well, good morning, everyone. ium it's 4:30. i'm scott mcgrew. >> i'm laura garcia-cannon. let's check that forecast with christina loren. >> it is windy to kick off your tuesday and i hate to say it, but the wind will strengthen as we kick off the day today. temperatures will creep up just a touch and then a big-time warm up on the way as we get into the end of the week. lots to go over this morning. right now a peek at your morning drive here's mike inouye. >> as we look at our camera, we

see a steady stream of cars. it's steady and kicks off a heavier volume expected today. from the emeryville camera. as christina said, a breezy morning across the bay and the bay bridge as well as the b benecia bridge. pretty gusty, hold on tight. we're watching the san mateo bridge. i wanted to show you already a good volume of traffic westbound 580 out of dublin out of livermore. crews are clearing and we'll talk about that in the next report, back to you. now to new developments this morning at 4:31. the crisis in ukraine the country's interior minister says 30 insurgents were killed this morning. four ukrainian troops killed in that fighting. gun battles took place atvaria positions around the city marking the most ambitious government effort to get the pro-russian troops out of the city. shut down one of the busiest

airports in eastern ukraine but it's not clear. detectives trying to figure out what led up to the deaths of two men inside a home near cherry view lane and the bodies were tis covered yesterday afternoon. police say the two men knew each other and both died of gunshot wounds. they say it's too early to rule the case a murder/suicide, however, police do not believe there is a gunman on the loose. neighbors, of course, shaken up. >> been here for 30 years in the same neighborhood and we have become neighbors. we have become family. >> neighbors say they heard popping noises the night before, but brushed it off as kids playing with fire crackers. now they think it could have been the shooting. a warning for bay area pet owners, someone is still trying to poison dogs in san francisco. a woman walking her dog yesterday morning found a plate of meatballs in sunset district. she said it looked like there

were pills mixed in with that meat and she called police. the tainted meatball problem started last summer when hundreds of dogs were poisoned. in two two more dogs were hurt. only one dog has died from the poisoning. we're getting our first look at the sketch of a man who robbed an elderly couple in their sunnyvale home. the victims say he demanded cash and jewelry, even yanked rings right off their fingers. the robbery happened yesterday afternoon at dorothy's house. the man came by the day before, seem frantic and she couldn't really understand him so she shut the door on him. he returned the next day and robbed the couple. new developments this morning in the case, the 21-month-old vanished in oakland in july of last year. her family now says her father, john webb, committed suicide

friday. police initially arrested webb for child endangerment but never faced charges with her disappearance. someone took the girl out of his car while he was inside a store on international boulevard. daphne's grandfather says whatever webb knew is gone. >> he didn't fix any problems. we're no closer from his standpoint on knowing where daphne is. investigators say the dublin teenager who was shot after he attacked an officer with a baseball bat had an altercation with officers the night before he died, as well. police say 18-year-old oscar herrera was most likely high on drugs saturday night when he threatened to eat his friend. his friend called police and officers used a stun gun to get herrera under control. later released from police custody. the next day, police were called to his house, again, because he was reportedly hurting his

mother. he attacked officers with a baseball bat, according to officers who then turned and open fire killing herrera. 4:34. san jose police say it was relatively quiet during yesterday's cinco de mayo's celebrations. officers were out in rounds. san jose police have the information on arrests and say it was mostly peaceful. promising changes at a crime lab went undetected for months. the dea's office said the wrong chemical was here to test people's blood for methamphetamine between january and march. seven false positives. the criminalests discovered the mistake last month. the person has been reassigned and all new samples will be double checked by a second analyst, but the mistake could impact three different cases. now, to our continuing coverage of a high-profile corruption case. the chronicle reporting while the feds were investigating

senator leland and chow, they were investigating montana but they came up empty. contacted montana about a business proposition. the fbi would deny or confirm that report. montana is involved with several business endeavors, including the group that wants to build a hotel complex in santa clara. right now the silicon valley is united to help local nonprofits. >> called silicon valley gives and a 24-hour, online fund-raiser that will benefit more than 700 nonprofits in santa clara and san mu teo counties. started more than four hours ago at midnight and goes all day long. for more information on how and where to donate, you can head to our website, nbcbayarea.com and search silicon valley gives. coming up in our next half hour, a report where volunteers are keeping the fund-raiser running.

