it's going to be beautiful across the bay area courtesy of the showers that rolled through really quickly, but an impressive batch to come through the bay area this time of year. afterall we are in the summer time. i'm tracking this little residual batch. as that area of low pressure dips into the south through today. we're going to cut off the showers around lunchtime. look at how nice it is this morning. we have plenty of 60s out there. concord, san jose, 60 degrees in santa rosa. it smells nice out there. we have beautiful conditions today. then we're going to crank up the heat towards record levels, also the fire danger for next week. we'll take you through the changes for your specific microclimate. right now back to you, scott, laura, the rest of the top stories of the day. government could place limits of construction on tall buildings all in the name of safety. we are joined live at oakland international airport, there's concern that the idea could lower property fall.

>> reporter: absolutely, that's a concern of developers and people who own property. it doesn't happen often, but planes can lose an engine during takeoff and airlines must plan for that possibility. planes are able to fly with an engine out, but have less power to climb quickly to avoid building cell towers and other obstacles. over at san jose international airports airlines reduce the number of passengers and the amount of cargo so that the plane is light enough to maneuver in the event an engine quits. the federal aviationed a nrgs is proposing to reduce the height of buildings. for example, building located 10,000 feet from a runway would have a maximum height of 160 feet. the current limit is 250 feet. the explosion of development near airports is driving this push because the more buildings, the fewer safe flight paths. as you can imagine, real estate

developers are criticizing the restrictions saying as you said, it could affect property values. the property posed limits would not affect existing buildings, but adding a floor or tearing one down to replace it with a taller one might be hindered. live at oakland, "today in the bay." >> thank you. weeks of graphic testimony about the beating much bryan stow. and yesterday, they heard from the two men who were sent to prison for the assault. they didn't hear much. in a video of a jailhouse interview, louis and marvin declined to answer questions. the two men are not named in the suit which seeks to prove the dodgers did not provide enough security to keep stow safe. woerkers at a nail salon in san jose will spend the morning cleaning up after a car crashed through the front door. you can see the car went straight through the front of

endless beauty salon. smashing windows and a wall. we have not been told what caused the driver to crash into the building, fortunately nobody hurt and endless beauty is a salon on lunde avenue. mountain view police posted items found in a burglar's house. they are hoping to find the rightful owners. they caught this man breaking into a bmw dealership. police say he was later arrested in a nearby neighborhood. police caught a third suspect from a lead in the investigation and found hundreds of stolen items in his house. now those items are now posted on mountain view's police pinterest page. i'm taking a scan myself. police are looking for other stolen things like motorcycles, gloves, leather jackets, and helmets. people who live in san francisco hope someone will help them find a man whose been stealing mail. look, this surveillance video

sent to us by a resident of the complex. you can see the man tearing open the mailbox with a crowbar and taking everybody's mail. it took him about three minutes to get in there and get out. people who live there say they've actually experienced mail theft many times before. they say packages started disappearing around christmas time. since then, their mail has been stolen three separate times. >> gosh, there's cameras everywhere too. deal or no deal, the mlb says the a's worked out a deal to stay at the coliseum for another ten years, but oakland mayor says not so the fast. commissioner bud selig says the deal includes an outclause in case the a's are allowed to move to san jose. gene kwaun says negotiations are still ongoing and supposed to be meeting today to talk out things. the authority that manages the coliseum is supposed to vote on a lease tomorrow. also be approved by the alameda county board of superviers and the -- supervisors and the

oakland city council. the weather could foresee it, the postponement, maybe. referee's are looking at the field to make sure it's not soggy. >> millions of americans are really counting on the clouds to clear above brazil so we can watch the match in the living rooms wherever we are, including here in the bay area. stephanie chuang is live outside the britain san jose. she joins us by phone on how the bar is preparing for the big game, they haven't opened up the doors yet? >> reporter: they have not opened just yet. so it is dark here. they are getting ready to open pretty soon. few hours away from the game of course. u.s. plays germany 9:00 this morning our time. really folks who need a win today. a lot of fans opening for -- hoping for passionate games bauds the u.s. is tied with portugal.

