lamar's murder case will be answered. 2,000 pages will be released today. kris sanchez live outside the courthouse in san jose where it should be released this afternoon. kris, what does mean for the defendant though, antolin garcia torres? >> reporter: well his attorney will argue that it means that he cannot get a fair trial in santa clara county if everybody knows every intimate detail of the case against him, however, for the judge presiding over this case, he said the public's right to know is overrides that concern for pretrial publicity. this is not a done deal. we will have a crew waiting out here on the steps of the courthouse behind me for the release of that grand jury indictment. the transcript however a judge an appellate judge could block that. for now the presiding judge ruled that the publics right to know overrides concern that the pretrial publicity will interfere with that accused killer, antolin garcia torres's

right if to a fair trial. it's expected to be released today. in it he might find out what the evidence against antolin garcia torres is and why he was indicted on murder charges. her family and supporters continue to comb the south bay looking for signs of her. her family believes she'll come home alive, but the santa clara county sheriff's office said over and over again that they believe that she is dead, and they have the toefd prove it. we've never been privied to the evidence, that could change today. we may also hear from some of the witnessed who testified in that grand jury indictment hearing, including the three women that antolin garcia torres is accused of attacking and trying to kidnap. but again, it goes back to the evidence that resulted in him being indicted. >> we will learn a lot about this dna evidence that we've been hearing about. where was the dna evidence located in garcia torres's vehicle?

what kind of dna was it? all of that is going to be made crystal clear by these grand jury transcripts. >> reporter: now clark says that a grand jury report is one sided meaning that the district attorney's office presents their case and the evidence that they have, but the defense cannot give their side of the story, cannot cross examine either. again, garcia torres's attorney wants that judge to keep the transcript sealed to give garcia torres a better chance at having a jury that had not heard all of the intimate details of the case before him. however, in most cases, a grand jury transcript is automatically public, it is considered a public document. so, what we're arguing about here is keeping it sealed, rather than opening it up, that's not the anomaly, it's the keeping it sealed part that is the anomaly. we'll find out whether or not the defense attorney gets his motion to appeal, or rather to overturn that ruling later today. reporting live in san jose, kris sanchez, "today in the bay."

>> could change everything today as well, thanks a lot, kris. well another twist in the tichelman case. this one reportedly dated a man in prison for legally -- looetly injecting a woman with heroin and leaving the scene without calling authorities. we are continuing to watch this case, so the important news here senior that in the case of the google executive, the woman, who is suspected of killing him with heroin may have had another situation in which a beforehand die -- boyfriend died of the same sort of case. alix tichelman is in a santa cruz county jail this morning. it is 5:04 right now, the pleasanton school district is calling a special meeting of the board to deal with the dismissal of a public employee. the mysterious meeting with some people very baffled in that district, they tell the pleasanton weekly they received

just a few day's notice about the meeting nop word on what it's about. the weekly says the board will consider discipline, release, or dismissal of a public employee. it is a closed session though there will be a public report following that session. north bay teen accused of using a stolen credit card to raent high end sports card will be back in court today. he could file three new charges against mohammad halawala this morning. among them, renting at least two luxury vacation homes in the county. the 19-year-old did not enter a plea during a court appearance last month. because of the possibility new charges could be filed. he's already charged with a eight counts in connection with a fraudulent car rental. 5:05 right now, we have breaking news we're following this morning, fire inside oakland international airport overnight. sheriff's office tells us that authorities have detained a 60-year-old man who is suspected of setting fire to card board inside the terminal one baggage claim area. airport spokesman brian kid say sthas an alert tsa agent spotted the incident and immediately alerted the alameda county sheriff's office. it appears the fire was small, quickly put out and no one was injured. we're told that if you have a flight this morning, that no equipment, no flight, and no passengers have been affected by this incident. again, a 60-year-old man has been detained for setting fire to card board inside terminal one baggage claim area. it should not affect daily operations this morning. live at oakland international airport, nannette miranda, "today in the bay." well, in the meantime, people in one peninsula neighborhood on heightened alert after police say it was a target of package thefts. three in one day. stephanie, the thief caught on camera. >> reporter: yeah, that's right, good morning, scott. we're in the belmont heights neighborhood two happening a mile and a half here. one on waterloo court and that was the one caught on camera by a security camera at that house. 3:00 in the afternoon. that was all on wednesday. you see on the right a man dressed in a white t-shirt and jeans, looks around a bit, he's carrying a box under his right arm and swinging the other acting nonchalantly. he's headed to his dark gray car parked there, a prius or similar-looking car. opens the back seat door, gets into the car and drives off. the police believe this man actually drove around looking for packages on porches in this neighborhood. now the packages were from three different stores delivered by different companies. belmont police posting this 22 second clip on youtube that was yesterday, and of course the hope is for adeally someone

