fire next. plus the state considers massive fines for water wasters hoping to hit them where it hurts. seems like every time we do this story we're tracking showers on the radar. that's the case again today. otherwise, we're going to track these for you, tell you when it'll clear. noticeable heat relief for today, getting into tomorrow, the breeze is going to pick up, ocean air back in the bay area, and then a much cooler weekend on tap. i'll take you through the changes in your microclimate in moments. >> and i'll take you the through the changes we're seeing already in the bay area speeds and the moisture christina's talking about. we'll see whether or not that's playing a factor for your morning commute. peek outside this morning, live look at mike inouye because he is so handsome. >> oh, thank you. >> and you know, san jose pails in comparison to all that beauty on this early tuesday morning, july 15th, this is "today in the bay." from nbc bay area, this is "today in the bay." good morning to you, thanks

so much for joining us, i'm laura garcia-cannon. >> and i'm scott mcgrew. new morning a key artery in loren county reopened for the first time for rush hour. crews working through the night repaving sir francis drake boulevard near san quinnton state prison. investigators say yesterday a big rig driver lost control, crashed, the truck carrying 1700 gallons full of fuel spilled across the road. nobody hurt. chp closed both directions of the road at 7:00 a.m. yesterday and finally cleared the scene just before 2:30 this morning. there is a little bit of moisture out there, but we are in a severe drought, and wasting water could soon cost you at least $500. in just a few hours, the state is set to vote on handing out fines rather to people who do not conserve. "today in the bay's" kris sanchez joins us now from santa clara county valley water district. when could those fines be issued?

>> reporter: we could see it go into effect immediately if the board agreeings to pass that -- agrees to pass that regulation. not just $500, but $500 a day, that's a lot of money, but they are trying to send a serious message. the state water board will vote today on whether or not to pass that, those regulations. this would affect anyone who overwaters their yard or who has a water feature like a fountain that doesn't recirculate the water or folks who wash without a nozzle on the end of the hose, they would be subject to a fine. the only way is wash down sidewalks or highways if there is a public health concern and that would spare city workers from washing down human waste. 20% as the governor said earlier this year, so far across the board, californians have only cut back by about 5%. now water regulators recognize that many folks have already cut back where they can, inside installing low flow shower heads and toilets, but because most

who live in the city use most of our water outside the home, that's where they are thinking that people can still cut back. not everyone is convinced that a fine will force people top conserve, but many say it is worth a try. >> i think we do need to conserve the water. you know, all over the place, it's not, what are we going to do? it's going to go dry, then everybody's going to be wow, what happened. you know, no, i think it's okay. >> even if this doesn't pass, there's still rules in place every local water retailer has a rule about wasting water. >> reporter: critics say that any money spent on enforcement would be better spend on educating people that conservation could mean enough water for 3.5 million californians for a whole year. now if the board enacts those mandatory measures they would go into effect immediately as i mentioned and they would remain in effect for nine months. by the way, police are not the only ones who could write

tickets. we're short staffed, especially here in the south bay, however, anyone who is enabled to enact laws, they could write a ticket as well so we could see more people writing tickets. in san jose, kris sanchez, "today in the bay." >> one to watch, thanks so much. just to give you an idea of how serious the state is about these fines, here's how they compare. second violation during a spare the air day will cost $500. get caught violating car pool rules and you'll bay $490. distracted, $159. nbc bay area will be inside today's hearing in sacramento, and you can get complete details on the state's plan for water fines during our news at 5:00 and 6:00. well we have breaking news, at least 19 people have been killed when a subway train in moscow derailed during rush hour this morning. investigators say a power surge triggered that alarm causing a train to come to a skeeching

halt. the sudden stop caused the trains cars to run off the tracks. now in addition to those killed, at least 50 other people are said to be in grave condition. another 100 were injured, but should survive. developing right now in the middle east, israeli military denying it launched an air strike into gaza. hamas police say rockets hit an apartment building in northern gaza. it comes as egypt is trying to negotiate a ceasefire between both sides. hamas rejected the plan earlier firing at least 35 rockets at israel. israel had accepted the truce plan, but said it would hit gaza hard if hamas rejects that deal. muslim and jewish leaders will gather in oakland todayed to pray for peace between israel and hamas. the prayer individual sl open to the public ae -- vigil is open to the public. some will take part in a ceremonial breaking of the fast organizers say everyone should be able to live without fear.

a resident of gaza who's visiting oakland will address the crowd as well. well the man accused of killing a vallejo police officer is expected in court to set a date for his trial. prosecutors pursuing the death penalty against henry albert smith jr. in november of 2011 police say smith shot and killed officer jim capoot after that high speed car crash. he pleaded not guilty, capoot was 45 years old and leaves behind a wife and three children. it is 5:06, plan to split california into six separate states is apparently headed to the voters. today billionaire tim draiper is expected to submit the signatures necessary to put this idea on the ballot. we have a live look at san jose. if voters agree, the heart of the tech industry would actually become the heart of the state of silicon valley. a long way to go though is the bottom line. fix california is the initiative name. the backer posted that it collected enough signatures for sacramento today. and of course, the plan backed and led by capitolist tim draper, let's look at how this would happen. it'd be six different states, jefferson, wine country, and sierra nevada area, then silicon valley right here, san francisco down to san jose essentially and monterrey as well. west would be l.a. and santa barbara and south california, that would be the inland empire region as well as san diego. let's look at the youtube video posted by california's in orange county. in it he says in 45 years, the state has gone from the best place to the worst place to do business. 47th in the country for k-12 education, and rates way too high. >> the land of the free, home of

