but she's been found safe. "today in the bay's" derek shore joins us live where the girl was dropped off, what's the latest, eric? >> reporter: well the latest is that, and the good news is that little girl is okay. sunnyville police have not told us if that suspect is in custody. what we can tell you is he is not in the santa clara county jail. his name jose ruiz valencia. police issued an amber alert for eight-year-old helena valencia correo. how and if the two are related still isn't clear. now officers say that little girl would be dropped off here at sunnyville bpf, but he's not in custody. he's a 1506, 5'8", and abandoned one of his cars and thought to take another vehicle. that would be a ford escape, a yellow one. license plate 5 pnh 641.

again we are not told whether or not he's in custody. if he is, he is considered to be dangerous and you are asked to call the police department, sunnyvil sunnyville dps. we are trying to get more information here, the situation between the two and whether or not jose valencia is in custody. derek shore, "today in the bay." >> i'm glad that little girl is safe, thanks derek. now moving to the latest developments in iraq. president obama has a plan for the crisis which for now does not include combat responsibilities for u.s. troops. >> "today in the bay's" kris sanchez joins us now. it's not surprise the president's decision is getting mixed reviews. >> reporter: the american public is on both sides too and iraqi war veterans. now the plan to, that was outlaid by the president last night certainly does not change that. 300 u.s. troops are headed to iraq to work on the ground alongside the u.s. military on

the fight against isis. not to fight with them though. u.s. forces will help to choose targets and strategized. the president not ordering any air strikes as the iraqi military wanted. at least for now. and that's what's getting the most mix red views here at home -- mixed reviews here at home. >> that does not foreshadow a larger commitment of troops to actually fight in iraq. that would not be effective. >> once again he's announced step a without thinking through the consequences of step b. >> some of that -- >> reporter: some of that pushback came from a group of iraqi war veterans. the president seemed steadfast sending john kerry to the middle east to rally support. at least some of his stops will be in iraq. sam. >> no doubt, resolution could be weeks and mornts away. thank you very much. the jury in the bryan stow

civil case took a tour of the stadium in hopes of gefting a better idea of what happened that day. the jurors visited the right field pavilion where he sat in 2011. then they walked into parking lot 2 where the beating reportedly took place. stow sued the dodgers claiming the organization did not provide enough stadium security to keep him safe. it'll take another four months before the police substation will open. the city in the pros of hiring 28 -- process of hiring 28 community officers to man that station. it's near highway 85 and highway 101 interchange. the station was completed four years ago, but it stood empty because of staffing and budget short falls. soft opening is expected at the beginning of october. as we speak, crews along the peninsula out trying to get rid of the west nile virus. just finished ground fogging in the area. its boarded by highway 82 and

101 and poplar and fourth avenue. it comes after mosquitos were found in the area infected with west nile earlier this week. san francisco transit leaders could be getting an earful from people against tech shuttle buses using public stops. "today in the bay's" stephanie chuang joins us live at the city hall with more details, and stephanie, this is an issue that seems to be a touchstone for people all over the bay area. >> reporter: yeah, good morning to you, sam. this is part of an 18-month pilot program that would use stops like this one here at mcallister for tech buses. this is across the street from city hall where later that the meeting takes place. tech giants like apple, google use these buss to shuttle workers to and from the south bay, peninsula, and san francisco. so far the shuttles utilized muni stops for free. that pilot program would charge tech companies 1 per stop per day to use roughly 200 bus stops

across the city. today leaders will decide and it involves about # 0 or so of those stops. now opponents of this program have also staged protests about this. one group that includes local union members filed a lawsuit last month against the city of san francisco in the hopings of blocking these shut frls using the bus stops. shuttles highly paid workers into the city has load it a skyrocketing number of evictions and highly paid tech workers. another issue some say is the private shuttle delays muni times because they block the buses, although there are no hard numbers or statistics to back that up. again this is a highly contentious issue. the meeting this morning at city hall starts at 10:00. again this morning. and if it does get the green light, this pilot program, it'll begin on july 1st. live in san francisco, stephanie chuang, "today in the bay." >> thank you very much, stephanie. it's 5:06, shall we talk to

morning shots as you get ready to start your day. this one comes from san rafael as that sun making its way up in the sky, we'll have more on weather coming up. it is 5:11, police arrested the head of belgium swiss bank ubs on suspicion that he and the firm helped wealthy clients evade billions of euros in taxes. police raided the home yesterday. prosecutors say the amount of tax fraud is around several billion euros. the information leading to the raid came from people who used to work at that company. a federal judge could strike down the class action setment reached after alleged illegal tech hiring practices. earlier this year if you'll recall, apple, google, adobe all agreed to pay $324 million to settle the suit that accused the companies of secretly agreeing to not hire the employees of other tech companies. essentially ka lewding amongst themselves. is the averages autoto a few

