new this morning, the house side of the capitol is shut down right now because of an industrial spill. the spill actually happened when workers were removing asbestos from the fourth floor of the capitol and something fell. crews are taking samples to see if there's any asbestos exposure. all lawmakers and aids have to stay away until further notice and all tour was of the capitol have been canceled. now the house is scheduled to hold votes later today. it's unclear if the votes will have to be canceled. chevron hoping to spend $1 billion to give its richmond refinery a facelift. dozens of people made their feelings known at city's planning commission meeting. chevron wants to renovate, nobody everybody in favor. some neighbors say they don't trust chevron to conduct clean and safe projects. especially after that massive fire two years ago. >> there's a whole quarters of refineries going out to martinez and benicia that have

disproportionately affected people in that zone. and so this is really not just richmond issue, it's also a regional issue. >> chevron says the project would add hundreds of jobs and expand the refinery's ability to process crude oil and oil with higher levels of sulfur. a second meeting is scheduled for tonight, then the planning commission is expected to decide whether to certify an environmental impact report. . approved, it would allow chevron to move forward with those renovations. 6:02, happening today, more pressure on president obama to visit the border while he makes a quick fund raising stop in austin, texas. yesterday he met with texas governor rick perry among others to talk about the crisis on the u.s.-mexico border. the president did not tour the border himself, and he defended that choice. >> this isn't theater. this is a problem. i'm not interested in photo ops, i'm interested in solving a problem. >> president obama is calling on

lawmakers to approve his $3.7 billion request for morning spending at the border. of course we'll have continuing coverage of this story in the next half hour including reaction from governor rick perry. it's coming up at 5u6 30. medical marijuana supporters are uniting protesting san jose's new restriction on pot clubs. >> "today in the bay's" kris sanchez is live at san jose city hall will protesters will start gathering around noon, good morning, kris. >> reporter: hi there, it is all quiet right now, but starting at noon, we could see a lively gathering of marijuana users, marijuana advocates, and supporters of those who use medical marijuana as the clock ticks towards next week when the city could shut down, the vast majority of dispensaries within the city limits. the city has some of the strictest rules regarding marijuana dispensaries in the bay area, including where they can operate and the hours that they can keep. there are regulations, dispensary owners are completely unrealistic for business. among the requirements, they

have to grow within the county and on site in collect industrial -- select industrial areas. around the clock security, open select hours during date. no one under 18 is allowed in and no one can use or sample any of the marijuana goods on the premise. notion gathering for a protest here at city hall today. they are asking people to continue to sign the betigs to put their own regulations before voters. more than one of them has told me that they have an enough signatures to do that already, though that has not been filed with the city clerk. while shutting down the majority of the existing pot clubs in the city will cut into the $5 million in texas revenue that the city has gotten, the majority of people pulled within -- polled within the city want rules in place to keep the marijuana out of hands of young people and to cut down on the crime that sometimes happens they say around those dispensaries. the cannabis collectors who

people to turn out around noon today and 7:00 tonight. they are offering up 1,000 free marijuana evaluations, medical marijuana evaluations for the first thousand people who show up. they are certainly trying to garner support so that their voices can be heard up in the tower here at san jose city hall. reporting live in san jose, kris sanchez, "today in the bay." >> thanks. >> thank you. right now it is 6:05, on thursday morning, time to check that forecast as we take a live look outside san mateo bridge, we'll check that morning commute coming up in a little bit. looks like traffic's heavier on one side than the other. first the forecast, the microclimate with christina. >> good morning to you, yeah a lot of people have been asking me what is going on, why is it so humid throughout? i have to tell you, this is the last day of that humidity, but it's not even going to be even half as thick as yesterday. that's the good news. definitely we are not acustomed to that subtropical feeling here in the bay area.

