saw on lockdown. live pictures of one of our reporters that works for the nbc station out of atlanta delivering his own live report with police in the background. they're looking for the shooter, possibly more victims. we know of six victims of the shooting so far. they're at the hospital, we don't know about conditions. fedex says it's aware of the situation. it's cooperating with authorities. we'll bring you more information as this gentleman is able to gather it and we'll bring it into our newsroom. today the nba will address alleged racist comments. the hotly anticipated news conference will reveal whether or not donald sterling will be disciplin disciplined. peggy bunker following everything that is coming down. and the punishment that the nba could possibly hand down. good morning, peggy. >> good morning, laura. this is a long time coming when you talk about clippers owner after 33 years of grievances against him a short audio recording released by tmz that

could be his undoing that is if adam silver decides to really punish him. all eyes today on silver and holding that press conference today to reveal exactly how the nba will respond made by sterling which, in short, had him telling his girlfriend not to bring black people to clippers games. >> the nba deals with this in a very quick and forthright manner. they will continue to have some credibility. >> you would hope that the treatment is fair, you hope that it's the result that satisfies players, the fans, sponsors, everybody at large. >> now, of course, all this is happening smack in the middle of playoff games. sunday had the clippers losing to the warriors, 118-97, that's where a player protest against sterling and took center stage. warriors coach marc jackson did not the loudest statement to be made is not showing up to the

games, jackson said. it is unfortunate and we cannot allow someone with these feelings to profit. and lauren, scott, that will be the big question. the nba setting a precedent today. no matter what if team owners responsible for their behaviors and comments or if poor behavior tolerated in the name of making a lot of money. many said sterling owned that team since 1981 and it's time for him to go. we'll find out exactly what kind of punishment they'll hand down, if any. >> everyone is listening, thanks so much, peggy. what the nba decides if the clippers have a coach next season. he believes sterling made those comments. he says he was offered a chance to speak with sterling after the news broke, but he declined. rivers signed a three-year deal last summer but said that sterling is the team's owner. he will have to rethink his future. we will have continuing coverage of the story throughout "today

a sad story that we know very well. >> what they're talking about today would basically close a loophole that, or developmentally disabled person as forcible rape. the family of 15-year-old audrie pott pushed for the bill and saratoga high school student who was sexually assaulted while she was unconscious at the party. classmates from saratoga high school drew on her body and took photos while she was out. charges were sustained in juvenile court of 30 to 45 days. but days after she was assaulted, audrie took her own life in 2012. today the public safety committee in sacramento is hearing audrie's law. the crime easier to charge in adult court. introduced by jim beal and also written by the santa clara d.a.'s office which looks to add an enhancement if electronic pictures or texts are shared that are meant to identify or

bully a victim. among those scheduled to testify at that 9:00 a.m. hearing in sacramento, audrie's father. reporting live in saratoga, christie smith, "today in the bay." >> thank you. millions of americans are bracing for a third day of dangerous and deadly tornadoes. spanned from a massive storm over the midwest and southern parts of the country. pretty new amazing video. look at the damage that was left behind. 11 people died in the south yesterday. as a second wave of tornadoes rolled through. we have video that was shot by a storm chaser. you can clearly see the power of that giant funnel cloud as it moves across central mississippi. dozens of people were hurt, as well. after two days of storms, 28 people have died. this morning many woke to sirens, more tornado warnings and downed power lines and damaged homes. coming up at 5:40, a live report from alabama where more twisters might touch down later today.

a local islamic group says it's unfair people who wear head dress are not allowed to ride gocarts. boomers discriminate against people who wear religious head coverings. they run amusement parks across the state including in livermore says it's a safety issue. one case where an australian woman was strangled to death when her head care was caught in the machinery. file complaints with the state and hold a news conference in santa clara this morning at 10:00 a.m. san jose city leaders will have a chance to respond to a controversial audit of the police department today. the city's independent auditor is expected to present her report to the mayor and city council this morning. the report revealed an increase in the number of formal complaints against officers. it also points out of the 177 allegations of excessive force by officers last year, internal investigations claimed not one was legitimate. sunnyvale city council

looking for parking this morning. today the council will talk about allowing some parking lots near levi's stadium to be official off-site parking. lot owners would apply for an annual permit allowing them to charge whatever they want for parking on game days. offering off-site stadium parking would be banned in all other areas of the city. want to check in with christina right now. look at this forecast and we could break some records today. >> it is going to be very warm out there. if you're one of the people who bought one of those parking spots, one of those lots out there, oh, what a way to cash in. temperatures are looking good out there. a lot of smart people in the bay area. i'm sure that was done in advance. 55 degrees right now in the san francisco area and you're probably one of the smart people that live here in the bay area and that means you want to plan for the day ahead. much warmer out there than where we ended up yesterday.

