the smell of a massive fire at a south bay landfill lingers in the air. what firefighters are now telling us, coming up. making after thieves take off with a number of items. how the 49ers could be the one thing standing in the way of joe montana building a massive entertainment complex right across the street from levi's stadium. it is monday, may 12th, this is "today in the bay." well, good morning, everyone. happy monday. 4:30 in the morning.

i'm scott mcgrew. >> lots to get to this morning, i'm laura garcia-cannon. here's meteorologist christina loren with a peek. >> we're talking about the hottest stretch of weather so far 2014. it's going to get really hot. we're going to postpone it until tomorrow and wednesday specifically where we're expecting the peak heat. as of today jump out of the 50s into the upper 80s. we'll get into the excessive heat in my next report. here's mike inouye. >> traffic flowing past the coliseum right now, you do have your overnight road crews and one in the north bay. as we look at the access coming in across the golden gate bridge. further north highway 37. across the golden gate bridge with a smooth flow of traffic in towards san francisco but highway 37 is still closed

between highway 29 and bellejo. we'll turn to breaking news. firefighters monitoring a camp for hot spots after they put out a grass fire earlier this morning. it happened at what is called the jungle. at first crews had a hard time getting to the fire but once they did, they were able to put it out pretty quickly. also new this morning, we have police in san jose spending much of the night canvassing the area after a stabbing happened near archer street and michigan avenue. officers say the man had been stabbed at least one time. he was taken to the hospital. we've been not told of his condition this morning. now the suspect has not been found or even identified at this point. investigators say they're still looking for a motive. not even summer yet, we're

already reminded of the importance of water safety as a baby nearly drowned in the east bay. it happened around 6:00 last night in concord when rescuers arrived they found family members tending to a baby who had gone under in a swimming pool. it's unclear if the child was with family members when it happened or fell in. the baby was taken to the hospital and is in stable condition. 4:33. fire crews are checking on a smoldering landfill to make sure that hot spots don't reignite. close to highway 237. the fire sent a large, dense plume of smoke into the air. at the height of the fire, ne nearly 50 firefighters and 11 engines were on scene. after several hours, crews were able to put out the flames and no word on how that fire started. a cal football player accused of attacking a man and his dog is expected in court today.

drew got into an argument with the victim and started perching him in the face and kicked his dog. the man's jaw was broken. allegedly happened near the cal campus last week. cal's athletic department said it is cooperating with berkeley police. the case against 49ers aldon smith expected to move forward in a santa clara county courtroom today. this is a procedural hearing and smith is not expected to be there. facing felony charges and drunk driving charges. also still considering misdemeanor charges after smith in a separate case made a fake bomb threat at los angeles airport. despite the recent legal troubles, the 49ers exercised an option to keep smith through the 2015 season. it will take a few more days before the apple store in berkeley reopens. an employee will be outside helping customers much like over the weekend. on friday someone drove a car through the front of the store. thieves ditched the car but grabbed several iphones and

computers. police are still looking for them. the 49ers threatening to stop joe montana from building a massive hotel and entertainment center, unless the team's new stadium gets more parking. the team is entitled to about 800 parking spots across the street from levi stadium, now that's on land that montana wants to build on, according to chronicle, the team is demanding that montana or the city find acceptable parking spots or they will not allow his project to move forward. one of the plaintiffs in the lawsuit against several tech companies including apple and google is protesting $324 million settlement, that was negotiated by his own lawyers. michael devine named one of four plaintiffs in a class action of 64,000 people who sued apple, google, intel and adobe. they claim the tech companies made the deal to not hire employees from each other's companies in order to avoid a

salary war. divine says the companies should have to pay significantly more and admits wrongdoing. the tech titan billionaire is scheduled to testify in court today. martins beach about five miles south of half moon bay is really popular with surfers, but the co-founder of sun microsystems shut down an access road going through his property effectively making that beach inaccessible. there you see the gates. the nonprofit surf rider foundation sued saying they violated the california coastal act that gives everyone a right to the beach. but an even older law could be on cosla's side. that land dates back to the treaty that ended the mexican/american war and gives him the right to cut off access to the beach. stage two of the tour of california starts in a full hours. it's a short race, 12.5 miles and rides past the main entrance

