an overnight kidnapping, but the man accused of taking her is still on the loose. for more information, we check in with derek shore who joins us live at sunnyville police headquarters where the girl was dropped off, what did you tell us? >> reporter: well it is relieving to know that little girl is okay, but the question is where is jose valencia. this is the suspect we are talking about. look at the two people involved in this, of course the victim and the suspect. a little before 10:00 last night, sunnyville police issued an amber alert for eight-year-old helena virginia lens yas. believed she was kidnapped by him. how those two are connected, we don't know. few hours later, officers say that little girl would be dropped off here at sunnyville dps, but jose valencia is not in custody. he is 150 pounds, 5'8", and he abandoned the car he was using in that kidnapping. that alleged kidnapping, but

it's thought to be driving his other car, that is a yellow ford escape. the license plate on that is 5 pnh 641. and as we understand it at this hour whereby sunnyville police continue to look for him. we are waiting for a call back from sunnyville d fost figure out exactly the status of this case, exactly what happened, and whether or not they have good leads on where valencia may be. the good news again, that little girl, safe at home this morning. that's the latest here from sunnyville, derek shore, "today in the bay." >> thank you derek, appreciate it. now a developing story. we now know what the president's plan is for iraq. not everyone agrees it's right. u.s. troops, no combat, yes. kris sanchez joins us live with more. >> reporter: good morning, it is a strategy that some say gives the insurgents time to continue their murderous march towards baghdad. to start the president is ordering 300 u.s. troops to iraq to work alongside the iraqi

military in their fight against isis. but not to fight with them. are the u.s. forces will help top choose targets and to strategize. and the president did not rule out targeted military action or air strikes, but he's not ordering for them just now. right now he wants iraq's prime minister to do something to get the sects to work together before the country erupts into civil war. some say the president's plan gives the insurgents more time to fight for baghdad. >> that does not foreshadow a larger commitment of troops to actually fight in iraq. that would not be effective. >> once again he's announced step a without thinking through the consequences of step b. >> reporter: some of the pushback did come from a group of iraqi veterans who want the president to disengage there, but the president seems steadfast and he's sending his secretary of state john kerry to the middle east this weekend to

rally support. at least one of the stops will be in iraq. it is a delicate dance for president obama who was elected in 2008 in part because of his commitment to wind down the war in iraq, the american public divided as well as lawmakers. >> thanks so much, kris. and the fallout from that is this, gas prices. they could sore at the pump here in the states. national average for crude oil is 3.68 per gallon. that is the highest price payed in june since 2008. according to oil future traders, the price could rise another 10 to 15 cents in the coming weeks, not welcomed news for consumers here. it is based on concerns that heavy fighting could limit the oil supply which is opec's second largest producer. 6:04, san jose police officers say a new staffing policy will be dangerous for them and the public. the unprecedented policy requires officers to work overtime so staffing levels can be met.

the department announced that plan yesterday. when overtime is needed, volunteers will be asked first if there's still a shortage. some officer lbs required to work three extra hours on patrol. but the officer's union argues overtime leads to stress and tired officers. well the deal should be done soon. this morning governor brown is expected to sign the state's $108 billion budget plan. than plan includes $7 million to help fund suicide nets along the golden gate bridge. . also calls for programs to supporting preschool, home care givers, and welfare to work grants as well as using 25% of cap and trade revenue for the controversial high speed rail program. it also focuses on paying down california's debt and building up the state's rainy day fund. in san francisco, city leaders will announce a proposal to stop marketing e-cigarettes to teens this morning. local congresswoman jackie spear will introduce the proposal in front of the san francisco general hospital. the issue has been talked about on capitol hill this week as

politicians slammed e-cigarette companies for luring teens with targeted ads. right now crews along the peninsula are trying to get rid of the west nile virus. they have just finished ground fogging in the area on your screen, see it right there, as you can see, it's bordered by highway 82 and highway 101 and poplar and fourth avs, this in san mateo. it comes after adult mosquitos were found earlier in the week stoking some concerns. >> that's right, they did spraying in san jose earlier this week as well. let's take a peek outside this morning, sun coming up, last day of spring. falling on a friday. summer hits early tomorrow morning, right christina? >> yeah around 3:23 a.m. tomorrow will be the longest day of the entire year. it's going to be pretty nice out there, butly say today, hotter than the first day of summer. we're going to cool off by 5 and 10 degrees. today's going to be warm, put that right on the map for you.