you can ditch that jacket by about 10:00 a.m. fog-free conditions in san francisco to start the day. few clouds over the south bay. we're expecting the 70s by 10 clk a.m. today and hold on to that 70 degree reading all the way through 9:00 p.m. tonight. so, basically, heat of the day comes in at about 3:00 p.m. but even as the sun starts to drop off because it's so warm out there today, it will be balmy tonight. temperatures only falling into the 60s. 88 degrees in the south bay, 87 degrees from the peninsula today and san francisco, look at this. 79 degrees and it's not even summertime just yet. we still have two days of april left. they're going to go down as the two warmest days of the month and the warmest days of the year so far. 91 degrees in the north bay and 89 degrees in the tri-valley. little warm, little breezy off-shore flow and flirting with records. i think we're going to smash records. thursday and wednesday are looking to be the warmest and also keeping tabs on elevated

fire danger. here's the good news when it comes to fire danger because of the recent rainfall and the late rainy season we're doing okay. so, no red flag warning and no weather watch and we'll let you know if that does become a factor. onshore flow returns and cooling clouds come bang ck into the forecast and we'll talk about that coming up. what are you tracking? >> well, i'm probably going it be tracking some of the beach routes later on. we'll see who makes some get aways for some lunch meetings and right now smooth drive past the oakland coliseum and i faced the camera south and tracking flashing lights from the coliseum south and looks just like after 98th we lost track of them. live look at the map to show you the sensors through that area no issues getting across the bay bridge. the giants play againsts the padres and hope for a different result tonight. a smooth drive around the bay and slower drive and coming out

welcome back, everyone. good tuesday morning to you. this morning, the santa clara county board of supervisors will talk about a proposal to require restaurants to be more up front with customers. "today in the bay" bob redell with more on what that proposal

could move for the restaurants and customers that eat there. good morning. >> good morning to you, laura. the next time you dine out in a restaurant in san pedro square in downtown san jose or else where in santa clara county, you can be better informed about that establishments cleanliness. a result of a report done last year by the nbc bay area investigative unit. in a few hours consider the implementation of the grading system similar to one already in effect in los angeles. if approved, restaurants here in the south bay would have to post a green, yellow or red placard in their window letting customers know whether they pass the safety inspection. green would mean no more than one major violation, yellow two or more, that would be considered a conditional pass and red would indicate not only the eatery had a violation, but failed to fix the problem. the county's department of environmental health website would also be posting more information, such as the

complete inspection report along with a score of 0 to 100 to reflect how well the restaurant complied. last year the investigative unit found many restaurants that would not show their inspection report when asked. which they are required to do by alaw. the unit also discovered that the ounty's website was vague in its own reporting of violations. now, a ucla study found that in 2003 food-born illnesses dropped by roughly a third in aenlos angeles after that city implemented the grading system. the silicon valley chamber coalition has expressed its concerns to the board over the $100 fee that the santa clara restaurants would have to pay to institute this proposed new grading system. also a concern that this new system might confuse customers that a straight up pass/fail would be clear. the santa clara county board of supervisors taking up this issue

standards. as we get into this afternoon, i think hot by many of your standards. temperatures this morning pretty mild to start the day. 40s and 50s and i wanted to start by showing you this spectacular shot over san jose. you can see that moon starting to set, the sun will rise. we'll get sunlight here as we head through the next half hour. as you know, our days are getting longer and our temperatures are getting warmer. we're not yet into summertime, but it is going to feel like it and a warm summer day here in the bay area today. i want to make sure you're ready for that. make sure you're ready drinking lots of water throughout the day and light colored clothing and breathable fabric always a good idea. temperatures nice and chilly in half-moon bay and the coast is clear this morning. little bit of patchy fog. through your inland valleys up in santa rosa and little fog up there and also in napa and

