make sure they have recommendations for change. >> "today in the bay's" kris sanchez joins us now. what are we going to find out today that's new? >> reporter: we find out what happened in the cockpit as that plane was going down into the sea wall there at sfo. that's an important day for not only the family of the three girls who died because of that crash, but it's also important for the rest of us who fly out of sfo and other airports. the ntsa can make recommendations about safety not only on the arps, but on the ground as well. asiana flight 214 was flying too low when it slammed into the sea wall at san francisco international airport last july. the boeing triple 7, flipped, slid across the tarmac and burst into flames. among the other preliminary findings we know, the skill of the pilots and the understanding of the flotle system is in question. aviation expert tells us today

we may hear more about what happened in that cockpit. >> what the crews are looking at are the changes, so it's clearer on whose responsible on the flight as you come in in landing. >> reporter: in addition to the three girls from china, 180 other people were injured and because the san may day owe county coroner's office died after being hit by two responding fire trucks, the ntsb may suggest changes to emergency response at the airport. the ntsb can only make recommendations to improve airport and airline safety, it cannot mandate it. that would be up to the faa and the airport commission. the hearing starts at 6:30, we're going to monitor it for you from the newsroom. we have stephen stock there, we're also going to stream it in case you want to watch for yourself. >> a lot of people curious. >> lots of updates. the former oakland high

school security guard -- >> before that though, at 5:30, we will take you live to washington, d.c.his morning where as kris mentioned, stephen stock, he's getting a firsthand look at the ntsb report, scott. all right, well new this morning, secretary of state john kerry meeting with kurdish leaders in northern iraq. kerry hoping to untaken al political mess that's been giving rise to that deadly insurgency. kerry wants to reform iraq's sooe the eye-led government to ease rising anger among sunni groups. yesterday kerry said the insurgency poses threats beyond iraq's borders and the future of iraq depends on the choices made in the next few days and weeks. the former oakland's high school security guard accused of attacking a boy in a wheelchair says he was acting in self-defense. he is the security guard down there, he's accused of handcuffing, then punching and dumping this teen from his wheelchair at the school last

month. mitchell's attorney tells the chronicle the teen involved has a history of discipline problems and spit on and antagonized mitchell before the incident. the student's not 100% wheelchair bound. it's 5:04 waen the owner of the facility where 19 people were left abandoned last year is not going to fight to keep her license to operate. according to the bay area news group, mary manuel withdraw h herself. the home was ordered to close down last october for violating several other department mandates. after it shut down, all employees expect a janitor and a cook simply left. leaving 19 elderly residents with basically no care. santa clara county sheriff's deputies caught a thief through a stolen computer. he was charged with a burglary and possession of stolen property. he stole several computers from

a business in april. last week, he apparently tried to use one of the computers to make an online purchase, deputies tracked him to his home. they found other stolen goods including silverware and money. crews in the south bay will be in force trying to get rid of the west nile virus starting tonight at 11:00, ground fog willing once again take place around sunnyville, and coopertino. it's expected to last several hours. it comes after some adult mosquitos infected with the west nile were discovered in the area just last week. >> mosquitos love the rain, christina loren, they're going to get a little bit of it. they are, you know what, not enough to accumulate, trace amounts of precipitation when which we cannot measure, scott, as usual, brings up a valid point. you don't to want leave that standing water anywhere around your home, do not let it accumulate because of the sprinklers. that's what attracts mote ski toes and they look to -- like to come out and dusk and dawn.

58 degrees in the south bay for today. 54 degrees right now. we are comfortable out there. it is crisp. i can tell you there's very little cloud cover and that's all courtesy of that westerly wind. it's relentless, but it's keeping our sky nice and clear. as i show you emeryville, what a difference a day makes here, no low clouds at this point, once we start to see the sun come up over the course of the next half hour, you're going to see a little bit of low cloud cover, but not much. summer sun by 10:00 a.m. 70 degrees for the peninsula today. a cool ocean breeze. it's going to be rather warm out in the north bay, 89 degrees here. this is the warm spot, but hey, you head on down to the east shore, comfortable conditions at 73 degrees. i'm going to show you the showers, let you know if your microclimate subpoena included. only a 20 to 30% chance, nonetheless it's rare. we're going to show you coming up in just a minute. it's traffic tuesday, here's mike ig eye. -- inouye.

