well, good morning, everybody. i'm scott mcgrew. >> i'm laura garcia-cannon. city of dublin, one of many across the bay area opening up cooling stations. the city library one of the places people can go to stay indoors as today's temperatures could reach record levels. for exactly how hot it will be, let's turn to meteorologist christina loren. >> it will be a scorching, a spring scorcher. we are still a month away from the official kickoff of summertime. temperatures this morning are very mild, we're mostly in the upper tos. just one degree away from 60.

in concord, mountain view and a hot day ahead and show you just ha hot where you live in just a few moments. right now check your drive, say good morning and no reason to get that motor running early this morning. it is mild. >> it is going to be an issue all day likely for the south bay. volume of traffic over my shoulder, but let's look at the maps. circling 880 at 101. major interchange and right now it is closed and resuming the transition from southbound 101. it had to be closed overnight and emergency repair work because of pot holes that popped up yesterday. they are doing the repair work and take first street or take 87 and get back to 101 south and add a few minutes on to your roadway and that is closed until potentially 5:00 p.m. and a big issue for the morning commute to cause folks to reroute. we'll track this in the south bay, back to you. >> thank you, mike. breaking news at 4:31.

rescue crews are outside a mine in west virginia this morning after a reported mining accident. it is happening in boone county at the broedy mine. at least one person died in the incident. it's not clear if anyone else is hurt or trapped. the mine is owned by patriot coal. about six months ago u.s. regulators notified the company of multiple violations putting workers' safety at risk. most violations occurred before patriot coal took over. no word if those violations have been resolved. we'll, of course, bring you more details as soon as we get it. also new this morning the oakland police department asking for your help in finding a missing 7-year-old girl. christie smith joins us live in oakland. there is a missing girl, but no amber alert. >> no ambert alert. we're talking about a 7-year-old girl from oakland who hasn't been seen since 6:00 p.m. yesterday. this morning oakland police officers are parked in the girl's neighborhood here on 73rd

avenue which is near the area of 0.co ccoliseum. she's four feet tall, 50 pounds with brown hair and brown eyes. she was last seen wearing a black shirt, blue ajeans and black tennis shoes. last seen near her home in oakland. oakland police say she's considered at risk because of her young age. now, of course, many questions to this this morning. what was she doing before she went missing? was there a car involved? an amber alert possibly. they are still trying to determine if this case is eligible for an amber alert. we are in touch with them. as soon as we get that information, we'll let you know. they're asking for the public's help in finding this little girl. >> all right, christie, thank you. investigators trying to figure out what sparked an overnight fire at a home in san jose. someone called 911 just after 11:00 last night.

reported smoke near the intersection of vista verde drive and floresta drive. after crews arrived took 40 minutes to put out the flames and nobody hurt. the san jose police officer accused of raping a woman expected back in court. prosecutors say graves drove the alleged victim to a san jose courtroom after she got into a fight with her husband in september but returned later and raped her. the woman did not report the incident until a month later when she was pulled over on suspicion of drunk driving. a former united airlines worker and his wife will find out their punishment today for stealing luggage in the midst of the chaos of the asiana airline crash. they stole bags belonging to people flying into sfo. one of their victims was a richmond couple who were

returning when the asiana flight crashed. investigators say they took it, returned most of the clothes inside the suitcase to a nordstrom in pleasanton for about $5,000. the couple pleaded no contest and faced up to a year in jail each. new this morning, a major decision against google affecting the very way the search engine works. the highest court in europe ruled against google saying they have to remove some of the sensitive information from search results. if search results for a person's name show outdated or relevant information google no longer linked to it. the court says the fact that the information is simply on the internet is not a good reason to index it. the lawsuit was brought about by a man from spain revealed results that infringed on his privacy.

