train. we are live where the accident happened. witnesses say maybe he was chasing his dog. >> reporter: well a friend of the victim i just spoke to says the man killed was walked a neighbor's dog when the dog got away from him. he ran after it to get the dog off the tracks. a vta train then struck and killed him around 9:00 last night near the baskin station close to the intersection of southwest expressway and stokes street. the friend says the victim suffered a brain injury a while back at a previous accident and may not have had the full ability to react quickly. about a couple dozen passengers were on the train. they were not hurt, but they had to be bussed to their destination. the collision caused major delays as you can imagine on the winchester line. the train was not able to stop in time. >> we are relying on the san jose police department top conduct the investigation. we as part of our normal

procedure will take the operator for testing and we will impound the train. >> reporter: the victim is the second person to die at this intersection. in january, a 14-year-old girl was hit and killed by a light rail train as she biked to school. people left candles and signs at the crossing. and back here live at this train stop, you can see that people have begun to put a candle and, beside it you can't see it, a bunch of flowers also for this victim. and the name of that man has still not been released. we should know later today the identity of the man. the dog is okay. we're told that the owner feels really bad about what happened. live in san jose, na net miranda, "today in the bay." >> thank you. now to a developing story in iraq. secretary of state john kerry arrived in iraq this morning in hopes of bringing the country back from the brink of civil war. today, kerry is meeting with the

country's shiite prime minister and leaders. u.s. officials say kerry is not there to get the prime minister to resign, though there have been calls for a new leader to bring shiites and sunnis together. investigators plan to release a report on the case of involving jerry sandusky. now among the questions whether politics were at play. >> "today in the bay's" kris sanchez joins us live with a report of what it's expected to reveal. >> reporter: good morning, the attorney gener who was in charge of the investigation at the time was also running for governor and that's the reason why people are wondering if politics had anything to do with why that investigation didn't go as quickly as a lot of folks wanted. jerry sandusky now serving a 30-60 year sentence for 45 counts of sexual assaulting ten boys. today, pennsylvania's attorney general plans to release that comprehensive account, kathleen cain vowing during her campaign to review this case repeatedly questioning why it took three

years for charges to be filed against sandusky. she argued that her predecessor took too long and wasted time while a suspected sexual abuser remained free. one of the predecessors as i mentioned, the current governor who was at the time the attorney general in charge of the investigation. it did take months between when that first victim came forward and when charges were filed against jersey sandusky. sources familiar with the report say there was reason for prosecutors to take their time because that first witnesses testimony might not have been enough to convict the former coach. that's according to to the philadelphia inquirer. the man who was the penn stacht president and two other administrators are also awaiting trial right now on allegations they miss led or lied to the grand jury in the case. now governor tom c oorks rbit is running for a second term and the findings like lit to determine that. a lot of people were date waiting for answers. this was ordered in february of last year. >> interesting, thanks kris.

park and rec worker accused of driver over and killing a mother at a san francisco park will be back in court today. he is charged with vehicular manslaughter and hit and run. police say last september, he ran over kristina vandamier while she was lying on the park in the grass with her baby and dog. baby and dog not hurt, she was killed. today the man will attend a status hearing. palo alto will hold a hearing on a housing project. it's just south of the intersection of california boulevard and columbia street. opponents of the 180 unit project say it's unsafe and puts pedestrians and bicyclists at risk. but the palo alto city says it has fully reviewed that plan and it is safe. meanwhile, also on the agenda, prohibit feeding wildlife and animals in city parks and open spaces. this is the second reading after the council approved the initial

north bay, 78 degrees along the peninsula. you can see we do have some commuters out there this morning on 10 1d and palo alto. let's check on the drive. mike is back, good morning, we're so happy you're back. it's good to be back. i was out sick last year, christina covered for my, thank goodness she was here. we're looking over here, we have commuters, 580, good volume of traffic. look at the map, that was jamming up around north livermore avenue. little bit later than we typically have on a monday for that crew to clear and a little bit of a build out of the pass. there you go, typical pattern though as you're coming through the area. we're watching the tri-valley because it looks like a few more cars. northbound 680 getting out of fremont, reports of a car fire right around on friday, but it turns out the car had smoke coming out. made its way to a station off after the roadway and that is not a problem for 680. i'll give you the updated answer. once the freeway's cleared, everything's good for the

