warriors fans on the left should be glad the team is playing indoors and temperatures in oakland expected to be in the 80s and meteorologist christina loren should be around in six minutes with the forecast. cal fire says that means even if you have a permit, you cannot burn anything outside. overnight, firefighter husband to move quickly to keep a vegetation fire in antioch from spreading. hap rnd around 12:30 this morning and the three-acre gas fire put out quickly. nobody hurt. now to a developing story, mandatory evacuation orders were lifted overnight for neighborhood after a large fire near southern california. the fire has already burned more than 1,000 acres in the foothills of east los angeles near rancho curancho. right now firefighters are in a defensive position and they don't have any portion of that fire contained. so far, no structures have

burned, but also no reports of injuries. we continue to follow breaking news in pensacola, florida, where an apparent gas, natural gas explosion caused the roof of a jail full of inmates to collapse. there were about 600 people inside when the building exploded. two inmates were killed, as many as 150 inmates and correction officers were hurt. the rest of the inmates were taken to nearby facilities. investigators still trying to look into what happened. they say it could be related to severe flooding in parts of florida and alabama. >> i'm shocked, i'm surprised. i am deeply saddened. i mean our community has had a lot of tragedy in the last 24 hours with all the rain and all the water and to come into the jail and find this out, we're just praying and what we're hoping for the best. >> the jail reportedly took on a lot of waterer during the downpours and parts of pensacola got up to 17 inches. we're learning new details

about the 2012 murder of a millionaire inside his own home. detectives say three men barged into the home and tied up robby and his wife and then beat them before robbing the home. he was gagged with packing tape and suffocated after the men left. during a preliminary hearing yesterday, detectives say they found a purse and bracelet from his home inside the house of one of the defendants. a woman is also charged in the case accused of providing information about his home to the robbers. the tsa says it's been working nonstop to figure out how a teenager from santa clara scaled a fence at sgc unnoticed and stowed away on a plane. an intense grilling by senator barbara boxer. christie smith live in san jose. the tsa inspected the airport just a couple weeks before this happened. >> that's right, scott. inspected and approved the fence

line here in san jose. as you can imagine, senator barbara boxer had a lot of questions and icisms on how that can be. how a 15-year-old was able to get over that fence and into a wheel well to make it to hawaii after that inspection. the santa clara teen was apparently trying to get back to his mom in africa. his survival and story grabbing wor worldwide attention. the tsa administrator said at a senate committee hearing between january and late march, the tsa conducted a comprehensive inspection and found sjc did meet all security requirements. they reviewed things like barriers, electronic access, badging system and law enfor enforcement support. the tsa regulates outside the terminal and with 450 airport there's is no one size fits all, so they inspect each one. >> their fencing was in fine shape but at least one prior

secretary of homeland security said show me a 15-foot sense and i'll show you a 16-foot ladder. there is no perfect solution so we buy down risks in a measured fashion that allows us to make sure that we're doing everything possible. >> now he said that there actually is no closed circuit tv footage of the teen going over a fence. apparently, that's just what he said afterwards. there is video of someone on the tarmac, but no one saw it at the time right away. there are opportunities, certainly, for improving security, but if congress doesn't pay for that, it's basically an unfunded mandate. reporting live in san jose, christie smith, "today in the bay." we could find out the name of the pilot who died when his plane collided with another one. the single engine cessna was pulled out of the water yesterday with the body of the

pilot inside. on sunday, the plane collided with another one causing the cessna to plunge into the water. the people in the other plane managed to land safely. san jose stay's president bending to the will of its students just hours after those students walked out of class on tuesday to protest student success fees. the president send out an e-mail saying the fees would be rolled back. supposed to rise to $790 next year, making it the highest that the campus system. mercury news reports opponents not pleased with the response. they say the real concern was where the money was going. they say it was going to pay for athletics. something he did not address in his e-mail. 5:06. let's take a live look at san francisco this morning. you know, it's hot out when it's already 63 in the city this early in the morning. things going to heat up as the day continues on. in the south bay, get ready for temperatures in the 90s. going to be even hotter than yesterday, is that right,

