like a billy holliday type. >> mariah carey takes our concert stage this morning. we're kicking it off right with her and we've got a big crowd this morning. look forward to that. let's start with the top story. got some new problems for crews battling the powerful wildfires in southern california. nbc's joe fryer is in escondido that's north of san diego. good morning to you. >> reporter: good morning, matt. overnight two teenagers were arrested for trying to start a couple of fires that were quickly extinguished here in escondido. they have not been connected to any of the larger wildfires we've seen this week including the one that burns through here, the cocos fire. which is only 10% contained and still destroying homes. the may fire storm has now claimed its first victim after a charred body was discovered at a homeless camp in carlsbad. mean while to the east, a fire

that started in san marcos has spread to escondido. >> boom, boom, boom. three columns of smoke. >> reporter: dubbed the cocos fire, this is the county's number one priority. destructive enough to devour a large home and to break a family's heart. amanda and stan rented a hill top house with a priceless view for three years. >> our patio deck. >> reporter: they evacuated an hour before the flames took everything. >> it just makes you think of all the times together. >> reporter: we were there as the cocos fire chewed through another dry hillside inching right up to a fence. the only barrier between the hungry flames and rows of apartment buildings. this is the last stand. firefighters working hard on the ground and in the air to keep these flames from reaching several nearby apartments. it took a barrage from the air

to douse the fire and save the apartments with only seconds to spare. 22 military aircraft have now joined the fight. from the air, nbc's miguel almaguer could see properties burned to the ground. >> reporter: firefighters did everything they could to beat back flames in many of these areas and in several communities they won. >> reporter: as for this family, they're now looking for a new home for their four kids with a fifth baby on the way. >> a lot of memories. three years, four children. but everybody's safe. that's what's important. >> reporter: the causes of the larger wildfires we've seen this week still under investigation. arson squads will look into all of them. it's unclear if any were set intentionally. >> thank you. earlier this morning we spoke with jim buchanan and t.d. walton. they have spent much of the past two days protecting their properties in escondido from those approaching flames.

at times they've been fighting this fire with little more than garden hoses. they even stayed in an area that have been evacuated. i began by asking these gentlemen how dangerous it was. >> it's been quite long, but it's a good night. we've been able to help each other and the neighbors. >> yeah. we managed to save my house and my garage here just with a garden hose. but we have a lot of escondido fire trucks. when it got real hot and heavy, they pulled upd. they're the ones that helped save everyth >> jim, speaking to how quickly these fires can spread, they seemed to be one place and then all of a sudden it jumped. can you tell me about that? >> yeah. behind us is coronado hills. that's where the cocos fire started. we thought everything was pretty much done. there was a ridge we could see last night when we were out, we could see them putting it out. we thought it was a helicopter drop. things like that.

there were three plumes of black smoke. one on the northern most point came across with a venn jevens. it hit a brush file in a field out back. skipped over my neighbor's house. got the two next door. and after i thought this was going to be it. and then the fire truck showed up. >> that brings me to my last question. is this safe? these are areas that actually have been under an evacuation order. are you sure you could get out quickly if you had to and how do you know you're not endangering the lives of first responders who might be called to rescue you? >> so far everything that's going to burn is burned. we've got three exits to get out of here. >> we're good. we have our own food supply back here. we have our little vegan community here and we're good. >> well, we wish you all the best as you battle mother nature here. jim buchanan and t.d. walton,

thanks for your time this morning. >> you're welcome. >> thank you. in the meantime, it appears banned los angeles clippers owner donald sterling is now digging in his heels for a fight with the nba. willie geist has more. good morning to you. >> good morning. according to reports, an attorney sent a letter to the league saying sterling will not pay the $2.5 million fine levied by adam silver. and sterling did not stop there. >> people want me to hire a wall of lawyers and to go to war. i don't think that's the answer. >> reporter: that was donald sterling on cnn earlier this week when asked about fighting back against the nba. now new reports breaking overnight say the embattled owner has hired famed anti-trust lawyer who sent a letter threatening to sue the league. usa today reports its seen the letter and claims sterling has done nothing wrong in the

letter. >> they're objecting to two things in their letter. one, they're not going to pay the $2.5 million fine. and they also object to the lifetime ban. >> reporter: nbc news reached out to sterling's attorney and to the nba. neither had comment. >> the ultimate battle has to play out in the courtroom. and donald sterling has everything to gain and nothing to lose by pushing this battle into the courtroom. >> reporter: this comes as sterling finds himself in the hot seat once again. after making his first public comments since the scandal broke. >> i'm not a racist. i love people. magic johnson, what has he done? >> reporter: last night the clippers suffered a season-ending loss to oklahoma city. but head coach doc rivers made no excuses. >> you know, we've gone through a lot of stuff over the last three or four weeks. i don't think that was why we didn't win. i don't think we should use that as an excuse. >> reporter: after the game,

