well, good morning, everyone. it's 4:30, i'm scott mcgrew. >> i'm laura garcia-cannon. taking a live look outside. while many of you are sleeping, rain actually fell in parts of the bay area. thunderstorms are possible throughout the day. for more on that, let's bring in meteorologist christina loren. >> yeah, good morning to you. a lot of thunderstorm activity along the spine of the sierra nevada right now. for us in the bay area, we have that humidity and it feels muggy out there and moisture coming down around the western-facing slopes. as we get into your day today, temperatures will be comfortable

and we'll keep the wind going and the chance for thunderstorms going, as well. however, the chance has shifted to the east bay hills. we'll talk more about that coming up and right now i want to welcome in mike inouye on a tuesday morning. >> looking at oakland where travel is very nice right now. we have your overnight construction crews. keep that in mind picking it up as you're heading through san leandro. the camera trembles a little bit. chp issued wind advisory for the bay bridge and the dumbarton bridge and they were all extended overnight. camera trembled a tiny bit in oakland and a number of people asked, do you still have that advisory? we're following what christina reports as opposed to what chp reports. over here the south bay showing a nice, easy drive at 680 and the earlier shot of the bay bridge toll plaza showed you no problems and back to you.

breaking news going on in russia right now at least five people are dead and 45 others are hurt after a cargo train collided with a passenger train in moscow. investigators say several cars of the cargo train derailed overnight and hit the passenger train. several cars of the passenger train then derailed. some even overturned. the cause of the crash is under investigation. officials say a 15 of the injured are in grave condition. students of bryman college in san jose should find out why their school was suddenly shut down in the middle of the day. bryman is a vocational college near the campbell border. specializes with medical and dental fields. when students arrived to class yesterday they saw no trespassing signs on every single classroom and office door. they had to leave in the middle of their classes and when a locksmith came and changed all

the different locks on 30 different doors students like amanda paid $16,000 for an eight-month program. she was supposed to graduate in two months. >> not all the schools are going to be able to take bryman college credit. i might have to start over then. >> if you have to start over. >> more money i owe for college and expenses. >> the locksmith only said it was a landlord/tenant dispute. we'll try to get some answers for you. 4:43. a memorial grew overnight at the scene of a deadly amtrak accident. a train a student did not see coming. 18-year-old brittany silvo was wearing earbuds when she was hit and killed by a train yesterday around dinnertime. at a vigil last night her mother told us her daughter's life was just getting started. >> my daughter was a wonderful person.

beautiful. fun to ride roler coasters with. she had the whole world in the palm of her hand. she was getting ready to graduate this year. >> witnesses told officers they tried to warn her that a train was coming but she did not see or hear them. the man accused of kidnapping and killing morgan hill teenager sierra lamar will now face the death penalty. jeff rosen made that announcement yesterday. this despite the fact that lamar's body has never been found. accused of taking lamar as she was walking to school. lamar's father support the district attorney's decision. >> if he's found guilty of this crime myself, my family feels it should be the ultmal penalty for taking, you know, something so dear to us. >> nbc bay area legal analyst

stephen clark think the d.a.'s decision is risky and could be years before the case goes to trial. >> it may actually play into the defense's hands because they'll continue to character this as a missing person's case and they're going to look at the jury and say, sierra lamar could still be found alive, are you going to return a death verdict? that can't be fixed? >> grsia lawrence's attorney is shocked because there is no body, not even a crime scene. investigators say the north bay mother accused of grabbing a child by the neck for reportedly bullying her daughter may have targeted the wrong child. daria garcia-bratcher she stormed on to the campus in santa rosa, grabbed the throat of a boy she thought had been bullying her daughter and now sonoma county officials say there is no evidence that particular boy bullied her

daughter. garcia-bratcher is expected to face a judge on thursday. the city of moore, oklahoma, one year ago today 25 people died and homes and businesses and two schools were demolished by a violent tornado. sarah has more on how those who survived are trying to move forward. >> reporter: a year later the memories in moore, oklahoma, are as fresh -- >> seen a tornado about half a mile away. >> reporter: as the day the ef-5 tornado tore a 17-mile long path through the metropolitan area. >> i wouldn't wish it on my absolute worst enemy in the whole world. >> reporter: more than 1,000 homes destroyed, including kim and marty schwab's place. they vowed to rebuild and now weeks away from finishing their new home. the sounds of construction. he remembers the first resident to move back just months after