recognizes and identifies the man because so far this is all that they really have. other cities like fremont have had police post up youtube videos of a porch and package thefts there. and they've seen success at san jose has always done the same thing. police here hoping for that same kind of success. live in morning in belmont, stephanie chuang, "today in the bay." >> thank you. 5:08 right now, let's check in with meteorologist christina loren, look at the forecast. >> hey good morning, scott, laura, everybody at home. look at your radar this morning. just to show you what's going on across northern california, chances are you may be planning a trip out of town if you're headed to tahoe, you'll be driving through a few showers from time to time this morning and some renegade thunderstorms as well. and. you're headed even further north, places lick retding, mount shasta. for us here in the bay area, changes coming your way on shore flow returns and result all that monsoonal moisture as of this morning is going to start to clear out of here, and for us,

that means it is going to be spectacular. what a way to finish off the week. 61 degrees to start the day in livermore. not a bad start, temperatures are comfortable out there right now, widespread upper 50s to low 60s. anywhere you head out of town, right now, if you're leaving, really good-looking conditions, but i can tell you that wind is going to increase later on today if you drive a high profile vehicle, you want to take it easy across northern california. that's when you get the wind, two systems competing. san jose right now the midlevel clouds overhead. i want to show you the difference in emeryville, overcast sky here to start and beautiful san francisco and the golden gate bridge. still dark, you can actually see all the way. both towers top to bottom. that's really good. you don't have the thick fog this morning. temperatures mostly in the low 80s to mid-70s, and i can tell you, it's going to feel nice out there today. we will be done with the humidity. i'm going to stay around 3:00 you'll notice the difference. wind are already shifting, we told you this was going to happen this morning at the end

you're watching "today in the bay." welcome back everyone, look at a beautiful start is to our day, and partly cloudy sky over the south bay this morning. hoping far nice weekend ahead, we'll check in with christina in moments. 5:14 right now. speaking of san jose, long line is forming in san jose this morning as families are lining up to make sure their children are preparing for the school year. lucero benitez is outside of sacred heart community services where families are signing up to receive a backpack full of school supplies. that can be expensive, lucero. >> reporter: hi, good morning, actually people are waiting in line to sign up to get some of those free backpacks and that process will happen at about 9:00 this morning, but people came out here earlier to line up and make sure that they get a spot and that they're able to sign up. some of the people have been waiting out here since 10:30

last night. they said it was important for them to be out here because they wanted to make sure that they get a spot. each year, members of the sacred heart community service center give out hundreds of backpacks to children who come from low income families and that's why some have been out here since early this morning because they want to make sure that they get one. it does come with all of the school supplies ready for them, and so, now we're going to speak to a community engagement, community members who with us, carroll stevenson, she's going to talk about what they do and why it's important, good morning. >> good morning. >> reporter: did you expect to see so many people lining up since early on this morning? >> well, every year we have more families coming. and so we started 12 years ago with just 150 backpacks, and this year we're providing 2,800 backpacks and we don't want to turn people away. we have limited spots, and we want to be able to serve as many kid as possible. >> reporter: and so, people will be signing up at 9:00 this