to folsom state prison. tomorrow stage three of the race starts right here in san jose. it will be one of the most challenging stages of the bike race sending riders up mt. hamilton and then an 11-mile climb to the top of mt. diablow. >> heat stroke could be an issue. they'll water down the riders and what not to keep the temperatures down, but at the same time, it's getting towards the end of the last climb and what not will be hot. >> another concern for cyclists the heat may affect the asphalt. it could cause the tires to soften and that could slow down your bike. san carlos one of the first cities on the peninsula to implement water use restrictions. the city council will meet whether people living there to cut back on water by 20%. several cities in the east bay and tri-valley have implemented

mandatory cut backs. we'll feel like taking a whole bunch of cold drinks of water this week. things will heat up. live look in the south bay. spare the air alert is in effect across the bay area today. the actual first smog warning of the year. >> let's celebrate. let's check in with christina. good morning. happy first smog day. >> unfortunately, i think we'll see three consecutive spare the air days. we have this big ridge of high pressure as we head throughout the next couple of days and we have offshore flow and the wind is not strong enough to mix up our atmosphere and get the stagnant air mass overhead. as a result, our air quality suffers. this is kind of our first warming trend of the summertime. and as kids are starting to get off school, they'll be able to get out to the beach as we head throughout the next couple weeks. temperatures are going to be really comfortable and as we head through the next couple weeks in particular, it is going to be hotter than average. this big, prolonged event. as we head throughout two weeks

unseasonably warm weather and put that on your radar right away. starting today, those temperatures end up in the 80s and then tomorrow we'll climb even more so we peak on wednesday. 86 degrees for the peninsula and 83 in the east bay. good morning there. 90 today in the north bay. hope you had a fantastic mother's day. this weekend we'll cool off a little bit. look at how hot it is going to be. even friday, saturday and sunday still way above average for this time of year, which is typically in the 70s, mid-70s. 74 degrees for san jose for early may. now, as we head throughout the next couple weeks, staying pretty hot. up and down trends and we'll talk more about that and when we might, just might get a little bit of rainfall. first, let's check your drive and say good morning to mike inouye. >> over here flashing lights center screen looks like they have stopped. as we take this camera, we are looking northbound 101 at 680 and nothing on the chp report in the earlier flashing lights.

we'll show you the map of the entire south bay smooth drive on the freeways as far as the slowing not really any story at center. scott told you about that fire there. we're tracking that on city streets, but freeways not a problem through the south bay. looking at westbound 580 coming out towards the dublin interchange. and a little slowing shows up north 680 coming through pleasanton. been checking the speed sensors and not a big deal and a crash much further north and at walnut creek and the onramp getting on to north 680 sounds like a car crash into the shoulder there and out of the freeway lanes and affects you getting on to the freeway. we'll look at the peninsula through palo alto all the way down into the south bay. back to you. cal transsupposed to start paving 101 at 85 and shoreline boulevard today, according to "mercury news" add lanes in both directions on 101 and supposed to be finished pie the fourth of

july. crews will do minor ramp work, as well. cal trans spokesperson says it has to be 55 degrees out to lay asphalt and the nights are still cold to pave. the exit to the san francisco bridge a little closer than you are used to. the exit will come up 1,000 feet closer than it did before. officials say the exit is well marked and if you miss the exit you'll have to cross the bridge and pay that $7 toll to get back to the city. so, make sure you watch out for it. >> or enjoy lunch in marin. it's 4:41. clippers owner donald sterling spoke out for the first time since that controversial audiotape. what he has to say about those racist remarks. the city of stockton heads to court to tell a judge why it should be allowed to declare bankruptcy. nearly three years after a quake badly damaged the washington monument, finally set to reopen. what visitors can expect to see.