tied with porch ga gal on sunday with the late drop and expect a very tough american team to fight on the field. but that's also the same case for germany which is tieing on saturday. that team has something to prove. so again, fans really excited. and what's also making this more interesting today, i've heard fans talk about how the u.s. coach is germany's former coach. he led that team in the 2006 world cup to third place, and former assistant is now the current head coach for germany. we are again, you know, waiting for the britt here, popular downtown san jose bar to open up this morning. we will have interviews with a couple different peoples this morning on "today in the bay." we have someone from the organization, we alsos have joe cannon, a former all-star goal keeper. he's a bay area native. he also played with a chris whose reffing the quakes for team saus in brazil. watch out of for him.

maps will show you the area right there. no slowing out of the north bay or heading out of the city into the north bay. they'll be slowing after work around at&t park. nice easy drive through the north bay and no delays across the bridges. that's a good flow of traffic right there. wider shot shows you just a gentle slowdown, debris reported in the roadway around the approach towards north livermore avenue. coincidence because that's where we see that pattern anyway. the rest of your commute, nicely hoff moving -- moving. 101 at monterrey road, monterrey street i should say in gilroy. no closure, overturned big rig goes on there. northbound 101 and southbound moving smooth. nothing like that for the peninsula, 101 and 280, you're at speeds, back to you. new this morning, mike, nato soldier was killed in an attack in southern afghanistan.

the soldier died as a result of an enemy of forces attack yesterday. clashes between afghan security forces and taliban fighters have been going on. southern afghanistan for the past four days with dozens killed. 5:19, more than 80 people were treated for dehydration and suspected drug and alcohol abuse at an electronic dance concert in boston. fire officials say some 50 people were treated at the concert last night. others were transported to the hospital. police are investigating a tv garden because people were allowed in even though they were drunk. officers also say most of those treated were underage. no one was seriously hurt. the concert was for a d.j. follow-up to a story we've been telling you about for months. three of the four san jose students accused of a hate crime are going to have to defend themselves at trial. they face misdemeanor battery and hate crime charges. that trial scheduled to start in december. a fourth student has been charged as a juvenile.

all three have pleaded not guilty to charges they taunted their african american roommate by calling him racial slurs, hanging confederate flag, putting a u-shaped bike lock around his neck. a bill requiring ride sharing vehicles to carry $750,000 worth of insurance is moving forward. a state senate committee passed that bill yesterday. the mother of a nine-year-old bay area girl who was hit and killed by an uber car on new year's eve says she supports the new rules. the driver had the uber app on, but he didn't have a pass skbrer at the time. are the family is suing uber which denied responsibility in the crash. corvette museum where a massive sink hole opened up is considering putting some of those cars back inside the hole. museum officials say attendance is up nearly 60% thanks to the sink hole opening. the hole thing, you'll see it here caught on camera.

the museum in kentucky decided to preserve the sink hole and officials says they may put one of the two cars back inside. the hole is now part of corvette history. a san francisco man has come forward as the winner of a $70 million lot toe ticket -- lotto ticket. he purchased the ticket and four others at a safeway in san francisco last month. his thoughts before buying the tickets, and i'm quoting here, why not? he does not work, at this point he'll probably work. the safeway gets 3506,000 -- $350,000. 5:21, your brazilians are asking rolling stones maria quiban jagger to cheer for someone else. let's take you outside in a beautiful shot of san jose. this is a bit damp out there, do be careful in your drive into work this morning, we'll be back in just a minute.

