it underwent major renovations recently and this morning mayor chuck reid, supervisor dave cortez among the guests at the grand store opening here. about 700 people expected today, special deals to be had at this. the address 377 royal avenue and looks like it's going to be a beautiful day to go check out the new orchard supply hardware in san jose. good morning and thank you for joining us. this saturday, may, 31st, i'm vicky nguyen. right to your forecast. meteorologist anthony slaughter is here. good morning. >> good morning, vicky. ed glad to have you this morning. waking up to clouds and drizzle at the coastline. let's start you off from the east bay and emeryville looking at san francisco and you can barely make out the city because of all the low clouds and fog hugging the coastline. after about 11:00 we will see sunshine but notice the temperatures 50 degrees in the north bay so definitely need a jacket. even in the peninsula where we're starting to see a little bit of sunshine, you can see

that marin layer, very thick this morning. it will take a little bit before this fog and drizzle burns off. as we mentioned we are talking about a nice day. we have such a lovely week across the bay. another picture perfect day headed our way. a little cool at the coast, 64 in san francisco, youl notice a slew of 80s and 70s for our inland valleys today. vicky, tomorrow temperatures go up and perfect beach weather in the forecast. we'll talk more about that coming up in the full forecast. >> fantastic. thank you. new video to show you police are conducting an investigation after a shooting in san jose last night. nbc cameras were the only one on the scene. it happened just before 10:00 on rocky mountain road. police say a man was shot in the chest and rushed to the hospital. the condition of the man is not known this morning but officers are still searching for suspects. b.a.r.t is back in service this morning after a major part of the system was shut down for nearly two hours. a person was hit and killed by a

b.a.r.t train at the west oakland station shortly before 10:15 last night. officials say that person was walking in a restricted area along the tracks. all trains were stopped at the tube between west oakland and embarcadero stations. service just started back up after midnight. a bizarre attack at an east bay school. a 9-year-old lured into the bathroom and then beaten with a hammer. police say her attacker is the mother of another child at that same school. that mother is behind bars this morning. it happened yesterday morning at lafayette elementary school in oakland. a district spokesperson says the little girl was beaten during recess. when the girl's teacher noticed she didn't return to class, they immediately called a security guard and searched for her. eventually they found that 9-year-old girl leaving the bathroom with the suspected attacker. that mother has a daughter in the second grade at lafayette. the district spokesperson says the suspect is a well-known volunteer at the school and

comes there frequently so her appearance did not raise any red flags. >> our speculation at this time and this is based on very early investigation, there was a feud between two families and this was an act of vengeance or to punish the rival family. >> it was a happens you event really where a parent betrayed the trust of the community during a time when the students were at recess out on the play yard. >> the woman was arrested at the scene. police say the girl was taken to the hospital but she is expected to recover from nonlife threatening injuries. yesterday's school attack is the fourth reported assault on a student in the bay area this month. thursday a man climbeden to a school bus in richmond and accused students of bullying his 8-year-old son. that man allegedly picked one boy up and pushed him against the side of the bus. also in the east bay a security guard at oakland high school fired and charged with felony child abuse after repeatedly punching a student in a

wheelchair. surveillance video shows the guard hitting the boy who had cerebral palsy and then dumping him on to the ground. the school resource officer told police the boy spit at him. this month a mother in santa rosa accused of choking a boy she confronted about bullying her daughter. the woman's lawyer says another student saw the boy choke himself to create red marks on his neck. that mother has not been charged with a crime. the santa barbara sheriff's department has launched an internal investigation into the actions of deputies before last week's rampage that killed six usc students. earlier we told you that deputies knew about el lodge rogers disturbing youtube videos three weeks before the attack. the videos prompted a well fare check on the 22-year-old. the investigation going on right now in that police department will look at why deputies only asked roger about the videos and did not watch them or take further action. the shootings in santa

barbara prompted a call for action in the bay area, a call to stop violence against women. suspect elliott roger proclaimed his hatred for women before carrying out his plan to kill as many as he could. after the shooting the #yesallwomen appeared on twitter. it is now exploding with tweets describing how women fear men and worse. >> this has struck a really deep cord in the hearts and minds of many, many women and men who have a hunch that this is a larger societal problem. >> most women i know, you know, they do, they fear being raped all the time, just walking in the city at night. that's something i don't have to think about at all. >> hopefully this is a wake upcall this guy felt this sense of entitlement. >> san francisco was one of a handful of cities across the country where these rallies took place. a game changer for transgender health care.