overall, nothing too heavy that will impact your visibility. and it's going to stay clear all the way through this evening. the sun will set at 7:57. we're getting daylight, yeah, for over 12 hours a day. and as a result, it's really, really warm out there this time of year. it doesn't even get dark until 8:30. let me take you through your day and show you your changes. i want to focus on the south bay. we want to look at the peninsula in my next report. between 6:00 and 8:00 a.m. we'll jump into the 40s into the 60s. by lunchtime, up to 87 degrees and then even once that sun starts to drop off between 6:00 and 9:00, we're talking about a very balmy evening. 70 degrees when it's dark out there at 9:00 p.m. tomorrow will be even warmer. these are your highs for today. 79 san francisco and 89 degrees in the east bay and 87 for the peninsula. just want to give you an idea of where we are headed and it will stay warm all the way through thursday and then that heat will drop off friday into saturday

but staying warm. look at this, isn't that 72 degrees look lovely? let's check your drive and say hi to mike. >> drive right past that 94. we're looking over here towards san jose and no 94 on the speed sensors and that's good. 65 is the posted speed limit and that's what you're doing. over the south bay, the earlier obstructi obstruction, whatever was in lanes has been cleared and the construction for 880 around coleman and also around stevens creek. those crews have cleared for the morning, as well. no problem towards the dublin interchange. westbound starting, so far closer to the bay and commute comes into the bay area and a smooth flow through dublin and get a look at our cameras out there and volume not too bad as you travel westbound and back out to the maps we're talking about and getting over towards

right now. police in atlanta are searching for an armed man who walked into a fedex facility and shot six people. it facility is on lockdown and police are going through that building actually looking for more victims. a live look at the scene this morning. reporters are actually on standby ready to do live reports out there. a lot of heavy police presence, all the victims are at a nearby hospital but their conditions are not known. fedex says it's aware of the situation, cooperating with authorities right now and we'll, of course, continue to bring you more information as soon as it comes into our newsroom. this morning the state senate will hear a bill taking on cyberbullying and sexual assault. the bill is named after a south bay teen that took her own life after her pictures were circulated at the school. christie smith joins us with details on audrie's law, good morning to you. >> good morning, scott.

such a heartbreaking story when you hear the details and her family pushed at this bill to aim at ending bullying, sexual assault. you may recall 15-year-old audrie pott took her own life after she woke up to find crude words written on her body. facebook messages suggested she knew photos were taken and students also knew that she had been assaulted. charges against the boys were brought in juvenile court of just 30 to a 45 days. today the senate public safety committee is hearing audrie's law written by the d.a.'s office and introduced by senator jim beal. it would make it easier to bring charges in adult court and add stiffer penalties if texts meant to bully and sexual violation of an unconscious or

developmentally disabled person as forcible rape. the bill has pretty wide support from a number of groups. also victim rights groups and california police chiefs associations and among the first scheduled to speak, audrie's father. reporting live in saratoga, christie smith. the san jose woman accused of stabbing her baby boy to death will be in court this morning. investigators say 23-year-old ashley newton confessed to stabbing her 7-month-old son after a car crash in livermore. investigators found her near the scene of the crash on saturday holding the body of the baby in her arms. in the meantime, three san jose state students accused of bullying their roommate because he was black will be in court today. 18-year-old colin warren and besslel along with bumgarner are charged with a hate crime.

accused of putting a u-shaped bike lock around their roommate's neck and taunting him because of the color of his skin. a fourth student involved is not identified because he is a minor. the incident alone with others to combat hate crime. lawyers for aldon smith will meet with a judge today talk about dui and gun charges. the linebacker has received an exemption. she will not actually be in court. the cases stem from two separate incidents where the charges were combined in november. he was also arrested for reportedly making a fake bomb threat at l.a.x. earlier this month, as well. no charges have been filed in that case. today at 11:00 a.m., we will hear from the nba commissioner sterling will face for racial remarks about who should attend his games. peggy bunker is here with some of the financial implications for donald sterling.

