live in the area where it happened. witnesses say last night's victim was chasing his dog? >> reporter: that's right. a friend of the victim just talked to me a few moments ago, and that friend says the man killed was walking a neighbor's dog when the animal ran away. he ran after it to get the dog off the tracks. and of course, tragedy happened. vta train then struck and killed him around 9:00 p.m. near the baskin station close to the intersection of the expressway and stokes street. the friend said the victim suffered a brain injury at a previous accident and may not have had the full ability to react quickly. about a dozen passengers were on the train, they were not hurt, but had to be bussed to their destination. it caused major delays overnight on the winchester line. this morning they appear to be back on track. last night's train was not able to stop in time. >> we are relying on the san

jose police department to conduct the investigation. we as part of our normal procedure will take the operator for testing, and we will impound the train. >> reporter: the victim is the second person to die at this intersection. in january, 14-year-old danica garcia was hit and killed by a light rail as she biked to school. people left candles and signs at the crossing at that time. and back here live, the same is being done here, candles and flowers are set up to remember the victim. the man's identity has not been released yet, but near this memorial, look up at the sign here, there's a sign that warns people to look both ways before crossing and of course sometimes whp you're chasing after a dog, you just can't see those. meanwhile, that dog is okay, the owner of that dog is saying to friend around here that she just

feels really bad that she had this man walk the dog for her. live in san jose, "today in the bay." >> wow, very sad, thank you very much. at 6:20, new this morning, secretary of state john kerry in iraq why where he hopes the meeting with the prime minister can help bring the country back from the brink of civil war. u.s. officials say kerry is not there to get the prime minister to resign. though there have been calls for a new leader who could bring shiites and sunnis together. kerry will also meet with sunni and kurdish leaders. coming up in 30e minutes, "today in the bay's" tracy potts will have the latest on the crisis in iraq from washington. convicted child molester jersey sandusky back in the headlines this morning. find out more about the investigation that led up to his arrest. "today in the bay's" kris sanchez will one of the questions to be answered, were politics at play, kris? >> reporter: hi scott, jerry sandusky went years after the

first victim came forward. the head of the investigation was running for governor at the time. jerry sandusky is serving a 30-60 year sentence for sexual assaulting ten boys. taetd's pennsylvania attorney general plans to release that comprehensive account. kathleen cain vowed during her campaign to review the case, repeatedly questioning why it took three years for charges to be filed against jerry sandusky. she argued that her predecessor took too long and wasted time while a suspected serial abuser remained free. one of those predecessors is current governor tom corbit who was the attorney general at the time and thus in charge of the investigation. as sandusky's trial, an investigator said that the investigation started all the way back in 2008. sandusky was not arrested until 2011. the sources familiar with the report say there was reason for prosecutors to take their time that the first witnesses testimony might not have been strong enough to convict the former coach.

that's according to to the "philadelphia inquirer." now the man who was the penn state president and two other administrators are awaiting trial on allegations that they miss led or lied to the grand jury in this case. governor tom corbit is running for a second term as governor. than report is a long time coming. it was ordered in february of last year. we expect to hear more about it at 7:30 this morning, scott. >> kris, dhaung. 6:05, federal investigators are in the bay area this morning looking into the a deadly plane crash in livermore. jerry parker died when he jumped out of his plane right before it crashed. the plane took off from livermore municipal airport just before 5:00 on saturday. witnesses say a few minutes later, the plane caught fire and went down. the crash started a brush fire north of 580. burned about one and a half acres before crews put it out. the tide may be turning against ocean front landowners who try to block public access to beaches. for the first time the

california coastal commission can now fine property owners who intentionally impede access. in the past, the commission could only take violators to court and had limited resources to be effective. now, the burden shifts from the commissions to the property owner. >> so before i could say okay, you're doing something wrong, we think, they'd get into a long, protracted court argument, the judge would throw his or her hand up and say i don't know what these guys are talking about. nop clarity here. all that's gone now. >> beach access is at the center of a dispute involving martins beach near half-moon bay where a land owner is accused of installing a locked gate to deny beach access. that case is now before a judge. 6:06, time to check the forecast as we give you a live look outside foster sympathy morning, can you make it out? haze to start out monday morning. feels great sometimes on a monday. clear things it up with christina loren. >> hey good morning to you, yeah the low clouds are going to