christina? >> you know what, a touch cooler from where we ended up yesterday. just about as warm, so, for most people, it doesn't mean much. 63 degrees the starting point in san francisco. you can see how mild it was. yesterday nice and mild as of this morning we're still running quite a bit milder than yesterday. about five to eight degrees. as we head throughout the day today, temperatures climb out of the 50s and 60s where they are right now into the low 90s. it is going to be another hot one, but not as hot as it was yesterday and we'll see the clouds increasing as we head throughout the day today. that means our natural ac will turn back on. we'll take you through that forecast coming up in just a minute, but, first, i will talk about what you expect this thursday. clear, mild start, a few 70s and another hot one inland and cooling clouds at the coast and sun will set at 7:56 and at that point completely socked in with fog at the golden gate bridge which i'm sure a lot of san francisco residents are happy

about. 78 degrees for today and a nice,conice, comfortable evening. 83 in the east bay today and 92 degrees in the tri-valley. stick with us and i'll show you what's happened this weekend and how comfortable it is going to be around here. yes, it's going to be pretty nice. how is that drive shaping up? it's friday. >> it's friday evening. we had some backup, though, christina, little slowing at the bay bridge toll plaza and all the cash lanes are cleared up and reason we had the backup, i will be honest, i will confess. we look at the camera towards the bay bridge toll plaza and miscounted the light and the two lanes closest to that's why the folks could not move over to the clearer lanes, they were not operating. everything is moving smoothly and no problems out of the maze. a smooth drive as the car pool lanes are also in operation, that's why someone was pausing there. we do not advise that, that is illegal waiting for that structure to change at 5:00, as well, now things are moving

smoothly around the bay and nice, easy drive and point out slowing coming out of the altamont pass and 580 moves at speed and the b.a.r.t. system does have five to ten minute delays into richmond or daly city. the hottest ticket in town is in oakland later tonight. the golden state warriors are playing their playoffs against the clippers. player steph curry could get back to his game. if you saw him on tuesday night in l.a., he only had ten shots, eight turnovers. of course, the clippers took out the warriors 113-103 and even steph curry admitted afterwards he's got to do a better job tonight of negotiating the clippers' "d" when he takes to the center court here at oracle arena. >> got in trouble a couple times and trying to thread the needle and a couple turnovers trying to split the defenders and that kind of deal. >> now, as you can imagine, a lot of interest in this game. not only in california, but nationally because of the los angeles clippers. one, for two reasons, one, they've historically just been a really bad team and if they would win tonight they would advance to the next round of the playoffs which doesn't happen often and then, of course, you have the other issue with the owner, donald sterling who earlier in the week the nba banned him for life and fined

and a live look at san jose this morning. the city now home to more than a million people. san jose hit the mark once before about five years ago and then, of course, populationrece. san jose, the 10th largest city in the nation. well, happening now, the storm system that tore across part parts of the u.s. killing dozens of people finally losing steam.

the florida panhandle drenched under nearly two feet of water. while in baltimore a long long blocked section of the street has just collapsed. in philadelphia, fast-moving flood waters engulfed a bus, two passengers and a bus driver onboard had to actually climb on to the roof of the bus to wait for firefighters to rescue them. luckily, no one was hurt. the storm is the same one that created deadly tornadoes in the deep south earlier this week. the national weather service says at least one of the tornadoes was an ef-4 twister with winds up to 200 miles per hour. at least 36 people died when dozens of tornadoes just tore through the south. jurors will be back at work at a san jose courtroom trying to come up with a conclusion in the latest apple/samsung court battle. wrapped up the first full day of deliberations yesterday. they are trying to determine if samsung infringed on apple patents.

samsung has also filed a countersuit. one pizza chain will soon offer you the chance to order while you're catching up on your favorite tv show. bertha coombs live at cnbc headquarters with details on that and a look at the day ahead, good morning, bertha. >> good morning, scott. these apps are getting more and more dangerous for those of us with impulse control. futures right now pointing to a higher start. stocks close out april gains and investors shrugging off are really mediocre firstst quarter gdp report and a lot of folks said it was the bad weather and you can see there, the dow notching the first record close of the year as we rang the bell here at cnbc to celebrate our 25th anniversary. it was really fun afternoon. this morning before the opening bell, we're going to get weekly unemployment claims and in 15 minutes consumer income and spending and also look over earnings from exxon mobil. the dow starts at 16580 record.

