kris sanchez. laura garcia-cannon is off this morning. a bay area amber alert is over this morning. three young children were found overnight in the east bay. the children are safe, but police are still trying to figure out who killed their father in the backyard of their san pablo home. stefy trang is live in richmond and we know the kids are safe, that is just half of the story, though. >> exactly, kris. a lot of questions in the air. the good news, as you mentioned, police found the three kids safe along with their mom somewhere here in richmond although investigators haven't released any other specific details and a lot of questions since the amber alert went out last night that's when police warned people to look out for this woman, alicia ortez. police had reported that she abducted her three kids ages 2, 6 and 12 from the san pablo house where they lived with their father on the 1600 barak on 16th street.

police found him shot dead in his backyard around 8:00 yesterday morning. investigators have not released his name, but we did speak with his friend who described the victim as a mechanic who was always seen with his kids, a good dad and a good friend. >> sometimes we go to parties, sort of like, you know, birthday parties and like that. we are friends. >> a black audi believed to be the victim's was outside the house. inside you could see a pink princess backpack. now, as for ortez, the mom, police say she does not have a permanent home and she is a transient who spends her time in san pablo and richmond. police have not, however, named her as a suspect in the homicide. they haven't named anybody as a suspect or paern of interest. police expected to give an update later this morning, we'll have the information then. the good news this morning, the

three kids found safe and sound. >> very tough ordeal for them, thank you, stephanie. new this morning, a federal report shows an alarming trend at american universities reported sex crimes went up in the last decade even as overall campus crime went down. the education department says 3,300 forcible sex offenses were reported on college campuses in 2011, compared to just 2,200 in 2001. we did the math, 51% increase. now, this report comes as more women are calling for sexual assault policies. lia francis called for a review of the school's policies. she said earlier this year she was assaulted off campus by someone who also attends the university. the man was suspended and ordered to complete 40 hours of community service, but still was allowed to graduate on time and return to stanford for grad school. stanford says it cannot comment on the issue. administrators at one south

bay high school are trying to figure out what to do about a racist remark that somehow made it into the yearbook. according to "mercury news" the yearbooks were distributed at monta vista high school that one caption had an, the last three letters of the person's name was purposely changed. there was no violent act so hard to file hate crime charges. the student was not threatened and no property was vandalized. a berkeley seismologist and b.a.r.t. will testify early this morning. this morning no word yet on what exactly they have to say but the subcommittee will closely examine the technology. the earthquake early warning system uses the technology to detect earthquakes right before they happen giving people enough time to protect themselves. e-cigarettes are taking center stage as leaders talk

about a new proposal to treat those devices just as they do traditional cigarettes. sarah benitez joins us from san jose where more on that. good morning. >> good morning, kris. they use cigarettes to heat and vaporize a nicotine solution and why they are banned on santa clara county property they may be banned in all public spaces. the board of supervisors will meet and decide whether or not e-cigarettes can be used in places like restaurants and bars and workplaces but it also includes banning their use within 30 feet of an entrance where smoking is already prohibited. the supervisor who is spearheading the effort is all he is trying to do is incorporate into a policy. tobacco is for those living in multi-unit residential buildings and that rule would not apply to the use of e-cigarettes. retailers are looking at paying

a retailer which would cost about $425 and generally retailers seem to be okay with that, but some who are opposed to the new policy, altogether because they believe the use of e-cigarettes is much more healthier than e-cigarettes and we'll have to see what the board of supervisors decided this morning. they are meeting around 9d:00 this morning where they decide whether e-cigarettes are banned in all public spaces. "today in the bay." >> thank you very much. city council will hear from the public today about whether to designate the historic domed theater in san jose as a city landmark. at past meters they decided to voice their opposition to the theater being torn down. it does not necessarily mean the theater will be preserved forever. just make it more difficult for developers to build something new in its place. nominated to historic register by the national park service and

that decision is exexpected next week. meteorologist christina loren joins us with a look at the forecast, you might be more popular today, christina. >> yeah, yeah, thanks for that reminder. check out my facebook page if you want to see what kris sanchez is talking about this morning. people do not love the heat in the bay area and the writing is all over my wall this morning. 58 degrees in san francisco to start. this is a product of yesterday's warmth. we are still holding on to some of that heat in the tri-valley. 63 degrees with completely clear sky out there. meanwhile, look at this, my friends. low clouds have returned and they span all the way down the east shore this morning. so, as we get that westernly flow today, that cool ocean low will be transferred all the way inland and you'll notice a ten degree dropoff and a 15-degree dropoff in some cases from yesterday. 56 degrees in san francisco and 90 degrees in the east bay down from 105 yesterday. one more warm day here in san