clippers fans spoke out about sterling's next move. >> it's par for the course for him. i was waiting for him to say i'm not going to pay that and make a big deal out of it and make the nba have to do something. >> the nba finance committee convenes again next week to consider forcing sterling to sell his team. i think the nba was ready for this. nobody expected sterling to go down without a fight. >> thank you. we've got the latest on the scandal involving va hospitals across the country. >> and eric shinseki says he will not resign if the department of veteran affairs is rocked by wrong doings surfacing in at least ten states. jim miklaszewski spoke to general shinseki and joins us. >> reporter: good morning. each time he says he's not going to resign, he sounds a little more determined. but lawmakers on capitol hill are saying enough is enough. and something at the va has got to change.

in testimony before the senate veterans affair committee, eric shinseki showed flashes of anger and frustration over the growing va scandal. >> any adverse incident like this makes me as -- makes me mad as hell. >> reporter: and later bristled. >> what do you say to those veterans who say you of all people have abandoned, have you failed these veterans? >> i took this job not to fail veterans. i came to make things better for them. >> reporter: whistle blowers allege that va hospitals in at least eight states were hiding veterans appointments on secret lists to cover up long delays in getting treatments. >> while people, quote, unquote cooking the books? >> i'm not aware of other than a number of isolated cases where there is evidence of that. >> reporter: former va doctor samuel foot, the original whistle blower from phoenix

alleges that 40 veterans reportedly died while waiting for medical care. the va inspector general said in 17 cases he has not yet concluded the deaths were caused by the delays. both democrats and republicans aren't convinced and are demanding a major shakeup at the va. congress is already looking at options. some senior lawmakers demanding the federal government provide these veterans on more options. >> all right. thank you, jim. some amazing video out of syria this morning that reportedly shows a huge bomb going off at an army base. according to a british-based activist group, syrian rebels dug a tunnel and packed it with 60 tons of explosives. it went hundreds of feet into the air. it is unknown if anyone was killed in the explosion. it's another sign of the times. wireless carriers are now giving some americans the options of

texting emergencies to 911 instead of calling. the text to 911 program debuted to some thursday. officials are still encouraging people to call in their emergencies. the text program is designed to make it easier for people who are deaf, hard of hearing, or have a speech impediment. remember the video yesterday of the cat in california coming to the rescue of the young boy being attacked by a dog? in case you don't remember, here it is again. you see the dog coming around the back of the car and rips the boy off of his bike. the boy's cat then comes in and saves the day. cat of course now has become a big star. and now a minor league baseball team, the bakersfield blaze, has reached out to the cat's owners hoping to get tara to do the ceremonial first pitch at a game. they will take to the mound to throw out the pitch on may 20th. we assume there will be human intervention unless the cat has

good friday morning to you. it's 7:26 i'm laura garcia, cannon. police are on the hunt for a shooter responsible for san jose's 17th homicide of the year. a man was shot on gridley street late last night. a block away from miller mccullum elementary school. the man was taken to the hospital where he died. investigators are looking for a motive. in the meantime, prosecutors will likely file murder charges today against a man who was found at the scene in san jose's 1 16th homicide. officers say the victim is a woman who was stabbed to death by someone she knew. investigators are working to try to find a motive and figure out how the two actually knew each other. this morning local

forced officials to issue more than 18,000 new evacuation orders. overseas, officials believe 18 people remain trapped underground at the site of that mining disaster in turkey. the death toll now expected to reach at least 300 people. in the meantime, the owner of that mine has spoken out this morning defending his company's safety record. and l.a. clippers owner donald sterling has apparently refused to pay the $2.5 million fine imposed by the nba for making racist comments. sterling's lawyer reportedly sent a letter to the league saying his client's actions do not merit any kind of punishment. an nba spokesperson declined to comment. still to come this morning, some shocking video. an outrage over the punishment given to a kindergarten teacher caught on camera, grabbing a student by the face and pinning him up against the wall. this morning that 6-year-old's parents are speaking out. >> we have a programming note to tell you about. monday, we hope you'll watch as we sit down with jessica simpson.