morning, right? what are you doing earlier to make sure that you're able to serve everyone? >> well we are getting ready this morning, we hope to open a little bit early so that people that have been here all night long can be comfortable, they can use the bathroom, maybe get a class of water or cup of coffee and we want to the make sure they can process quickly and get on their way. people have to get into work this morning. >> reporter: thank you. this morning the the sign-ups will happen at the ska credit heart community center. it's located at 1881 south third street. lucero benitez, "today in the bay." >> great to see the difference we make, thanks a lot, lucero. skyline is growing this afternoon, san jose mayor chuck reid will take part in a topping off ceremony at one market south. that is the new 23 story apartment tower downtown. the city council hoping $150 million project high-rise will revitalize downtown and bring new retail shops to the area.

the federal government trying to make sure your kids don't charge up too many on those, too much money ravrt on the tablet apps. bertha coombs live at cnbc headquarters with a look at the new lawsuit filed against amazon and early morning trading, good morning, bertha. >> reporter: good morning, scott. yeah, we have the futures pointing to a higher start, looks like the open up about 30 points or so. roller coaster ride on thursday falling sharply at the open, following europe's lead on worries about solvency in portugal. raising fears we might see a repeat of last summer's european debt crisis. dow down 180 points in early trade, but cut the loss by the end of the day closing down 70 points to 16,915. the nasdaq starts today at 4396 after losing 22 points. both are on track for the worst week in three months, but we are coming off of some pretty big highs. the federal trade commission is

suing amazon saying the company hasn't done enough to prevent kids from making inept purchases without their parent's permission. most were in virtual games with charges from 99 cents to a whooping $99. amazon says it's going to fight the suit and it has already refunded money to parents who have complained. it's really a dangerous thing. you hand it off to your kid and little do you know you're going to get a three digit bill a little later. >> virtual tractor. bertha coombs, thank you very much. exactly. let's check in with christina loren whose probably never bought herself a $99 tract tractor. >> no, but my mom has a john deer, i mow the lawn. it's really, really fun. you're right, you know what you're right, it makes it more fun too because not a great time. one of the ways you can help out with the drought is switching over to mulch. you can put rocks out in front

and you know what, you're going to be helping out the whole state of california. as we surprise, we see the world as culturally, they really need that water. the good news is we have showers coming down in the central valley right now. and through northern california. we're not getting much activity here in the bay area, those are monsoonal showers, nonetheless, what else what happens is our atmosphere is nice and moist. so for areas in the central valley. as far as fire danger, rather pretty for now, that's going to change. san jose at 60 degrees, 61, good morning, san francisco. here they are. the subtropical showers, mostly impacting northern california. even more so than we're seeing. but for us, we're going to continue to see for today in the central valley. all this moisture's going to continue to push off to the east though as we head into your

weekend moving away from the bay area, as our winds shift out of the west, as an area of low pressure comes through, and that's going to make it feel a lot more comfortable. we are noticing the arrows now coming off of the ocean. that's a good sign. really comfortable day out there. on the peninsula, 65 degrees, nice, cool breeze in san francisco. 83 degree in the tri-valley and that's the warm spot today. not too bad out there. east shore, 68 degrees, really comfortable out in oakland. and yeah, we're looking really good to see that supermoon tomorrow night. it's going to be really, really great. if you can get out to the science center in oakland, they're having a supermoon hike, should be clear, 8:00, get out there. 3i6 degrees. and yeah, mike, i'm going to talk about what makes it so super coming up. stick around for that. i know you're curious. i can see it in your eyes. >> i'm curious why they call it a supermoon. over here the bay bridge, same pattern there.