i want to tell you about some things that could really slow you down this morning. s.a.p. center at 8:00, there's a big event happening here. and a lot of people are going to be funneling to one general location at one time. so this is something that's really going to slow down the commute. we're expecting delays this morning there, also california, sonoma raceway, state route 37, we have a little nascar pre-game little practice out there. expect delays parent 37 and 121 and that's going to occur mid-morning, then tonight, the a's are back at it the. number one team in major league baseball. 7:15, people like to tailgate throughout, make sure you give yourself extra time or leave the office early. the good news is, no delays. everything is up to speed. we'll keep you updated throughout the morning. keep in mind, the s.a.p. center, 8:00 a.m., a lot of people, one general location, good spot to avoid, back to you. happening now, word of a rescue of several men that was stuck on a scaffold in new york

city. these are pictures just into our newsroom just a short time ago. we saw the scaffold just dangling there where we know that men were just dangling off of it. the good news is they have been rescued. this happened own the 179 floor of a building on east 57th and lexington. that's near central park this morning. multiple crews arrived on the scene to do what they could. but you saw the scaffolding dangling there for a moment as they pan up to the picture there. men dangling off of it. the great news is they were all rescued this morning, but quite frightening. >> 17 story fall would be dangerous to say the least. very fortunate and lucky they were able to survive that. this in new york central park on 56th and lexington in new york's south side. friday morning, still ahead on "today in the bay," ducking for cover as bullets fly after a concert. we'll tell you which high-profile venue went into welcomedown overnight. putting the brakes on tech

track after dropping eight of the last nine games. they square off against the arizona diamondbacks. you can catch that action right here on northbound bay area. our coverage begins at 6:30. at 6:13 in the morning here are today's top stories. right now investigators in colorado looking for the person who opened fire at a popular concert venue. it happened during a show featuring nas near denver. 300 u.s. militaried a advisoriers are heading to iraq to help deal with that country's internal conflict. the american military advisers will reportedly help iraq's military choose targets, but they will not fight. amendment to cut off funding to the nsa is headed to the senate after the house overwhelmingly approved it late last night. it places limits on how the nsa can permit access to e-mail, online browsing, and chatting history. police have arrested the head of the belgium swiss bank

ubs on suspicion that he and the firm helped wealthy clients evade billions of yur owes in -- euros in taxes. the amount is around several billion euros. nothing to laugh at there. the information leading to the raid came from people who used to work at that company. at 6:14, private shuttle buses help move thousands of tech workers across the bay area, but it is their use of public bus stops in san francisco that certainly causing controversy. "today in the bay's" stephanie chuang joins us live at san francisco city hall where a public meeting on this issue will take place later this morning. stephanie, these shuttles already got the green light to use some of these stops. >> reporter: right, good morning to you, laura. that approval came earlier this year to test out the pilot program for 18 months. we're talking about the tech giants for apple and google using so-called tech buss to shuttle workers from the south bay to the peninsula to san francisco using muni bus stops

like this one in mcallister across city hall. this has been going on for years for free. the pilot program would charge them 1 per stop per day. it would get about $1.6 million for the city each year. the municipal transportation administration holding a public hearing this morning to get feedback about 80 stops in particular across san francisco that the shuttles could use. some take away parking and converting the loading magazines. the shuttles are good because they eliminate at least 45 million vehicle miles and 760,000 metro tons of carbon each year. however opponents of the program whop have staged protests filed a lawsuit last month against the city in the hopes of blocking these shuttles from using bus stops. they say the tech buses sometimes block muni buses causing delays. opponents also say the shuttles bring in highly paid tech

is that guy ok? you're watching "today in the bay." welcome back this friday morning. it was a story that made national headlines. a bus driver saved from bullets bay bible in his pocket, but now, police in dayton, ohio, say that story is a lie. police say ricky wagner stabbed and shot himself and fired two bullets into his bible to stage an attack. it's unclear they say why he would make all of this up. he told police he was attacked by three black teenagers. the dna was the only dna found on scene. and ballistic tests show the bullets would have been easily gone through that bullet if it was in his chest pocket. wagner is sticking with his story. he's been not charged with a crime, but might lose his job. new video showing a greyhound bus crash in arizona.

you could see the passenger attack the driver there. it happened back in january. other passengers tried to fight off that man, but he swerves the bus, sending it into a median at 70 miles an hour. passengers went flying. 24 people were hurt, seven of them with broken bones. police say a lab test shows the suspect was on methamphetamine at the time. he is now under arrest. check out amazing video from florida. look at the left of your screen. you can see a motorcyclist suddenly launched from his bike after hitting a car. he does a cart wheel and roll, and he gets up with barely a scratch. just a little road rash we're told. the motorcyclist claims he purposefully threw himself to survive. he's purchased a motorcycle, apparently not deter skblpd he's like a stunt man, my good pns. >> maybe he had gymnastics in

his background, we're not sure. >> that's amazing. heavy rains caused a huge mudslide near a minnesota hospital. a large chunk of land fell right underneath this medical center last night. some staff had to evacuate, but the hospital says patients are in a different part of the building that is not in danger. the good now so far is that noens was hurt. the minnesota governor declared a sterng because of -- state of emergency because of so much storm damage. cleaning the grand canyon sky walk is not a job for everybody. it takes a well-trained crew hanging by a lot of rope and thousands of hours of work. the sky walk tracks hundreds of thousands of people from all over the world every single year. >> i'm a big thrill seeker, but not that. >> what do you think is going through their heads? >> exactly. it is 6:26 right now, still ahead, climate change labels. which bay area city could post new warnings at the gas pump.