and the nasdaq at 4114 after gaining 11. so, if you're a couch potato, maybe this is reason to rejoice. if you're on a diet, this is a tough one. hulu is launching an interactive ad that lets you order from pizza hut directly within the app. the show that you are watching while you pick up again once you place your food order so you won't misany of the action. the technology could be expanded to include other advertisers in the future. that's a real diet buster, i think. they always make those ads look so good that it's really hard to resist when it's that easy, the press of a button. i don't know, i might want to avoid that, personally. >> fair enough, you're watching a little sure lock. >> what lazy people. >> i know, we could have like a starbucks. morning show and we could, you know, you could order a starbucks just from your phone. >> i am proud to say that i am one of those lazy people and definitely use it. >> look at thyou.

>> i do a lot of homework and order out, a lot. 5:17. funny how technology is staying two steps ahead of everybody and i can tell you right now, we are in that game, as well, which is why we give you your seven-day forecast at the bottom of your screen. we know here in the silicon valley and the bay area, you are on the go, you are instantaneous information and the great part about that, it is very detailed for all the different microclimates. you might actually work in the city by the bay and live in san jose and, as you know, there could be a 10 to 20 degree difference on some occasions. for today, we'll see a big dropoff at the coast. very comfortable there later on and the cooling clouds return, as well. that's basically the only place where we'll find the 70s today right at the immediate coastline and offshore flow persists. the cloudless sky for the past 48 hours. let's show you where we are headed as we progress throughout the day today. stronger onshore flow and you'll

really see here at that futurecast as we head between 10:00 and 2:00. this little guy is going to kick up some pretty significant coastal wind and for us that means the wind back off the pacific and the clouds, thehe cl ocean air moving back onshore by friday, saturday morning. we're talking about a com clouded sky and a comfortable afternoon. typical for the bay area. we talk about what's called may gray. first day of may, no gray. not just yet. 92 degrees in the south bay and peninsula 91 and 92 for the east bay and 91 degrees in the north bay and will be warm out there. you don't want to overdo it, especially if someone works outdoors and little ones going to school. stay hot today and then temperatures drop like a rock as we get into your upcoming weekend and it is going it be very comfortable and talk about the levels coming up. right now let's check your drive. >> 580 through dublin and we dee see a lot more headlights still behaving very well. we'll show you the maps and how that plays out. thursday's commute starts to

build a little bit earlier than wednesday's commute. that is the traditional pattern we see from time to time with speeds below 60 right where we saw the camera. that's where the arrow is. heading in westbound from livermore and see the volume start to creep and that's where the slowing starts to creep. down to the 60-mile-per-hour and no big surprises here. we'll take you to the south bay with the northbound route for 81 and 87 and very smoothly right now. keep that in mind, post-work traffic and about all the rest of the crews moving through the south bay and no big drama there as you head towards san francisco or over towards the bay bridge and smooth drive down the east shore freeway, as well. check the bay bridge. toll plaza itself gets a good flow of traffic and no problems the cash or the fastrak lanes and the camera off the richmond san rafael bridge. my goodness right in the middle of the roadway and 580 across over to the east bay with no

delays for delays for 10 now, to an exclusive investigative report. the city of san francisco ontrack to collect more than $3 million in fines for fare invasion, more than twice as much as last year. some riders using their clipper cards on muni are questioning whether those citations are valid. tonight the investigative unit looks into complaints about broken machines, problems with card readers and plagerized tickets. >> the tickets that i had was mostly blank. didn't have an officer number or a street location and missing very crucial information in terms of the validity of the ticket. however, the ticket was scanned and put on file with the city system was completely filled out correctly. >> how confident are you that these tickets are fair? >> i'm very confident. >> well, what's behind the spike in fare and beating a ticket on appeal? we'll take a look and investigate tonight at 11:00. new this morning, armed

ukrainian forces taking up posts outside parliament as part of the security drill. ukraine's acting president said the armed forces are on full alert in response to russia. pro-russian forces have occupied some government buildings in eastern ukraine. the pro-russian militants are raising flags and city buildings taking over police stations. sky news is reporting forces have also taken over a weapons store filled with artillery and assault rifles. world leaders continue to try to influence what is happening in ukraine. just yesterday, the international monetary fund approved a two-year, $17 billion loan package for the country. texas trying to steal the sriracha factory out of california. a texas state senator wants to move the factory to the lone star state and the popular sauce good for the economy. recently made headlines for its stinky odor. a southern california city had to declare it a public nuisance because the spices would get up in the air and irritate the