degrees for most spots. even right at the water, right by the beach, temperatures are going to get warm tomorrow. before we bring showers into the forecast, those will move in as wet head through the midsection of your week. really only bullseyeing the north part of the bay area. definitely possible. i'm going show you where and when coming up in the next report. mike is back, let's check in on your drive. >> instead of them being sick, that's work, better than being sick. over here look at the san may day owe bridge where there is better than a lot of mornings. you see the sign lit up on the right. you see something about a crash. if you get into a crash, pull over, no problems on the bridge. 92, just there at 280 and 92. involving a deer and we had some activity in the lanes, but it sound and looks like everything is moving smoothly. i wanted to point that out, same

thing from 101 flu the same area. looks nice into the construction zone southbound towards university. the rest of the bay, look at that, pretty predictable pattern. we'll talk about the rails. we just got word that they have a major delay system wide. reports of some sort of problem on the tracks between emeryville and oakland. that'll be an issue, that's capitol corridor, over the bart trains are moving smoothly and no problems getting into san francisco. all those rams are moving on schedule. looking over towards the tri-valley, typical pattern here and debris reported around the area, but no problems on our live camera shot. we'll check that out again when i get back to the desk. backup here, we see that they're looking nicely, no problems there. there's no problem, they're impeding the view from the camera of the bridge itself. when you're on the bridge, the and drive aez visibility, you're all right, don't be alarmed. we see the fog drifts around, we'll let you see if there's any

that sweet stride and temperatures are going to be comfortable every single day this week. you'll notice though on thursday, had to use the rain icon for san francisco. i will show you if your city is expecting showers. and we'll talk about some changes, pretty significant coming to your microclimate this week. she pulled out the rain icon. we had icon for debris here west 580. strask moving smoothly whereby but i'm still on the lookout for what is an issue. chp says there's some kind of deaf brie. we'll bring you more details that has comes in. and wooem talk about the slowing as well, coming up. here's a look at today's top stories. people are leaving flowers and candles at the intersection whereby a man was hit and killed by a light rail train in san jose. happened late last night right next to the baskin station. investigators say he was running after a dog when he was hit. the man accused of opening fire at a seattle university could enter a plea in court today. prosecutors say they'll seek a

life sentence for erin evara. he walked on to seattle pacific university and killed a student before he was taken into custody. right now hazmat crews carefully going through a suspected meth lab. five los angeles police officers were rushed to the hospital after they were exposed to chemicals inside a building. the suspect was also hospitalized. tonight palo alto city leaders will talk about an ordnance prohibiting feeding wildlife and ferrell animals in city parks and open spaces. it's the second reading after the council approved the initial plan. tonight's meet willing start at 7:00. right now mountain view, dog owners allowed to let their pets run free without a leash at some parts. the pilot program is in effect at six parks with designated off leash areas. stephanie chuang joins us live this morning, how's it sitting with people so far? not much company with people behind you. >> reporter: good morning to you

both, so far quite, not many folks out here yet. you can bring dogs out starting now and not run the risk of getting citation. that patch of grass is where you can do that. this is popular for a lot of people, cyclists, walkers, roller bladers, tennis court, people working out already over there. there's a baseball field here and patch of grass where kids play soccer. it'll show leaders here in mountain view if people and off leash dogs can share the space safely. most people, 67% of the 750 who responded liked this idea of the unfenced area where dogs could run free. before council members approve the plan, this will be hosted in february. dog owners, there's split. some say with such limited land in the city, this will keep people happy. others say they can let their dogs run free, but they won't. >> it's hard because when you