shoot video while hanging ten or jump out an airplane. gopro will trade under a gpro. shares will start trading at $24 each after it priced at the high end of its range last night. and at the offering price, they're worth about $3 billion. last year the company generated nearly a billion dollars in revenue. here's the guy behind it, nick woodman. -- goodman. he accepts an award, sberper in of the year award. woodman an avid sportsman, graduated at ucsd and formed gopro with some of his college classmates. now it's going to be up to investors today to decide if they think gopro has a future or a flash in the pan. consumer tech hard to predict. things get cheaper and more common in the electronics. remember at one point, cisco paid half a billion to buy flip video, flip cameras don't exist

anymore. >> quite the start for them, thanks a lot. new this morning, shooter is on the loose in san francisco. he opened fire outside a busy store. investigators say two men were arguing inside a t.j. maxx. just before 9:30 last night. the fight spilled outside, one of the men shot the're in the -- other in the stomach then took off. the victim was taken to san francisco general but we have no update on his condition. investigators looking into a fire at stanford's accelerator. it started on stanford property in menlo park near 280. crews briefly shut down the freeway in both directions because of the thick smoke. when crew ace reporting lived, they de-energized the accelerator and used special extinguishers to put out the fire. it appears the fire started in a large electrical switching cabinet. no one was hurt, and crews say there was no threat to the public. at two miles long, it is the

longest linear accelerator in the world. the search is on for a driver of the black sedan who hit someone in the south bay in san jose. it was blocked for a while as crews investigated that hit-and-run. the victim taken to the hospital, we're told he should be okay. it took a little more than a day for investigators to catch up with an arson suspect once they released his picture to the public. we showed you it yesterday morning. man was wanted for setting more than a dozen fire at construction sites and buildings in the south market neighborhood in san francisco. he was arrested yesterday. investigators are expected to release more information about that arrest today. hilary clinton is expected to draw another large crowd twlb you saw a video of the man that laura was talking about. hilary clinton is signing books this morning, it's a sold out event at book passage in san francisco's ferry building. last night she spoke at the theater to promote her book, "hard choices" and discuss why she's not committed to a run for

president. clinton says she's expecting a grandchild. the former first lady also announced the clinton initiatives coming to oakland at the childhood development program called too small to fail. formal announcement is expected next month. >> i just checked online, could be standing room only tickets for that event this morning, book passage, but they won't know until 9:30. >> just in case you want to say good morning to hilary. anybody whose in town right now, you know this is our tour season in the bay area because down in socal, it gets hot. we get tolerable temperatures. i can tell you right now though, this is very unusual this morning. look at the showers, they race through the bay area overnight, that was the first batch of rain. we'll going to see another batch come through the next couple of hours. i'll show you the future cast in just a minute.

worst. southbound 680, i've been tracking this, earlier hit-and-run, one of the cars took off. if you saw anything, call chp around castlewood is where it happened. the other car has major damage, but no major injuries. its cleared the roadway without any problem. that's good news. i'll track it past castlewood, it's your commute direction. commute builds a little bit through the south bay and pence last, no problems, and no real unusual patterns here towards the bay bring. we'll give you a live look and see how things are shaping up. we have the cash lean lanes stacking up. 10 to 15 minutes from now, very light traffic, but there's fog too as well. keep that in mind as you're crossing over, back to you. >> sounds good, thanks. football fever in south bay. team usa fans flock to watch parties across the country, flock to watch parties, referees in brazil will check to make sure it's not too soggy because of the heavy rains.

you're watching "today in the bay." welcome back everyone, it is 5:42. this morning house speaker john boehner says he is suing president obama for miss using his -- misusing his power, good morning, tracy potts. >> reporter: good morning, the state of the union where the president said with all the dysfunction and things not happening in congress, he wanted to do some things on his own. he issued several executive orders and now speaker boehner says they are unconstitutional that the president is not faithfully executing the laws that congress passed as he is supposed to do based on the constitution. so he wants to sue the administration. nancy pelosi, the minority leader from the bay area says that this is nothing more than a