good morning. >> good morning to you, laura. this is a defining moment for the nba and the pressure is on adam silver. he will announce at 11:00 how the nba will respond to the racially made comments and, of course, the commissioner silver has promised to act quickly on this as possible outcomes, most of them financial are these. silver has the authority to give them a life-time suspension and fine them $1 million. which sterling purchased back in 1981 for $12 million. the team's current value is $775 million. jackson is proposing a boycott of all clippers games but that hurts the players and the fans. xavier says you have to hit sterling where it hurts. >> they are hitting him where it counts. his pocketbook. hurting a potential sale. >> and the pocketbook is exactly where this scandal is hitting.

sponsors carmax, kia, virgin america, says they're stepping back or stepping out. michael jordan says as a former player i'm completely outraged. no room in the nba or anywhere for the kind of racism and hatred that mr. sterling expressed. i'm appalled this still exists in our country and at the highest levels of our sport. we're also hearing this morning that the naacp is wanting to meet with sterling. they say they have issues about what he possibly and allegedly said and they want to sit down and have a conversation with him about it. that is breaking this morning. back to you. >> thank you very much, peggy. a lot of people are speaking out against sterling. they're also making an effort to show their support for the clippers. last night the miami heat staged a silent protest in a show of solidarity with l.a. players tossed their warm-up gear on the court and wore their

88 degrees in the south bay. yesterday we hit about 76 to put things into perspective for you and 87 along the peninsula today and 79 degrees in san francisco. we do have some big changes coming your way and especially as we head through the next couple days. i want to show you what to expect by today. by 9:00 a.m. you can peel off the jacket between noon and 3:00, we jump to 87. this, my friends, the hottest point of the day. 6:00 to 9:00, nice and mild out there. 82 degrees at 6:00 p.m. and 9:00 p.m. we're at 70 degrees. we'll keep you updated and i can't wait to tell you if your city or may or may not break a record. >> all the reports coming in the last five minutes. here's what we have now. san jose as the commute gets kicking in for this traffic tuesday. just about our quarter to 6:00 first burst we see in san jose.

warrant or not. can police view information on your cell phone without your consent? that's the issue before the supreme court this morning. "today in the bay" tracie potts live on capitol hill with more details for us. good morning, tracie. >> they can now, but the question is, should they? two cases. one stem from california, a san diego arrest where police ended up finding evidence of gang activity on a man's cell phone. the question about these phones is this. are they more like your wallet or your purse or are they more like a mini computer for which police would need a warrant? the obama administration says because of technology, key evidence can quickly disappear from a phone shortly after or around the time of arrest. people can log in remotely, encryption on the other hand, this phone has a lot more information than your wallet does. for that reason, police should have a warrant.

that apartment building, there is the roof damage and also a gas leak there. crews have been working all day to get it repaired. these tornadoes swept through, like i said, in the evening hours, the early morning hours. but people did have time to prepare. here in bessemer no one was injured by the tornado which is really, really lucky especially when you start touring the streets behind this neighborhood. you are seeing downed trees and just massive, massive trees ripped down at the roots. you are seeing power lines pulled like spaghetti noodles pulled on the floor, asphalt, rather. so, you're getting the sense back there of how strong that storm is. we're not able to drive back there right now because of the danger of those power lines. thousands right now without power as crews work to restore those lines, get them back up. now, of those businesses and homes without power, that includes this medical center here behind me.

they have been going on generator power for the last little bit. they are still able to accept patients in their emergency rooms and weren't prepared for this. something they can say about this area, they do know how to continue to go about and continue to serve the community following these tornadoes. schools some delayed today and some delayed starts and some canceled altogether for the day in order to keep everybody home and safe. we are expecting bad weather here today. you can see the gray, gray skies behind me. light winds right now, but rain expected later. what people are hoping doesn't happen is a repeat of last night you're home, you're comfortable and in bed and the tornado sirens start again and it will get bad. >> somehow scarier at night, thank you, stay safe. christina, yesterday you were telling us that was the storm here on friday. >> that's typically we're in the springtime and it is tornado season. what happens is the storm systems come through.