lawyers for the state of arizona will be in san francisco today to try to convince three federal judges to uphold the state's restrictions on abortion drugs. last month the rules were blocked in appeals court. the regulations limit where and how women can take abortion-inducing drugs and block their use after the seventh week of pregnancy. now, women can use the drugs into nine weeks of pregnancy. allow the rules to be implemented while attorneys for planned parenthood arizona want the injunction kept in place. police in sunnyvale looking for two burglars after fighting a with home owner and pulling a gun. a man confronted two men breaking into his house and one of the men ran off and the homeowner managed to catch up to the other. they fought briefly until the man pulled out a gun and the gun was fired and nobody hurt. sped away in a mercedes-benz suv. while officials don't know yet what caused a fire at a san

jose landfill they do think it was an accident. it happened sunday afternoon. crews put water on that fire until 11:00 p.m. dealing with burning wood and it burned like candles. a thick plume of dark smoke could be seen over most of the city but this smoke did not significantly affect air quality. activists plan to crowd city hall as the council considers regulations for medical marijuana clinics. look at the proposal to limit pot clubs to industrial areas far from schools and homes. pro-marijuana groups say that would efefectively ban pot stores. try to put limits on the clinics but the clinics were overturned. try to keep cool today. temperatures near the south bay expected to be near triple digits just in time for cyclists to pedal into town for the third

leg of the race. past livermore, danville ending at the top of mt. diablo. race leaders say it could be one of the toughest legs in the tour's nine-year history. the race started sunday in sacramento and went through folsom yesterday. ride 700 miles throughout california in just eight days. >> up mt. hamilton and mt. biablo in the same day. it is going to be hot. >> it is. at least when you go up in the higher elevations, you do get some cooling but it is going to be tough for them. they're going to be put to the challenge for today and hopefully if any of your riders are watching this morning, we want you to stay safe. 46, good morning to you north bay. we are at 55 degrees here in the south bay to start the day and the national weather service is onboard with this heat wave. at this point we do have an excessive heat watch in place and a heat advisory, you want to drink plenty of water if you're going to be outdoors for any

potentially all day or at least until 5:00 p.m. you have to reroute and take 87 up to 101 and add congestion and rerouting on surface streets. reports of a lot of smoke in the area and checking with cupertino fire to check that out. we are concerned about a lot of fires there and circled mt. hamilton over there off of our freeways where that amgen race starts taking a roadway you're not going to take on the comm e commute. but watch the area around mt. diablo state park. 580 through the tri-valley moves very smoothly. oakland 880 no problems past the coliseum and the tubes sound like they have overnight road work for the next few minutes. back to you. >> all right, mike, thank you. one of san francisco's most dangerous intersections is about to change. the city is going to put in a traffic light and countdown crossing signal. in february, a 78-year-old man was killed in that crosswalk,

two other pedestrians were hurt this year. do be careful that traffic light won't come until july. extra police presence at last night's giants game urging the thousands of people walking to the ballpark to be more careful. our cameras caught quite a few close calls near the park. san francisco police chief says the number of collisions is down and ticketing is up. despite those statistics the number of traffic deaths, unfortunately, has not decreased. facebook founder mark zuc r zuckerberg the target of a real estate lawsuit. what the developer is alleging, next. an officer killed just moments before this house exploded. what police are now saying about that. the fight over casey kasem. a judge now intervening as his children struggle to find out where the legendary disk jockey

they try to save the only mobile home park. residents pay about $700 a month for rent. the ownerers have run the park for nearly three decades and a developer has offered more than $30 million for the property to make room for luxury apartments. if it goes through, the families will have to get out. >> going to start crying just to think about that feeling, i mean, it's our home. it's where i grew up. you know, i have so many memories. >> she says that she wants to stay here because of the kids and because she wants them to come to these schools because they are good schools. >> the owner's attorney says the deal meets city requirements. after three days of testimony the city appointed an administrator whether the sale should go through and compensate the families. facebook ceo mark zuckerberg faces more this morning. a real estate developer is suing zuckerberg saying he did not live up to his side of a deal