no big surprises, we expect a heavy volume of traffic, right now no surprises for dublin, let's look at the map though for the tri-valley because we have a couple of issues reported. back here in the pass into livermore, west 580 shows the build, at the edge of the screen, reports of a motorcycle which is now stuck in the center divide, sounds like they had mechanical difficulties. any time someone standing in the center divide big a. slowing, right at the scene, same thing coming off that dublin interchange. there'ses a car reported with a flat tire. eastbound countercommute, but may be visible. that's why we're seeing slowing in the opposite direction. unlikely because it's on the shoulder. end with a shot of the bay bridge and smooth drive across the bay. back to you. >> thanks so much, mike. this morning audrie's law could pass a key test vote at the state capitol. it is a bill noent close loopholes in sexual assault climbs. miranda joins us live where audrie pott went to school. lawmakers put off this vote last week. >> reporter: well, yeah, it's going do a tough battle in sacramento. it's between two groups, a group that say sthas they want tougher laws, tougher crackdown on juveniles who sexual assault an unconscious or disabled victim. tougher punishment goes to far says the other group. audrie potts was 15 when she drank too much and passed out. three boys admitted to the attack and to taking pictures which were later shared with classmates. audrie committed suicide. the teens were sentenced 30 to 45 days. audrie's law proposes to increase the minimum sentence to two years. reduce the confidentialal and impose bigger fines in cases where social media is used to share photos of the crime. >> what we're asking dpr in a

two-year minimum sentence is completely reasonable, it's warranted. >> it takes away the discretion of the judges and probation officers to craft a rehabilitatetive program that truly works for kids. >> reporter: the assembly public safety committee will try again today to pass audrie's law. it was put off until today after it didn't have enough votes last week. the hurtle appears to be democrats who are reluctant to pass mandatory sentencing laws that sometimes leads to overcrowding behind bars which could lead to california facing big trouble with the fed. live in sarah toga, nbc bay area news. >> thank you. 5:09, almost a third of the state is experiencing exceptional drought this year. there are cities that are getting creative in the hopes of getting people to conserve water. >> stephanie chuang live where a new billboard campaign is turning heads and hopefully turning off the faucets, good

morning, steph. >> reporter: yeah, good morning laura and scott. conservation and sexy not mentioned in the same sentence, right? that's whatd city of san francisco is hoping to do with the new ad campaign. you'll see some of the ads at muni stops. jiggle it is one, about repairing a home plumbing leak and saving hundreds of gallons of water a day. quickie, saving two and a half gallons a minute by cutting down the shower time. dirty hands, asks people to turn off the faucet when using soap and that's supposed to save two gallons a minute. doing it it another one of the five ads. that references replacing your old toilet, qualifying for a rebate of $125 or more. but it's not just messages in writing, a barry white-esk voice asking you to conserve in a ad released next week. >> turn off the faucet while

soaping those dirty hands. screw it on, yeah. >> reporter: all right, so points for getting creative there. the san francisco public utility's commission gaye its midyear supply update yesterday revealing that the total storage is under 65% of maximum capacity. all available snow pack has melted, trying to get the message out there, pnc asked dmers to voluntarily reduce water consumption by 10% or eight billion gallons of water by the end of the year. said yesterday that it has only reached 17% of that goal. so not only is that, the city of pleasanton trying to approve spending up to $200,000 to hire a public relations firm to get that message across in that city. san francisco not alone in trying to turn heads so to speak. live in san francisco this morning, stephanie chuang, "today in the bay." >> those are clever.

you're watching "today in the bay." welcome back everyone, it is 5:14, a reprieve for local students attending three colleges under investigation by the u.s. government. the u.s. department of education has cut a deal with crittenton yan colleges which own healb and

everest colleges. they'll get $16 million of federal funds to stay in operation until the student students can graduate. they were falsifying job placement rates, altering grades, and attendance. bay area mayors petitioning the fcc in support of net neutrality. at the u.s. conference of mayors, the mayors of san francisco, fremont, san may day owe, and others called on the fcc to enforce the free flow of information over the internet. now this resolution mostly symbolic, but they do hope it'll sway lawmakers on capitol hill. in january, a federal court decided based on current law the fcc had no jurisdiction to enforce net neutrality. well for a quick look at the markets this morning, let's go to courtney reagan, she's live at cnc headquarters, good morning, courtney. >> reporter: hi, good morning, scott. futures lower after stocks start odd an mixed note.