francisco and then temperatures fall right back to average. you got to pull out that jacket, again, as we head into the end of the week. we'll hold on to that heat in the tri-valley and cooler than yesterday. and we'll talk about that cool down and how we have really nice conditions for fathers like mike as we get into sunday. that's coming up. over to you for now. >> we'll take that. fathers like me or good fathers, as well. looking towards the area of the east shore freeway. i do my best, we all do. this is the best view of the roadway we can from our emeryville area. the glowing lights because of all the fog right here. christina is talking about how it's pushed down and it will be denser in some spots and then completely cleared in others and higher than you might expect for the high rises and, of course, we don't drive in the area. no slowing through that portion that you saw a smooth moving and coming down off the carquinez bridge and the earlier stall westbound 24 right around the caldecott tunnel and a

smooth drive here and no more slowing through oakland. we have a game tonight and we'll have a doover and fresh start for the giants. in the city, remember king street will close after the game. dublin interchange moving at speed and moving out of the altamont and this pattern nothing unusual for a tuesday except for lighter flow of traffic and that's great news. jump over towards the san mateo bridge and a clear view here westbound and there's the high rise and no problems to or from the peninsula along 101 and 23280 on the peninsula. you're at the limit, as well. getting back to the maps, smooth flow of traffic and from san francisco to the south bay without delay, south bay roadways a little slowing shows up but i checked it all out, 59, 58 and we're getting more folks hitting the roadways and always watching the roads and your rails, though. no major delays and muni with

a connecticut man who scammed cisco systems out of hundreds of thousands of dollars. he made false service requests to cisco and then report defective networking parts and receive a replacement part that he sold for money. skr cisco lost more than $800,000 in the scam. keep an eye on ebay stock after one of its key executives jumped ship. david marquez is leaving to take head of facebook marketing unit. his real passion is building products, which he says he was

not able to do at paypal. they will report to ebay ceo until a replacement is named. reid hastings is riding high this morning. just yesterday he beeat down a shareholder vote that would have challenged his role as chairholder and ceo. hastings is now a billionaire for the first time. also a stock to watch this morning, apple shares of the cupertino company jumped after that 7-1 stock split yesterday. that jump helped the s&p 500 to close at another record high. and for a look at the rest of the day's markets and what they're doing, we turn to seema mody live at cnbc world headquarters. good morning, seema. >> futures lower after stocks rallied for a fourth straight day on monday after the dow and s&p 500 hitting new record highs. 57 points away from 17,000. investors continue to weigh the strength of the economy and

touch cool down today. not to be a whiner, but it was hot. >> it was hot. by our standards here in the bay area, 90 degrees is a hot day. when you're talking about 100 degrees, you can imagine we have some dry, hot months ahead. i can tell you right now, we are going to cool off all the way through the end of the week and stay mild for most of next week. as you know, summertime in the bay area and no weather trend lasts forever. it will get hot, again. best thing you can do is prepare for it. if you haven't bought an extra fly fan just yet. made the purchase for that air conditioner, might be that time to do so. does look like a hot, dry summer by everything i looked at. 59 degrees in san jose and 53 degrees in livermore and drop off by five to ten degrees. these clouds moving in so quickly you can gauge them with a naked eye this morning. really cool stuff there. mostly clear.

your sun is going to be up in 15 minutes because of those long days we have warm temperatures. 84 degrees for today in the south bay, 81 degrees along the peninsula and we're looking at 90 degrees out in the east bay and warm temperatures, definitely not as warm as it was. drop off to ten degrees and back to average by tomorrow and getting into father's day weekend, comfortable temperatures and we'll see that here on the seven-day forecast and always scrolling at the bottom of your screen. here's mike and your drive. >> scrolling right here through the middle of your screen. the sun and a beautiful layering, looks like one of those that you used to do in school. the foreground and the next paper behind you. we have a smooth drive on our maps, as well. you see the light flow of traffic and slowing out of the altamont pass. no problems for west 84 and no issues for sunol and pleasanton. a smooth drive through the tri-valley. south bay where we still have the construction crews there. 17 moves smoothly south over the

