i'm scott mcgrew. >> i'm laura garcia-cannon. police questioning a driver who hit a pedestrian at a gas station pinning him underneath his car. the crash happened near 24th and gary in the outer richmond district. christie smith joins us live in san francisco and christie, depite td despite the horrifying scene, the victim will survive. >> we did get an update from san francisco police and they are telling us despite a very serious head injury, this man is still in critical condition but it does appear he is going to survive his injuries after being trapped under that car that you see right there. now, police are telling us the information they're now getting is that this man may have been milling around this gas station overnight before this accident. and got into some sort of exchange with two men who arrived here in that same car at about 3:30 this morning. they came here because they had a flat tire. this is on 24th and erie, a

chevron station. here's where it gets confusing. police say for some reason they can't explain, this man actually laid down near the car. >> him and the passenger were attempting to change the tire of the vehicle. and at that point the victim had some interaction with both the driver and the passenger of the vehicle. i'm not sure what the interaction was. >> now, investigators did detain that driver and actually the driver was conferenrontational him this morning and also check his blood levels to see if alcohol was a factor. another thing they're doing they have taken surveillance video from the front and that will shed some light on exactly how this happened and how this man's head and what they're thinking

the car rolls and, again, they're thinking this tape that they get from here will clear a lot of these questions up. reporting live in san francisco, christie smith, "today in the bay." >> thank you very much. opening statements are expected today in bryan stow's civil suit against the l.a. dodgers. comes two days after questioning potential jurors. "today in the bay" peggy bunker here with the details. put the jurors through pages of questions, peggy. >> they want to know any sort of alliances. these potential jurors really had to answer honestly if they were dodger fans, if they could be possibly impartial when it came to well-known frank mccourt and his former baseball team. stow's civil suit against the l.a. dodgers and mccourt all begins today. the ground is that the dodgers did not provide enough security or adequate lighting at the game. a former paramedic and father to two suffered brain damage during that beating and permanently disabled. you see him here arriving in a

wheelchair for a jury selection. he did stay throughout that selection process. $50 million is how much his attorney said his past and future medical bills after being nearly to death on opening day all because of his giants jersey. what has happened to him is tragic. >> to see this young, vibrant, you know, person who lived his life helping people as a paramedic and now all of a sudden can't get out of the wheelchair by himself. this wasn't a big sympathy play or anything like that, but this was the jury has to understand what this whole case is all about. >> the two men that beat stow pleaded guilty to the attack in criminal court earlier this year. as for the jury, eight men, eight women have been selected. they include an attorney, a school bus driver, a nurse, a journalist and a mail carrier among others. first on the stand this morning will be stow's mother, ann, who has been care taking for her son now for three years. lawyers representing the dodgers say that l.a. police provided a

huge security force at that game. however, witnesses report seeing no security guards in that parking lot where stow was attacked. so, that all gets under way today and we'll be watching it very closely, scott. now to an nbc news exclusive. edward snowden speaking in his first sit-down interview on american television. snowden sat down with brian williams in moscow. stole secrets from the nsa and released them to the media. william showed snowden the cell phone and what can intelligence agencies do with information connected on that phone? >> any intelligence service in the world that has significant funding and a real technological research team can own that phone the minute it connect to your network. the minute you turn it on it can be theirs. they can turn it into a microphone and take pictures off of it. it's important to understand that these things are typically done on a targeted basis.

