laws by digatizing books. the guild argues google's effort to create the largest digital library is viliting the rights of authors and stifling internet book sales. in november a court ruled in favor of the mountain view company saying it was only showing snippets of books in its database. tomorrow, april 15th, the tax deadline for millions of americans, but new numbers show it is becoming less and less likely that the average filer

will get audited. new responsibilities are preventing the irs from policing tax returns. the cuts are affecting people trying to get a hold of an irs agent. have you ever tried to do that? that's not easy. millions of phone calls are going unanswered in addition to monitoring tax returns now tasked with enforcing the president's health care law. for those of you that are last-minute filers, if you haven't quite done it yet, see shorter lines at the post office this year. e-filing is the preferred method for tax filers. just over 30 million tax returns were e-filed however by the end of this year, more than 125 million tax returns will be e-filed. 5:14, a number of bay area companies expect to release earnings data this week. investigators hope that will spur a little on wall street. good monday morning, simi.

we had an accident, there was some debris in the roadway and you want to take it easy if that involves a route. switch over and show you the traffic maps. there were at one time three separate accidents in this area and you can see it's still moving fairly smoothly, but another area starting to slow down on altamont pass things starting to slow down and no accidents coming through the altamont pass. the other area we want to show you the bay bridge approach, right now, looking pretty good. we'll take you outside, wide open lanes and no problems to reports here and the lights are not turned on. let's take you down in the south bay and san jose and you can see lots of green on the map, no problems to report. in fact, 101 right here where our camera is positioned, as you take outside, no problems and just a few extra cars moving through right now here at 5:18. back to you ladies. it's 5:18. the judge in the trial of olympic runner oscar pistorius has adjourned proceedings for

just reopened within the past hour. authorities say the driver stayed at the scene and is said to be cooperating with police. fremont fire tweeting out this picture of a garage fire. they call it a code four and they're still at the scene. just happened a few blocks from dakota road and fremont boulevard. no one was injured in the fire and it did not spread to another part of the main home. fremont firefighters managed to keep it under control. they did say that two cars burned, no firefighters injured, but, sadly, two dogs died. 5:31. santa clara police shot and killed a woman who they say attacked officers with a baseball bat. the woman who has not been identified reportedly called police yesterday afternoon saying she wanted to hurt herself and others. when officers arrived at her house, they say she attacked them with an aluminum baseball

bat. two officers opened fire, killing her. 49ers linebacker aldon smith is out on bail after he was arrested at l.a.x. airport for reportedly yelling the word bomb inside terminal one. christie smith is in santa clara this morning, christie, the latest of incidents that we've heard of in recent weeks. >> yeah, good morning to you, peggy. whether you're serious or not, you can't make a bomb threat at the airport. if you do, you'll be arrested. that's what police at l.a.x. are saying happened in the case of the 49ers star linebacker aldon smith. this was his latest arrest and it went viral almost immediately. tmz sports was the first to post video of smith being taken into custody. apparently smith says on the tape he didn't do anything wrong, but police say he may have been drinking prior to that incident and became belligerent after being selected for a second security screening.

at the airport. christie, thank you for the details. the fourth criminal case against smith in the last two years and also been arrested twice for dui and is facing weapons charges in connection to an ought of control party at his san jose home back in 2012. our investigative unit has spent hours looking into all of smith's legal troubles after this recent incident, including his weapon's charge. you can see those details on our website, nbcbayarea.com, just click on investigation. 5:34. investigators in san jose still trying to figure out what sparked a massive fire that gutted kntv's old studio. that building over on park avenue or near downtown san jose has been abandoned for the past several years. but firefighters say homeless people were living inside. bob redell just spoke to someone who was living inside. he's live with that. what did they have to say? >> they're very suspicious of