commute. drive south which is your commute direction into the south bay. the rest moves nicely. few more folks on the roadway along the peninsula. you're between san francisco and the south bay. toll plaza with just a slight bield. we have an earlier slowdown on the right approach than has cleared and now we have your typical cost and no problem for fast track, back to you. >> thanks, mike. 5:058 starting this morning inless than an hour, what you can see at the park may be very different. at 6:00, new pilot program goes into the effect. designated off leash areas. "today in the bay's" stephanie chuang joins us live with a lot more, how tees sitting with people living in the city? >> reporter: you know there's a mixed reaction from people we spoke with before this morning. good morning to you, laura. . you come to parks like it one in mountain view, excuse me, there are signs like it one that say your entering the off leash area. this is where you get the

details on where dog owners can let their dogs run around off leash. it starts at 6:00 this morning. it is a pilot program that will show city leaders if people and docks can share the safely. the city says it surveyed the community last year with 68% of nearly 7 506d respondents saying they favored having more unfebsed, off leash dog areas. there was a meeting in february before city council members approved this plan. dog owners say with such limited land around here, this is a great way to keep everyone happy. >> it's hard because when you live in a place without a backyard, and you have to keep your dog on leash all the time. >> sometimes it's a dog area, and sometimes it's not. and that was really important because in the city the size of mountain view, land wise, there's limited space. >> reporter: this pilot program will run for one year. the city says it'll post permanent signs in a few months

you're watching "today in the bay." and a very good morning to you, it is 5:13, happy monday, this is a live picture of san jose, we actually hear some rain could be on the way, even in june. we'll take a look coming up. it is 5:13, marn million more -- more than a million more japanese cars were recalled this morning. honda recalled more than two million cars worldwide including a million in north america. mazda and nissan issued smaller recalls. all of this stems from faulty air bags manufactured by the corporation. now in some cases, the air bags can fail to inflate in a crash. nearly ten million vehicles worldwide have been recalled since that problem emerged. things are better two months

after the heart bleed bug emerged. it sent internet companies into a frenzy. security firm reports that more than 300,000 servers are still vulnerable to that bug. it's about half of the initial vulnerable servers when the bug was first uncovered. it is a software flaw that allows hackers to steal passwords and access your sensitive information. security experts say your best bet is to use of a different pass word at every site to minimize risk. the ceo of american apparel is fighting to get its job back. if the kpeen doesn't give his job back today, he'll sue. last wednesday, the board voted to replace him and fire him as chief executive. the move comes from a alleged miss conduct. a source tells the l.a. times he miss used company funds and leaked nude photographs of a former worker who was suing him. american apparel says its confident it did the right thing

and that's what brought in the clouds and dropped our temperatures. as we head throughout the next couple days. winds are going to continue to maintain on shore. it's not going to get too hot out there, between today and tomorrow, we are going to see a dramatic jump in your temperatures. about five to ten degrees between today and tomorrow. remember your seven-day forecast scrolling right there for you at the bottom of your screen. sop, a little drizzle out there, definitely possible, especially if you take one patchy coastal fog will be the case for the most of the day. as we head throughout tonight, sun doesn't set until 8:35. 80 degrees in the south bay. 78 degrees along the peninsula, 64 in san francisco and 86 degrees in the east bay for today. we told you about a very rare chance for showers later on this week. we have another area of low pressure coming in. it's going to keep temperatures comfortable. we hit that sweet summer stride temperature wise, but yeah, looking at showers, especially to the north of the golden gate bridge, right now the best chance looks like thursday into early friday. we'll keep you updated and i'll show you the future cast coming

up in just a minute. right now, good morning, mike. >> good morning christina. we're looking over towards san francisco. you notice some of the low clouds drifting through the area as christina's been talking about. your drive not affected, but you have a smooth floi of traffic at the toll plaza starting to build. let's look at the toll plaza and the east shore freeway, 24, 580, no major issues out of that construction has cleared from west 580 to east 80. we have your typical slowing developing. a little slowing there. watch along the planes. christina mentioned highway one of possibility for fog and just north of that tunnel, slide alternate there, the new pass there. we have construction which is off and on back on the roadway. if there is fog, it'll be disorienting. otherwise your flow moving nicely. look at the transit, that changed since i was gone last week. no problems for muni up into the