the obama administration ended a decade's long ban on coverage for sex change surgeries. the change comes from the department of health and human services. today's ruling recognizes the procedures as medically necessary for some people who do not identify with their biological sex. this means transgenders who receive medicare may no longer be automatically denied coverage. their request will be reviewed like any other medical treatment. >> because it's medically necessary care. it enhances quality of life. it makes you feel on an equal playing field as someone else. >> the decision was prompted by an administrative challenge brought on last year by a 74-year-old army veteran whose doctor recommended that gender change surgery. the national park service has a new task, finding places of significance to lgbt americans. interior secretary sally july made the announcement at new

you are watching "today in the bay." welcome back. time now 7:11. taking a live look outside at dublin from our sky camera network. sun just coming up right there and looking to be quite a beautiful day and what a lovely shot here. this is the south bay as the sun peaks through the clouds. meteorologist anthony slaughter will be here to tell you how to dress for the rest of your saturday. but now let's get to the news. an unusual push to get out the vote. south bay pot dispensaries offering free marijuana for people who participate in next week's primary. voter turnout is expected to be extremely low for tuesday's election, but organizers of this pot for votes effort think they can provide some incentive. "today in the bay's" nannette miranda tells us how. >> reporter: at medical marijuana dispensaries across

the bay flyers are urging people to vote in this tuesday's primary electionion. as an incentive many are giving away free or discounted pot to patients who prove they voted. >> a lot of people don't know about the primary elections. we have some important races including the mayoral race and we want to make sure that politicians understand the power of our voters. >> reporter: no medical marijuana regulations are on the ballot but the cannibis coalition fills with so many vacant seats this is the right chance to get the right people in. the u.s. election code forbids giving something away in exchange for voting. the hot congressional race between mike honda and ro khanna suggests the free weed is illegal. >> there may be federal issues, but there's also federal issues providing cannabis, so, you know, it's kind of one of those gray areas. >> yeah. but you're still going to do it anyw

anyway. >> reporter: in that case some patients say no need to hide anymore and the free or discounted weed is going to get them to the polls. >> yes, it is. it gives me motivation to know that the cannabis clubs are getting well known out in the public. >> reporter: some members of the public feel the free weed is unethical, but it's the political system we live in. >> i feel that it's just the same as any lobbyist out there, buying a vote, except this one is a little more blatant. >> reporter: a low voter turnout is expected so the offer could bring out more people and sway close races. in san jose, nannette miranda, nbc bay area news. the city council has been talking about news rules for medical marijuana dispensaries. leaders considering a drastic cut to the number of dispensaries limiting them to 20. right now there are more than 100 open in san jose. council members are considering creating a buffer zone around day cares and schools and requiring dispensaries only sell marijuana that they've grown

on-site. meanwhile, the city of san jose is getting some relief from years of city budget cuts. the details are in mayor chuck reed's newly released june budget message. increased revenues will pay for added public safety. the upcoming budget will allow a third police academy for the year and the hiring of another seven community service officers. those are civilians who provide administrative support, freeing police to patrol and investigate. increased funds for gang prevention and intervention also in that message. the budget will also allocate nearly $50 million for pavement repair. that's the first time this issue has been addressed in a decade. much more ahead on "today in the bay," coming up mark zuckerberg makes a huge donation to education. why there are concerns how that money will be spend. >> moving up to lots of clouds and fog, even in san francisco, but we are expecting lots of sunshine this afternoon and a much warmer day for tomorrow. the full details on your weekend forecast coming up in just a

. you are watching "today in the bay." good morning. time now is 7:17. this saturday morning. taking a live look outside at san rafael north of the golden gate bridge. a little bit of cloud cover and fog and anthony slaughter will be by to tell us when those clouds are going to be lifting up and providing some sunshine and there we are on the peninsula. taking a live look out at palo alto where things are expected to be a bit warmer this saturday. well, a huge donation to help bay area schools from the founder of facebook. $120 million. but some are not liking the donation and warning the money might not equal results. those critics point to newark, new jersey where many say a similar donation from zuckerberg hasn't done much. will this be different? our business and tech reporter scott budman checks it out. >> reporter: the first $5 million is earmarked to come

here to the ravens wood school district where some of the spoils of being a technology leader will be used fittingly to improve the technology. >> i assumed that our district would have laptops and computers and wonderful internet access because we're in the silicon valley coming in, and that's what i thought. i found out that actually there are pockets where there is no connectivity. >> all the ideas that really resonate. >> reporter: mark zuckerberg and his wife priscilla chan will give $120 million to the school in their backyard. >> the bay area is our home. we've seen firsthand that the quality of education, it really varies in our area from the highest performing schools to the most underserved schools. >> reporter: but when it comes to education, more money doesn't always equal more success. >> the devil is ultimately in the details, right? stacey boyd runs school.com.