what started this fire. old tv studios were abandoned. they were not vacant. 27 to 28 homeless people, transient people who lived inside this building. made it their home and many were here at the time when this fire started around 3:00 yesterday afternoon. including this man we spoke to within the past hour. >> this is accidental? >> not really. >> why? >> somebody had a grudge on us. >> somebody you kicked out? >> no. not really. >> he was a little ambiguous in speaking with us but indicated to us earlier off camera that, perhaps, it was in fact somebody who they kicked out that came back and started this fire. that's not official, that's what he's gathering from being out here. of course, the fire department has yet to have their say on this. you can see in the video quite a large fire that started around 3:00 yesterday afternoon. went to five alarms. that means the fire department had to call for backup four

times. about 100 firefighters fighting this for just under two hours finally got it under control around 5:00 yesterday afternoon. based on their interviews with the people who lived inside, they believed that everyone did get out okay. they will, we believe, make sure this morning when the sun comes up go in there and do another search inside the building. the fire department is still out here. we have seen over the past hour, hour and a half there's been smoke and in some cases some flame and that's why they're out here with their hoses charged to make sure if something does start to heat up and flare up to put it out just to make sure it doesn't turn anything bigger than it was yesterday. reporting live in san jose, bob redell "today in the bay." >> spent so many years broadcasting in that building. kind of hard to look at this morning, bob. >> sad to see it go. we dug up old pictures of before and after of this is the former kntv studios on park

>> hi, peggy, good morning. it's been a very tense situation in ukraine and getting more so as the hours progress this morning. prorussian separatists again trying to take over some key buildings and towns in eastern ukraine and threatening to send in the government to stop that. of course, the u.s. is watching all of this unfold very closely hoping to use diplomatic means to stop any more violence and all this violence that we have been seeing over the weekend prompted a emergency u.n. security council meeting. accusing russia of citing a lot of this violence and russia denying the accusations and also saying it's looking at more sanctions, things on specific sectors like energy, banking and also mining to try to get russia to back down. and john mccain is saying the u.s. should go even further and maybe even sending weapons into ukraine to stabilize and fight back against this violence and that's something that could now

be on the table as everyone really wants to see this violence calm down. live in washington, i'm danielle lee. >> it has been such a long stretch of upheaval. thank you very much, danielle, appreciate it. this next story is nothing but tragic. a utah woman in jail for admitting to either suffocating or strangling six of her babies after they were born. megan huntsman who was 39 was arrested after her husband found the babies in cardboard boxes while cleaning out the garage. police do not think that he knew anything about it. huntsman reportedly told police she killed the babies after giving birth to them between 1996 and 2006. huntsman has a teenage daughter and two adult daughters who live at that home. police say they found seven babies, but it's unclear why she's only charged with killing six. a well-known white supremtist and former ku klux klan leader is being held in kansas on preliminary charge of first degree murder. this comes after the attacks

that killed three people at a jewish retirement complex. cross was arrested after the shooting. officials say he shot a 14-year-old and the boy's grandfather outside the kansas city community center and then walked to a nearby senior center and killed a woman there. cross reportedly also shot at two other people, but missed. the southern poverty law center, a group that tracks hate groups has known about cross for decades. they even sued him once for intimidating african-americans in the 1980s. teachers and staff will return to the pennsylvania high school where 20 people were stabbed last week. after alex hribal went on a rampage stabbing 21 students and a security guard with kitchen knives. students will be allowed to return with family members on tuesday and school will resume with normal schedule on wednesday. a robotic submarine will soon start mapping the ocean floor in hopes of finding some sign of the missing malaysian airlines plane and within 72

hours the air search for the missing jet will be called off and unmanned sub will start its own search. the sub can chart any debris on the sea floor. officials, though, cautioned against raising hopes that the plane will be found. searchers did find an oil slick yesterday but don't know yet if that oil actually came from the plane. the sub really mapped the bottom of the mroor. sort of like a lawn mower, about the same speed, incredibly slow. >> so interesting. i wish they would find something. >> just anything. >> 5:46 right now. monday morning we want to take a look at not only today, but the rest of the week, as well. >> you know, monday. you know we're in for it. we have the whole workweek ahead of us. but the good news is, we're getting into some of the nicest months, at least clime tulogically here in the bay area. let's look at what we're working with this morning. 52 degrees in san francisco. as you know, no sort of normality here in the bay area when it comes to our weather, but as we head through this