washington. a vote today could make new york the 23rd state in the country to legalize medical marijuana. major change for your federal benefits. today the obama administration is announcing guaranteed relief to care for a same sex spouse. with more details on this landmark proposal, let's go live to tracy potts who joins us on capitol hill. tracy, this is an impact on thousands of families. >> reporter: it is, and it's not the situation in california, but in many other states where these marriages are not legal the federal government says families will be able to take advantage of the family and medical leave act which basically says if you need to take time off work to take care of of a partner or a loved one, you can do so without fear of losing your job for the first 12 weeks. that has not been the case for same-sex couples, but the labor department is extending that benefitted. they are the latest in a series of federal agency and

departments that are changing their benefits after last year's supreme court decision that struck down a key part of the defense of marriage act. so that is one thing happening today. also, the justice department is expected to announce that they're wrapping up their review of federal benefits and almost all benefits can be extended to same-sex couples except for a few, and for those few, they need congress to make changes. they're looking for legislation, laura. >> thanks so much, tracy. interesting story this morning straight from the bay area, berkeley could become the first city in the country to require warning stickers about climate change on all gas pumps. berkeley city councilman chris worthington came up with this idea, he says the warning signs like the ones you're about to see right here are ways to clean unthe environment, a reminder. the signs infringe on consumer's first amendment rights. >> what exactly are consumers supposed to do with the information that the city of berkeley is suggesting be forced

upon service station operators? >> the state of california suggested that, you know, greenhouse gases are a serious problem and global warming needs to be addressed. maybe we can do things that are alternative, like public transit and alternative transportation. >> this proposal has overwhelming support from city leaders and the city council could be voting on it by the fall. it is time to check the forecast, let's take a peek outside this morning up in the north bay in san rafael, a nice start to our friday morning. we've been experiencing some warmer temperatures, but maybe that's just gearing us up for summer. officially starts tomorrow, but it'll be cooler, right? >> yeah, little bit cooler, typically gas prices go down, because of what's happening in iraq, it's a good time too fill up your vehicle. and yeah, that's an interesting story coming out at berkeley. i'm going to put that up on your facebook page. let's talk about what's happening out there. right here, right now.

it's a nice day. 57 degrees in livermore. kind of crisp, cool out there. we're at 56 degrees in san jose, and 50 this morning in half-moon bay with a very shallow marine layer. you can see right through it this morning. that's not going to keep us cool out in the extreme east bay. as you head out and about this the friday, let's tell you what to expect. you can expect a beautiful day actually for the first part of the day. then lunchtime, if you have the outdoor plans, you want to get them completed before we hit noon because we'll be in the 80s. that's when it gets warm because we're going to be outdoors in the direct sunlight. nice for dinner out. . that's something you like to do on a friday night, it should bid comfortable all across the board. beautiful barbecue weather as well. that starts tomorrow. 92 degrees in the east bay today, 72 degrees in san francisco. couple degrees warmer than yesterday. we'll hold on to the mid-80s here in the south bay, be up that's a warm day for us. we're running about five to ten degrees above average in most

child by the neck because she thought he was bullying her daughter. but she says she only confronted the boor and -- boy and never touched him. she will be back in court next month. chp hopes to get help from this spectacle. during the peek of the morning commute, the man set his truck on fire, you see it delight, then danced around it. this happened just past the toll plaza, bizarre, homeland security officer happened to pass by. he and others detained the man. investigators say he seemed to be suffering some sort of psychiatric emergency. so she will not be charged. scary scene there and thankfully everyone's okay. still ahead, new twist in the search for the missing malaysia airlines plane. nice picture right now, this is sunrise over the san mateo bridge somewhere underneath there on a friday that marks the last day of spring, but low and behold, summer is on the way. we'll hear about that the coming up after the break.

perspective showing you both coy tower and al ka trez. we hope you have a wonderful day. the serge continues for the missing malaysia airline flight 370. crews will begin mapping the deep sea at the bottom of the indian ocean. look at these pictures. it's a dutch survey ship that will map out that area. it'll take about three months for the ship to map it out. about 1,000 miles east of australia's northwest coast. the plane of course disappeared on march 8th with 239 people on board. car bomb targeting lebanon's head of security exploded just hours ago. emergency responders are still helping victims, but the lebanese red cross told nbc two people were killed and 20 others injured. investigators say the bomb was intended to kill the head of security, but it went off after he already passed by. 6:40, coming up new this morning, little girl found safe, but the man accused of kidnapping her is still on the run. why the search is spreading throughout the south bay next.

