she's accused of grabbing the throat of a boy she thought had been bullying her daughter. private investigator hired by her attorney says another student saw the alleged victim choke himself to create red marks on his neck. garcia denies assaulting the boy. we'll have a live report in the next half hour. today lawyers for the san francisco man who led fbi agents on a manhunt earlier this month will meet with a judge. the grand jury handed down an indictment against ryan exam berlin, charged with possession of an illegal destructive device, carries maximum sentence ev of ten years. came today's meeting could determine if his psychiatric evaluation will happen. a bay area music teacher faces life in prison for reportedly inappropriately touching three young students at a daly city performing arts school. brian butts was arrested last week but investigators just released details of the case.

butts was a guest instructor at music arts studio. when the owner returned, several students told him about the assaults. >> so three occasions, this fellow touched them inappropriately in the chest area outside the clothing, but did touch and fondle them in the chest area. >> butts pleaded not guilty on monday. the students are between 13 and 15 years old. a man killed a few units shy of graduating from college will be given a posthumous degree today. he was shot and killed when he accidently went into the wrong apartment in his building. the 68-year-old man who shot him was arrested but later released. what was a scary situation yesterday afternoon, investigators spent the night monitoring the shells of two sunnyvale homes burned to the

ground. chris sanchez is live in sunnyvale where two families are without homes this morning. investigators still don't know how the fire got started? >> reporter: they will get in there and try to dig around a midst all of the chore ehe chau. the fire truck monitoring for hot spots did leave just a couple of minutes ago. this was in stark con ttrast to the flames we saw yesterday. the homes quickly consumeded by the fire. firefighters did move quickly, but the fire moved even faster. two houses are now a total loss. but it could have been a much worse story if not for some quick thinking of good samari n samaritan, one a tree terrorism who ran door to do you know tor people to get out. >> i ran inside the house and

got everybody out of the house. i pounded fire, fire. >> at least our lives, we have our lives. and i think my ghneighbor's dog died. >> reporter: firefighters ran into the burning home, but they can't stay long. they were for used to take a defensive position because they were afraid the home would come down on top of them. they doused it from the outside. at one point from our chopper vantage point, we did see a man climbing on top of the roof of his house with a garden hose trying to keep the fire from overtaking his home, as well. police wanted him down from that position because they said it was dangerous. they even threatened to arrest him if he didn't come down, but he says he couldn't stand by and watch. investigators will be back here at the scene this morning combing through the debris trying to figure out what the origin was and what the cause was. insurance adjustors usually come out the next day, as well, and

the families will certainly be trying to figure out what is next for them. chris sanchez, today in the bay. it is 5:04. new this morning, investigators trying to figure out if a brush fire in oakland was started on purpose. the fire burned bushes and trees in an area half the size of a football field. several roads were temporarily shut down near the intersection of courtland and brooke dale avenue. that fire several miles away from where crews have been patrolling the oakland hills. five separate fires broke out tuesday afternoon, all within a couple of hours of each other. they think three were intentionally set. and the two others were started by embers. investigators say burn patterns suggest someone may have even put gasoline on wood to get those fires going. a judge has approved pg&e's plans to raise their rates, though not as high as the utility might like. a law judge agreed to allow pg and e to hike it year and every

year through 2016. under the plan, rates will go up enough to increase the utility's profit by almost 7% this year, 4.5% in 2015, and 5% in 2016. since the increases are to reach a profit goal, it's still unclear how much your energy bill will go up. the proposal must still be approved by the state's public utilities commission. crews will finish the second round of mosquito fogging tonight. it comes after some adult mosquitos infected with west thil we 23450 nile were found in the area last week. >> hopefully not the too much humidity on tap for today. let's check in with christina. >> they're looking okay. here is the one note i will bring up because you're very, very wise, sam brock. they do love that humidity. so if you ever accumulating

globe. a good portion of europe, asia and africa and all over the country. early this morning, facebook released this statement saying, quote, we experienced an issue that prevented people from posting to facebook for a brief period of time. we resolved the issue quickly and we are now back to 100%. we're sorry for any inconvenience this may have called. american apparel has fired its controversial founder and ceo. yesterday the board of directors voted to fire ceo after and ongoing investigation into alleged misconduct. it's unclear what that misconduct was, but the board says it was doing the right thing. over the years, there have been several sexual harassment lawsuits filed by employees. there were reports he had meetings in his under way. american apparel stock continues to fall. filming has begun for the upcoming netflix television