santa cruz summit and no major problems in your northbound commute where we'll start to see a later build and this week, especially, a lot lighter around the bay and first week of vacation for many schools and last week of school for many others. across the bay westbound it is moving smoothly and southbound 280 right there where we're worried. chp gave us a report some reporting going southbound and northbound lanes right there around north ridge. and heading up into the area. i'll track that and no further reports of anything going on on the roadway. smooth drive in towards san francisco and the north bay moves nicely, as well, across the bay. live look shows you an easy flow of traffic southbound just starting to build right now and over at the bay bridge toll plaza, no problems either. back to you. >> all right, thank you very much, mike. now, an investigative unit exclusive. if you get a traffic tickt and you decide to fight it in court,

what are your chances of getting off because the officer doesn't show up? tonight the nbc investigative unit answers that question. after reviewing thousands of records, the investigative unit discovered which law enforcement agencies are missing the most court dates. information that has already forced change. the data has uncovered problems with officers failing to appear in court, costing the courts, cities and counties more than a million dollars last year. >> when you got these numbers, a bit of a wake-up call? >> i think for us when we look at the numbers provided to us, we recognize the fact that we need to do a better job. and we want to do a better job. >> is missing a court trial 15% of the time acceptable? >> i'm not going to tell you what's acceptable or not acceptable until we take a good, hard look at everything. >> tonight at 11:00, chief investigative reporter and the nbc investigative unit turned the spotlight on bay area law enforcement agencies writing traffic tickets and not showing up in court. the location for the next

america's sailing race has not been announced, but looks like san francisco won't be hosting. the ceo oracle team usa said he eliminated one of the four areas fighting to host the 2017 regatta. while he will not say who is out of the running, san francisco proposal was the least appealing of the four. that most likely leaves san diego, bermuda and chicago still in the running. mountain view's mayor will ask the city council to allow the pride flag to fly over city hall. chris clark is the city's first openly gay mayor and tells "mountain view voice" since there is now parade in mountainview, a small way to show the city's tolerance and diversity. currently no city policy exists. clark wants this to be a one-time approval for pride flag. palo alto happy doughnuts will reopen this week after new

well. we'll see how that shakes out affecting your drive or not. a little backup for those cash lanes and follow the commute, coming up. and we are looking live at san jose this morning. a pretty start and a milder start to this tuesday, june 10th, this is "today in the bay." good morning and thanks for joining us, i'm kris sanchez, laura garcia-cannon is off this morning. breaking news in the east bay where an amber alert for three children that were said to be abducted from san pablo is canceled. the children found safe with their mother in richmond. still questions about who shot their father in the backyard of their san pablo home. stephanie is live with the latest. stephanie, we know the children were with their mother but are police saying she had anything to do with the murder of their father? >> we don't know.

police haven't said very much about either the homicide or where these three kids were found along with their mom. we know it was somewhere here in richmond, not many details. a lot of questions about where the four of them were since the amber alert went out last night. now, the three children ages 2, 6 and 12 were missing and went missing after their father was killed. an amber alert was issued with police expecting that the kids' own mother 35-year-old alicia ortez that did not live with him abducted her own children. police found the kids' father killed in the backyard of his san pablo house. again, he lives with his three kids. investigators have not released his name, however, we did speak with his friend who said his daughter played with the victim's 6-year-old daughter. he also said the victim works as a mechanic who was always seen with his kids, describing him as a good father. now, here was some of the scene outside the house. there was a black audi believed

to be the victim's that had a pink princess backpack sitting inside. as for ortez, the mother, the mother, she does not have a permanent home but they believe she spends time in both san rafael, as well as richmond. again, the good news, the mother and the three kids found safe in richmond this morning. we're actually expecting investigators to give an update in about an hour and a half and always catch the latest on our website, nbcbayarea.com. >> we're looking forward to that upda update, thank you very much, stephanie. the pakistani, the gunman attacked a training facility at the airport located in the southern tip of the country. video from pakistani television shows security guards rushing to the scene and taking up positions behind buildings or berms around the facility.