until the end of the school year, the nelson family is trying to get their little boy ian's life back to normal. this after that troubling video was brought to their attention. in this surveillance video from riverdale schools in ohio, you can see 6-year-old ian nelson walking alone into a school bathroom. when he comes out, his teacher, who appears to be looking for the kindergartener, can be seen grabbing him, picking him up and pushing him against a wall. she then grabs his face, then his shirt, and picks him up again, jostling him. his neck appearing to snap backward. >> i was crying. like i said, it broke my heart to see my child get harmed by a complete stranger. >> reporter: when ian's parents anthony and autumn first heard of the incident, they didn't think much of it. that was until they saw the tape. >> i was just in complete utter shock. >> reporter: ian never said anything about it to his parents, but another staff member at the school reported it.

barb williams, the kindergarten teacher who had been at the school for 14 years is on unpaid leave for ten days, suspended until summer break. >> they should have just fired her when they found out about the whole situation. >> reporter: the school says it filed reports with the hancock county sheriff, the department of education and children's services. >> you don't ever want somebody's child to go through that and that's not what we're about, and, you know, we move forward. >> reporter: ian has only said a few words about the incident. >> she -- um -- did this to me. hard. >> reporter: as for ian, for the final weeks of the school year, he's in a new classroom with a new teacher. and the nelson family has hired a lawyer, but they have not taken any legal action against the teacher or the school. the hancock police department

privacy concerns, because after all, it's hard to tell who may be watching. has the faa dragged its feet when it comes to regulating this industry? >> there is no doubt that the technology has outpaced the regulatory aspects. >> reporter: right now, hobbyists can only fly drones like this legally below 400 feet. but this week, the faa announced they would allow certain companies to apply for exemptions to that rule. the industry predicts unmanned vehicles will rake in more than $82 billion. drone advocates say the possibilities are endless. >> it's pretty cool. >> reporter: this is the b-bot drone from the parent company. is there literally an app for that? you can control it right from your mobile device. which takes some getting used to. drones are already capturing stunning video of recent tornado damage in arkansas and flash flooding in florida. amazon.com has plans to deliver packages using drones, and real

good friday morbing to you, 7:56. i'm laura garcia-cannon. starting tomorrow sfo will shut down two of its four runways for the summer. the airport has to shut down those runways to finish a federally mandated safety project. the airport is building construction zones at both ends of runways 1l and 1r. they handle most of the airport's departures. the work will cut the number of flights that could arrive during peak hours and send all southern-california bound fights over san bruno and daly city. this summer those cities could see 10 to 12 more planes per hour flying overhead during peak times in the morning and the evening. let's check the morning forecast now with christina. >> hey, happy weekend to you. we made it to flooid. you know what, we have a good-looking weekend shaping up. what happens is those low clouds

>> reporter: good morning, natalie. two teens we arrested overnight accused of trying to set a couple of small fires here in escondido. but right now, they have not been connected to the larger wildfires we've been seeing this week. also, the fires may have claimed their first victim, a charred body was found at a homeless camp in carlsbad. the number one priority remains the cocos fire, which started in san marcos and has spread east to escondido. that fire about 10% contained. the 1,200 acres burned and a few more structured destroyed yesterday. but many more homes were saved the air attack has been very helpful. 22 military aircraft have fined the fight. the hope is that the weather conditions will continue to improve today. natalie? >> thank you, joe. more trouble for former nfl player aaron hernandez, who's already facing murder charges. hernandez was indicted thursday on two new counts of first-degree murder. officials say he had a chance encounter with the victims at a boston nightclub in july of

2012. prosecutors say hernandez followed the victims out of the club and then killed them. hernandez is being held without bail in the june 2013 murder of odin lloyd. the internal watchdog for the department of veteran's affairs told congress there is no proof that delays in treatments at v.a. hospitals led to patients' deaths. also testifying was v.a. secretary eric shinseki. he angrily denied that he had failed veterans, despite reports that 40 of them have died while waiting for medical care and that v.a. hospitals in at least nine states doctored records to cover up delays. shinseki also rejected calls for his resignation. los angeles clippers owner donald sterling is threatening to sue the nba and refusing to pay a $2.5 million fine for his racist comments. his attorney has reportedly told the league that sterling will also fight his lifetime ban because he feels he has done nothing wrong. meantime, sterling's clippers were eliminated from the playoffs thursday night with a home court loss to the oklahoma

"the new york times" is denying that. but the story has definitely prompted a discussion about women in the workplace after critics branded abramson pushy and overly aggressive. her defenders say that's sexist.