searching for victims of an apparent natural gas explosion at a jail. this is in florida. the building exploded in the middle of the night and caused part of the roof to collapse. two inmates killed, as many as 150 inmates and officers hurt. >> the building had received heavy flooding the day before as a result of the storm, but came through with 600 inmate in the building at the time. search and rescue teams have done at least three searches through the building and we are confident at this point that we have everyone out of the building. >> there were about 600 people inside the jail at the time of the explosion. the rest of the inmates were taken to nearby facilities. investigators still looking into what happened. they do say, as you heard, it could be related to the flooding. witnesses say the explosion shook the ground for a good five seconds. a gas station attendant works nearby says he's from california, he's not exaggerating. it felt like an earthquake. developing now in southern

california, officials fear the winds that whipped up this brush fire in the foothills of los angeles could start up, again, and undo all the work they did overnight. the fire started yesterday, quickly burning more than 1,000 acres. intense winds just pulled those flames into the night sky, spreading embers among the hill sides. at one point, more than 1,600 homes were evacuated, but those orders have since been lifted. the national weather service has issued a red flag warning for extremely dangerous fire conditions in parts of los angeles, san bernardino, ventura until tonight. in some areas, the weather service expects hot and dry conditions with wind gusts between 60 and 70 miles per hour. we have new video this morning of serious flames slicing through a home in san jose. this fire started just before 9:30 last night. firefighters had a hard time getting to it. there was also the blockage and barriers in the front yard. they managed to save about half the house. it happened on foxworthy avenue

and crews had to call for backup twice. two people and their dog inside the home when it started. one of the people burned on the hand, but should be okay and the fire is under investigation. 5:32. senator barbara boxer and a tsa administrator agreed to disagree at a senate committee hearing. boxer asked about security problems at sjc after a teenager from santa clara man aged to stw away. christie smith is live. we heard the tsa inspected that airport just three weeks ago. >> that's right. sjc was found to be in compliance with the rules for it perimeter security but senator barbara boxer questioned how could that be and said what happened next here was a nightmare. what if it was someone else and not just a 15-year-old who was apparently just trying to get back home to his mom in africa. he climbed a fence here at san jose maneta airport and stowed

away in the wheel well of a plane making it all the way to hawaii. story so incredible, it seemed to take on a life of its own. john pistol told a senate committee they have been working nonstop to figure out exactly what happened here. he said that inspectors reviewed physical barriers here, electronic access, badging systems and compliance with all tsa directives and sjc did meet the requirements. there is a six-foot fence here and sjc took the extra step of putting barbed wire up. but what he said, basically, no one size fits all. he disagreed with barbara boxer's criticisms. he said it's not enough to fill out a paper and say, check. >> i think you're drawing the wrong conclusion from why as you say clearing. we are assessing the airport security program. if it's done to our standards, then we will say, yes, you're doing it to our standards. it's not a guarantee that nothing bad will ever happen. if that's what you're getting,

looking for 100% guarantee, that's not going to happen. >> sjc has six miles of fencing around it and suggestions were made about what could be done for improvements here. but the tsa administrator said that without funding from congress, it's basically just an unfunded mandate. reporting live at san jose international, christie smith, "today in the bay." an iraq war veteran is in the santa clara county jail this morning accused of kidnapping two women and hearing from the parents of both one of the victim and one of the suspects. kenneth middlebrook kidnapped two women in two separate incidents in san jose and mountain view on sunday. each time forcing them to drive him around. in the case of the first victim, it started with her giving him a ride voluntarily and then police say middlebrook demanded she get in the trunk. >> he jumped ahead and tried to choke her. when he tried to shock her,

she's like starts screaming and screaming. >> and the woman got away by ramming her car into the car in front of her when they pulled over to exchange insurance information. she ran out of the car. middlebrooks father apologized to the woman last night. his son needs help not prison time after a tour of duty in iraq. >> she came back completely emotionally, psychologically, spe spirittually. >> two hours later police say middlebrooks kidnapped a 61-year-old woman and forced her to drive her around for hours and he briefly stepped out of the car and the woman drove away and police capture ed him short therefore. the sierra snow pack survey of the season will all take place later this morning. they're really prepared for the