series. motorcycles raced back and fort through the city streets. the science fiction show created by the writers of the matrix is about eight people who have psychic powers. crews will film in various locations throughout the city. the show is expected to air on netflix at the end of this year. the nerve bank decision to cut back on stimulus programs could cause the markets to rally today. for a look at how futures are trading, let's turn to jackie deangelis. futures are a little mixed, so we'll very to see where the session goes. but stocks rallied on wednesday following the latest decision by the federal reserve. the fed saying the economy has rebounded in recent months and the labor market is improving, as well, although a little cautious on the housing recovery. it is taking a little more time than expected. the federal government signaling interest rates may start to rise

next year, but saying that, we should expect to see them low for a considerable period of time. meantime, we'll get some data on unemployment and manufacturing. so look for that. the dow rising 98 points yesterday to finish at 16,906. nasdaq up 25 to 4362. a 14 year high for the nasdaq. t-mobile offering users a one week test drive of its wireless network. customers can sign up on line, get a free iphone in two days and pay no charges unless of course they return the phone at the end of the week. the company says streaming music no longer going to count against your data plan. remember last year t-mobile hook things up by unbundling service fees. so they're reversing course on that. back over to you. president obama's head will be the first 3d portrait of a sitting president at the smithsonian. digital specialists scanned his head and used a 3d printer.

new riders in time for the 49ers season. they reviewed months of inspection records. vta trains carry 140,000 riders a day. records revealed they failed to properly maintain critical signals in many of its trains leading to hazardous conditions that could cause head-on collisions and train derailments. >> when your inspectors found these problems, what did they instruct vta to do? >> not run those vehicles. and we found that they did run them after that. >> vta is a very safe operation and i encourage everyone to ride vta. >> tonight more on what inspectors found and why they say vta has been slow to make some of those fixes plus concerns about whether the trains will be ready in time. we investigate tonight at 11:00. today some of the top men and women in the u.s. swimming

the fires going. investigators will exam burn patterns and debris in hopes of figuring out what started a fire that burned two homes to the ground yesterday in sunnyvale. chris sanchez is live there with what we know so far. have there been any updates? >> reporter: no updates so far. but we know investigators will be out here again today looking for any sort of clue as to what happened here. the homes are surrounded by fencing. the fire truck that was monitoring for hot spots has left the scene. but it is a stark contrast from yesterday as we watched the fire quickly assume the two homes. firefighters moved quickly but the fire moved even faster. the two houses now are a total loss. but it could have been way worse if not for quick thinking good samaritans, one of them a tree trimmer ran door to door telling people to get out. in one of the houses, there was a home daycare center where there was a child sleeping inside. fortunately every made it out inside. >> i ran inside the house, ordered everybody out of the

house. no one was answering the door, i under founded fire, fire. >> but at least we have our lives. and i think my neighbor's dog die died. >> reporter: firefighters had to take a defensive position from the outside trying to douse the flames, keep them from spreading to the other homes. at one point we did see a man climbing on to the roof of his house next door trying to wet down the roof and do what he could, though threatened with arrest by the police because they were concerned for his safety, he said he just couldn't stand by and watch his house go up in flames. fire investigators will comb for clues today and as soon as they tell us what they think happened here, well will of course give to you. reporting live in sunnyvale, chris sanchez, today in the bay. today a san jose judge will hear it from a man who insists he is the biological father of audrey pot. pot of course the saratoga teen

who committed suicide after she was sexually assaulted at a party. michael wants to be included in the wrongful death lawsuit. the pots filed the suit against the parents of the boys who assaulted audrey. the three boys searched 30 to 45 days. the arch bush shop is scheduled to speak at a march for marriage rally in washington, d.c. today. comes as local catholics as well as leaders like gavin newsome and mark leno urged him not to attend. no response, the arch bush shop sa bishop says it's simply a pro marriage march. over 30,000 people signed the petition asking that he not go. 5:33 on your thursday morning. yesterday was a bit toasty but

so definitely a big contrast between the of course micro climates. these are your temperatures today. 88 for the east bay, 87 authority bay, hot spot also south bay at 84. cooler conditions along the peninsula. just 82 degrees. and speaking of the peninsula, a great looking drive on 101 and 280. we are stacking up in some of the usual hot spots. westbound 580, let me show you what it looks like through dubl dublin. starting to seat cars stepping on the brakes a bit and the space definitely becoming more limited between the cars. you're stacking up here, but this is the only spot. we'll keep you updated. back to you sam and laura. it is 5:35. today a bay area mother could find out if she will face charges for allegedly choking her daughter's bully. the mother claims she didn't land a hand on the student.