just goes to show how used we get to the dry air mass. that's typically overhead. it's really nice out there this morning, really comfortable temperatures. thanks for waking up with us, 59 in concord, 57 degrees, this morning in santa rosa, 55 for half-moon bay and 60 degrees meanwhile in mountain view. i want to show you the sights across this beautiful bay area we get to call home. live look here at emeryville. that will intensify throughout the day today. we're going to see more ripples on the water as the wind picks up. let me show you pleasanton meanwhile, beautiful start here, mostly clear and san jose, staying mostly clear sky to kick off your thursday as we get into the this afternoon, comfortable conditions, not too hot, but right around the threshold where you are going to have to use your ac. especially out in the extreme east bay. the tri-valley getting close to 90 degrees out there. as we head throughout the day though, you'll notice the humidity, especially by about lunchtime sliced in half yesterday, 78 degrees on the

peninsula. that's a comfortable day. look at difference between the east shore and the tri-valley. they'll be at 86 degrees. 65 meanwhile for san francisco and 76 degrees in the north bay. but just a gorgeous morning, and whenever we start with the low clouds over the san francisco bay, good sign that temperatures are not going to sore. we've had it -- soar, we've had it pretty easy so far. i want to keep you up to date. but hey, we're chipping away at those days, each and every weekday morning right here with you. and i can tell you, we're still counting on that el nino. we'll keep you updated, first let's check your drive, welcome back, mike inouye. good morning, good morning. that's what we're looking for. over here the bay bridge look at louisiana fuente. the metering lights are on. we have been be turned on earlier, there was a car that

had no gas, and ran out of gas at treasure island. smooth drive across into san francisco. we'll look at the maps and we're talking about a smooth approach right now. incline the only issue. i've circled in san francisco, at&t park plays a's, coming across for the second game in a row and fourth in its series, midday games, expect a later back up of building again at the bay bridge. we'll talk about that in a second how you can get around that. we have a slow down westbound 80 approaching highway four. hercules was in the slow lane, looked like it clears at the shoulder, there is a clear down there, that's not so bad. and ve knee that bridge moving nicely as well. tri-valley, build continuing over towards west 580 and dublin interchange, no drama through livermore. the orange around 15 miles per hour at its worst as you come into livermore. that's good for the commute. build starts for south 680. south 88 as well. hayward, typical pattern there, laura showed you the san mateo bridge. . does see a heavier flow, but

that's no surprise right now and smooth drive for that. same thing for the south bay, northbound 101 showing a little build for san jose. and the golden gate bridge, we'll show you this as well. take the ferry to the giant's game, that disrupts the schedule for a typical fare ri riders and so they'll have to keep in mind that on game days like today they have to check that ferry schedule because it is changed a little bit. . >> okay, great deal. 6:09 right now, developing situation in the middle east. this morning israeli army tanks were seen moving closer to the board we are gaza. it comes as israel is dramatically escalating its aerial assault against hamas cites. overnight strikes hit more than 300 hamas targets. focussing on what its military says are underground tunnel networks and rocket launching sites. since the offenses started three days ago, israel carried out about 750 air strikes. 81 palestinians have been killed

next week. this afternoon in city hall they're going to get people sign a petition allowing them to stay open. the giants are considering a new dress code, excuse me, for fans. >> bob redell joins us live at at&t park and fans, if fans don't comply, they could be e skbrekted from the game. >> reporter: and what the organization, the giants are considering is a ban, scott and laura, on a clothing that's culturally insensitive. it happened a few mondays ago, it was native american heritage night. during a game a woman who was native american confronted a man who was in the stands wearing a plastic red, white, and blue head dress. you could see them here in a picture that she shared. and she explained to this fan that it was offensive. he agreed to hand it over, which she was surprised pleasantly. when she refused to give it back, security showed up. the woman whose name is april

ended up in a scuffle with san francisco police. you can see this here in the youtube video. they returned the head dress back, detained here and kicked her out rft park for quote unruly behavior. same for the native american man shooting this video who posted it to youtube under eradicating offensive native mascot ri. they were both released after the game with no charges filed, no arrests. she eventually wrote an article for huffington post explaining her position, explaining what happened that night, and apparently the san francisco giants taken what she wrote to heart because the organizations reportedly looking into instituting this new rule that would ban culturally incensive attire and just general offensive behavior. people who don't follow this rule will be ejected. this is just a proposal, nothing has been set in stone as of yet. reporting live here at at&t park, bob redell, "today in the bay." >> all right bob, thank you much. let's take a live look outside, time to check the