they made. he bought a piece of property from the developer and allegedly promised introductions and referrals to other wealthy people who might buy home. the developer says that didn't happen. zuckerberg went on to buy four other homes near his property, spending more than $43 million. that special craft beer at your local bar could cost more this summer. jackie deangeles live at cnbc world headquarters with details on that and more. beer and markets, good morning, jackie. >> good morning to you. a good combination. futures higher this morning. we will start with the markets after we saw a very strong day for stocks on monday. now, the market was led higher by recently beaten down sectors. the biotech names and the internet stocks. the dow and s&p 500 closing at record highs and the nasdaq having its best day in more than three months. look for data today on retail sales and import prices could move the market around. the dow rising 112 points to

finish at 16695 and the nasdaq adding 71 points. meantime, at&t is in active talks to buy satellite dealer directv a deal worth $50 billio. a merger would create a media giant close in size to where comcast would be if it completes this merger. its purchase of time warner cable. at&t would face a tough review by regulators. they are opposing further consolidation and finally that fun story, not so fun because it comes to paying a little bit more for that microbrew these days. actually an explosion in growth in the $14 billion craft beer industry has pushed prices for hops from $7 to $10 a pound. those are levels we haven't seen since the drought hit the market since 2008. craft beers use up to ten times the amount of hops found in

beers like big brewers like anheuser-busch and this early in the morning i didn't think i would learn this much about beer. hops is what is made of and i don't have neither to show you. >> you could have little glasses set out in front of you. samples. >> jackie deangeles, thank you. >> a lot of people will want a cool one today. let me tell you that. temperatures creeping up, christina. >> just like the beer price. if you want to drink lots of water out there this morning, we are going to see the 50s. stay hidrited throughout the day, even though it's not hot out there just yet you will do your body a favor if you start drinking that water and stay hydrated and get it started before you leave the house. ten degrees warmer than yesterday and yesterday was pretty mild even at the oescean. 85 degrees in san jose and trade that in for 95 degrees and we have the spare the air alert in

place. if you're someone who suffers from as mu or respiratatory, this is another reason to stay indoors and likely spare the air tomorrow, as well. we'll keep this stagnant air mass overhead. if we see the triple digits, it looks like that will be gilroy or out in the extreme east bay. the highest microclimate cities coming up. right now 86 degrees for san francisco today. that is hot day. also be one of the days when it's very hazy out there. poor air quality and hottest temps of the air on the way for tomorrow. we'll bump those numbers up even more so and more cooling at the end of the week and see that here on the five-day forecast and two more very hot days to get through today before we start to see the heat break and we will keep you updated. back to you, scott and laura. >> we'll keep our eye on the weekend, thanks, christina.

the u.s. sent surveillance planes to nigeria to help look for 200 girls kidnapped by the group boco haram. u.s. officials are considering sending unmanned drones to help find the girls. in the past, boco haram was paid millions for the release of its hostages but experts disagree about whether nigeria will negotiate. >> the best we can hope for at this point is quiet negotiation, which keeps them safe, which gives you more time to identify where the vast majority are and potentially some sort of rescue. >> right now, there are about 50 people from the u.s. helping in this search, including fbi hostage negotiators. a police officer in new hampshire has been shot and killkill ed and a house leveled in an explosion. steve arkel was at the home to

respond to a domestic dispute. by the time the other officers arrived to help the home covered in flames and then just simply blew up. now, the man inside the home also presumed dead, arkel leaves behind two teenage daughters. singer clay aiken has suspended his campaign to represent north carolina in congress after his chief rival unpexectedly died. keith christo died yesterday after an accidental fall at his home, according to his family. they were both fighting to represent the democratic party in the race for north carolina's second congressional district. though the polls closed last week, the race was still too close to call with aiken holding just a slight lead. if crisco comes back and wins they'll select a nominee to come back and take his place. casey kasem is missing and a judge has revealed his wife
