from nbc bay area, this is "today in the bay." a good tuesday morning to you, it's 4:30 i'm sam brock. >> and i'm laura garcia-cannon. lots to get to this morning. let's check the forecast first with christina loren, good morning. >> hey good morning to you. happy tuesday. it's a traffic tuesday, mike has the day off. i'm doing double duty this morning. good news is, we don't have any problems on the roadways just yet. construction, we'll ghetto that in a minute. weather's not posing any sort of a problem for you this morning on your morning drive. we are going to see just a spectacular day ahead ending up in the 70s for most spots.

we'll talk about that coming up. right now let's take an overall look at what your drive is doing right now. look good. you see a lot of green here. no delays, obviously, it's early out there. i want to tell you about early morning road work that could slow you down. we have one shut down through parker studio at least for the next hour. when it opens up, we'll let you know. give yourself extra time, it's due to construction. we'll keep you updated all morning long. >> thank you so much, christina. we have breaking news out of kenya where nine people were killed by extremists in the second attack on a coastal town. somali militant group claimed responsibility saying they were revenge for the hands of ken yan forces. the group also warned foreign tourists to stay out of kenya. now yesterday's attack came as most people were watching world cup soccer. 48 were killed. the town is south of the somalia border.

now to the developing story gripping international leaders this morning. president obama is weighing military options as the chaos in iraq threatens to spin out of control. he's spent 270 troops to secure the embassy and move staffers out of baghdad before meeting with his national security team last night. the president told congress he might send 100 more. more, he's considering deploying special forces, equipped, but not to fight. baghdad are signed up to fight against militants. convoy took the volunteers directly to the front line. thousands of iraqis have heated up to take up arms against isis. >> when you have people murdering, assassinating in these mass massacres, you have to stop that. you can't just let them run

whole hog over the country. >> the state department confirmed the u.s. is talking with iran, but talking is about it at this the point. the white house is putting together a plan for congress that would use money saved from the war in afghanistan for this new conflict or potential conflict. iraq will have much more on this story all morning long. kris sanchez is monitoring, she'll have an update in the next half hour. also we're available any time, if we're not on air, go to nbcbayarea.com for the updates. 4:33, in the state capitol today, they will decide if a law named after a aud ri pott who went to the high school. she was sexual assaulted at a house party two years ago and photographed while unconscious. after those pictures were circulated online, pott took her own law. it would require a mandatory

minimum develop year sentence for those found guilty in cases like pott. they received punishments of 30 to 35 days. >> we feel that what we're asking for in the two-year minimum sentence is completely reasonable. it's warranted. >> the opponents say the bill goes against the mission of the juvenile justice system which is to rehabilitate young offenders. looking for a man who reportedly groped a woman as he rode by on a bicycle. the 20-year-old woman says she was walking through a parking lot at cal where she noticed a man across the street near the touchless car wash watching her. as she kept watching, the man rode up and grabbed her chest. she yelled at him and she took off. she wasn't hurt. the man was riding a pretty unique bicycle, it was a black fix gear bike with black spikes and straight horned handlebars with the ends going up. homicide investigators in

san francisco spent much of the night trying to figure out who killed a man in the city's in addition district. the victim was found on 16th street between gary row and valencia streets last night. paramedics declared him dead on sea. they're not saying how the man died or if there's suspect. they're waiting to talk to his family. the south bay family coping with the murder of husband and father is getting financial help from across the country. a fund raising page was created for the mom and her two boys. she speaks little english. one boy has autism. the sole breadwinner, lam, was shot and killed two men including a 17-year-old. they're both awaiting trial. the family had no savings to police set up the page on youcaring.com. >> she's still hurt inside and

nothing can tell what it is, how she feels inside. no words can say it. >> when i saw the children, especially the autism child, seven-year-old, it was heart breaking. and i know that she's going to need a lot of help based on circumstances. >> the money won't bring back her husband, but certainly the donation's helping. and right now they're coming in from around the world. they've topp eped $100,000. chp hopes you can help identify a person hit and killed. someone's car swerved on 580 near grantline road and hit a woman's puppet. the -- pickup truck. the suspect was driving 80 miles an hour. chp is looking for a dark, possibly black car with possible damage to the front right end. the woman in the trunk is in the hospital with serious injuries. the san jose football players who barely escaped an apartment fire says he hopes to

be back on the gridiron this upcoming season. jared leif was in the hospital for more than a month. his recover have i far from over and he's not sure if the doctor will clear him to play football any time soon. he was asleep when his roommate called to tell him the third floor apartment was on fire with smoke pour og under the door. he knew he had to get out right away. >> just ran through basically a wall of fire, i think my whole, my whole living room and kitchen was on fire. and just ran out the door. >> lucky to be alive. he says the whole experience has made him appreciate life more. he grew up in martinez and went to el hombr rerks high school. firefighters in south california are containing a wild fire that threatened hundreds of homes in bakersfield. yesterday it was 10% contained. right now firefighters have it