face and chest in a hospital this morning. woman taken to the hospital as well. two pets also suffered smoke inhalation, this all happened at an apartment on 159th avenue near the bay fair center. the battalion chief on scene says the fire appears to have started in the kitchen. luckily flames did not spread to any other units in the building. today some of the questions surrounding the sierra lamar murder case are expected to be answered. 2,000 pages of grand jury transcripts will be released. "today in the bay's" kris sanchez live outside the courthouse in san hose where it'll all happen. what does it really mean for the defendant, antolin garcia torres? i would imagine his attorney's concerns. >> reporter: right, he says if this is released, antolin garcia torres will not get a fair trial, it's important to note that in almost all cases here in the united states, with our judicial system, the grand jury testimony is considered a public document. now the 2,000 page grand jury

give their side, cannot cross examine any witnesses. we may also learn about witnesses, three women who garcia torres is accused of assaulting and attempting to kidnap as the d.a. presented the grand jury with a pattern of behavior to bolster their case. though we will have a crew waiting on the courthouse steps right here behind me for the release of that document at 5:00, it's not a done deal. the defense attorney could still ask another judge to overturn that ruling and keep this document secret, though as we mentioned before, it is generally considered a public document. its now been under seal for four months. reporting live in san jose, kris sanchez, "today in the bay." >> thank you very much, kris. this morning san francisco police want to talk to anyone who witnessed a brutal beating near at&t park dwred. sent a woman to a hospital. the woman tried to break up a fight between two men on second and king streets. she was punched in the face and knocked out. this morning, she's in the hospital with serious head injuries. another man treated at the scene.

happened around 6:00 last night, couple hours after the giants, a's game wrapped a up. it's unclear if the people involved were actually at the game, and so far, no arrests have been made. the fight happened just one day after injured giants fan bryan stow was awarded $15 million. he was brutally beaten outside dodgers stadium three years ago. 5:34, a crash is cleared, but you may see construction along highway 34. that's because parts of the road were so badly damaged they now need to be repaved in order to be safe. shutting down part of highway 17, it finally reopened about 5:00 in the afternoon. as you see the big rig there, causing a chain reaction. one person died. eight others are recovering. the guardrail is also being

replaced. beefing up security after an elderly couples home. it happened after camino real. late wednesday night a burglar removed a window screen, the suspect stole a brees and rummaged through the couples belongings. they woke to find as me left behind. the couple wasn't hurt. in the south bay, there's growing concern about the west nile virus and the treatment being used to get rid of it. vector control says they found nearly 300 infected birds so far this year. that's three times the number found in all of last year. drought and warm temperatures could be partly blame, the county has fogged, some people living in the area are worried about the increase use of chemicals in 30 years of fogging, there has not been a single documented case of the spray hurting anybody. except perhaps mosquitos. 5:35, i want to the check the forecast with christina

we're looking over towards the tri-valley with a easy drive as well. westbound 580. no problems, we do have a crash at the onramp affecting folks gettingen to 580, but on 580 itself, you see flashing lights, little distraction and slowing just for the time being. the south bay moves nicely northbound in all directions as laura just told you, highway 17 reopened. watch out, there may be rail repair work and roadway repair work. keep in mind in mind. no problems right now, but vta, you guys have fallout because somethings going on this weekend. >> that's right. you know well about this. seven light rail stations near levi stadium. make improvements to the service at levi stadium. they will be closed so crews can lay down new tracks that will eventually accommodate extra trains on game day. the stations are expected to reopen. the company behind a controversial app that let users auction off the parking spots

season suspending its service. last month, san francisco city attorney sent monkey parking a cease and desist letter. the city threatened to sue saying the business model is based on illegal transactions. monkey parking says it's not giving up. executives from the italian-based company are traveling to san francisco in hopes of collaborating with the city to find a solution. well it is 5:39, president's back in washington getting ready to push congress for more funding at the borderer. we'll have a live report next. dozens of tanks up for auction this morning. how you can own a piece of history.