s&p 500 snapping the winning streak. nasdaq did eek out a small gain to close at a 14 year high. data on home prices, new home sales, and customer confidence. flipping nearly ten point, within 100 points of 17,000. the nasdaq edging up a fraction to 4368. >> thank you. could the a's be distancing the team from the city of oakland? some fans think so. the score board changed last week as you can see from the image posted on instagram. instead of oak which appears on the board, a's was in its place. the person thinks it's the teams way of getting back at oakland for the drawn out lease extension talks. the a's say it's not true. our score board, folks had been researching what other teams in pro sports did-city or nickname. >> a subtle dig at the world.

let's check in with christina this morning. >> there's a number one team in major league baseball right now. >> the giants not trailing far behind. >> even after a significant slump, you know what i'm talk abouting if you're a giant's fan. the good news is they're at home, at least for the next five to seven days. i can tell you right now as we get into the next seven day game stretch, it's going to be nice out there. but it will be chillfully san francisco. now today, they have a game at 7:15, tomorrow it's a day game, and we're going to look at the forecast for both coming up as we head throughout the day, i can tell you it's going to be warmer out there. 5208 start the day in livermore, on our way to the mid-80s, so noticeably warmer here. we ended up in the upper 70s to low 80s yesterday, today we're going to trade those in for the midup toer 80s in the warm spots. coast tam fog out there, but mostly clear to click off your tuesday as we head throughout the day today, we're going to see patchy fog clinging right to the immediate coastline,

otherwise, mostly sunny conditions and it's going to be warm as a result. little gusty later on today as well around the water. temperatures work like this, 82 degrees in the south bay. 86 degrees for the extreme east bay, 67 degrees in san francisco, and 89 degrees in the north bay today. that's going to be the warm spot, santa rosa and na that both get unseasonably warm later on this afternoon. to want give you a preview of where we're headed. temperatures are going to be really, really comfortable as we get in the next couple days, through saturday as a matter of fact. but i have to tell you, there's a chance for drizzle and showers. that looks like thursday into friday for areas north of the golden gate brinl. as far south as sfraebs, but the no further south than that. no action in daily city. however, i'm going to show you what it looks like, time it out on your future cast in just a moment, stick around for that if you can, here's mike to help you get out the front door, good morning. >> good morning. easy drive for most of the bay. i'll call out a couple of slower

spots. west 580 out of the pass, grantline road, disabled motorcycle in the center divide, then distraction, but the most of you slowing. now just starting as you're coming out of livermore and in towards the eastern edge of dublin. no big surprises and eastbound 580 off 680. we have reports of the car fixing the flat tire, no lanes are blocked. be careful for the folks on the side of the road. also watch west 24, earlier crashes plurl have just about wrapped up. i'm going to monitor this, no slowing so i'm going to take this off of our big alert list for the time being, i'll remember it, let you know if anything else develops. approaching the maize, smooth flow of traffic and look at the south bay as well. northbound routes, the construction crews are picking up. we'll give ewe look at the toll plaza with an easile to of traffic out of the maize. no problems, just a brief pause to pay for cash payers and the north bay, 101 a is your major

commute and no problems. west 37 for vallejo, back to you, scott. big bowl of breakfast cereal could do more harm than good. children who eat too much fortified cereal could be getting unhealthy amounts of vitamin a, zooeng, and -- zinc and niassan. the portions were set by the fda in 1968 and haven't changed since. health experts say getting enough of the nutrients is of course important, but actually getting too much can even cause liver damage and bone problems. it is 5:20, we now know the cause of the massive fire that torely it the ankless national forest last year. it burned some 30,000 acres. took almost two weeks to contain. u.s. forest service says it started because of electrical power lines although they

at 3:30 in the morning. it's heavy out there. we'll check with him in a minute. u.s. national team getting ready for its crucial final group game against germany. the u.s. needs at least a tie to guarantee it advances to the knockout round, and the same goes for germany and this is led to speculation the two teams will purposefully play to a tie in order so they can both advance. both coaches though say they're playing to win. it's 5:24, british company selling off some world cup merchandise at a bargain basement price. >> that's a miss take while printing, that is president obama in the center there. >> the mug was supposed to be the english player chris smalling. you can decide for yourself if you think he looks like the president. the company now selling the 2,000 mugs on wholesale side in the u.k. for 2,000 british