first let's talk about what your microclimates are headed for today. coolest weather as per usual, you head to the coast, 64 degrees. lots of cloud cover in san francisco, just up the road in santa rosa, you're going to be about 20 degrees warmer in the mid-80s for today with the cloud cover burning off up in the north bay. right around 9:00 a.m. this morning, but hey, 80 address, not a bad way to finish off the day in the south bay. 78 degrees for the peninsula. mid to low 60s today at the coast and in san francisco, bring that coat with you if you're headed to work out there. 69 for the east shore and 88 degrees. out in the north bay, what a great weekend for nascar out there. now as we head throughout the next couple days, we're going to drop off temperatures, bring in showers potentially late wednesday into thursday. now the whole bay area's fair game for drizzle and soupy conditions, but what when it comes to the organized potentially measurable precipitation we're counting on that north of the golden gate brinl. you can see the clouds increasing, really thick as we

come back wednesday morning. the best chance for rain comes into the mix as we head through thursday in early friday. let's check your drive, here's mike inouye. >> the dublin camera, this is the same speed as far as the flow of traffic. this stretch, we know it's building the volume. let's get a look at the map. we have reports that the debris and now finally reported by chp. tire shredded up in the roadway. right two lanes headed towards the dublin interchange, we didn't see the activity on the live camera, we showed you, we see slowing coming through that area. watch it, there may be a traffic break, but it's unleekly it's going to break up. there's a slower drive developing, and now slow south 680, your typical pattern, but 84 showing a good volume. that is a little more congested around the area. the south bay, smoother drive and 101 starts or it clear up right here at 680, but we have a slower drive north 101, north 87 towards 880.

reports of fender bender there. we'll track that. just happened here. live look where we had the slow down and we'll the traffic flows nicely from 680 to 280. and toward the airport without arm problem. back to your maps. we're showing you the rest of the bay which shows a predictable flow. san mateo bridge moving nicely in both directions between the city and the south bay. getting into the city, we have the bay bridge, backup at the toll plaza. slow west 5le 0 through the maize. but the feeling is nice, 50s, 45 at the very worst. driving through the north bay as well. southbound to 101, across the golden gate bridge. live look at the golden gate bridge shows you as we're watching, there's haze. the bridge view is just fine. of the bridge and of the north bay from the city, that's a little bit of a problem. that's okay because it's further than you need to see, back to you. >> thanks a lot. it's i6 20,less than an

new this morning, journalists now slapped with seven year sentences in egypt. the courts found two al jha zeer ra journalists publishing live to support the muslim border. they are now classified as a terror group. the verdict is a blow to freedom of expression because the prosecution provided very little evidence in this case. the journalists were arrested after police raided their offices in cairo last december. bowe bergdahl one step closer to going home this morning. he's been moved and now getting outpatient care at a texas military base. the army says the next step in

bergdahl's reintegration sprosz to get him exposure to more people and increase social interaction. bergdahl was freed by the taliban last month after spending five years in captivity in san francisco. the army is investigating the circumstances of bergdahl's capture and will not be questioninged until recovery is complete. supreme court could rule on cases this morning. affordable care act and the future of broadcast television. first the court could release a decision about hobby lobby's religious objections to the affordable care act. the company does not want birth control coverage included in basic health care plans, even though the affordable care act calls for it. and we could find out if a judge is going to stop areo, a company that charges customers 8 a month to watch any broadcast television, network live or recorded, broadcast networks say areo takes free programs on the

fuel depot on cruz drive in san jose. you can see again a handful of workers there. we've reached out to them for comment. we're waiting to hear back. some close to the situation worry the protest could cause local gas prices to spike. 6:32 on a monday morning, time to check the forecast this morning as we give you a live look outside. golden gate bridge shrouded this morning. time to check the forecast with christina laren for a peek of the week as well, good morning. >> hey good morning, laura, scott, everybody at home. new workweek, new forecast, new season. temperatures this morning are comfortable, mostly upper 50s and wind out there this morning. your wind arrows con fewed right now. they don't know which way too point. you can see the south end of the bay area. wind arrows pointing offshore. meanwhile on the north end, we're getting the influence of a disturbance that came through over the weekend and the wind arrows are coming off the ocean. we have plenty of low cloud cover here in san francisco to kick off the day. as we head into this afternoon,