the twister. >> he saw that happen the very first one. i think some of us just about cried because we were so happy. >> reporter: perhaps one of the most emotionally difficult rebuilds, that of plaza towers elementary. 9-year-old christopher leg and six uother students were killed there. like 6 o% of oklahoma schools, did not have a tornado shelter. the new building will, but christopher's mom won't stop until there is one in every school in the state. >> it's not a matter if a tornido will come to oklahoma again, it's a matter of when. >> reporter: painful lessons learned the past year. >> you know they're going to return, as she said. across oklahoma, 1,100 schools do not have tornado shelters leaving half a million students and teachers potentially at risk, but the state says retrofitting every school would cost nearly $1 billion. oklahoma's governor said voters and local school districts should decide whether to build

shelters and raise property taxes to help them rebuild. here in california it's not a matter of if, but when we're hit by a major earthquake. the bay area may be in for more than the big one. after years of digging into faults, scientists have managed to look back 400 years and identify a pattern. they say between 1690 and 1776, many large quakes shook the region and relieved stress that had been built up in the fault lines. now scientists think that pattern will repeat and they say we're in for a series of big earthquakes instead of one single event. >> stress is coming in and it has to come back out. it comes back out as movement on the different faults. >> now, most of the quakes in the clusters studied in the 17th and 18th centuries were between magnitude 6.6 and 7.8. >> which is fascinating because they're looking more and more into the earthquake warning

systems and how helpful that would be. >> less than a minute would be amazing. >> exactly. take shelter. be prepared always in our neck of the woods. you never know when one is going to hit. you have to have extra food and supplies. >> always idea to grab extra water and canned goods and stay stocked up. looking at your doppler radar. a little bit of activity happening over in the sierra nevada. up to tahoe today, you want to take it very, very easy because i can tell you right now traveling cautiously is really going to be important. we have some gusty wind, up to 50 miles per hour and thunderstorms rolling through the sierra nevada as we speak this morning. for us in the bay area, we're starting out with the subtropical air mass overhead. still cool and still getting this comfortable ocean breeze. it's rather strong, however, this morning in san francisco. and sustained at about 18 miles per hour there. 17 miles per hour, meanwhile, in oakland. single digits to report in your

inland valleys this morning. now, as we head throughout the day today, we'll climb out of the 50s, into the 70s. comfortable temperatures but a better chance for thunderstorms today, especially over the east bay hills. that's the area we're really watching for and we could see some activity here. over the western facing slopes surrounding san jose, as well. the temperatures pretty mild and not warm enough to get severe weather around here. nonetheless, we'll track isolated activity later today and we'll talk about that and big-time warm up as we get to your holiday weekend. right now, let's say good morning to mike inouye. >> folks further east right now and look at our dublin camera for westbound 580. look at the stream of headlights heading westbound. we are looking at a smooth flow of traffic going through the area and despite the fact that a little further back a report of a disabled vehicle in your center divide. it has cleared from lanes and a smooth flow here. the rest of your bay looking at

welcome back, everyone. a beautiful tuesday morning to you. pretty shot outside. taking a look, this is from emeryville you see across the spans of the bay bridge this morning. always a beautiful start. 4:44 right now. san jose city council might vote on the way medical marijuana clubs operate. council took public comments last week. there are more than 100 pot clubs operating in the city. zoning and regulations for those dispensaries. some of the changes possibly include cutting down the number of pot clubs to 20 and increasing the distance between the pot clubs and schools. the debate over what your child eats at school is heating up on capitol hill today where a committee will consider easing

government rules that critics say result in more expensive and less tasty menus. for the past two years students are getting healthier lunches at school as part of the campaign by michelle obama that emphasizes fruits and vegetables. this year schools will have to go further reducing sodium levels and only offering whole grains. the guide lines go too far. >> we just need a little more time to get the kids used to what we're offering and have the products available that we can get at a reasonable cost and that students will accept. >> kids complain about school lunch. that's been happening for a long time. but kids also complain about math and science and that doesn't mean we stop teaching math just because kids would rather not learn it. >> today the committee will consider giving schools that are struggling financially a one-year waiver from the requirement. new research shows breathing dirty air during the second

trimester of pregancy puts kids at risk of as asthma. this is the first study to pinpoint a specific time frame. medical experts say it's always important to cut down exposure to fine particles throughout pregnancy, but women in their second trimester should be extremely cautious. go pro filed paperwork for its ipo. they hope to raise about $100 million, but that amount is likely to change as banks managing the deal gauge investor interest. so far no word on how much the shares will cost or how many shares the company hopes to sell. but we do know it will trade on the nasdaq using the ticker symbol. they make the small, durable cameras. in front of surf boards, you name it, made just under $1 billion last year. also buzzing around the tech industry this morning,

