morgan hill high school at the center of a cinco de mayo controversy. "today in the bay" bob redell joins us live oak. >> they just arrived. around 20 members of the morgan gilroy patriot group and you can see them behind me and what they're doing is standing outsi outside. you can see american flag on their shirts and, of course, holding american flags. what they're doing is protesting a recent federal court ruling that upheld live oaks decision back in 2010 to send home four students who wore american flags clothing to school on cinco de mayo. seen as a slap in the face the mexican holiday and the school banned the shirt arguing to inflame tensions between white and latino students on campus. took the district to court and this past february the ninth circuit court of appeals side would the school and hence the reason you see this protest group out here this morning. we did speak with the school

superintendent this morning for the morgan hill unified school district. if you look to your right, you see had high school in the background where they installed a temporary chain link fence with green mesh there. that is to keep the protests separate from the students. and the superintendent was telling us this morning that you could see the students put up that banner earlier. we're all different branches. there is somebody showing their support. you can hear that horn in the background and the superintendent tells us the students wish that the media and protesters would just stay away. >> they want to make if a regular day. the students have expressed that. they don't like the outside attention. and we're trying to help them with that. but they wanted to send a message that what the media and the world has really depicted as a divided school is really not a divided school. it's a very unified school.
6:54 am
>> and you're looking at a video that the district posts on youtube over the weekend. a student-created video that has former students talking to current students about the 2010 flag controversy. the message from the video was, we the students have moved on from this. we'd like the adults to do the same in reference to the people who are here protesting behind me. the school says they want to make this a safe day for the students and that's why they have the fence up. morgan hill police also have officers out here on patrol, as well as staff from the district. one reason why they want to make this at least distracting for the students as possible is this is the start of ap testing. as you look live the man in the suit is the superintendent of the school district. he has been in touch with the patriots group that you see right there. not sure what the conversation is right now. the police has been in touch with this group, as well, another group to send those kids
6:55 am
home that day. both groups have been in touch with police and according to police they have been cooperative and expect them to be lawful. >> bob, one of the central ironies here is if you were a freshman when this happened, you've already graduated. none of the kids there at school were there when this happened. >> right. again, to reiterate the message the superintendent said and they put it on that banner there. these kids say that they want to move on from this. they don't want to be a part of this for whatever reason. they just want to have a normal day at school. especially like i said since ap testing is getting under way today. >> best of luck to them. bob redell, thank you. the man accused of setting the old kntv studio on fire is scheduled to hear the evidence against him today. he pleaded not guilty to arson and first degree burglary charges last month. today he will be back in court for his preliminary hearing. the homeless man deliberately started a fire in the building that burnt to the ground. as many as 30 homeless people often stay there, but

right there it appears as if a single cable snapped dropping the eight women who were performing the hair hang on the chandelier. they fell between 35 and 40 feet the ground injuring a ninth person on the floor. it was packed with families and children witnessing the fall. they took a total of 11 people to the hospital. many of them performers with broken bones. one of the injured performers required immediate surgery. now, this morning the spokesperson for the circus is defending the human chandelier. >> one of these performances, all the rigging are materials we bring with us to every single show. every single city we go to and it's inspected every single time it's put up. to my knowledge, no reports of any problem with any of this rigging in the past. >> now, more on that hair hang here on the chandelier. have to tell you, it's pretty tough to watch, almost as the actual fall. you see here where the circus performers are literally hooked
6:58 am
on to the apparatus by their hair. it certainly looks like a very difficult stunt to pull off. you asked me before what kind of floor these performers fell on to. turns out the circus actually brings a rubber floor with them, they set it up for every single performance. so, they didn't fall on to concrete. that rubber floor there probably helped them out quite a bit, scott and laura. >> lots of broken bones. who knows the internal injuries, as well. >> then the rigging falling on top of them. thank you. let's switch gears and check in with christina and she'll look at our forecast. some rain in the works on cinco de mayo. >> make sure you're ready for that. grab your umbrella, poncho probably appropriate for the day. temperatures in the 40s and 50s as we get into this afternoon. it's going to be pretty comfortable out there. 64 for san francisco and i'm a proud latin girl so, yeah, today's important. let's check that drive.