temperatures will be warmer. upper 80s out in the tri-valley and those look like the warmest regions. your microclimate showing the separation. we are getting into the time of year where we have a 20 it grde difference. for today, going to be warm and then onshore flow increases and going to keep our temperatures at bay for tomorrow. taking a live look here. now, this is from the east bay. i want to show you this shot. mike helped me set it up this morning. you can see all the way to san francisco this morning. just a little bit of haze out there to start the day, but no low clouds to point out. mostly in the 50s. 56 in san jose and 55 for oakland and all the uniform numbers out there even with that clear sky and a storm system just to our north and for today mostly sunny condition means rapid warming all the way through about 11:00 until 2:00 p.m. and then as we get into tonight, those low clouds will return and this will drop your temperatures by about ten degrees for tomorrow. so, for today, upper 80s and

this is it. 84 for the south bay and peninsula is at 81 degrees and 70 in san francisco and the 50s return over the weekend in the city by the bay. we'll talk about that coming up right now and send it back to you, scott, laura and mike. >> mike joins us on set right now with a look at that morning commute picking up out there. >> it is. a tougher drive a few minutes ago. oakland to 880. a look here past the coliseum. interesting as we hit 6:09 and getting better for the nimitz. that is the cantor sign folks know about. partial blockage by a fire crew because of a fender bender earlier. a pause as fire crews direct you around. if that's your off ramp, expect slowing off the southbound side. heading up towards 16th where there was an earlier crash and blocked a couple lanes and had a big backup and cleared past the embarcadero heading through downtown. we'll see for more slowing as folks hit the roadway there.

it happened at a gas station. firefighter husband to use a jack to rescue the man. he suffered a serious head injury but expected to survive. the driver and passenger of the car are being interviewed by police. students and staff will hold a vigil to honor george chen, one of the young men killed in friday's attack near uc santa barbara. chen graduated from leyland two years ago. the vigil starts at 8:30 tonight. a train engineer and conductor are recovering this morning after a train derailed on staten island. transportation officials say a train car went off the tracks after hitting a bumping block. no passengers were onboard. crews plan to take advantage of friendlier weather today as they battle a wildfire burning near yosemite. cooler temperatures and weaker winds are expected. the fire started monday and burned down two homes and about 680 acres. evacuation orders were lifted for about 50 people. twice as many were ordered to leave when the fire broke out.

nearly 700 firefighters are working on that fire. five of them have been hurt but they're going to be okay. right now the fire about 40% contained. australian agency says the missing malaysian jetliner is not in the area where they thought it would be. the area in the southern indian ocean where crews just wrapped up and expanded search based on the plane's possible route. now, the australian agency leading the search says the pings detected in that area were probably from a ship and not the plane's black box. no sign of the plane since it disappeared in early march. a special town hall meeting will be held to explain 860 allowing immigrants to apply for driver's license. on first street in san francisco will run from 6:00 to 8:00 tonight. the bill goes into effect next year. explains what people should expect when applying and what documents they're going noo need. what should you expect when

kick off a thursday and 87 degrees that is warm out there at the north bay and lots of sunshine right off the bat and temperatures will be warmer, noticeably warmer than yesterday. this is going to be the warmest, though. no more climbing after this. peak warm for today low clouds return late and by the time you start to make your way home from work you notice low clouds thickening up and temps will tumble as a result of that onshore flow by about six to ten degrees cooler for tomorrow and then the weekend temperatures looking pretty mild on saturday and a warmer day on sunday. that's why i want to show you your beach conditions because this always makes it easier to get through the workweek when you know what's coming your way this weekend. up to 80 degrees in santa cruz and 68 degrees comfortable conditions even in point reyes and also tell you what happened across the bay area this weekend. right now let's check your drive and here's mike inouye. >> coming into the greater bay

area. right here as we come out of livermore and into dublin, a good volume but steady flow and good spacing as you get closer to our camera point there. look that maps and see typical pattern for the tri-valley here slowing in through livermore and dublin b.a.r.t. station moving very smoothly and folks making that bend and heading south into pleasanton heading through sunol, as well. past highway 84 where you're joining us with that traffic that did cut through livermore. a smooth flow of traffic, as well. over here in the castro valley and typical pattern there. the earlier slow downs from both directions past the coliseum where there is a 12:35 game by the way. let's get a live look out at the coliseum where we see the southbound side and folks are backing up and ten cars at a time at the most as they try to make their way past a fire crew, which is still taking care of any smashed up car over on the side of the off ramp and very narrow there because of construction barricades, as well.

