from nbc bay area, this is "today in the bay." well good morning everyone, 4:30 in the morning, ooichl scott mcgrew. >> and i'm laura garcia-cannon. new video this morning of what was left behind after an overnight fire. broke out in san jose near interstate 280 and bird avenue. crews headed to the scene about 1:30 this morning after getting calls of trees on fire. a few trees burned along with debris. the fire was knocked down quickly. no word yet on a cause. now this comes as san jose firefighters are coming from an exhausting day yesterday. two brush fires had crews scrambling to gain the upper

hand overnight. just six miles away, much larger fire crept dangerously close to homes in the hills above the neighborhood. we have reporters there this morning. here you see some of the overnight scene, some of the folks waking up to the fire hoess and caution tape. it was a close call for about a dozen homes. no homes burned. started it about 1:30 yesterday afternoon. and you had that dry, you had the wind and the dry brush causing four alarm fire. the helicopters and ground crews used to fight that fire. two were injured. we haven't been told what kind of injuries. some people of the feel like it could have been worse. >> we have to get out of here in five minutes. we have some dogs and it was a little heroing. >> you may have scene it if you were in the south bay. 85 and 101 could see the fire. much smaller fire burned

about a few miles away. crews from mountain view, gilroy and palo alto were called in to control those flames. some golfers played right through it. crews stayed on the scene overnight to watch for hotspots. firefighters were dealing with 100 degree temperatures as well. another round of warm weather expected. and let's check in with meteorologist rob mayetta. hoping that this action is not a sign of what's to come. >> yesterday we saw the worst case scenario. that was around the time the fire started late afternoon. this morning though, we're starting to see some chiengs. if you're waking up around san jose or north of downtown, you probably can smell the smoke. we had a change in the wind direction out of the southeast which is pushing up towards the north for this morning. you can see our humidity levels as you'd expect for the morning

fairly high and there's good news for the forecast today in that wind speeds will be gusty for the afternoon, but temperatures are coming down with the shift now to an onshore breeze and more marine air, high temperatures in the 80s to low 90s. that is a big drop from the near 100 degree temperatures yesterday. sop by lunchtime, now looking at 5u8 around san jose and inland climbing into the 70s to mid-80s around antioch and we'll continue to see cooler temperatures through the rest of the week. look at the forecast in a few minutes. now here's mike with the morning commute. >> reporter: very concerned about this, the headlights that, they're not coming towards us. this is because of a traffic break. looks like just reopened a couple of of lanes. reports of a motorcycle crash and motorcycle versus another car. make a coke cola delivery truck. northbound just approaching 98th. i didn't move the camera far enough south. reports of somebody down an

injured person. presumably the driver of the motorcycle and the hayward police are arriving as well. i'm going to move the camera, i'm also going to check on the status of lane and tracking the person as well, whoever is injured. slowing right there at the coliseum. the rest of oakland is very smooth though. the rest of the commute, predict bld, however down in fremont, we have a closure that we haven't seen for about a year. this is warren and mission off of 880. overnight construction crews, but southbound side, i saw them clearing a few minutes ago and that will continue in the morning. we'll track that, back to you. there will be extra officers patrolling in san francisco while police find out who shot a man in front of a groum of kids at a playground. allan callaway was shot as he was playing dodge ball as children. he was there for the hertz park summer program. he was trying to turn his life around after spending time behind bars.

>> he came, he made everything right. he got us our jobs. we told us girly be girly, you don't have to be racky. be us and don't let nobody ruin what we have to do. >> small memorial was set up at the park. balloons and candles marked the spot where he was killed. police have not arrested anyone and no suspects. concord teacher is on trial this week. joseph martin faces 1506 counts of child molestation. the mother of two boys, he's accused of abusing, says martin taught her boys in the fifth grade at woodside elementary school and was a family friend. >> i gave him all our baby clothes, and he would send home treats and cookies and baked goods with my son. always making my son be the one come to his classroom to pick them up.