"today in the bay's" reporter joins us live in sarah toga and

lawmakers still working on possible changes to the original bill? >> reporter: that's right, audrie's law faces another key vote today after it was delayed last week because of the lack of votes. the proposal as it was written last week increases the minimum sentence for sexual assaulting an unconscious or disabled victim to a minimum of two years for juveniles. reduces the confidentiality sentence and imposes bigger fines where social media is used to share photos of the crime. audrie's parents are pushing the tougher punishment after her expressed her life is ruined. the 15-year-old drank too much at a house party. three boys admitted to attacking her and sent papers to class mates. the teens got 30 to 45 days for that. opponents say the justice system needs to have flexibility. >> it takes away the discretion of the judges and probation

officers to craft a rehabilitative program that truly works for kids. >> we feel that what we're asking for in a two-year minimum sentence is completely reasonable, it's warranted. >> reporter: the assembly public safety committee will take up the bill again today and has the approval of the senate. now when votes are delayed it's usually an indication to buy nor time so all sides can come together and come up with a compromise. amendments if any will be brought up at today's hearing, nbc bay area news. >> thank you. now to the very latest on the investigation into asiana airlines flight 214. this morning we may find out what happened inside the cockpit of the plane as it crashed at san francisco international airport. "today in the bay's" kris sanchez joins us now, investigators released new information in an hour.

>> reporter: certainly we're hoping for. we expect greater detail about what happened inside the cockpit as the airplane smashed into the sea wall at the airport. the boeing triple seven came in too low and too slow for a safe landing and it flipped, slid across the tarmac and burst into flames. three girls from china died in that crash and the ensuing emergency response at sfo. northbound bay area investigative reporter stephen stock whose covered aviation for years is live in washington, d.c. for the hearing. stephen, we've been hearing from chairwoman debora hersman for a long time that this isn't about pinpointing the blame, but about finding out what happened so it doesn't happen again in the future. >> reporter: that's exactly right, kris. this hearing probable cause hearing is due start 9:30 here on the east coast, that's 6:30 your time, and essentially you're exactly right, they are not looking to assign blame but to exactly determine what went wrong. and all you have to do is

essentially look at the title of the agenda of today's hearing and it is called dissent below visual glide path and impact with sea wall. that's a complicated way of saying what you just said, kris, that this amps going too slow and too low when asiana flight 214 crashed into the end of runway 28 left at san francisco international airport last july 6th. as you mentioned three people died and dozens more people were injured when that plane cart wheeled down runway 28. as we first reported back in august, our investigative team uncovered the fact that there were questions about the pilots being overreliant on automation. essentially the facts show these three pilots, very experienced pilots all, sat in the that cockpit and did not react for a full 26 seconds after the plane dropped below the altitude and speed needed to land safely. today the ntsb is going to focus on exactly why that happened and

of course issue its probable cause. we'll be here, kris. >> thank you very much stephen in addition to the proximate cause, we expect to want hear recommendations for changes for safety, not only at the airport, but also on those airplanes as well. investigative reporter stephen stock will have another update in 30 minutes. he will be inside that hearing as that report is being read. be sure to watch nbc bay area news at 5:00 and 6:00 tonight for an in depth report look at that the report as well. >> all right, kris, thank you much. new this morning a man who grew up in the bay area will have to face a judge in southern california tomorrow on three counts of murder. he was arrested saturday morning in san diego in connection to the killings of three people. flint and salvador were killed last christmas eve, the brother's body found in the truck of a car several weeks later.