the taliban says it is an act of revenge. right now security forces are still trying to fight off those militants so it is not yet clear whether there are any deaths related to the fight. meanwhile, the number of deaths from the first attack at the karachi airport up to 36. seven bodies found inside a cold storage unit. at this point it's not clear how they got there or who they are. a group of militants, some described as police attacked the airport on sunday night and fought with pakistani forces for about five hours. most of the militants were killed. the pakistani taliban claims responsibility for this attack, as well. new this morning, police say they think who shot a child in oakland overnight. investigators are not releasing the specific circumstances surrounding the shooting, but they say a woman in her 20s and a little boy were shot near international boulevard and 81st street. they have not yet said how old that child is. investigators expect the woman

and the child to survive. police say they have a possible suspect, but that person is not yet under arrest. the shootings came just hours after a 3-year-old boy was grazed by a bullet on international boulevard, about 2 1/2 miles away. new this morning, facebook is gaining more ground and the company is buying new land across the street from its current campus in menlo park. bob redell is live in menlo park and their first campus was very big and how much more land are we talking about here? >> be about the equivalent inside. we are talking about a sizable chunk. facebook has agreed to buy a ten building site from this company here and it's a very large piece of property. covers 59 acres here at 300 constitution drive. right off highway 84 kiddy corner from facebook's main campus. as you can see on the map we put up there for you. in a statement to mercury news,

facebook confirmed the purchase is happening but not for how much or what they plan to do with it. an investment in their future with no immediate plans for development. incidentally this 59-acre parcel is next door to where facebook is building its so-called west campus. that's an additional office campus that will accommodate several hundred more employees. you could see maybe where they're coming from and buying this piece of property. now, this latest purchase demonstrates how committed facebook is to growing its company here on the peninsula. you think about it three years ago when it moved to its current headquarters on bay front, the company had about 2,000 employees. now, it's close to 7,000, 4,000 of whom are at these headquarters and you take into consideration how much room they have at headquarters and the space the campus will have next spring that social media giant will have room for an additional 5,000 employees plus. reporting live here in melo

park, rob redell. medcould marijuana regulations will, again, take center stage at san jose city council after lawmakers deadlocked on the issue last week. where the pot shops should go and how many the city should allow. right now mayor chuck reid keeps proposals away from schools and homes and does allow for more than 600 dispensaries in the city limits. they're ready to submit a voter initiative with more than 30,000 signatures to overturn it. our own christina loren double duty yesterday working overtime to bring us the forecast and then hitting the links in that heat. she emceed the catholic charities golf tournament and even wore snazzy matching shoes. this year's fund-raiser was at the cinnibar hills in san jose. all the money raised helps

families in san jose. >> that's always how it works out. you plan a golf tournament a year in advance and end up occurring on the hottest day of the year. we love helping out in the bay area no matter what the weather holds. we're not going to hold on to any trend. this time we're trading in the heat for cooler weather. san francisco right now socked in with fog and those low clouds, as we speak, are making their way across the san francisco bay. you can actually see that at this point moving across the east shore. now, let me take you live and show you how that looks because as we head throughout the next couple hours we're going to see the marine layer move over the bay bridge and it will disappear and this fog will swallow it. as we head throughout the next three hours, we'll show you that. mild start in the south bay and temperatures in the 50s and a couple 60s out there. hot inland, again, i have to tell you that. not as hot as yesterday. 105 in livermore.

84 for the south bay and the peninsula today at 81 degrees. that is a lot more comfortable than where we have been and the tri-valley will hang on to that heat for just one more day. five to ten degrees cooler as we head through tomorrow and then by thursday more of that cool ocean air moving in. we will take you through your father's day forecast in just a few moments and flag day is this saturday, as well. don't forget about old glory or dad, over to you, mike. >> looking over here towards the east shore freeway and you can barely make it out through the low clouds and looks really dramatic. just a little slowing and nothing as far as the issues of traffic flows and then look in front of the bay bridge toll plaza camera and when you see that, the low clouds at the level of our camera and below it you can see our buildings. the cash lanes are backing up here, no big unusual pattern. we'll look at the maps and talk about the approach and 24 and 880 and 580 easy drive right now. lighter volume around the bay