>> concord police investigated him last year. teachers were concerned about martin's behavior back in 2006, but the principal did not call police. martin's attorney says his client is not guilty. >> we're trying this on a mass hiser it ya theory where a spark starts a talk, and the gossip spreads. >> now several families are suing the school district saying the principal put kids at risk by not calling police back in 2006. happening today, several new laws are goinged into effect, both on the local and state level. mountain view is banning styrofoam containers. retailers cannot sell products made from the material. the statewide ban on gun magazines goes into effect today, it is illegal to make, import, or sell or lend a gun magazine that holds more than ten rounds at a time.

smoke detectors and rental units must have non-removable ten-year batteries. firefighter will hand out 200 smoke alarms with a ten-year battery to help bring attention to the change. state's minimum wage goes up fromle to 9. this is the first north carolina in six years. the state will increase minimum wanl again in $2016 to 10 an hour. the new minimum wage will only affect some bay area cities. others have higher wages. san francisco pays 10.74 and will ask voters increase that to 15 in november. in stan jose, the minimum wage is 10.15 an hour. also today the golden gate ferry, caught up more cash for the ride. the ferry and regional bus fares are increasing by 25 to 50 cents, depending on how far you travel. however the marine county local bus fare and giants ferry, those

don't go up. fares will stay the same for ac transit passengers. there's a new way to pay. you can buy full day passes for adults. and this eliminates paper transfers. the passes are good for unlimited local rides all day. they cost 5 for -- $56 for -- $5 for adults. if you don't buy a day pass, you cannot get a transfer. tonight berkeley could be one step closer to becoming the first u.s. city to tax sugary drinks. the city council will vote on whether to put at soda tax measure on the november ballot. the measure would impose a one cent per ounce tax on sodas, energy drinks, and sweetened iced tea. the proposal is strongly been supported by berkeley city council members and two independent poms found two third of voters also like the idea. council members will talk

about medical marijuana shops within berkeley. some of those guidelines include requiring dispensaries to get fire and electrical inspections before they get business licenses. it would force the shots to close by 9:00 at night instead of 10:00, that's what currently is required. last month the council approved opening up a fourth dispensary and said in a year it would consider allowing more. turning now to our microclimate forecast, it's 4:39 as we look outside city by the bay san francisco. look at the lights. nicely alum natoed. coolest part of the morning. let's check in with rob, his the morning forecast in for christina, good morning. >> good morning we're seeing changes this morning, especially if you're around san francisco or looking across the bay from the east bay and emeryville back over to san francisco. right now 50s and 60s outside. tri-valley, livermore, 63 degrees. 57 closer to emeryville and oakland as we watch the low clouds come in, we're going to

see a cooler afternoon. winds on shore this morning into fairfield and livermore and low clouds we will see that ocean air-condition drop the temperatures off around the central bay. one thing to watch if you're heading up to areas around lake county or the sierra this afternoon, we could see slated thunder off to the north and east. the low clouds the story here. as we head into tomorrow mormg, once again, low clouds dropping down the temperatures. south bay locations, 83 degrees. up towards the north bay. high of 82 dloo there. and even the tri-valley down from 1700 plus degrees yesterday to 90. we're starting to see cooling today and it'll continue as we go through the rest of the weeks, look at the extended forecast in a few minutes. now a check of your tuesday commute, rob. we have this issue over here 880, we got confirmation that someone has died as a result of this crash. involved a motorcycle and a coke cola delivery truck as well. and that's northbound 880 just before you get to the 98th

avenue onramp. south of coliseum. if you are coming out of hayward approaching the coliseum, that's where traffic is stopping. just prior to 98th avenue. folks we have not gone -- who have not gotten on the freeway, go around that and get on north of the coliseum. haguenburger, 66th, those will all join north of the crash. traffic break currently going on for northbound 880 basis of this deadly crash. 580 also clear for you. it's a little out of the way, again very clear for the rest of the freeways through oakland. we're following this still, construction clearing. we have the slower showing. mission at and 880. consider that closed still. automall parkway as you're connecting between 680 and 880 until they can move those completely out of the area. the rest of the bay is clear guys, same thing for the pence laes, easy drive in, thank you. >> thanks so much. still ahead "today in the bay." waves of immigrant children going to california. why the president says he's been

attend a funeral for three teenagers who were kidnapped and found dead. the bodies of the teens were found yesterday in the west bank near where they disappeared on june 12th. he says the militant group hamas is responsible for that kidnapping and will pay a heavy price for their deaths. neither confirmed nor denied those allegations. 300 more u.s. troops are headed to thooirk morning. the additional troops will help those already there to protect the u.s. embassy in baghdad. american citizens who have not been evacuated. now be a toeflt 7 506d american troops in in iraq. in the men time the state department subpoena moving to some of its embassy staff to baghdad. waves of immigrant children will be moved to southern california. they spent yesterday holding signs trying to get the government to do something else

with the children. many were captured trying to cross without adults. the texas facility is overwhelmed and deporting unaccompanied kids is difficult. president obama is asking congress for $2 billion in emergency funding. and he's asking homeland security and the attorney general for an outline of the action he can take a loan without congress. >> the failure of house republicans to pass a darn bill is bad for our security, it's bad for our economy, and it's bad for the future. >> house speaker john boehner says the president acting without congress will only make the problem worse. bad news for students taking out loans for college. the average borrower can expect to pay $4 a month for every $10,000 in loan. interest rates are tied to the financial markets.