limiting the sunshine, even in san francisco where you can barely make out the buildings. see here right now visibility really reduced. less than eight miles. so once you wake up and get outside you'll notice the cloud and the fog activity, but you know what later on this afternoon we will see sunshine as we head through the day, temperatures today inland will be the warmest, 70s and 80s there. notice in san francisco today, only 64 degrees. so yeah, that's jacket weather as we head through the rest of this afternoon. you know what if you're trying to hit some of the area beaches tomorrow looks to be one of the better days because we're going to see warmer temperatures. for today looks like temperatures will still be very nice even for our inland locations from morgan hill to sair toe fwa back into the 80s there, san jose 77, the peninsula from san mateo towards palo alto mix of low to mid 70s from 73 to 78 and san francisco as i mentioned will be chilly today, so definitely not the best beach day, but we have better weather coming tomorrow if you are trying to hit the beach.

83 san jota rosa, walnut creek,, and livermore 82 degrees. as i mentioned we are talking about those beaches as we kick can off the summer tomorrow being june, so if you are trying to make plans to head to the beach looks like it's going to be chilly to date with 62 in point ray, 64 ocean beach, santa cruz nice at 75, but for tomorrow look at how the temperatures jump. we're talking about close to 80 in santa cruz so may be planning to take the kids to the beach there, ocean beach at 72. a little warmer but not overly warm for this time of year. our average high at coast is right around 70. we're going to stay put as we head through the next couple of days. the future cast does show we are talking about fog and drizzle returning as we head towards monday. tomorrow will be a warm bright day, not expecting as much fog as we're looking at this morning but but monday and tuesday notice how the marine layer stays against the coastline even through the afternoon hours for places like san francisco. so while we'll be nice and sunny today and tomorrow, monday and

tuesday more cloud cover does return and even drizzle detected on our future cast through monday and tuesday morning for the coastline. so just keep that in mind as you get ready for your commute and, of course, for the next work week. for today and tomorrow look at the jump. in the 70s for today. but back into the 80s for tomorrow. so as i mentioned tomorrow a better beach day even for our inland valleys. maybe want to hit the pool. a dramatic dropoff with the cloud and fog we're expecting from monday and tuesday. about a 10 degree drop from sunday to monday. 70s return for places like san jose, low 70s. we're talking jacket weather by monday and tuesday. as we head through wednesday, thursday and friday of this upcoming week does look like temperatures start to warm so as we head intop june, get a little bit of june gloom for the first half but at least the afternoon sunshine towards the latter part of the day. >> seeing a lot of the micro climates as you mentioned, 60s to 80s. thank you. >> much more ahead on "today in the bay." coming up they have spent two weeks on top of a san jose

"today in the bay's" garvin thomas has the latest installment of our bay area proud series. >> reporter: of all the places in the city of san jose to hold a party, the roof of the parking garage at the corner of south fourth and east san fernando might seem less than desirable to most people, yet completely logical to these people. >> wish they'd come out and fly. >> reporter: for jodi and more than a dozen volunteers like her, over the past two weeks this spot has been their home away from home, while keeping a

garden before june comes around the corner tomorrow. good morning and thank you so much for joining us. i'm vicky nguyen. right to your forecast now with meteorologist anthony slaughter. gardening weather? >> yeah. at least the afternoon hours, it's funny because here in the bay area we're used to the june groom we typically see as you were hinting at and looking at it now and this is going to be the status at least each and every morning for the next few days as we get into june. the onshore breeze kicking in. unfortunately, no rain in the forecast in the short term but the drizzle and fog will be with us as i mentioned and see temperatures are cool, definitely need a light jacket, 50 degrees in the north bay but notice in the south bay we're already starting to clear out. we have the low clouds even the fog holding on tightly in the highs will be comfortable from 77 in the south bay to the peninsula just a degree cooler. san francisco only topping out in the 60s for today. and i want to take you into the south bay. this what is we're going to be looking even in san jose each and every morning, at least through the upcoming week. notice temperatures are expected to warm quite a bit tomorrow.