week, pretty much hitting the averages by the midsection of the week. today is above average and then we might just get some rain at the very end of your seven-day forecast. we're going to talk about that coming up so you can see as we pan around san jose, it's mostly clear to kick off the day and we have a nice-looking day shaping up in our inland valleys and on the warm side. you can see in san francisco, some fog drifting around from time to time over the embarcadero and overall that's typical for this time of year. 81 degrees in the south bay and 79 degrees today along the peninsula. that's pretty warm. temperatures are going to be nice out there and a nice sea breeze, as well, if you want to open up your windows until about lunchtime and then close those shades if you want to get by without having to use that ac. that's my trick. temperatures look good. throughout the next couple days they drop like a rock and that means comfortable conditions inland. tuesday in san jose and 76 degrees for your wednesday and we'll climb a little bit for thursday and then friday into saturday, we get a slight chance

for some showers. you'll see that here. 10:00 p.m. i stop the clock on your futurecast and just picking up a little bit of return here and this is what we're expecting. a little bit of shower activity mainly to the south of us right now where the models are bringing it in. however, the cut off low, we could get dumped on if this thing approaches the bay area. we're watching for it for you, right now, not looking so good. let's check that drive, here's anthony. >> thank you, christina. i'll take a look outside at the bay bridge approach and steady stream of cars moving in here and the lights not turned on just yet. you can see the fastrak lanes getting on by. you can see, again, lots of rain that things are moving very smoothly here in this location and off towards the altamont pass. one area starting to slow down coming through livermore and what it is looking like in dublin. this particular stretch of highway can get through without a problem. not dealing with any accidents right now.

that's really excellent. let's show you what is happening in the peninsula, lots of green on the maps from 280 down 101 and even approaching 104 and in san jose, as i mentioned, no problems here, as well. lots of green on the map show things looking smooth. here is where our camera is. let's take you outside and you can see that because more cars on the road and no accidents in that location, as well. guys, back to you. >> thanks so much. investigators plan to use a black box-style device to figure out how fast a fedex truck was going when it slammed into a tour bus killing ten people in northern california. in the meantime, they say there's no physical evidence that the fedex truck was on fire before it hit the bus, like some witnesses saidpen the bus was carrying 44 students from southern california to tour humboldt state university. after that crash, dozens of injured students escaped through windows before that bus caught fire. but five students, three adult chaperons and both drivers died.

some survivors say they will never forget what they saw. >> i watched him on fire before i kicked out the window and then there were two engaged, they died on impact and i saw that happened. >> a nightmare to live through that. federal investigators will exam bus safety rules to see if there is any way to improve passenger safety. moments mid-air aboard a california-bnd plane after a passenger tried to open up the door mid-flight. passengers said they heard loud, frantic voices. this flight on its way from chicago to sacramento. witnesses say a man was trying to open up the rear exit door because he wanted to jump out of the plane. a group of passengers got up and ran to the back of the plane to help flight attendants tackle the man to the ground. made an emergency landing in omaha where air marshals took him off the plane. the plane did arrive in

sacramento about two hours later. you see him being escorted off of the plane. causing a major safety concern about the new bay bridge. rust was found inside one of the chambers where the suspicion cable is secured. designed to prevent corrosion. the rust makes the rods and cable strands on the new span vulnerable to cracking. but a bridge spokesman said there is no concern about corrosion. santa clara county board of supervisors will discuss a proposal tomorrow about using sheriff deputies to help fill empty positions at san jose police. the police officer union calls the proposal "an intriguing idea" but not a long-term solution. now if the board approves that plan, it will have a staff report back on the city's interest and feasibility study by april 29th. the time right now, 5:51 on your monday. a new report that could have you cutting back on those summer barbecues.