mountain view, and 55 degrees to kick off the day in half-moon bay. and you know what, we have a full deck of clouds just like we're seeing in ocean beach this morning. but we do have an interesting change to tell you about as we head into this afternoon. you see these midlevel clouds here in sunol. definitely not seeing as much as this time as yesterday. here in san jose, same deal. midlevel clouds, not a lot, that humidity definitely dropping off overnight, and today, you will notice the difference. all right, let's get to that forecast because wind is going to pick up as we head throughout the day today, and because of the positioning of at&t park, right there on the san francisco bay, wind often plays a roll in the game. so for today, you're going watch for those flags to blow out towards center field and potentially we could get a gust up to 35 miles per hour, that could pick up and carry that ball. as we get into this afternoon, temperatures not bad for any of your outdoor plans, 76 degrees in the north bay. 82 degrees for the south bay. and 78 degrees on the peninsula. making that home stretch toward

the weekend. and we have a super moon on the way as we head through saturday night. you'll get a clear shot of it from the science center in oakland, they're having a hike out thereto, comfortable conditions, looking for something to do, 79 degrees here in the south bay on friday, we're going to stay nice and level, comfortable conditions all across the board. let's check on your drive, here's mike inouye. >> super moon hike sounds beautiful. this is beautiful as far as the traffic flow is concerned. little confusing though. this is emeryville, the berkeley curve, which is in oakland as you cross over the border heading to the bay bridge into san francisco. west 580 slow, that's all you have to worry about. look at the map coming off of 24, that's the slower drive and not that bad in fact for the bay bridge toll plaza. metering lights are on as we been telling you, 12:45 game for the giants. midday traffic and late morning build at bay bridge toll plaza as folks head over there. use bart or caltrans to get the mass transit options. debris west 80 just past golden

gate field. the earlier brush fire has cleared from richmond without any slowing, injuries, or problems, and that's good news. the earlier crash over at hercules, it has cleared just past highway 4. smooth drive continues over here. dublin interchange, no drama, just a continued build out of pass, and livermore is a light build. subtle here, south 608 w small slow down out of pleasanton, and that's your typical pattern as well. here at the soupt bay, northbound 101 shows slowing through san jose. i want to talk about the roads and rails mass transit. and we talk about caltrans and bart as well as muni, great options to use towards the giants game. it'll be congested midday as well as after the game which goats folks out of town on a thursday, sometimes it happens, just trust me. over here the rest of the bay moves smoothly. no drama for the peninsula. and we're looking at san jose, live shot there shows you the volume we're talking about. now kicking in from 680 here. and coming across the bay, we

talked about an easy drive. we're getting more company, and no problems seeing the planes from the east bay. and clear drive into and out of the city, back to you. >> thank you, mike. 6:19, the owner of the dog abandoned with the word free written across its body has come forward. >> yolo county woman says this is her dog. she has no idea how the dog got out of her yard muchless thousand got to ve knee that. police say she showed up with vet records and photos. they don't think the woman played a part in the dog's abuse and abandonment. now shannon bettencourt is the woman who found the dog. she wanted to keep it, she says she's upset. >> when i first found the dog, let's find who did this. and hopefully finded it a good home. and then, i ended up being that good home. and then, nobody found who did it. even though they had leads, they didn't do anything about it. >> bettencourt found the dog last week with that writing on its body.

joins us live on capitol hill with more, good morning, trey is. >> reporter: laura, good morning, following the president in austin within the hour he's meeting with democrats in a couple hours around lunchtime, he's got that speech on the economy, but immigration is still the big issue, and he did get a chance to sit down with texas governor rick perry to talk about their differences. president obama's in austin today raising money for democrats speaking about the economy, and fighting critics who say he should be at the border. >> he has shown playing pool, drinking a beer, and he can't even go 242 miles to the texas border. >> how can you have a humanitarian crisis as the white house has called this, and not want to go see it for yourself? >> i'm not interested in photo ops. >> reporter: the president and rick perry will two short conversations in dallas. perry wants drones and 1,000 national guard troops at the

border, plus policy changes to deport immigrants, including children, faster. >> if the president's serious about addressing this issue, if the president is serious about border security, he can pick up the phone and have it started tomorrow with the dod. >> reporter: washington, lawmakers today will question homeland security, health and human services, and the state department about the president's $3.7 billion request for emergency funds to deal with the flood of children from central america. >> i cannot vote for a provision which will then just perpetuate an unacceptable human crisis. >> reporter: in guatemala, jay johnson signed two agreements to help get immigrants out of the u.s. and back across the border. secretary johnson's here testifying today about the budget request. meantime back in texas, governor perry says part of the problem is the the government needs to roll back policies that he believes allows immigrants to