worst. last month we were just at 32% of that average snow pack. let's take a live look at at&t park with the giants off, that means fans won't have to sit outside in the heat and they certainly need a ball cap out there because the heat is pretty intense this week but things by tomorrow, i think, will cool down. >> thank goodness. let's check in with meteorologist christina loren. i know we are spoiled. >> you know how it goes in the bay area, the heat comes in waves. we have bypassed the hottest wave. we're still mild and we are in the 60s, but a gorgeous sunrise starting to take shape. that's right, shaping, tanker going through there and just nice and clear and you can see from top to bottom, no low clouds. takes your breath away a little bit this morning when you get to see something like that. typically we kick off the month of may with may gray and that is the low clouds we see in the morning which makes for nice, sunny finishes. as a result, we're starting out

so mild and temperatures are easily going to climb into the 90s as we head into the afternoon. 92 degrees is the forecasted high in the south bay and happy to report still in the good to moderate air quality range and air quality has not suffered through this heat wave. as you make your way out the front door widespread 60s to kick off the day and a few 70s out there and another hot one inland. stronger onshore flow means a more comfortable evening shaping up, which means you'll probably sleep a little bit better if you don't have an air conditioner. you can probably put that pan away as we head into the weekend. 91 degrees in the north bay and 92 degrees in the tri-valley. hey, that's down from 98 we saw yesterday and we keep that cool down coming in fast. i'll talk about that in my next report, after all, mike, we are so much closer to the weekend. i'm looking forward to friday, how about you? >> i'm looking forward to the weekend and something below 90.

to bob redell. 5:45 now. we got through the hot part of this warming trend. and it was pretty brutal out there yesterday especially down in gilroy. as we head throughout the day today, we're not going to be flirting with the triple digits like we saw yesterday. we are talking about significant cooling coming to the coast, but just about as hot inland and you do want to keep that in mind. but by tomorrow, we're going to crash those temperatures dropping by 10 degrees and an additional ten as we get into your saturday. so, that is the weather story of the day. going to be hot, again, and then temperatures will drop. part of the reason it will be so warm out there is because of the mild start we're getting widespread 60s out there. the sun making an appearance over san francisco and a warm start to the day and temperatures right now in the mid-60s. as we head throughout the day today, this is what you can expect. show you the trend for the peninsula because there are going to be changes today. not that hot sunshine all day and clouds will increase as we head into this afternoon. 68 degrees on the peninsula at 9:00 a.m. and then between noon and 3:00, we're up to 91 degrees

and still three to five degrees cooler than yesterday. once that sun starts to set as we have a stronger onshore flow, temperatures will drop a lot faster. by 9:00 p.m. yesterday, we're in the 70s and overnight a lot more comfortable. these are your highs, though. you will notice, not quite as warm as yesterday and the reason why is we're going to get the little disturbance today. we're talking about major changes. show you the live picture of san rafael and see the clouds starting to increase here. let's check that drive. mike, how are we looking? >> we're looking all right. we'll show you the bay area. entire map nothing unusual and we're just starting a little build. this is the first burst we see for san jose northbound 101. we have seen this for a little while. westbound 580 and the leading edge continues to be right here approaching the dublin interchange. we'll see traffic start to slow a bit through pleasanton and dublin over the next half hour. again, no big surprises out of the tri-valley or altamont pass.

in santa rosa the 13-year-old who was killed by sonoma county sheriff deputies who thought the boy's replica rifle was a real gun. there will be two marches in san jose for immigrant and workers rights. the first starts at 4:00 at our lady of guadalupe church and the other will start at the intersection of story road and south king road and the two groups will meet for a rally at city hall. doctors are warning about a new global health threat this morning. a growing resistance to antibiotics. doctors say patients are not getting better because antibiotics are not working. researchers at uc berkeley warn simple infections can now be dangerous. >> many of the, you know, you track infections which is a very common infection. you know, almost all want to get at some point in their life are beginning to be caused by these drug resistant e. coli. >> dr. lee riley is calling on researchers to develop new