back now with the story of a mom from michigan who's taking off on an emotional mission this weekend. alicia stillman is leading a group of mainly college age students to canada to get a vaccine that is not yet approved in the u.s. it honors her late daughter emily and she hopes will save lives. dr. nancy snyderman has the story. nancy, good morning. >> good morning, savannah. the disease that alicia stillman wants to bring to everyone's attention is a series one. bacterial meningitis which often strikes college students. in this case, it's a rare strain that is difficult to diagnose and can strike suddenly and can

be fatal. after high school graduation, emily stillman dreamed of making it big in comedy. >> she probably would have made it on "saturday night live," but my husband and i said well you have to have a plan b just in case. >> reporter: late last january, emily, a 19-year-old college sophomore, phoned her mother complaining of a terrible head ache. >> i said gosh, em, you're tired. take a couple motrin and go to bed and we'll talk in the morning. >> reporter: but the next morning, the call came from emily's college dean. emily was in the hospital with bacterial meningitis. >> i just kept telling myself, she's been vaccinated. this is a misdiagnosis. >> reporter: emily died two days later. she had received the meningitis vaccine and booster, but they did not protect her against meningitis b. this school year, more than a dozen cases and one death have been tied to meningitis b outbreaks at princeton university and the university of

california santa barbara. the food and drug administration granted those universities permission to vaccinate thousands of students with an unapproved men b vaccine, and says the fda has been working closely with manufacturers, pursuing the development and approval of men b vaccines for the united states. >> i'm angry that we don't have the vaccine, and other people do. other countries do. >> reporter: turning that anger into action, this weekend, the emily stillman foundation will take more than 50 people on a bus trip to canada to be vaccinated. >> when i protect 50 people on sunday, it's going to be very bittersweet for me. because i couldn't protect my own daughter. >> the vaccine is currently approved in canada, australia, and europe. why not the u.s.? >> well, the question is a good one and i don't have a good

answer for you. the fda e kwif laquivalents in countries -- the fact that our fda has allowed this vaccine against meningitis b to treat two college tracked to the fda t comment. i suspect in this year you'll see it in the united states. >> i was wondering. you say fast track what does that mean in the fda world in >> i think we have shown in other countries it works, the data is there. in this case the fda can probably be krit sighed for being too slow. they can't deny that this strain is in the united states. i would not be at all surprised to see this on the market in 2014. >> it's a sad story about emily. it bears repeating. what should you look for that is a tell tell sign of this strain? >> in this case parents did everything. they got the vaccinations for the strains that we have in this country, the two shots, but the symptoms can mimic anything from

this incident, which braeeaks m heart. another staff member reported it. teacher barb williams, who's been at the school for 14 years, was given unpaid leave for ten days. the suspension came ten days before summer break, so she leads into a vacation. it's not clear how ian's parents got their hands on the video, but they say that the teacher should have been fired, that anthony said said if he were to do that, he would have gone to jail. >> absolutely. >> and here's what ian's mom autumn had to say about it. >> i was crying. like i said, it broke my heart to see my child get harmed by a complete stranger. >> everybody's hearts breaking. you see ian's head just snap back. >> here's what ian had to say about it. >> she -- um -- did this to me.

hard. >> the momma bear comes out in all of us. >> i was just thinking the same thing. >> you just want to take that woman and give her what she deserves. >> what's perplexing -- listen, police say there's an open investigation. the school filed a report with the hancock sheriff's department. the education children's services now involved. the school superintendent has apologized. we did reach out to barb for a comment on this, barb williams, and we did not hear back from her. >> she has an attorney. >> she has an attorney. you know, there's layers of this. but what also breaks my heart is that ian was perhaps afraid, so afraid he didn't tell his parents. i know you all are parents. that's the one thing, if someone harms your kid, you want them to come to you with the confidence to say someone touched me, someone hit me, whatever the case. but the school superintendent has apologized. here's what was said. >> anything like this is always,

you know -- you apologize, you don't ever want somebody's child to go through that. and that's not what we're about. and we move forward. >> but moving forward, does it mean she needs to be fired? >> beyond fired. press charges. the whole thing. there needs to be a lot more done in this case. >> this isn't an unruly high school student who's out of control. >> not that it makes a difference what age, any student no matter what. you don't touch a student in that manner. you don't do that. >> let's say it was a full grown teenager who was threatening another student. >> if you're trying to break up a fight perhaps. >> but even then, my mom is a teacher and you have to be careful then because teachers have broken up fights and they have been charged with assault for grabbing. but this is on camera. and to the point of ian's parents, had they been called -- if someone saw them do that in the supermarket, they would have been carted off in the back of a police car. >> there's no way she survives.