microsoft. the company expected to unveil a new tablet, possibly a mini or a surface 3 at an event in new york city today. we'll know around 8:00 this morning. and walmart says it plans to hire about 500 workers in sunnyvale. the new tech jobs are part of an expansion of the company's digital operations. walmart's e-commerce unit struck a deal to lease more than 100,000 square feet near the corner of central expressway and mu dilda avenue. finally sprint users can say good-bye to the annoying texts and calls from telemarketers. in the largest settlement yet, the sec is fining sprint $7.5 million. the company also has to create a plan to make sure it follows sec requirements in the future and update regulators over the next two years. turning now to a microclimate forecast. let's take a live look outside right now at palo alto. traffic picking up just a little

bit. we'll check in with mike in just a moment. first get to meteorologist christina loren. >> happy tuesday. taking a live look here over emeryville. an area of low pressure on the way today and active weather as a result. now, temperatures this morning are pretty chilly, cool enough out there for a coat or a jacket. 55 degrees to kick off the day in san francisco. i want to show you what's happening just to our east. we've got a lot of thunderstorms developing. and we are fair game for a couple isolated thunderstorms today as well. as this front comes through the bay area. best chance is going to be over the higher elevations, the western-facing slopes surrounding san jose and the east bay hills. this morning you don't need to grab your umbrella keep in mind we could see thunderstorms and gusty wind is expected as we head throughout the day today. so, let's take it right to your futurecast. stop the clock at 9:00 a.m. and little bit of shower activity very light and mostly in the south bay at that point. by 2:00 p.m. that activity moves

to the north bay as the front comes through. it will kind of drag to the east and as it does so it brings in that threat for some thunderstorms. the best chance for today is going to be over the east bay hills. you have about a 30% chance for that. meanwhile 20% chance here in the south bay over our high elevations. now, as we get into that weekend, temperatures will climb and feel like summertime for the unofficial kick off as we get into memorial day. we'll look at that forecast coming up a little bit later and a lot going on across the bay area this weekend and we'll take a sneak peek at some of those event and right now send it back to you, scott and laura. >> thanks, christina. new this morning, oscar pistorius will get a break from the courtroom as he begins a psychiatric investigation at a state hospital next week. a judge issued that ruling earlier today and postponed court proceedings until the end of june. he will be allowed to leave the facility at the end of every day. the evaluation will last no longer than 30 days and be completed as soon as a panel of

mental health exports finish a report for the court. the former olympian is on trial for the murder of his girlfriend. satellite data used in the search for missing malaysian plane could be made public soon. it will release the data after an outcry from some of the family members of the passengers. the families want to use the raw data to conduct independent analysis. the malaysian government says calculations using specific data show the plane ended up in the indian ocean after it vanished in march while flying from kuala lumpur to beijing. thailand's army declared law this morning. the move is to provide safety to the people and denies it is the beginning of a military crew. nearly 30 people have been killed since protests began in november and the military said it took charge of public security to prevent more deaths. ordered anti-government

protesters to remain in their camps to prevent more clashes. the army also ordered ten tv channels to stop broadcasting. paul mccartney has canceled more shows in japan because of an illness. he got sick last week and canceled several performances early and his doctors are ordering him to take a complete rest. fans get their money back. in a statement he thanks his fans for the support and understanding. he's still expected to perform all his shows scheduled in the united states, including the last concert ever at candlestick in august. >> maybe he got what i have because i can't shake it. still ahead on "today in the bay" history at the u.s. open with the bay area tie. we'll introduce you to the youngest player ever to qualify for that tournament. oh, my, this early hour a lot of traffic on the east shore freeway and it's made a little slower a lot slower because you only have half a freeway right now. show you our bigger view of this and what's developing, coming up.

in the nba. the former player has spent the last four years in the broadcast booth and also serves as the general manager of the suns. he also won several titles as a player alongside michael jordan. california chrome set to arrive in new york today breathing strip and all. with a triple crown on the line, the chestnut will spend the next couple weeks preparing for the belmont stakes. yesterday new york officials ruled he could wear his nasal strip during the june 7th race. the strips were banned in previous races. if california chrome wins he will be the first horse to win the kentucky derby, preakness and stakes since 1978. well, young redwood city girl will make history when she tees off at the u.s. women's open next month. >> the youngest player to qualify for the tournament. last month she beat out the competition winning the