city. out to the live shot here, we'll see how things are shaping up. you see again the low clouds, just fine, we have westbound, i saw a few slower moving rigs and that caused a slowing drive down the inclien. now westbound 92, back at speed from the side, good stuff guys, back to you. thank you, mike. lombard street lost its cars for part of weekend but gained foot traffic as part of a test program. san francisco closed the legendary crooked street to drivers during weekend afternoons. but this is what it looked like on day one of the program saturday. everybody just started walking. the weekend closures were made after people who live on the streets complained there were too many cars clogging the road. the closures will be every weekend through july 13th as well as the 4th of july. >> now they have to avoid pedestrians. well there was an unexpected attraction for people at disneyland yesterday. check out this instagram

picture. black smoke over cinderella's castle. anaheim's fire department says an outdoor trash can caught fire in an area not open to the public. it was out within five minutes. no one was hurt, nothing damaged, no word on how that fire started. today san francisco will become the set for the latest tv show created by netflix. starting bright and early at 7:00, cast and crew members will hang around the district filming on location far new series called sense 8. the show about a group of people hunted by an evil something. not quite clear yet. it was supposed to come out this year, looks like its been pushed to 2015. 5:20, bay area sports stadium considered a top investigation for vegans. heading up next.

let's take a live look outside this morning, this is san jose, it's monday, june 23rd, this is "today in the bay". from nbc bay area, this is "today in the bay." well good morning everyone, thanks for joining us, happy monday morning to you, i'm scott mcgrew. >> and i'm laura garcia-cannon. investigators walked a stretch of tracks in the south bay where a man was hit and killed by a light rail train overnight. it happened in san jose where a teenage girl died earlier this year. we are live at that the set of tracks this morning, and the memorial is growing this morning. >> reporter: that's right, this is so tragic and a memorial is growing so that neighbors can remember and honor this man. police believe the man was chasing a dog and a friend of the victim confirms that the man was walking the dog for a neighbor. the dog got away and the man may have been so focussed on getting

okay and that the neighbor just feels horrible and feels very bad about this situation. as far as the morning commute, trains seem to be back to normal. we've already seen a couple of trains come by. live in san jose, "today in the bay." >> very tragic there, thank you very much. happening now, crews are working to surround a brush fire burning in the hills above glendale in southern california. started yesterday afternoon, already burned about 150 acres, the good news is no homes are threatened and there've been no evacuations. the bad news, two firefighters were hurt after they slipped on the steek terrain. in addition, five hikers were rescued. 5:32 this morning we expect to learn whether politics played a part in how long it took to bring convicted child molester jerry sandusky to justice. here we go, now my mic's on. we're going to hear aesht the report in about two hours, what we know right now is that jerry sandusky went three, four years after his first accuser came forward and we're going to find out whether the investigation to led to his conviction ultimately was delayed because of politics. so we -- there was, it was quite a big delay. we know he's serving a 30-60 year sentence for 456 counts of sexual assaulting ten boys. today's pennsylvania attorney general plans to release the comprehensive account. kathleen cain vowed during her campaign for the attorney general's office to review the case, repeatedly questioning why it took three years for charges to be filed against sandusky. she argued that her predecessors took too long and wasted time while that suspected serial abuser remained free. one of the predecessors is the

likely, he'll die behind bars. >> thank you kris sanchez. federal investigators are in the bay area this morning looking into a deadly plane crash in livermore. 63-year-old jerry parker died when he jumped out of a plane right before a crash. the plane took off from livermore municipal airport just before 5:00 on saturday. witnesses say a few minutes later, the plane caught fire and went down. that crash started a brush fire north of 580, it burned about one and a half acres before crews managed to put it out. the controversial kill switch bill face ascii vote today in an assembly committee. the state senate and another committee already approved that bill. it would require a switch on smart phones sold in california to allow users to disable devices. mandating such technology will cycle innovation. supporters say it would deter theft. we know the drought is bad, but today the utilities commission will talk about how bad the situation is in the city.

this is the commissions midyear water supply update and they'll talk about supply levels at the reservoir. the reservoir of course located in yosemite, but it carries water all the way to san francisco and beyond. an assistant general manager recently told the mercury news the reservoir has enough water to last two more years, and that's even if everybody conserves. and what we really need is rain, but a lot of it. there's hints we might get some this week, i'm very curious christina. >> yeah, that's even. everybody conserves, that's not factoring in the rain we're likely to receive as we head into the next rainy season. i have to point out right off the bat now that we are in summer time. our hot and dry season is up and running. so if you live in the wooded terrain of the bay area, you really want to maintain that wooded area around your home. you want to trim the trees, clear the brush around your house, and you know the law is 100 feet of clearing.