tantrum, essentially and it has more to do with a do nothing congress than the constitution. the white house is not worried about the lawsuit. they're not going to devote time to it that the president is doing his job, but there are constitutional questions, john boehner says about whether or not that's the case. what we don't know is what order they'll specifically target. immigration, health care, the minimum wage, all orders issued by president obama in the last several months, laura. >> one to watch, thanks tracy. investigators looking into the missing malaysian plane. are confident the plane was on autopilot until it ran out of fuel and crashed. it led investigators to shift the search for the plane further south of the most recent suspected crash site in a remote stretch of the indian ocean. the new search area is based on fresh analysis of existing satellite data from the plane. 5:43 the u.s. supreme court resumed police must have a

warrant before searching your cell phone. all nine justices agreed cell phones are private property. police officers must get a search warrant before going through cell phones following an arrest. the state of california, which was on the losing side of the case disagreed with the ruling saying the law will make it difficult for police officers to do their jobs. the supreme court also ruling a company called areo has to stop selling on the internet. the company rebroadcast television that reaired over the internet. people sued to make aereo stop, they argued it's only offering an advanced antenna service. its been 77 years since the famed female aifuater amelia earhart attempted to circle the globe. >> in a few hours from now, a 31-year-old woman with the same first and last name will attempt the very same journey.

"today in the bay's" nannette miranda is live where amelia earhart will begin her journey in a few hours. >> reporter: well that's right. this is truly an exciting event. around 8:00, amelia earhart will attempt to fly around the world from here at oakland international airport. well not that the amelia earhart, this amelia earhart, amelia rose earhart of colorado, the former weather and traffic reporter at our fellow nbc news station used to be embarrassed when people kept asking her about whether she was a pilot, they'd follow up with would she fly around the world like the original amelia earhart? she eventually said why not. she was ten years experience as a pilot will recreate the flight around the world that her name stake attempted 77 years ago from here. it's a 28,000 mile trip, but as you know, the pioneer disappeared in 1937 over the

pacific ocean. today's amelia was asked by her friends whether she'd be afraid about her trip ending badly, but she has a way to calm the butterflies. ask her why she's doing this, amelia says she wants to honor amelia earhart and her legacy and support women in aviation. she also has a foundation that puts women through flight school. modern day amelia though will have a co-pilot this time, shane jordan with her. they expect the trip to take between three weeks and one month. that'll be 17 stops in 14 countries. live in oakland, nannette miranda, nbc bay area news. >> interesting thing. of course amelia had not a co-pilot, but a navigator. once going one direction, that worked out well, but didn't get arounded it. of course the second going the other direction where she was

miller says he only saw new at the very last second. undercover officer shooting at a man in the desert. if they not heard the shots, he would have driven into the line of fire. now officials have not yet released details about this be shooting. other beenses say they saw the suspect shoot agent undercover officers. the suspect apparently killed. cal osha joined the investigation into what caused a fire plane to flip. the driver, 55-year-old mitchell ohl was injured in the accident. he's still in intensive care. he's now awake breathing on his own. cal osha and chp looking into safety violations during that training exercise. 5:50 in just a few hours local leaders will hold a news conference at the golden gate bridge to talk about how they're going to pay for a new suicide barrier to be installed. this is a live look at the bridge this morning where state senator mark leno will be joined by mental health professionals to prevent, present more information about putting up a barrier on the bridge.

so far, $76 million has been set aside to build the barrier, and a transportation board will vote on it tomorrow. ban lot of opposition to the proposal because some think it would be too expensive, hard to install, and an eyesore. after nearly a week, a water leak in the south bay has finally been capped off. last night crews fixed a leak in the willow glenn neighborhood. it started on buyerly avenue. san jose water company says it fixed the leak in a reasonable amount of time, but neighbors stay took too long. one neighbor had to call the company a few times before they finally showed up. in response, the san jose water company says they have to alert all utility companies first so gas and cable lines can be checked before they open up the streets. >> yes, it's not losing an insignificant a. water, but we need -- agent of water but we need to follow safety procedures to repair this as quickly and safely as possible. >> san jose water says they're track record of preventing leak is well above the national