"today in the bay's" derek shore live outside of the sunnyville police headquarters where the girl was reunited with her family. derek, what do police know about the suspect? >> reporter: well there's a little they are telling us at this point. i can tell you these two are the ones involved. and this man, right here, jose valenc valencia, he apparently is still on the run. that's the latest information we have. take a look at these two people

again, now a little before 10:00 last night, sunnyville police issued an amber alert for helena valencia corio and believed she was kidnapped by jose lew valencia. officers say that little girl would be dropped off here at sunnyville dps, but jose valencia is not in custody. he's a 44-year-old man, 150 pounds, 5'8", and apparently abandoned his car that he used in this kidnapping and is thought to be driving a different car. it's a yellow ford escape. the license plate, 5 pnh 641. that is california plate as we understand it. again, jose valencia apparently still on the run at this the time, but the good news this morning is that little girl is safe and back with her family. we are working to get more information from sunnyville dps as to exactly what happened here

and if they have any leads on where that suspect is. for now that's the latest in sunnyville, derek shore, "today in the bay." >> thankfully he's okay, thanks a lot, derek. jurors in oakland have a decision to make any day they could hand down a verdict in the case of two of alleged gang members. prosecutors say killed a three-year-old boy during a driveby. the prosecution said the men were trying to get revenge on a rival gang when the toddler was shot. the defense called the evidence circumstantial and claimed investigators rushed because of community outrage. u 50, lawyers expect the redwood city woman accused of driving drunk and crashing into a couple to be back in court today. investigators say in october, her blood alcohol level was more than twice the legal limit when she hit and killed these two as they walked their dog in menlo park. she crashed into a tree later. she is still in custody on a $2

million bail. this court appearance has been delayed several times since her arrest. investigators are looking for evidence to figure out the cause of a grass fire that destroyed two homes in the san jose foothills. neighbors say they first saw smoke coming from a vacant home yesterday afternoon. those flames quickly spreaded to another house and surrounding brush. all of this was neither 680, 280 interchange as you see on the map right there on clayton road in the east foothills. 17 san jose fire department engines jumped on to that fire hitting it from both the air and the ground. san jose police officers say a new staffing policy will be dangerous for them and the public. the unpress denlted policy requires officers to work overtime so staffing levels can be met. the department announced that plan yesterday. when overtime is needed, volunteers will be ased, if there's still a shortage, some officers will be required to work up to three extra hours on patrol. the officers union argues overtime leads to stress and tired officers.

finally it's time to ink the deal. this morning governor brown is expected to sign the state's $108 billion budget plan. that plan includes $7 million set aside to fund suicide nets along the golden gate bridge. also program supporting preschool, home care givers, and welfare to work grants as well as using 25% of cap and trade revenue for the controversial high speed rail program. it would also focus on paying down california's debt and building up to state's rainy day fund. if you're driving on one of the most iconic landmarks, go somewhere else. here's a live look at the world famous windy road of lombard street. it is open to traffic right now, but not for long. it'll billion closed every weekend starting tomorrow from noon until 6:00 until july 13th and also closed on friday july 4th. now the closures are temporary. they're part of a program after people living on lombard complained about traffic in the area. but you can still walk down the street.

in the men time, going to be a busy one on the roads in downtown san jose this morning. nearly 14,000 people expected to attend the american communications network seminar. it's at the s.a.p. center. it starts at 8:00 this morning. laura, good for the vierpt or bad for the residents? the controversy over tech shuttle buses using bus stops in san francisco will take center stage at a public meeting this morning. "today in the bay's" stephanie chuang joins us live at san francisco city hall, stephanie, it's a pilot program giving the shuttles to use public stops, it's already gotten the green light kind of, but what kind of feedback are you expecting to hear today? >> reporter: good morning, sam, we're expecting to hear quite a bit of mixed reaction on this controversial issue. the pilot program already approved earlier this year, but so much opposition, the start date was pushed back. the issue of course is tech companies using shuttles, then using these muni bus stops like this one here across city hall, its been happening for years and for free.

and some are very unhappy with this. opponents of the buses have staged protests and filed a lawsuit last month against the city to block these shuttles from using public stops. the pilot program disregards legally mandated reviews of the impact. they also say the tech buses sometimes block muni buses causing delays and bringing in highly paid tech workers leading to skyrocketing rent and housing costs and the evictions of lower income tenants. now this would charge tech companies 1 per stop per day. that's estimated at giving $1.6 million for the city each year. . sf municipal agency or sfmta is holding a public hearing this morning to get feedback about roughly 80 of the stops in particular that the shuttles could use. some include taking away parking, converting that station to shuttle loading zone. the shut are also good because they eliminate at least 456 million vehicle miles and 760,000 metric tons of carbon