they work from west to east and as they go over the rockies, though. they have to go up a mile up and those storm systems just blow up and then as we head throughout, yeah, the nation, the plain states, in particular, we get severe weather and today that is the case. the next couple days, the situation out there is going to improve as that system works its way off shore. we have another one i was telling you before we're hinting at a little bit of rainfall activity as we head throughout sunday and that's when we're finally going to see the really break, as well, as we get into the weekend. another area of low pressure moves from west to east and we'll have to wait and see what that one does as it works its way across the nation. before we hit that system, we have hot weather to get you through. let's start with that this morning. weather story of the day, temperatures are going to be about 15 degrees and about 0, 25 degrees warmer than average as we finish off the day. definitely, getting the coolest point of the day right now. temperatures nice and mild and

mostly in the 50s and 53 degrees in the south bay and 55 degrees in san francisco and as we progress throughout the afternoon, your temperatures are going to climb into the upper 80s. you want to keep that in mind as we head throughout the day today, near record warmth. we'll take you to that forecast in just a moment. right now, want to check your drive and say good morning to mike inouye. >> i'll take you to the bay bridge. these cash lanes starting to back up and the flashing lights, don't worry about that. it's safe to travel across the bridge and a little smoother, even though we have this backup and we may see the metering lights turn on early because of this issue. look at the span i've been tracking this as traffic flows westbound and you see a smoother drive over on the san francisco side reports of a car stalled there and car has a flat tire and the bridge crew got there and said, we'll escort you off and make your way off the bridge until it's safe to repair it. all the way across just for the next few minutes and hopefully

that will clear soon and we are prepared for the metering lights to turn on. no net effect off the maze and although there is the build and that will affect your commute the most. no problems for 24 or interstate and that coming into san francisco. here's the tri-valley and built for a traffic tuesday out of the altamont and farther back at grant line road there is a crash blocking one lane. as it moves to the shoulder, more traffic continue on and build into livermore nice flow of traffic towards dublin. the south bay moves nicely, as well. first burst which hit and now sticking just a bit as you travel north of 680 on highway 101 and smooth flow of traffic there coming into downtown for 87 and look at palo alto, as well. one of the last to show the start for the commute and right now showing an increase in volume past willow and no delays between the peninsula and san francisco or vice versa.

back to you. >> thank you very much, mike. new this morning, south korea's president is apologizing for the government's response to the deadly ferry sinking. in the meantime, strong currents are making it difficult for divers to search the sunken ferry. 97 passengers still believed to be missing. one diver said all he focused on while dealing with the harsh conditions is getting the bodies back to their families. the coast guard confirmed today the official death count has risen above 200. planes will no longer fly above the indian ocean in search for the missing malaysian airlines jet. the search officially called off yesterday. it flight 370 vanished 52 days ago and officials say it's highly unlikely any debris will be found floating but they say the underwater hunt will be expanded. a robotic submarine mapping the ocean floor will start soon searching an area of 430 miles

long and 50 miles wide. that task could take more than eight months to complete. officials will hire salvage crews today to pull the wreckage of a small plane out of the bay. crews located the wreckage of the cessna a mile and a half off the richmond shore. the pilot is presumed dead. witnesses say the cessna and a hawker sea fury were flying close when they crashed. the impact took part of the cessna's wing off. the hawker, similar to this, had some tail damage, but landed safely about 100 miles away. investigators did not release the names of the pilots, but told they did know each other. we will find out if three middle school students will be charged after they broke into a high school and killed the classroom pets. three teens broke into wilcox high school over the weekend and killed a rabbit, a duck and a rooster that was kept in those classrooms. the students are accused of vandalizing a snack shop and

nchsh a very good tuesday morning. look add the sun coming up over the bay. going to warm things up. could break some temperatures in fact today. a huge warming trend in the works. we'll check in with christina coming up. 5:53. netflix strikes a deal. the second deal the company reached to pay for access to broadband networks and in february, netflix signed a deal with our parent company, comcast. the ceo reid hastings over at netflix said he only made the deal to give customers better service. google's self-driving car project one step closer to reality. the project logged about 700,000 miles to this point. most of them freeway miles but you can see in this google video posted on youtube. the project's director says the technology is getting better and the cars can detect hundreds of