and looking over towards west 580 with a smooth drive and the earlier wrongway driver has cleared from the chp reports without any further issue. na nothing unusual for the south bay and watching the rails and the roads for your transit systems and no delays reported but muni has and told you about that going on for a while. b.a.r.t. has 44 trains on time right now. >> a lot of folks were rushed off the train because of smoke. you can see these pictures posted on twitter by some of the riders but b.a.r.t. is back on track this morning and this happened, of course, at the west oakland station late last night. now, b.a.r.t. says the train didn't catch fire and the smoke likely stemmed from an engine problem. no one was hurt and all trains back in service and if they're slow this morning, mike inouye will let you know. it is now 5:45. five nato soldiers killed in what appears to be an incident

it is 5:42 now. a new report is providing a complete picture of widespread problems at the va. the internal audit of the veterans affairs shows tens of thousands of newly returning veterans waiting at least three months for medical care. "today in the bay" danielle lee is live on capitol hill and we're paying especially close attention to this in the bay area because they're looking at one of our local va hospitals.

>> kris, that's true. the numbers are pretty astounding when you think about it. 57,000 veterans that had to wait for more than 90 days for care. 13% of va schedulers were told to manipulate the request time so you wouldn't be able to tell there were these long wait times for care and then add to that the fact that 69 facilities, so an expanding investigation now under review. that is in addition to the facility in phoenix and the va did visit many facilities in the bay area and only singled out it in livermore. the house had a hearing yesterday and really trying to get answers about how all of this was allowed to be, especially as the va spends billions of dollars each year. the acting inspector general for the va richard griffin was trying to explain exactly what the va is now doing to fix the problem. he said that they're overhauling the scheduling system and

letting more veterans go and get private care when they can't get care through the va as quickly as they need to and some senior leadership is likely going to need to be punished, possibly even criminally and that will all come out at the end of this investigation which will be done likely some time in august. meantime house republicans here on capitol hill are planning to have a vote this week on a bill that would allow veterans that can't get care in 30 days through the va to go to a private facility and bill the va so they aren't waiting any longer. new this morning, five american soldiers are dead and they may be the victims of friendly fire. defense and military officials tell nbc news the five were working with afghan military in the southern part of the country doing security sweeps. the head of this weekend's runoff election when they were suddenly attacked by taliban forces. the americans called in an airstrike and according to u.s. officials a stealth baaccidentae

american forces. the south korean ferry disaster will be charged. four crew members including the captain have been charged with homicide. all of them were in court today. the ferry sank two months ago killing nearly 300 people onboard. most of them who died were high school students on a school trip. a senate committee will hold a closed door hearing on capitol hill today to discuss the controversial prisoner exchange for army sergeant bowe bergdahl. 40% of americans say the exchange of five taliban detainees for bergdahl's freedom was the wrong thing to do. tomorrow defense secretary chuck hagel is expected to testify. and now we all are wondering what is going to happen in our microclimate forecast. how hot is it going to be where you live? i know where i live in the south bay, still going to be pretty

warm, though not as bad as yesterday. >> not as bad. we have to use our ac early june, kind of a bummer. >> a bummer before the summer. temperatures this morning are running anywhere between two to seven degrees cooler for most spots. half moon bay was the only city that hit average temperatures yesterday. they had this fog bank that just kind of set up shop and hung out all day. that kept your temperature 40 degrees cooler at the coast. than what we saw inland. 105 degrees. that is a hot day inland. this morning temperatures are definitely chilly out there for some spots and you probably don't even need a jacket in mountain view. san jose 57 degrees and that fog is increasing. i love just absolutely love watching the fog roll in and that's what we're getting this morning. because of our early daylight hours as we head throughout the next couple hours we'll continue to see the marine layer move across the east shore. that's kind of where it will stay and not making its way quite to the tri-valleys.

>> good morning, kris. this ban would happen in all closed public spaces. currently they're bound in property in all of santa clara county, but the new ban, we're talking about all enclosed public places, excuse me, such as restaurants, bars, inside the workplace. so, this morning santa clara county board of supervisors will decide whether the e-cigarettes can be used in these places. they're also talking about whether or not they can be used within 30 feet of an entrance of any place where smoking is already prohibited. the supervisor spearheading the effort says all he is trying to do is to incorporate them into a policy that already exists for tobac tobacco. living in multi-residential buildings and that rule would not apply to the use of e-cigarettes. retailers are looking at paying for a retailer permit which

the third man was shot in a walmart store as he reportedly tried to stop the two on their shooting spree. he was fi. a search is under way for a uc berkeley student who disappeared after going out alone for a hike.