>> reporter: good morning. that's right, the mother delia garcia bratcher will likely learn whether or not she will face any charges today in a santa rosa count -- rather sonoma county courtroom. this mother was originally accused of grabbing the throat of a little boy who was allegedly bullying her daughter. but there is some question as to whether or not she actually did that. there are varying witnesses and the attorney for garcia bratcher says this never happened. >> she never laid hands on this boy. that is what must be made clear. she did ask him to stop bullying her daughter. she did not get the wrong boy. the boy is lying if he claims otherwise. it's that simple. >> reporter: since there were varying descriptions of what happened, the d.a. wanted a little more time to investigate. that court date was put off a month. that is today. and again, we will be learning

welcome back. it is 5:39. as militants battle their way towards baghdad, president obama is working to get washington politicians on board to w. a plan to save iraq without dragging the u.s. back into war. in the meantime, some private companies are working on getting

people out of iraq. today in the bay's tracie potts joins us live on capitol hill with the latest on possible military action. >> reporter: good morning. no word on military action yet. the u.s. is still trying to get the iraqis to pull together and fight this enemy on their own before we send in planes. we do have drones and maybe planes out will doing surveillance, but no sort of military action that the president has announced so far. after that refinery attack that started yesterday, concerns by big oil companies. exxonmobile is pulling all of its people out of iraq. also bp has decided to pull about 20% of its people out. the iraqis say they are nowhere near the fighting, but it certainly raised questions and concerns about where these militants might move. they need a better handle on what is going on on the ground.

>> vice president biden made more phone calls to iraqi leaders yesterday. is it working at all? >> reporter: to the prime minister, to the kurdish leader. essentially telling them all the same thing, the vice president said that they need to pull together and get rid of their differences and fight this enemy on their own and not expect the u.s. just to come in and solve the problem. you asked is it working. to some degree, yes, on paper in front of cameras, we're seeing iraqi leaders talk about unity. we're even seeomething sunnis join the shiite army fighting against the sunni militants, but it hasn't stopped them yet. >> one to watch. thank you very much tracie potts live from washington. the unrest in iraq is giving congress pause about the president's plan to withdrawal troops from afghanistan next year. violence tips. this morning three heavily armed suicide bombers attacked a nato convoy near the afghan-pakistan border. it was along a key route for nato. the attack triggered a gun

battle with police guards. police killed two attackers, but one blew himself up. 37 fuel trucks exploded, as well. the taliban has claimed responsibility. the obama administration insists afghanistan is not iraq. the white house plans to withdrawal u.s. forces from afghanistan by the end of 2016. today house republicans will elect a replacement for eric cantor. cantor stepped down after he was unexpectedly defeated in a historic virginia primary. it was the first time that a majority leader has lost in a primary election. republican whip and californian kevin in being car any mccarthye frontrunner. spain welcomed a new king earlier today. there he is felipe vi will take over the throne at his father and former king juan carlos hands over his crown after a four decade long reign.

reporters she was inspired by her big brother and while her dad is good, he still can't beat her. she two months ago, she won the drive chip championship. so she's used on winning and also the attention and pressure. >> i think i like crowds. they don't bother me. i play better the more people that come watch me. so, yeah, i'm really excited, though. >> thinking about this week that makes you nervous? >> not really. >> reporter: not everybody is happy that li is in the open. number one lmpt pga player told "usa today" sports that she's not a big fan of li at the open. if li was her kid, she wouldn't have let her play at the qualifier at just 11. she says kid shoes experience more wkids should experience moe

probably don't even need a jacket. overnight we get what i like to call the equalizer. all of our temperatures basically drop into the 50s and then we get the separation as we head into the afternoon. all because of the wind. the on shore flow will impact the immediate coast bringing cooler conditions here. otherwise we'll cut it off. it won't even make its way to the inner bay today. so for us, i can tell you right now, it's going to be another warm one. want to make sure you're ready for that. but we won't exceed the mid-90s. 82 for the peninsula, 84 south bay. 68 in san francisco. 87 in the north bay. so not too hot out there. still, though, a little on the warm side especially as we break it down for you city by city throughout the various micro climates. gilroy will hit 90, palo alto a warm spot. and the maybe getting up to 70

inappropriately touching three young students at a performing arts school. brian butts was arrested last week, but investigators just released details of the case. butts was a guest instructor at music tart studio while the owner was out of the country. when the owner returned, several students told him about the alleged assault. >> on three occasions when the girls were by themselves, it wasn't like there were other students in the room, this fellow touched them inappropriately in the chest area. outside the cholothing, but did fondle them in the chest area. >> butts pleaded not guilty. the students are between 13 and 15 years old. business owners and police are working on a plan to combat what is known as the oldest profession for women in one san francisco's hot spots. between 11:00 and 4:00 in the morning at union square, numerous prostitutes walk the streets soliciting men and women. witnesses say they sometimes aggressive and it's bad for