racist, he just made a mistake. yesterday's interview with cnn was the first time sterling has spoken publicly since an audio recording of him making racist remarks surface. in the interview, sterling also asked for forgiveness. the nba responded to wife's recent comments about wanting to retain ownership of the team. if team owners oust sterling, none of the current owners, including his wife, can be involved in owning the organization at all. lawyers for the city of stockton will appear before a judge today asking for bankruptcy protection. the city is asking a judge to approve its plan to reorganize more than $900 million in debt. they lent the city 35,000 to build fire departments and parks and stockton wants to pay back just 10% of that total. stockton is the largest city in california to file for

bankruptcy protection. meanwhile, new trouble for general motors has nothing to do with the faulty ignition switches. jackie deangeles is live with details. good morning, jackie. >> good morning to you, scott. well, gm as you said has another public relations headache that it's dealing with. a new survey by top suppliers that shows the company is considered the worst big automaker to work with, even less popular than chrysler, which held that spot since 2008. now, the suppliers give gm low marks on everything from untrustworthness to communication. toyota and honda are the most highly regarded among suppliers. meantime, the futures are pointing to a higher open on wall street as the markets come off a mixed week from last week. the second record close of the year on friday, but the nasdaq suffering its worst week in a month. look for reports this week on retail sales, inflation and housing and also earnings from macy's and walmart. we saw the dow rise 32 points on friday to finish at 16583, the

nasdaq adding 20 points to 407 is. finally this morning, some good news. perhaps you can expect more cash in your pay check this year. a "usa today" finding think that wages will climb and that will help fuel a more rapid recovery. wages have risen about 2% annually since the recession ended in 2009, but when you adjust for inflation, they're actually pretty much flat. as unemployment falls, however, a more limited supply of available workers could force companies to start stepping up these pay hikes. and i know that is what a lot of people out there want to hear. back to you. >> jackie, i'll march into the boss' office and ask for a raise. >> jackie told me, too. as we prepare for spring heat wave, a winter storm warning for most of northern colorado and parts of wyoming today. one part of colorado a driver actually had to be rescued from a truck that drove into a creek yesterday morning.

cities across the bay. we're talk about 100 to 105 degrees as we get into the next 72 hours. it's a little chilly as we head throughout the day today, we'll climb into the 70s by about 10:00 a.m. and then by lunchtime already in the low 80s in places like gilroy, the ridge of high pressure moves in and this will drive our wind off shore and the wind is not going to be strong enough to mix up our atmosphere. and the stagnant air mass shaping up and we get the dry, northerly winds we do increase the threat for fire danger. a dry heat as we head through the next couple of days and temperatures are already going to be warm. yesterday was really nice and pretty warm, already. we're talking about a ten degree warm up and 89 for the east bay today and 88 for the south bay. looks like we'll stay with this prolonged period of warm weather all the way through about the 15th and then as we continue on, temperatures will start to moderate a little bit, we might get some rain as we get into your holiday weekend.

we'll talk about that coming up and right now we'll send it back to you. pro-russian forces say people in two eastern ukraine regions have voted overwhelmingly to become sovereign states. 89% of the people who voted in denesk and as many as 90% of the people voted for sovereignty. now, russian officials say those results should be respected and implemented. western powers have called the referendums a sham. ukraine itself calls the whole thing illegal. members of the european unions are meeting in brussels to expand sanctions against russia. just hours ago the leader of an islamic extremist group released a video. he will free kidnapped nigerian school girls in release for militant prisoners. more experts including hostage negotiators will arrive in the northern part of the country today. even though no word to where the girls might be.

the failure to rescue the girls for four weeks has attracted international outrage. just last week nigeria was forced to accept international help after ignoring offers for weeks. here in the bay area, demonstrators will hold a vigil for the girl tonight. the vigil set at 6:30 on university avenue. the focus will be to call for justice and to show support for women and girls across the world who are victims of a violent crime. the washington monument will reopen today. it had been closed for nearly three years because of damage caused by anu earthquake. it created holes in the top of the exhibit. they can ride an elevator to the top and it's the highest point in the nation's capital. >> anyone who hasn't been up here to get a full sense of the wonder of washington and the national maul, this is the place to see it. >> tours are set to begin later this afternoon. tickets available on a first