commute. here's mike inouye. >> impact your drive, at least. commute very light rain now and looking at the bay bridge where there is wind advisory. yeah, we caught the breeze and you hold on tight. as we look at the foster city approach coming off the high rise of the san mateo bridge that's what i'll warn you about right now. that doesn't mean there is no wind, they just didn't call it in. on the hayward side a smooth drive over towards that high rise. light volume of traffic when you expect to cross the bay here and look at oakland past the coliseum. o.co and alameda over towards oakland and overnight maintenance that will be open by 5:00, another 20 minutes or so until they use the bridge to get across and looking to the south bay, as well. northbound 101, this is the heaviest amount of traffic around the south bay now and an easy flow for 101 and same thing for the santa cruz mountains.

welcome back, everyone. good tuesday morning to you, taking a live look outside. christina is telling us the winds that we have been feeling across the bay area will continue today. we'll check in with her in just a bit. a snapped clip may have caused eight circus performers to fall about 20 feet over the weekend. now, we're going to show you the video, but some may find it hard to watch. the performers were on a plat form dangling from their hair when the platform plummeted to

the ground. all eight women are still in the hospital with injuries that include a pierce liver, neck, back fractures and even head injuries. while investigators are looking at the faulty equipment, the official cause of the accident has not been released. tough one there. in new video the head of extremist group in nigeria said the 300 girls taken from their gi school will remain slaves with us. he plans to sell them. he also threatened to attack more schools and abduct more girls. his name means western education is against educating girls and has been committing violent attacks in nigeria hoping to carve out an islamic state. the house of representatives plans to vote some time in the next few days about whether to authorize a committee to look deeper into the 2012 benghazi attack. if approved the committee will be responsible for investigating the obama administration's

response to the attacks in which four americans died, that includes a bay area native ambassador chris stevens. the desire for a probe goes right along party lines. house democrats say they're undecided about whether to take part in the probe. many see the committee as unnecessary because there are already several ongoing investigations into that attack. 4:44. happening today. president obama will release the third annual national climate report. comes just after a month the united nations released a report on climate change. the president is expected to outline what the white house is doing to address global climate change. last month the president pledged to cut carbon emissions and require more fuel efficient cars. >> our concern is if he wants is to actually do what he says he wants to do and get the economy and jobs back, this is the last thing this country needs. he will actually be hurting the people he wants to help most. >> today's report also expected to look at the effects extreme

weather has on our health. transportation and energy. one of pay pal's top executives is out of a job after a bizarre day-long twitter rant in which he targeted co-workers. hired as director of strategy at pay pal two months ago but on saturday started trash talking his co-workers online saying the company's vice president of global communications is "useless" his later tweets, some as recent as yesterday were incoherent. leading to one follower to ask if he was okay. he insisted on twitter that he quit before he was fired at pay pal. in an effort to take on amazon google expanding shopping express service in that and the rest of the news before the bell, let's turn to courtney reagan. good morning. >> hi, good morning to you. futures relatively lower after stocks rebounded from a big drop following a better than expected report on the nation's services

sector. the dow avoiding a three-day losing streak. the dow which had been down as much as 136 points closed up 17 to 16,530. the nasdaq rising 14 to 4138. gm says a top engineer who led an internal investigation into the defective switches a year before the company recalled 2.6 million cars is retiring. once reported to directly now ceo mary barra and decision is not related to the recall. separately "usa today" says they're offering prices purchasing to the owner of recalled cars. the move comes weeks after gm said it would offer to drivers a program that ended april 30th. google is taking on amazon offering same-day delivery. google charges $4.99 per order while amazon charges $9.98 for