belongings. the snoop youth football league. special guests include former san francisco mayor willy brown, rapper mc hammer and hall of famer ronnie lott and all going on. 6:20, this morning a man is behind bars after attacking actor brad pitt. these were photos taken after the attack during angelina jolie's movie. witnesses say the man jumped a barrier on to the red carpet and struck pitt in the face. security took that man into custody. pitt was reportedly okay after the attack. but this is interesting, the suspect apparently has a history of pulling pranks on hollywood stars according to "l.a. times" earlier this month at the film festival in france when he crawled under furara's dress and grabbed bradley cooper around the leg and had a run in with

stars in 2013 and in 2012 he reportedly kissed will smith at the moscow premiere of "men in black 3." a southern california city officially dropped its fight against the maker of the popular hot sauce, sriracha. voting last night to drop the public nuisance declaration and lawsuit against the city initially issued that declaration after residents started complaining about spicy odors burning their throats and eyes and coming from the factory there. the sriracha maker said it fixed the problem but began in august. we'll find out. took just over ten hours for a kick starter campaign to go to over $1 million in funds. >> $$400 for that. that's the campaign backers burton and wolf celebrating the milestone as it happened. burton is a well-known host of

online surveillance. >> how can it be said that when all three branches of government have made reforms as a result of this. >> reporter: for now no out for snowden. even after this interview secretary of state john kerry called him a traitor. snowden insists he did the right thing. >> what is right is not the same what is legal. sometimes to do the right thing you have to break a law. i may have lost my ability to travel, but i've gained the ability to go to sleep at night. >> reporter: well, that is his story. it is not the story of the u.s. government. they, obviously, disagree. john kerry was very upset about that yesterday and spoke out about it and in terms of what happened next for him clemency the u.s. government says is off the table. at some point he has to face the charges, if he comes back to the united states. >> right, so interesting to see what happens next. thanks a lot, tracie. much like snowden a bay area

man blew the whistle on spying a decade ago. back in 2003 he worked as a san francisco-based at&t technician. he installed the splitter that sent copies of to a secret room on market street set up by the nsa. he said he knew it was illegal at the time and kept company documents after retiring in 2004. these became known as the bush-era wiretaps. he told the story two years later and he said he's relieved another person could back up his story with actual government documents. >> when he came out i was delighted. it was an indication for what i was saying. it also revealed the programs that we're doing are vastly bigger than even i understood at the time. >> klein says the united states should let snowden come home. >> snowden should get retroactive immunity and be given a reward for his service

look at the sensors this is what we're talking about the arrows northbound 87 and 101 where you see the orange on the map and just a couple seconds ago and that's your typical build for the south bay. 85 and 280 as you approach 17 or 88 respectively. the peninsula over on the left, no delays there for 101 or 280 into or out of san francisco and along san mateo and palo alto. tri-valley building since early in the morning and pleasanton and sunol where you join up with the folks from 84 and slow you down towards fremont and southbound off of 238 and san leandro and hayward and the approach towards the san ma tte and dounbarton. cleared to the shoulder westbound as you approach richmond and in towards the berkeley area and the maze itself, a good slow down there and we'll get a live look out there and an illustration of why

and an update to breaking news. san francisco police say a man who was struck by a car pinned underneath is going to survive, despite suffering very serious head injuries. this crash happened overnight at a gas station near 24th and geary in the outer richmond. christie smith joins us live in san francisco.