come into this country even when they're caught and given a court date, assimilate into society, disappear into society because the release before they have to come back to court. laura. >> thank you so much, tracy. let's check your forecast as we give you a live look back out at san francisco this morning, and let's join christina loren, good morning to you. >> good morning to you. yeah, we are blow og the fog horn -- blowing the fog horn, this is thick out there, but i can tell you it's not going to impact your drive. you don't have to give yourself extra time. and you know what, we are almost to the weekend, my friends. temperatures this morning, really comfortable, 62 degrees in san francisco. we're at 60 meanwhile in oakland and 58 degrees here getting a beautiful start to the day in san jose. so it's really comfortable out there right now. and yeah, you'll notice right when you walk out the front door, not as humid as it has been. still on the sticky side for today and tomorrow, and by the weekend, really comfortable

commute, your typical slow spot from 60 up towards mckey, worse there right now. look at the maps, general slow down and here, not so bad, only about 45 or 50. 87 northbound, we saw early slow down sticking around from capitol expressway into downtown. 85 picks up a little volume through sarah toga, no drama there. southbound 880 shows the slow down. we're going talk about some other issues here. mass transit system, we have to alert adjust couple minutes ago from bart, 15 minute delay reported out of the oekd station. in either direction heading down towards fremont. that is an issue. bay bridge toll plaza looking pretty good, smooth off of the maize, metering lights are on. also as we looking at caltrans and bart, giant's game, sucker that would over there. midday giant's game moons a late morning, more midday basically back up the bay bridge toll

shooting near houston that left four children and two adults dead and a teenage girl critically injured. the suspect is the father to those children. he is now in custody after a long standoff with police. police say the man drove to the home in spring, texas, shot the children who range in age from 15-7. he also shot a couple who has been taking care of the kids while their mother was out of town. the 15-year-old was able to talk to police and gave him the, told him their grandparents were the next target. police stopped him just before he made it to their house, he's in custody. public forum will be held following the decision not to charge a sheriff's deputy who shot and killed a 13-year-old boy named andy lopez. on tuesday, about 100 protesters gathered outside the santa rosa courthouse to express their anger about the decision. the district attorney says t deputy was justified because the deputy thought lopez had a real gun. it turned out to be a replica. tonight's forum is at 6:00 at

the veteran's memorial building. 6:45, new details on the high end prostitute accused of killing a google executive. santa cruz police say forest hayes may not have been call girl alix picleman's first victim. yesterday tichelman was charged with felony manslaughter. detectives says she injected hayes with a deadly dose of heroin on his santa cruz yacht last november and think she's done this before. they investigated hayes's death, they discovered she had another male companion who died of a heroin overdose. 6:46, firefighters pinpointed where the fire started at a restaurant. monday's fire started outside manresa near garbage cans. the exact cause is unknown. it caused nearly a quarter million dollars in damage. the owners promised to rebuild and reopen, but that is expected to take months. let's take you out live to emeryville this morning as we check your microclimate forecast, and we join christina

loren, good morning. >> hey, good morning, yeah, you can see from that live picture of emeryville, we have a lot of voibl moisture out thereto. when it comes to humidity levels, we are watching the fire in the south bay, up high this morning, but one thing that's also up are your wind speeds. and right now i want to focus in on that, in the san jose area, 13 mile an hour sustained speed, significant for us, we're getting combusts closer to 20 miles per hour. that smoke is going to drift up the planes since we have that wind out of the south. what else is happening out there because of that south wind, we're getting that garlic smell all the way up to san jose. even reports along the peninsula, coopertino area of that smell of garlic this morning. so definitely something we're going to be watching for you overall update on that fire in just moments. 62 degrees in san francisco, 60 degrees in oakland, and 60 in mountain view. we have this that flow for the past few days. and as a result, our hillsides are still pretty moist. whechbt red flag warnings for the past couple weeks and