. . good morning to you. it's 9:26. i'm peggy bunker. police are on the hunt for the shooter responsible for the city's 17th homicide of the year. a man was shot on gridly street in east san jose last night. that's just a block away from miller mccollum elementary school. the man was taken to the hospital, where he later died. investigators are now looking into the motive. meanwhile, prosecutors will likely file murder charges today against the man who was found at the scene of san jose's 16th homicide. now, this happened last night at a home on canyon ridge drive in east san jose. officers say the victim is a woman who was stabbed to death by someone that she knew. investigators are now working on a motive and trying to figure out how the two knew each other. this morning, local congressman eric boswell will present a solution to increase security at mineta san jose in

light of the stowaway case. he toured the perimeter of sjca to elevate that fence he hopped over. at a new conference later this morning, he'll recommend implementing new radar technology to protect the perimeter at the airport. a quick break. when we come back, we'll take a look at your weather and your traffic.

mandated safety project. the airport is building construction zones at both ends of runways 1l and 1r. those are the northeast-facing runways that handle most of the airport's departures. the work is going to cut the number of flights that can run during peak hours. it will cut all flights over san bruno and daly city. in fact, this summer, those cities could seen as many as 10 to 12 more planes flying overhead during peak times, also that would be during the morning and evening. surely something people there will notice. are. >> you don't have to postpone your activities for the mornings and evenings any longer, because our natural ac has turned back on, peggy. you can see that full deck of clouds over the golden gate bridge. a very welcome sight. that's what's going to keep our temperatures down for today. we are climbing into the 60s at this hour. plenty of 60s, but still not too hot out there. and as we get into this afternoon, that cool ocean air will make its way all the way inland. as a result, look at our numbers for today. a substantial drop-off here in san jose, down to 84 degrees.

school. the man was taken to the hospital, where he died. investigators are looking into the motive. meanwhile, prosecutors will likely file murder charges today against the man who was found at the scene of san jose's 15th homicide. this happened last night at a home on canyon ridge drive in east san jose as well. officers say the victim is a woman who was stabbed to death by someone she knew. investigators are working on a motive and trying to figure out exactly how the two knee each other. we'll take a quick break and when we get back, a look at the weekend weather forecast and your traffic.

it is time for boom taftic as we look at the effects of memory loss. it is easy to think you're sliding toward dementia when you forgot a name or forgot an appointment. >> there are other factors at play that may mimic the disease and may have a cure. barbara hannah gutherman is a contributing editor and dr. brett osborne is a neurosurgeon. >> hello. good morning. >> let's talk. what are the real symptoms of dementia because i think a lot of people aren't quite sure. >> or they think dementia is the same at alzheimers. >> that's a big misconception. dementia is a group of symptoms.

alzheimer's is a brian disease. and that's the difference right there. alzheimer's is under the umbrella of dementia. and alzheimer's is 70% to 80% of dementia cases. that's number one. >> if you were misdiagnosed with alzheimer's when it was dementia. >> people are probably forgetting things and can't remember names or keys, should they be concerned there is dementia at play? >> that's a good question. that always happens to me, and it is in the range of normal. >> it is a great question. and just like your iphone, your computer has glitches, we have these glitches on occasion. and those occasional glitches are completely normal. and within the realms of normalcy. when they become contiguous and start affecting your activities for daily living, then it becomes a concern. >> how do you define that,

>> do you smell what i smell? >> all these animals smell. >> our last animal -- >> good-bye. nice talking to you. >> our next animal, most people call it a peacock, but it is actually -- this is a female. think of a peacock. you know what a peacock looks like. >> we work at nbc. >> so this is -- this is the juvenile and the males. the females have to be camouflaged. they have this sort of very dull coloration they have a little bit of that iridescence on the neck. the males are the ones with the bright, beautiful fancy colors and use those to attract the females. kind of a little wit of the opposite with how humans typically do it. >> look at that mohawk. >> she's not that old. only 6 months old. >> is that a mullet? >> it may be a mullet. >> another beautiful animal. they live in asia. when they come out, they look just like baby chickens.

well, good morning, everyone. thank you for joining us. i'm scott mcgrew. >> and i'm peggy bunker. we begin with a story that is new at 11:00. dozens of students at a san francisco high school are wearing ties today, in protest, they say, for one of their classmates who had her photo rejected from the yearbook because she wore a tuxedo. nbc bay area's christie smith is live at sacred heart. and christie, students there are really standing up for their fellow student. >> reporter: yeah, good morning to you. students are very, very vocal about this. they say their friend should be able to wear whatever she wants for her senior photo in the yearbook, including a tuxedo, and they say that she was left out of it because of what she