start-up car maker rks elio motors plans to release a high mileage car at a low price. the arizona company says that three-wheel car gets 84 miles per gallon on the highway. $5800. it can keep the price low because of the design features, they're very simple. the two-seater doesn't have a name yet but could be on the road in the u.s. by september of next year. more troubles for gm this morning, the company recalling another eight million vehicles worldwide for more problems with ignition swrichs. let's turn to morgan brennan live at cnbc world headquarters, good morning. >> reporter: good morning scott. gm announcing six more recalls, that's affect 8.4 million vehicles with 7.6 million of those in the u.s. now most of the cars are older models and are being recalled for ignition switch issues. gm is aware of seven crashes, eight injuries, and three deaths. the company has now recalled

nearly 29 million vehicles this year. almost double the amount of cars the entire industry sold in the u.s. last year. meanwhile, futures are higher after the mixed, after a mixed session on monday, however, the markets closed out the second quarter on a high note. the dow is up for four straight quarters while the broader s&p 500 is up six straight, that's the best streak since 1998. today we're getting data on manufacturing and construction spending. the dow falling 25 points to 16826. nasdaq rising ten to 4408, back to you. >> thank you much. time to check in with rob, he got up bright and early this morning. >> it's too early. sun's not up. >> let me get you the coffee. >> we need it this morning. low clouds and fog in san francisco which is good news if you're watching from the tri-valley and you don't want to the see 105 degrees again. they got a stronger sea breeze this morning. we have numbers in the 50s and

60s outside right now. the weather story of the day will be that stronger sea breeze what which will bring cooling and in fact this morning around san francisco, west wind about 12 miles an hour, you'll see the low clouds out there, and over to emeryville, northwest wind at close to 12. with the all day sea breeze, temperatures today running a bit cool we are patchy fog and some mist on the coastline, staying cloudy out on the coast, look at the inland highs, 80s to low 90s inland. you can head to the high country today, upper level disturbance that's tossing high clouds across the bay area. there's a chance we could see thundershowers there around lake tahoe for the afternoon. look at that fog, locked in on the coastline, that coupled with the onshore wind will keep us high today. three to four days of hot temperatures now, starting to move off towards the east. so no longer are we talking about 90s to # 100 degree temperatures, but things getting closer to average for this time of year as the inland highs

finally drop off into the 80s to low 90s this afternoon. san jose today, near 83 degrees. san francisco in the mid-60s and the trend will be for those temperatures to stay fairly comfortable over the next few days. 72346 foster city. 67 around the marina in san francisco. temperatures beginning to cool off a bit today. in fact only the most inland spots in and around the tri-valley we'll see the temperatures running into the low 90s. early preview here for the forecast for the fourth of july as we look at things for the end of the week. it looks mostly clear for plans as we head towards friday evening and the temperatures looking good. numbers mostly in the 70s and 80s, and upper 60s closer to san francisco. that cooldown should last through the end of the week, back to you. an acoustics expert at the stand in the oscar pistorius murder trial today talking about the screams that neighbors heard the night that reeva steenkamp was killed. the expert called by the defense team in hopes of proving the neighbors who said they heard the screams of a woman were miss

so you know if you use davis to get over to san leandro street or international boulevard, that's where you can get on at i9. anywhere north of the coliseum and you're clear of the crash. south of there you run into that as you use hayward. there's slowing in the same area 580. i'm going to let you know if that's related slowing. otherwise it moves smoothly on the roads. we have the rails delay as well for the bart system, they're recovering from an earlier power issue. about 15 minute delays guys, back to you. ahead on "today in the bay." busy morning for san jose firefighters as crews work to get a brush fire under control quickly. this as crews are camping out watching for flare-ups. plus the unusual and public that one bay area city is cracking down on prostitution.