his family members, many of whom live in hayward say they were shocked by his arrest pane support him 100%. his only prior arrest was on a weapons charge. 5:35, south bay family hopes you'll help them find a person who ran over a loved one. he was hit by a car while walking home with a friend in san jose. his friend told the family he was hit by a black truck and that someone in the truck stopped to look at him before taking off. now the family is begging witnesses to come forward. >> we just want the suspect, the male or female who seen this or hit him stop and look and took off. that's not fair for the family. you know, because this is serious, he's practically dying on his death bed. >> he is in critical condition in a coma. the hurricane happened near -- hit and run happened in silver creek road. if you have any information, san jose police to want hear from

you. los angeles police were on tactical alert overnight as crowds spilled on to the streets to celebrate mexico's big world cup win. a large crowd of enthusiastic fans blocked a major intersection in the san fernando valley yesterday. at one point, chp officers cut off access to interstate five to keep the fans safe. at least one person is arrested. officers not allowed to come home until the tactical alert was lifted earlier this morning. in huntington park, five people were arrest snd world cup celebrations. police on horseback and officers had to break up large crowds. lapd typically does have officers on alert for any sort of big event like this. it is 5:37 right now, time to check the forecast with christina loren. looks like a beautiful morning. >> it is going to be really nice throughout. good morning to you, laura, scott, everybody at home. you know what we could deal with the triple digits, we could see air quality suffering, we are not going to see either of those

things for quite some time. that's because we have an area of low pressure on the way to the bay area. it's keeping temperatures comfortable right now. mostly in the 50s. let me show you the different types across all the various mie crop climates in the bay area. san jose nice and clear, hazy, little bit of low cloud cover, but not much this morning. meanwhile we're just getting a spectacular sunrise at this the point in san francisco. so just a gorgeous way to start the day here. and we have a really nice finish for glout san francisco. it is going to be a little bit on the warm side. i've got to put that on your radar. out in the south bay, not too bad, 82 degrees, couple degrees above average for today. 86 meanwhile for the east bay and you're going end to up in the upper 60s and san francisco, windy at times. especially as we head throughout this evening. the wind will pick up. as we get into the next three days, preview for you, limited cloud cover today means temperatures will end up close to 90, we are going top shave five to ten degrees off today's highs as we get into tomorrow afternoon. those clouds will increase and

then we're talking about showers as we head through thursday and potentially into friday as well. i'm going to show you your future cast in just a minute. stick around for that. right now mike is busy and it's early. what are you tracking this morning? tracking the bay bridge toll plaza because right about now is when we see right about this. see the crowd gathering for the cash lane. it's 5:39, we expect to see metering lights turn on in the next ten minutes. the east shore freeway coming out of the maize, easy drive so far. you saw the build just starting over there. now we're looking southbound 880 around fifth is where there's reports with a car with a flat tire around downtown. nop slowing and no updates in the last few minutes. we will track that and let you know if they have a lane blocked over the next few. meanwhile over on the other side, the peninsula moves nicely as well into and out of san francisco. typical slowing for 580 out of the pass and towards the dublin interchange. easy drive for the northbound route, no slowing yet for 101, but we'll see that over the next

sun. so as we head throughout the morning hours, we're only going to see a little bit of the fog clinging to the immediate coastline, those ragged patches we're so acustomed to. throughout this afternoon though, breezy to windy conditions develop, it's going to clear all the low clouds out of here, and then as we get into this evening, it'll be a little bit gusty at the bay, and at the coast, i can tell you right now, it'll be comfortable as a result inland of that wind picking up. so here's where we're headed. 82 degrees for the south bay today, a nice cool breeze for those of you who live and work along the peninsula, 78 degrees, lovely day in silicon valley, 66 for san francisco out in the tri-valley, hot sun for today, 87 degrees for you, 73 for the east shore and it'll billion warm out there in the north bay today. up to 89 degrees. now let's get interesting, shall we? we have showers on the way to the forecast. on the way to the bay area as we head throughout thursday and friday. and it's really unusual to see this because june, july, and august are the driest months in the bay area.

scott, supervisors are concerned because right now medical marijuana dispensaries are allowed in unincorporated areas of the county, but santa clara county supervisors may have control in they end up passing an immediate and temporary moratorium to prevent any dispensaries from opening before the county can develop laws to regulate them. although right now there are no pot shops or cultivation shops licensed by the county the new law prevents them to grow at a single site in the city in the county or a county that border santa clara county and that worries leaders. this. morning, the supervisors will decide twlornt pass the urgency ordnance hoping the moratorium will prevent the growing operations from cropping can up within the city within the county over the board's july recess and give it time to prepare zoning ordnances to regulate them by august. county leaders will hear why they aren't wanted in the county including the rise in crime and