the area including oakland as well with slowing for 880. concern in oakland with the bart system just 15 minutes ago, reports of a 15 minute delay because of some police activity on trains, but now we have no delays reported by the bart system. same for the rest of the mass transit. caltrans, bart, and muni are great options. midday again, getting away from there as well. vta through the south bay, no problems, and the rest of the bay, typical schedule, south 880 through hayward in the southbound direction to. the tri-valley has your typical slowing here north 80 shows a heavier volume and traffic and that is a concern. we're looking over towards north 101 as well. then skipped over one of the cameras. we're going to end with oakland past the coliseum. we talked about the building commute. it's north of high street. easy drive to high street and slower through downtown and the southbound side builds here and through the bridge, back to you. >> thanks a lot, mike. it is 6:50, today medical marijuana supporters are protesting new restrictions put out by the city of san jose.

the city is forcing pot clubs to shut down starting next week. >> lucero benitez is live where protesters will start gathering soon, good morning. >> reporter: good morning, it's expected that many marijuana users along with supporters will be out here today in front of city hall in san jose protesting what could be next week's potential shut down of the majority of pot shops here in the city. right now, the city has some of the strictest rules regarding marijuana dispensary including where they can set up shop and the hours to keep regulations. they are unrealistic. among the requirements, dispensaries must grow pot on site and select industrial areas. around the clock security though they can only be open select hours during the day. no one under 18 is allowed in, and no one can use the pot in the store. in addition to gathering to protest here at city hall today, marijuana advocates also want people to continue to sign a

petition to put their own regulations before voters, more than one has told us they have enough signatures to do that already, though it has not been filed. while shutting down the majority of the existing pot clubs in the city will certainly cut into the $5 million in tax revenue. the majority of people pulled -- polled in the city said repeatedly they want rules to keep place out of hands of kids and to cut down on crime that sometimes happens in the area around dispensaries. the pot shop collectors who want people to turn out and rally here today are offering a free voucher to the first 1,000 people who show up to this rally with that voucher. they can receive an evaluation and if they do pass, then they would get a free card for medical marijuana. live in san jose, louer is voe benitez, "today in the bay." >> thank you. it is 6:52, chevron is hoping to spend $1 billion to give its richmond refinery a so-called facelift. company says the renovations will make the refineries safer and cleaner.

dozens who packed a heated meeting last night in front of city leaders are split on the idea, especially in the light of a massive fire at the refineries two years ago. stephanie chuang live outside the refinery. stephanie, the company says the project would let its process more crude oil. >> reporter: that's right, good morning, laura. and the company saying it would not increase the generation of pollution here, but there are a lot of doubters, and especially of course with the images of that fire you talked about in august of 2012, the flames, the heavy smoke in the skies here, still pretty vivid for some, and some did go and speak at the meeting last night at kennedy high. supporters spoke about how this will lead to hundreds of much-needed jobs, mostly construction, of course, opponents are concerned about safety, they're nervous that'll lead to an north carolina amount of pollution since the project is set to expand. the ability to process crude oil as well as oil with higher

levels of sulfur. again, chevron says there'll be no increase in toxic air contaminants. >> the modernization sprojt a billion dollar investment in the refinery. it's a reliability project to its core that allows us to replace some of the oldest prosing equipment within the refineries. >> reporter: and old equipment was one major problem identified by central regulators with the chemical safety board after that august 2012 fire that sent an estimated 15,000 people in the area to seek medical treatment. now a federal investigation included the company did not apply safer technology when it could and should have. there was also a fire in 2007 that left -- led to a shelter in place for the community. the planning commission must decide whether to approve the final environmental impact report and grant the company a conditional use permit that would of course give the company the green light to move forward and that decision by the city could come at a meeting tonight.

culturally insensitive. this is because an incident that happened a few montds ago. june 23rd, it was native american heritage night. during the game, a woman fan who is native american, confronted this fellow fan. white man who is wearing a plastic red, white, and blue head dress. you can see him here in a picture she shared with the huffington post. she explained it was offensive, to her surprise, he agreed to hand over the head dress. when she refused to give it back, security showed up and this happened. you can see this in the youtube clip. the woman whose name is april ended up in a scuffle with san francisco police. they returned the head dress back to the man's group, detained her, and kicked her out for unruly behavior. a native american man who shot this video who ended up online. they were released after the game with no charges filed, there was no no arrest and she eventually wrote an article explaining her position, and apparently the san francisco giants have take whan she wrote