same-day delivery in 12 u.s. cities. for now google is offering free membership, at least for six months. back to you. >> courtney, yeah, that started here. it's marvelous. >> just in time for mother's day. >> it's at your doorstep. let's check in now with christin christine. she has a look at our forecast. maybe a hat is in order. >> if you have hat, hold on to it tightly. wind will strengthen as we progress throughout your tuesday. starting out with temperatures rather chilly. compared to yesterday, we're running quite a bit cooler to two to five degrees and if we head throughout the day, temperatures are a touch warmer by the day's end and you're probably not going to notice a difference because a bit of a wind chill factor all day long. patchy fog and although it's pretty blustery out there. that's what is keeping your coastline nice and clear this morning. as we head throughout the wind today, that wind will get stronger and gusts in excess of

45 miles per hour through our local mountain passes. keep that in mind. you have to barbecue outdoors and live up in the mountains and it did not probably blow over you want to tie it down or put it somewhere safe for today. as we head throughout your evening, the wind will start to drop off and sun sets at 8:03 and our days are getting longer and our temperatures will refleck the lorefle reflect the longer days. mild air overhead, thanks to a system of low pressure that came through yesterday. 72 degrees that's the forecasted high in the east bay and comfortable out there for today and warm out in the north bay, 77 degrees and that gusty wind will strengthen as we head throughout the day today. let me give you the idea and show you the futurecast. 40 to 50-mile-per-hour wind gusts at the forecast at about 4:00 p.m. and then that wind starts to drop off as we head to the evening. right now, back to you, scott and laura. well, instead of taking his kids to an amusement park, a bay area dad is taking a different approach. will is building a roller

coaster in his backyard. >> i have to dig ten post holes which is about 24 feet of post hole and it's a fair bit of work, but i learned a trick on gilligan's island. >> he said he started building the coaster simply because his son asked him to. he couldn't think of a good reason to say no. the tracks are made out of wood beams and pvc pipes. he spent $3,500 and worked 300 hours to lay down that track. hoping his kids will learn anything is possible. >> you win the dad competition today, but, mike inouye and i will take you on again next week. meanwhile, mother's day is right around the corner. louisville slugger working hard to make sure hundreds of pink bats are ready. >> on sunday 200 major league players will use those pink bats. after the game, players will

welcome back to you. the time is 4:53. believe it or not, that is at&t park, the home of the giants. it's dark because the team is in the middle of a long ten-game road trip. so far it's been very successful. the giants are a perfect 4-0 in the first four games of the trip. they look to make it 5 for 5 this afternoon in pittsburgh. now, yesterday the g men overcame a six-run deficit to beat the pirates 11-10 in 13 innings. this thing ended after midnight and the irs if pitch today just after 4:00 p.m. the highly anticipated opening of the 49ers new home and now the team is letting us in on some of the bonus features. for just $25, fans can schedule a tour of the new stadium. keep in mind, the cheapest

road crews blocking one or two lanes your usual suspects including eastbound 580. westbound we're coming into the area. you see right by the arrow, little green blotches there and christina talking about your shelter valleys might have a little fog. not a problem for visibility towards that dublin interchange. i do want to show you a live shot of the bay bridge. as we look from our emeryville camera. there is wind advisory issued by chp across this pan overnight and same thing for the benicia bridge. watch that still closed between the island of alameda and oakland for the next few minutes overnight maintenance guys. a sea lion pup lost his way along bay area waters set to be released back into the water. >> discovered a few weeks ago 100 miles inland. it's believed hoppy is trying to find food. he found almonds. inexperienced, he got lost.

this is "today in the bay." well, good morning, everyone. thank you for joining us i'm scott mcgrew. >> i'm laura garcia-cannon. the situation in ukraine is growing this morning especially along the eastern portion of the country. peggy bunker joins us in-studio with more on this developing story. good morning, peggy. >> good morning, laura. a country torn apart at the seams. other steadfastly to remain an independent ukraine. now, the conflict remains centered in eastern ukraine with another helicopter was shot down, the third attack in less than a week. four ukrainian soldiers have been killed in battles with pro-russian separatists. the separatists lost 30 of their soldiers yesterday. 2,000