christie, investigators say the victim and the driver may have had a conferenrontation before crash. >> we definitely know there was an exchange of words, but the latest information we have is that the gas station is back open after a very serious and unusual accident that happened overnight. there was an exchange of words between two men who were here changing a tire and another man who was already here and that man ended up with his head trapped underneath their car. it happened about 3:30 this morning. that car just towed out about 20 minutes ago from the chevron station at 24th and geary. where police say the two men roll under to the station because their front tire blew out. they were going to try to change it. those men got into exchange of words with another man who was milling around the gas station earlier. for some reason, and here's where it gets odd, police say the man actually lay down near that car which hit him and he was trapped under it. >> so, when the fire department showed up, he was lodged

underneath the tire. so, in order to free his head, it was imperative that they hoist the rear end of the vehicle in order to free his head from underneath the tire. >> so, that man was taken to the hospital, listed in critical condition, but the good news we're told he will survive. what police are telling us is that the driver in this was actually confrontational and not very helpful at all. he was detained. they say his blood alcohol will be tested at the hospital. another thing they're going to do to try to clear all this up is they say they've taken surveillance tape from the station and they're going to have a look at that and try and get more clarification on exactly how this accident occurred. reporting live in san francisco, christie smith, "today in the bay." >> very strange. it's 6:46 right now. time to check the forecast and take a peek outside. taking a look up at the sun over

the bay area. christina joins us with a look at that microclimate forecast for you. >> close to the weekend, fabulous conditions and a lot happening across this big, beautiful bay area for both saturday and sunday and some free events. we'll show you one of those right now. as we get into your afternoon for today warm conditions, in fact, today will be the warmest of the week feeling like summertime out there in some cities with the upper 80s on the way. but you can see from this mostly clear start over san jose the sun is up and will stay up through 8:23 in the south bay. as we head throughout the day today, look at this nice, clear start from emeryville and not so choppy on the bay and you can see all the way from emeryville with a lack of low clouds to start the day and temperatures are chilly enough for a coat, something you can ditch later on. we're in the 50s for now and headed towards the upper 70s. by lunchtime, you want to peel off that first layer and 83 degrees the forecasted high and 87 and east bay 87 degrees in

the north bay. that's a warm temperature for you and definitely noticeably warmer than yesterday. let's take you through the changes as you get through the next couple days. cooling clouds will return as of tonight. six to ten degree dropoff and hold on to that seasonal, mild pattern as we get into both saturday and for the first part of sunday it will be nice and then a little bit warm. might be a great day to make those beach plans. take a look at where we're headed both saturday and sunday and comfortable levels for you and five degree warm up for saturday and sunday and mid-70s in the south bay to the low 80s on sunday. talking about free events in berkeley. 71 degrees the chocolate and chalk art festival. comfortable conditions free for you and the family and 10:00 a.m. to 5:00 p.m. and bring your chalk out there and enjoy and, remember, the kids will muck up their nice clothes, right, mike? >> we call that artistic expression in our house and my kids really express themselves a lot sometimes.

"today in the bay" peggy bunker joins us with the details. his attorney says stow's medical bills are no doubt in the millions of dollars. >> a staggering sum. stow's attorney estimates that bryan's fast and future care could reach $50 million. they want the l.a. dodgers and former owner frank mccourt to pay up. civil suit against the dodgers and mccourt begins today after two days of grilling potential jurors about their alliances to the dodgers. the grounds for the civil suit states they didn't provide enough security or adequate lighting at the game.

stow, a former santa cruz paramedic and father to two, suffered brain damage during that beating. he is permanently disabled. you see him arriving here at the jury selection proceedings at his wheelchair and his attorney said he's not aware and what happened to bryan is tragic. >> to see this young, vibrant, you know, person who lived his life helping people as a paramedic now all of a sudden you can't get out of the wheelchair by himself. this wasn't a big sympathy play or anything like that. but this was the jury has to understand, you know, what this whole case is all about. >> now, the two men that beat stow pleaded guilty to that attack in criminal court earlier this year. as for the jury, after completing pages of questionnaires about topics like their own experiences at dodger stadium and opinions about responsible drinking, eight men, eight women were selected for the jury. they include an attorney, a school bus driver, a nurse, a journalist and a mail carrier. first on the stand today, though, will be stow's mother