the two workers were riding in a basket over a new bridge span when that basket suddenly fell nearly eight stories. according to investigators, a hook that secured the lift failed and that caused the basket to fall. the burrelling game firm construction has been working on the bridge since september. the identities of the victims have not been released. one man is from richmond. new this morning, u.s. military officials have deployed a pair of surveillance drones over japan for the first time. the global hawks have a wing span of about 130 feet and they fly much higher than commercial jets. the u.s. military will operate the drones at the air base in northeastern japan from june through october. they say a global hawk can observe the surface of the earth from an altitude of more than 49,000 feet using high performance infrared sensors. >> more advanced capability ps in japan such as the global hawk has strategic significance in

further contributes to the security of japan in the region. >> staff on the u.s. mainland will perform most of the remote controlled operations while misawa personnel control takeoffs and landings. federal investigators are looking into a possible insider trading scheme involver golfer phil mickelson, investor carl icahn and a las vegas gambler. tomorrow. we were talking about the fog and drizzle this morning. tomorrow we're expecting the same thing for the escape from alcatraz triathlon. it's it's going to be cold for the swim at 54 degrees at 7:00, 8:00 temperatures only go up a couple degrees. fog and clouds will hold on for the bike part of the race and then for the run by 9:00 in the morning, 58 degrees and again you'll notice the cloudy skies will be with us at least until about 11:00 in the morning for today and again for tomorrow for that matter. you can see as we look from our sky camera perspective we are starting to see sun in palo alto from the peninsula towards the east bay but san francisco as we were talking about a minute ago still shrouded with cloud cover and this is going to be the way it looks all the way until about 11:00 this morning. this afternoon temperatures do warm but not a whole lot at the coast. only 60s today in san francisco, but you'll notice away from the water inland valleys back in the 70s, even a few 80s near the tri-valley and up in the north

>> you are watching "today in the bay." >> it's a national debate playing out here in california. for the first time in state history, we have a law that tracks and regulates the practice of fracking. a law that follows a series of our investigations but six months after that law took effect we ask, is it being enforced? investigative reporter steven stock looked at the numbers. >> under the new law the state of california is supposed to make lots of data about fracking wells available to the public to keep us all better informed. but six months since that law first took effect we discovered it's not quite working out that way. at first glance st. andrews gardens apartments in l.a. appears like just about any other neighborhood in california. >> the only barrier between this particular site and our apartment units is this wall. >> reporter: but beyond the

krindser block wall behind the tarp don martin only recently discovered a drilling operation was using hydrochloric acid. >> we have a right to know what's going on in our backyard. >> reporter: six months ago a state law called sb-4 took effect which was supposed to require all oil and gas companies to notify neighbors about oil well stimulation such as fracking or the use of acid. sb-4 required the state to post a list of all fracked and stimulated wells on its website within 60 days. >> it angers me. because first of all, we weren't informed that there were chemicals on this particular location. >> reporter: and an investigation by nbc bay area has discovered just as much public confusion and uncertainty over what wells are being fracked or acidized as before sb-4 took effect. we found wells like this one, or this one, both located in kern county where fracking occurred, but so far the fracking has not been reported on the state's

website. >> basically communities across california are being kept in the dark. >> reporter: holland is an attorney with the center for biological diversity, environmental group calling for a halt to all fracking operations in california. >> fracking is a dangerous practice and to not know where it's happening or how frequently, that's a huge concern. >> reporter: analyzed state, local and industry data comparing the state's fracking website with the industry's voluntary fracking website frack focus and found discrepancies. we independently verified those discrepancies and found 77 wells out of a total of 116 that had been voluntarily published on the private site fracfocus. all 77 as of may 20th had not been posted on the state's website. we also found 62 wells where local air quality management records show that hydrochloric acid was used. those wells don't show up on the state's website either.

as you see here we mapped all of those wells on our website. >> the bottom line is these regulations aren't working. they aren't keeping communities safe from the dangers of fracking. >> i would say they aren't properly informed as to where we're at. we are hitting the marks. >> jason marshal the chief deputy director of convervation. >> when i see 77 more on frac focus than on this website that's not through intent or the state dragging its feet or trying to be slow in this process. >> not at all. we are working diligently as the operators reporting that stuff on frac focus we're getting information they need to give us, because there's additional information so we can link that up and post it on our site and we're given two weeks, 15 days to do that. >> sb-4 is still a new law so it doesn't happen overnight. >> reporter: state senator mark leno cosponsored sb 4. >> are you happy with the results that very little has been done for sb 4? >> i'm concerned. it only reinforces why we should

consider a moratorium until we gather the information that's required in sb 4. >> isn't that the whole point of sb 4 to make sure the public gets to see what's really going on? >> it absolutely is the point. >> reporter: marshal insists the state is complying with the law as currently written. >> one of the crepe trol premises of senate bill 4 is to increase transparency. again we cannot impose some additional reporting requirement on operators. >> starting to be a concern about our health and safety. >> reporter: don martin says he and his fellow residents wished they knew more about what was going on behind that tarp. >> in order to protect the residents here it needs to be enforced. and that's part of the problem. the lack of enforcement. >> since we began our investigation the state has updated its website but it still does not have the exact number of fracked wells that are listed on the industry's frack focus site. find all the wells on our website as well. the department of conservation does admit the law could be
