heading back to court. we are joined live at the court where defense lawyers are questioning the relationship between grant and his father. good morning derrick. >> reporter: good morning. that is right. and no doubt security will be tight here at the courthouse as that former bart officer takes the stand. it has been more than five years since an unarmed oscar grant was shot and killed here. since that time he has paid out more than $3 million for his death. his father who was behind barba for his murder, his attorney questions how close the father and son were and in return

questions his true intensions for filing this suit. attempts to settle the case have gone unsuccessful and grant's father is asking for unspecified damages. he will be taking the stand at 10:15 this morning. he has maintained a very low profile but we will be in court and tell you what happens. he is expected to tell you what happened back in 2009. live for today in the bay. >> new this morning, san francisco police are trying to track down the driver who hit a person in the road overnight. officers say they saw a car hit somebody on eddy street just before 11:00 last night. the car then took off. they ran after it but could not catch up. the driver was nowhere to be

seen. the victim is expected to be okay. police say tu lan tran tried to put out the fire. investigators say tran had been camping in the area at the time. >> san jose city leaders want to keep the century 21 dome theaters around in the city. they voted to make it a historical landmark. chris, have we established a security here? >> reporter: no, you can callkv something special but that doesn't make it true for everyone. this designation doesn't mean that it is spared. it is going to be more difficult to develop that property. it was a 7-4 vote to grant the building historic status.

some people here were among those who saw their first movie in the theater. fans of the dome's worked together to get the city to grant that status, but get it designated as a national historic landmark. some say the domes are ofsghsw because they are in tact and not old enough to be historic and the city needs to make way for new development. this does not mean that the theater cannot be developed. by the way, the decision on that national designation is due in the next couple of weeks. chris sanchez, today in the bay. >> there is no controversy over

we have a number of reports off of 880. it looks like typical slow action. again, this is reported over the last couple of minutes. watch your commute toward 880 southbound where things start to slow down. that is not unexpected. 880 northbound shows a little volume and down to the east shore 80 we'll look at the toll plaza. we had a disabled vehicle at the toll plaza. i saw some flashing lights cleared. and they are moving smoothly now. now that the crash northbound 280 has just cleared the roadways. we see the lanes recover and ail spilled through that area. we are looking at transit status through the southbound. no delays reported.

this morning all too common. a community in mourning as soar school becomes the scene of a deadly shooting. today was supposed to be the last day of class for students at reynold's high school. >> reporter: the shooting happened here yesterday at 8:00 am. police tell us a lone student walked into the jim nagymnasium

opened fire. a student as shot and killed and a pe teacher was grazed and wounded. it was quite a scene here. police say they were quickly able to lock down this area. they say they found a second stund who was nstudent who was connected to the student. there have been 74 school shootings over the last 18 months that average one every school week. something that concerns investigators here in portland. they have no information on the motive and that is an answer that they have been looking for today, guys. >> thank you very much. >> here is a look at the map

shooting trial of oscar frant. grant's father is suing the former bart police officer who shot his son good morning. >> reporter: good morning that former bart police officer will be in court today expected to take the stand here. he is expected to recount what happened back in 2009 and it was in 2009 that he shot and killed oscar grant who was unarmed at the bart station. he eventually would be convicted of involunteer manslaughter and he would do away with civil lawsuits filed by grant's mother and daughter. this lawsuit comes from grant's daughter who was behind bars who was convicted of murder himself. there are some questions related to the relationship the two had together. if they were in deed close or