thousand dollars per employee. it's not good enough for the plaintiffs. one has already protested this deal saying workers would have made $3 billion if that collusion had not occurred. the tech companies settled earlier this year to avoid a potentially damaging trial. 97% of smart phones in the u.s. will have kill switches. google and microsoft announced they'll add the kill switch to the operating system. iphones have the switch which allows the phone's owner to deactivate it the making it useless. in the past five months, thefts of apple devices dropped 17%. at the same time, thefts of samsung devices without the switch went up. 51%. let's go now and get at quick look at how the markets are doing, jackie deangelis who is live at world headquarters, good friday morning to you, jackie. >> reporter: good friday morning to you as well. we're watching the futures this morning pointing to slightly lower open on wall street,

going to be hot today, even yesterday when we did see temperatures in the 90s, it wasn't that bad in san jose at least a little bit on the warm side out in the tri-valley. it's just about as warm, if not a touch warmer in the inland spots today as we're not getting the low cloud cover. temperatures are comfortable out there. you don't need the jacket this morning in the south bay along the peninsula or the east bay starting out in the upper 50s. same for san francisco. you might need to pull one out this morning in the north bay where we are enjoying the 40s to start. we're on our way to the 90s later on today. temperatures are really going to climb by about 40 degrees over the court of the day out in the north bay, that's a larng spread. in the south bay, 84 along the peninsula today. ocean air will influence parts of the bay area. the closer you live to the coast, the cooler your temperature will be as per usual. we're going cut the onshore flow. it will be warm out there in the tri-valley. 83 for the peninsula.

14 hours of work per day with a maximum of 11 hours behind the wheel. walmart did not comment on roper's schedule. the report also says that roper was speeding before his truck plowed into the limo. morgan's condition is improving. vote today could make new york the 23rd state in the country to legalize medical marijuana. the compassionate care act would legalize some forms for severely ill patients, but only through vaporizer or in an oil base. they will not be the able to buy 12 it in splant form. just this morning, pope francis condemned the legalization of marijuana saying it would not produce good results. this morning governor brown is expected to sign the state's $108 billion budget plan. now this plan includes $7 million to help fund suicide nets along the golden gate bridge. also calls for programs supporting preschool, welfare to work grab thes, as well as using 25% of cap and trade revenue for

the high speed rail program. also focuses on paying down debt and building up the rainy day fund. city leaders are expected to announce a proposal to stop marketing e-cigarettes to teens this morning. local congresswoman jackie spear will introduce with the proposal in front of san francisco general hospital. the issue has been talked about on capitol hill this week as politicians slam e-cigarette companies for luring teens with targeted ads. all right those with high aspirations of being the world's greatest dad, tough to top this father's day for a vacaville man. he delivered his newborn daughter on sunday on the way to the hospital in fairfield. they thought they had more time to make it to the hospital, and it appears they were wrong in that assessment. steven pulled over to the side of interstate 80 and that is where his daughter was born. >> after we delivered her on the side of the freeway, we giggled, did that really just happen? and it just kind of, it's a story that we will never forget. >> that couple shocked the er

the amendment late last night. it placed limits on how the nsa can gain access to e-mails, online browsing, and chatting history. it's a change to the defense aprop rations bill. . puts an end to the nsa's ability to get records in bulk. all new this morning, eight-year-old girl was found safe three hours after she was taken from the south bay. derek shore is live outside of the sunny valley police headquarters where the girl was reunited with family and derek, what do police know about the suspect? >> reporter: well it's really unclear at this point whether or not that suspect is in custody. now it was a little before 10:00 last night sunnyville police issued an amber alert for are the eight-year-old girl and believes she was kidnapped. jose lewis ve lens ya was related or somehow related to that girl and he was believed to be the suspect. officers say that little girl

would be dropped off here at sunnyville dps, but jose is in the in custody. he is 44 years old, 150 pounds, 5'8", and he abandoned one of his cars and was then thought to be driving a yellow ford escape. the license plate on that would be 5 pnh 641. again as we come back out here live, that's jose valencia. as far as we understand he is not in custody. police are looking for him at this the point. as far as we know, we're trying to get more information from sunnyville dps. that is the latest, derek shore, "today in the bay." >> derek, thank you very much. investigators spent much of the night searching for bullet casings while we wait to clear that, checking for bullet casings, other clues in the parking lot of a venue near denver. this was the red rocks shut down late last night after somebody started shooting in the parking

lot. authorities locked down that parking lot and every car was searched before leaving the scene. the shooter though is still on the run. >> my friends, they got emotional and choked up by it because they didn't understand what was going on. didn't funs somebody was on the loose or if could potentially harm us since we were walking down there to get dloun. >> this happened at a rap concert featuring nas. the victim's conditions are unknown at this point. investigators say they do not know if the victims have any kind of prior relationship with the shooter. now toe a developing story, president obama committed to troops in iraq, though not the military actions of the government was actually asking for. but the president seems steadfast sending secretary of state john kerry to the middle east this weekend to rally support there. at least one of his stops will be in iraq proper. this is of course a delicate dance for president obama who was elected in 2008, you remember laura on the basis of his promise to end the war in iraq and withdraw our u.s. troops. >> exactly, as things are heating up, and changing so rapidly as we've seen every day, it'll be interesting what comes with the john kerry going there as well. >> thanks a lot. sam. laura thank you. fire investigators are looking for evidence to figure out the cause of a grass fire that destroyed two homes in the san jose foothills. firefighters say conditions were perfect for a wild fire, it was hot and dry with bursts of strong wind. neighbors say they first saw smoke coming from a vacant home yesterday afternoon. flames quickly spread to another house and surrounding brush. this was near the 680, 280 interchange, that's on clayton