also, this is something that i don't always point out, but really this year i'm going to start. you want to report any suspicious activity that you see. make sure you can pull over to a safe spot and report it. we have to want keep this bay area beautiful. we need your help to do so. 55 degrees to start, 56 in oakland, and 52 degrees, good morning in half-moon bay. a reflection of those low clouds overhead, it is not clear in the half-moon bay, nor san jose. we're getting those as well. plenty of low clouds this morning. and we're looking good at at&t park where the giants are back at it. they're taking on the padres, we'll have the forecast in just a michelle obama. low clouds to start, this is the bait area from space. you can see the low clouds republican banks up against the east shore this morning and the immediate coastline, we're nice and clear for the most part throughout many of your valleys. south bay, east bay in particular. 78 degrees for the peninsula today. 88 degrees out in the extreme

east bay it's going to be warm and the north bay as well. we got a little bit of a jump in temperatures for tomorrow. you might have top use your ac before the rain. right now let's join mike redskin eye and -- mike inouye this morning. you're seeing they're slowing as well as the volume builds. the left approach about midparking lot where those cash barriers as well. the volume builds low clouds. look at the maps that we're showing you this approach is just fine out of maize that we just showed you. the toll plaza getting towards the richltd center. we have one brick down there, blocking one lane as you're coming off the area. cutting boulevard, no major issues and major slowing at the toll plaza. we'll track that coming off the east shore freeway heading off the north bay. the rest moves very nicely right now. we're looking at west 5le 0 with a slowing at livermore.

meeting with the iraqi prime minister just a few hours aide. tracy potts joins us live. the white house is very adamant kerry is not there to get the prime minister to resign. >> reporter: right, but a lot of people here in washington think privately that maybe he should. publicly the white house position has been that's up to the iraqis. what he's there to do is bring that government together. the u.s. thinks that the shiites and sunnis need to pull together to fight this common enemy and that is the point of these meetings. three of them so far this morning with the prime minister for about an hour and 40 minutes they sat down and other political leaders as well. it's already afternoon there in iraq. meantime, we're getting new information this morning that along out border, militants have taken over that entry point into iraq. it's a main road from iman to

baghdad. we're still trying to verify that information. if that's the case, it is a significant move forward for the sumi militants. >> one to closely watch i should said, thanks so much, tracy. in the men time, former bowe bergdahl one step closer to going home this morning. bergdahl has been moved from an army medical center, now getting outpatient care at a texas military base. the army says the next step in his reintegration processes is to get him exposure to more people and increase social interaction. he was freed after spending five years in captivity in afghanistan. the army is investigating the circumstances of bergdahl's capture, but he will not be questioned until his recovery is complete. 5:43, happening today in mountain view, dog own lers now be able to let their pets run free without a leash at some designated parks. here's a look at the six parks taking part in the program. stephanie chuang joins us live

at one of the mountain view parks. the program starts in 156 minutes and then the dogs can run free. >> reporter: that's right, good morning to you, scott. dog owners say they've been doing this, but the this is the first time they can do this without the risk of getting a sigh tigs. this is one of the places you can let your dog off. this one will tell you exactly what the designated hours are as well as the areas where you can have the dog off leash. these parks are popular not just for dog owners but for cyclists, walkers, parents who like to bring their kids. the question is can people and these off leash dogs share the park without problems. they got positive feedback after surveying the community a year ago with 67% and 750 people responding say they'd like to have unfenced, off leash areas for dogs. we spoke with parents who say they have a dog and some say they will keep their dogs on a

leash and don't trust them and hope other rs might consider doing the same. >> i assume people know that if their dog is dangerous to children they would be keeping them on leash. >> the people are responsible enough. >> reporter: the city hosted a public input meeting back in february before city council members approved the plan making at least 2700 mountain view residents happy. that's how many have licensed their dogs with the city. the pilot program runs for one year. it'll also post permanent signs in a few months information to dispensers to make sure dog parks stay clean. you can see the hours, 6:00 until 10:00 in the morning. different parks have additional hours. and here you have a additional hours to get your dogs off leash from 5:00 in the evening until just past sunset. live in mountain view, stephanie chuang, "today in the bay." >> good news, thank you stephanie. >> we were talking earlier that dogs love us, but we're not sure that they'd come back. >> bill that crazy lady, come