your temperatures are going to get comfortable, another bay area center in the south bay. 537 degrees right now. you're on your way to the low 80s and that's it for today. we're going get that cool ocean air, it's going to persist all day long. sop really comfortable conditions, right at the immediate coast, cool enough for a coat, but not bad. 63. san francisco. 78 degrees in the peninsula today. 80 meanwhile for the south bay at 88 degrees. dry and breezy out in the north bay. that'll be the warmest region for the north bay. now i promised you we have the chance for showers coming in. we'll talk about that coming up. we'll check your drive, here's mike inouye. beautiful shot that you showed as far as the sunlight goes. but we also have, this is 101 at 680, not at problem and the map shows you this is an easy drive for this time of day just starting the second burst. as we zoom in we're focussing on north 87.

there's reports at a taylor onramp. we have slowing coming through downtown and heading up towards 880. that is an unusual stretch and unusual slow down. the rest starts to build. southbound 880 at the 101 interchange there. reports of a crash as well. we don't see slowing and that's been there are for five minutes and no problems for the connected lanes. they're all open and that shows up the same on the speed sensors. tri-valley, pretty typical pattern. a little shift in the past ten mirns, over off to the right you see the arrow. there's the debris back before you get to the north livermore scale and that's causing folks to back up to the pass. then a smoother drive through dublin. there's enough troosk show the slowing. out of employee santon -- pleasanton. south through hayward, the planes very smooth for 101 and 280. there's the dogged down as you're getting through berk le and emeryville.

in fact we have all lanes backed up, but the fast track lanes are moving well. even though the lights were turned on before 6:00, you have your the slowest drive off 24. you are moving pretty well and golden gate bridge despite some cloud hovering around the deck. no problems out of north bay. that's an iconic look. >> exactly. >> which is a different kind of luxury. >> thanks a lot. there was trouble far rower in the racing competition off california's central coast. >> the coast guard came to the rescue of this rower who capsized in high winds yesterday. it was in the chilly water for about four hours. rescuers say he had all the right equipment to help them find him. >> found the individual because he had a emergency positioning device and also had a radio where he was talking to us on and we were able to direction, point off his frequency and found him right away.

and the man may have been so focussed on getting the dog off the tracks that he just didn't see or hear the oncoming winchester train which struck him around 9:00 p.m. near the baskin station close to the intersection of southwest expressway and stokes street. candles and flowers have already been placed here to remember the man who died. he still has not been identified. the victim's friend says the man had suffered a brain injury at a previous car accident. and he may not have had the full ability to react quickly. vta says the driver will be tested and the train is impounded until the investigation is complete. the collision caused major delays last night forcing 25 passengers to use temporary buss to get to their destination. >> our train was traveling southbound, winchester train, traveling southbound toward bin chester and there was someone in the rite of way, and the train was not able to stop in time. and struck the person.

year sentence for 45 counts of sexual assaulting ten boys. today pennsylvania's attorney general plans to release the comprehensive account and kathleen cain vowed to review the case repeatedly, questioning why it took three years for charges to be filed against sandusky. she argued that her predecessor took too long and wasted time while a suspected serial sexual abuser remained free. one of those predecessors is the current governor, tom corbit was the attorney general at the time and was in charge of the investigation. an investigator with the ag's office said it started in 2008. sandusky not arrested until 2011. but sources familiar with the report say there was reason for prosecutors to take their time, one of those reasons being that the first witnesses is testimony might not have been enough to convict the former coach. according to the philadelphia inquirer. the man who was the penn state president and two other

out. >> good morning laura and scott. that pilot program set for a year as of 54 minutes ago. started at 6:00 this morning and here at the park, the designated area would be this patch of grass here. we haven't seen many dog walkers so far. we've seen plenty of cyclists using this trail, walkers. there are also tennis courts here. people up and about this be morning for that are. baseball field, soccer field, lots of people come to parks like these. the question this pilot program is set to answer is can people and off leash dogs share this park without problems? city leaders say 67% of nearly 750 people surveyed last year said they like the idea of the off leash area. we spoke with parents who also have a dog and some said they would keep their dogs on leash because they don't trust they'll behave and hopes others might consider doing the same. >> i assume people know that if their dog is dangerous to children they would be keeping