75% contained and the flamed, they have them surrounded there. vacation orders were lifted for hundreds last night. since the fire started on friday, it has destroyed three homes and damaged another. in the men time, a wind advisory has been issued for the area for today. so extra crews will be monitoring the containment line to put out any spot fires caused by some of those blowing embers. much closer to home. firefighters are plotting kelly park leaders for cutting back on thick brush in the park. more than 50 firefighters help put out the brush fire yesterday near the happy hollows zoos in sarn jose. firefighters say the fire could have spread faster if the park had not cut back the brush. cool temperatures and humidity helped crews get that fire under control. now toe a story that's still -- to a story that's still developing. residents of pilger, nebraska, will be able to survey the damage after twin twisters touched down last night in a scary scene.

five-year-old was killed and 19 others injured. half of pilger is gone. nearly every house in town has at least some damage. the tornados dropped out of the sky roughly a mile away from each other. look at the size of that. eventually merging into one tornado. meteorologists won't know the intensity of the storms until late today at the earliest after they have a chance to survey the damage. >> it's just unbelievable because you're just kind of in a state of shock because it's, you can't believe that it can be gone so fast. >> hard to even believe what you are looking at. one witness said she watched one of those tornados move down main street destroying every sing m business on it. it was quote like god dragging two fingernails across the land. terrifying scenes. >> it is, and sad the life of a toddler was lost as well. to see that thing barrelling towards you, frightening. much more fortunate in the bay area. >> we have our own concerns here, mostly the fires

christina. wind conditions, something to keep track of. >> we had the brush fire yesterday in san jose near the happy hollow zoo. this morning we are getting an onshore flow, but the wind direction is starting to shift. as a result we're warmer today. tomorrow is when we're dealing with the greatest fire concern for the bay area because it will be dry. offshore winds, down sloping dry winds for your wednesday, then we'll cool off as flow returns towards the weekend. now this morning, your temperatures are in the 50s, thanks for waking up with us on a tuesday. if you're headed out and about, this is what you can expect. because the wind is dropping off, we are going to see more low cloud cover this morning. sunrise 5:46 a.m. temps are going to climb by 5:00 to -- 5 to 10 degrees. now as we get into this evening. you're going to see a lovely finish. 8:32 is your sunset, beautiful sea breeze will pick up for a

nice day starting out. we'll check the forecast coming up with christina in just moments. supreme court will take up the issue of free speech involving social media. the high court will hear the case of a pennsylvania amusement parkt worker who got in trouble for posting about wanting to kill his wife and shooting up elementary schools. he says he was kidding. but a judge found him guilty of making online threats. what matters the judge says is not whether a person is making a threat, but whether a reasonable person feels threatened. some say the test does not work on the internet where it may not be obvious someone is just blowing off steam. >> in the less, it would probably be good to be sensitive. apple could be out hundreds of millions of as it settles about pricing ebooks. they have not said what the terms entail. consumers sued apple saying the company overcharged customers by some $280 million for e books

and they wanted three times that amount. the settlement is reportedly contingent on the outcome of last year's ruling. the company worked with five major publishers to drive up the price of e books. new troubles for general motors. the automaker is recalling nearly three and a half million more cars for ignition switch problems. for that and the rest of the news with the news before the bell, we turn to jackie delaware ankless. >> reporter: good morning, let's start with the futures, they are pointing to a higher open on wall street after stocks posted mild gains for the second straight day yesterday. now unease over the situation in iraq cur,ing enthusiasm about market and data that we got yesterday. now today, consumer prices and housing starts, that's the data coming out this morning and the fed kicking off a two-day policy meeting. dow finishing at 16,781. nasdaq up ten to 4321.

gm making headlines, recalling another 3.4 million cars for faulty ignition switches. they'll replace keys that could move the switch out of the run position, if they're too heavy, that of course can cause the engine to shut off and drivers to lose control. now gm says that its received reports of eight crashes, but no deaths here. the recall affects seven models from twouz to 2014. they've raumed more than 20 million cars this year. and finally it's time for siri to meet dom. that lets customers order food by speaking to a computer. generated voice. they've been ahead of the curve with the technology. one of the first to introduce online ordering in 2008. 18% of sales come from mobile orders. so i wonder if dom and siri will be a new sort of mobile device romance here.

gwen, he was just 54 years old. he lost his battle with cancer yesterday. his death is raising new concerns about the use of smokeless tobacco in major league baseball. for much of his 20 year career as a san diego padre, he tucked it away between gum and cheek. he underwent surgery or it remove a growth in his mouth. one of the greatest hitters of all time was known for that infectious smile and sweet swing. loved not only by san diego but really across the country including right here in the bay area. >> he never thought he had arrived as a player. he never stopped improving. and trying to get better as a hitter, a base runner. an outfielder. all year he would work on his game, he would good to the ball park or go to the cage. and a lot of players don't do that. they think they have arrived, but that's what i learned from