deal with immigration and customs, the hearings, the judges, that area, that money is expected to run out in the middle of august,less than a month from now -- less than a month from now, as for at the border, agents patrolling, that money could run out by mid-september. shortly before the end of the fiscal year. now jay johnson, the homeland security secretary is urging congress to do something about this to pass the $3.7 billion in emergency funding to deal with the crisis at the border, especially the tens of thousands of children. lawmakers have a couple of plans on the table, but they want. exchange, particularly republicans, want in exchange more authority for the obama administration to deport those children quickly. >> tracy potts live in washington, thank you. it is 5:42, we have breaking news to tell you about this morning. a man is under arrest for allegedly starting a small fire inside oakland international airport. the airport this morning. what do you know so far? >> reporter: we know that authorities detained a 60-year-old man who is accused of setting a fire inside terminal one baggage claim. here's video we shot just a few minutes ago. apparently the card board has already been hauled outside the terminal, but the smell still lingers inside. these are very large piece of card board. oakland airport spokesman brian kid says an alert tsa agent spotted the incident around 3:30 this morning, and immediately called the alameda county sheriff's office. it appears the fire was put out quickly, no injuries have been reported and no motive at this point. if you are trying to catch a flight this morning. no equipment, no flights, or passengers have been impacted. the lines are now starting to get pretty long here at the screening area. back live here at the airport, a 60-year-old man has been

detained for setting fire inside the terminal one baggage claim. it appears that the airport is back to normal. live at oakland international airport, nannette miranda for "today in the bay." >> all right, thanks for the latest. caught on camera. belmont police say a man targeting one neighborhood has been captured by a private security camera. they're hoping for some tips. "today in the bay's" stephanie chuang live in belmont. stephanie the thefts happened within hours of each other. >> reporter: that's right, i just spoke with a man who lived in this neighborhood for 14 years and he told me that this is the first time he's heard of this happening here. but two of them happening in a one and a half mile stretch here off hal mark drive. then 3:00 p.m. on wednesday, waterloo court and that is when a security camera was rolling catching a thief in the accident. when you see the video, you see a man on the right sidewalking out. white shirt, jeans, looks around, carrying a box under his right arm. acting nonwhat lontly heading to his dark gray car parked there.

it's a prius or similar car. he opened the door, tosses in and gets in. of course drives off. police believe that this man drove around this neighborhood looking for packages on porches. the packages were from three different story stores, delivered by three different companies. belmont police posting the tip on youtube yesterday hoping that someone will recognize and identify the man caught on camera. that is what happened in fremont. police there had actually posted a video in november of 2012, and three months later, they had caught a woman who they believe was responsible for taling that packening a. meantime, belmont police hoping for success here. live in belmont, stephanie chuang, "today in the bay." . >> wove had so many of these. i'm going to get some myself. >> they're everywhere. >> i think it's a great idea. >> there you go. don't mess with them. nice weekend. >> it's the the weekend. here in the silicon valley too. you know what i mean, it's not

to come out of the west. and for us, that means onshore flow is returning. and look at this. you can really see that represented now in our live picture, ocean beach, stocked in with fog, same cloudy sky here in the south bay. look at this, all the way out to pleasanton, we have the low clouds as conditions are changing as we speak. temperatures are going to feel true to form today. it felt a little hotter than your true temperatures over the past couple days because the air has a weight to it. when you add that moisture. that humidity, we call it a heat index when you stack the temperature in with the humidity. 64 degrees in san francisco, and 75 degrees, oh, what a beautiful day in wine country. it's going to be beautiful there all weekend long. you want to hit the beach, saturday, 74 degrees, but look at sunday, up to 82 degree. a lot of sunshine coming your way. then when we get into next week, it's going to be hot. i have to tell you, 88 degrees in the south bay my monday, but 68 in san francisco, and then we'll start to cool you down tuesday, wednesday, and