on to your job for that 12 weeks without fear of losing your job. it's a proposal, and it's a proposal that we expect to hear more about today. the details just came out overnight. also today, the justice department is announcing that they are ending their review of federal benefits for same-sex couples. that was after the supreme court's decision this time last year. that review expected to extend benefits pretty much to all same-sex couples. they want congress to make changes so that those benefits could be extended as well. >> tracy potts from washington, thank you very much. while these are ironed out in d.c., the plan will have an effect in some states, but not here in california. it won't mean much. that is because we have laws to give same-sex couples the same rights and benefits as others, laura. today the ongoing controversy over tech buses using bus stops in san francisco will take center stage at a meeting in the city. that's where we'll find "today in the bay's" stephanie chuang.

stephanie, the city could give them the green light to use public stops. >> reporter: yeah, good morning to you, laura. the city gave the approval for this pilot program back in january this year, but it's hosting a panel hearing today. if you've been in san francisco, you've seen these buses come up to stops like it one on mcallister using them to pick up and drop off workers. the city today is holding again a public hearing wanting feedback about 80 stops in particular across the city that the shuttles could use. apple and google use these tech buss to get workers to and from in san francisco. so far the shuttles have been utilizing these for free. now the pilot program would charge them 1 per stop per day. estimating getting $1.6 million for the city every year. two weeks ago the city environmentally cleared shuttles using 20 or so other top stops. some would mean converting that

to shuttle loading zones. the agency says these shuttles eliminate at least 45 vehicle miles and cut down carbon from the road and air each year. but opponents who staged protest filed a lawsuit last month against the city in hopes of blocking these shut frls using many bus stops. they have brought in tech workers into the city, driving up rent and housing cost and causing skyrocketing number of evictions of lower income tenants. they also say the titles claim the shuttles block the buses. now back here life at city hall, this is where at 10:00 this morning there will be that city public hearing. the permitting pros is set to start next week, but once all is said and done, this pilot program was actually slated to start july 1st. its been pushed back to august 1st. the city had too much to do before it could begin this program. live in san francisco, stephanie chuang, "today in the bay." >> thanks so much, stephanie. we are in the land of

here to show you in the san francisco area. that's enough of the low cloud cover to keep your temperatures in the 70s here. and the best part about the bay area's microclimate, the variety. if you want the 70s, all you have to do is drive towards the ocean in 30, 40 minutes, if you're dropping off by 10 to 20 degrees. that's the best part about the bay area. sunny and warm, warmer than yesterday in some cities. we officially kick off summer time tomorrow. then we have a nice, comfortable weekend for you with temperatures hitting seasonal averages. today, above average at 86 degrees in the south bay, 84 degrees for the peninsula. and about 73 degrees meanwhile in san francisco with that cool ocean air moving on shore, but only neigh its way to about oakland. east shore, 77 degrees reflecting the ocean air. 92 in the north bay where we cut that off. hot out there. overall, you give and take, give and take, as we head throughout the weekend, we're going to drop you off in the san francisco area, 67 degrees on saturday, meanwhile, we'll return to the low 80s in the south bay which is about average for us.

miles south of the first suspected crash site in the indian ocean. underwater drone scoured nearly 350 miles off the ocean fiscal year. just a month closer to australia, but found absolutely nothing. the new search will use more powerful sonar equipment and based on refined analysis of satellite information. it disappeared more than three and a half months ago. the state medical board is investigating claims that female prison inmates were sterilized without giving consent. report found 39 cases in which inmates understood they were agreeing to medical spears they would leave them sterile. they allow them when medically necessary, but prisoners are not allowed to use it as a method of birth control. the report found between 2006 and 2013, 144 women had been sterilized for the soul purpose of birth control. now "today in the bay" follow-up, a judge is giving prosecutors more time to investigate diehl ya garcia

bratcher, the woman accused of choking a 12-year-old boy in santa rosa. no charges have been filed yet. garcia is accused of grabbing a child by the neck because she thought he was bullying her daughter. she says she only confronted the boy and told him to leave her daughter alone and never touched him. she'll be back in court next month. 5:49, proposal to limit workouts for young football players is on its way to governor brown's desk this morning. the would would -- bill would restrict how much full contact practice they have. practice would be limited to two days a week, 90 minutes each session. full contact practice would be banned during the offseason. conditioning and drills would not be counted. the idea is to reduce the number of brain injuries and concuss n concussio concussions. some coaches say california kids will not be able to compete with players from out of state who have unlimited full contact practices and better skills. >> many of them can't afford to