the brave. okay, so how free are we if we're stuck in a school that we can't choose, and we're stuck in a state that we can't excuse, then how brave are we if we don't challenge that? >> reporter: so draper wanting to challenge that of course. there are major hurtles, the u.s. constitution requires both congress as well as the state legislature to approve this idea. this division of the state, and if it gets on the november 2016 ballot, at least now it seems it may not pass, february poll revealed 59% of surveyed californians did not support the idea. so again, long way to go, but draper and the fix california baby, expected to hold a press conference with more information later today in sacramento. live in san francisco this morning, stephanie chuang, "today in the bay." >> he has a different state of mind so to speak. thanks a lot, steph. well it took three years of research, studies, and meetings, but the santa clara city council thinks it came up with a

solution to deal with traffic outside of levi stadium. personalized parking. "today in the bay's" bob redell live outside levi in santa clara, bob, the plan could be approved tonight, run me through it, what is personalized parking? >> reporter: well the individualized, customized turn by turn directions to your regular parking spot here at the new levi stadium, scott. the city is expected to approve this multimillion dollar parking plan. one design to avoid the log jam that drove fans nuts at candle stick. now that's not to say there won't be traffic to people getting the levi stadium, the city and team believe they've designed a way to get the 19,000 cars expected game day into the thousands of parking spots spread out over 28 lots which you can see laid out on the map. to the nuts and bolts here asking about, scott, to make this work, drivers would receive their own customized directions to their parking lot. one that they could access

either online or on the back of their parking pass. it would suggest which highway off-ramp, and once on local roads will provide turn by turn directions. also a series of temporary signs and upgraded traffic lights that'll herd fans so their parking spots. they would be set to the a synchronized skenl to about four hours prior to game time. instead of sending everyone on the same route or randomly to their same spots, drivers would be spread out to smaller groups so you're sharing your route with hundreds of other drivers instead of thousands. now of course this required that fans cooperate and follow directions. fans will have access to an app with realtime traffic and parking information. two lots that would have bicycle parking, private charters, taxis, like uber would have pick up and drop off areas and vta would be running trains every ten minutes. again, the city council expected to have arapahoe this unique

parking plan tonight, and don't forget, the ribbon cutting if they are thing behind me, its been a long time, it's just a couple days from now on thursday. reporting live here in santa clara, bob redell, "today in the bay." >> it's amazing to watch, bob, thank you much. it's amazing how big that thing is and how quickly it went up. 5:11 right now, morning commute, let's cherk in with mike -- check in with mike inouye. >> they are moving well, especially, bob was talking about levi stadium, i'm wondering how i'm going to help out. that phone is going to be ringing off the hook helping out people individually. that's the reason why valley transportation authority, vta, is working on some of the mass transit solutions that bob was talking about as well as the stories in the redwood city. look at traffic flow, it's easy. redwood city and mountain view is involved because they're going to park and take cal train over there. we'll see how the parking situation works out for them. vta, there's bart, and the ferries moving smoothly.

in fact all the ferries throughout the system this morning reporting no delays. we're talking specifically about the lunch for ferry terminal, you let folks know that we have reopened sir francis street boulevard at 2:20 this morning. you can begin cut through the 580 and the ferry terminal. that's great news because yesterday it caused a huge problem coming across the richmond san rafael bridge. nop problems this morning or coming over from the east bay. easy flow of traffic heading towards the bay bridge. surface street traffic through berkeley itself. no drama through oakland or for the south bay as we talked abouted. slowing through livermore, 580 out of the pass, the green and blue means moisture in the air. look at the live shot and we see a smooth flow of traff once you reach the street without difficulty. christina, we talked about the moisture on my radar, but yours is more detailed. >> it is impress thif morning, mike, good morning. look that the, we're tracking widespread rainfall across the bay area at this hour. and this is all ushered in by high pressure, not in the

traditional counterclock wise low pressure systems that originate in the good enough of alaska and into the bay area. high pressure is firmly situated over the four corners region. it pulls up moisture from just off the coast of baja and brings it right here into the bay area. so it's stick you, but we have showers and rain-cooled air. i have to tell you, it's a nice, refreshing change this morning. i am tracking a significant batch of moisture right here headed up 680, if you're headed towards 880 on 680, really slick conditions in the fremont area this morning. otherwise, we're looking good. these showers are all going to press to the north as we head throughout the next couple hours. but we're expecting this batch of rain in san rafael at 6:10 this morning, and we're going to continue to the see these showers move through as we head throughout the morning, but then by this evening, everything moves over to the sierra nevada. if you're headed that way, we could see flash flooding, keep that in mind. you want to travel cautiously and keep your radio on as well because they will update you on any sort of changing weather elements if you're headed that

you're watching "today in the bay." well the power of the press, san mateo's gopro closed down more than 5% after yesterday's bell. the sudden drop in stock due in

part to a weekend article in barrens which pointed out our smart phones could make gopro's unnecessary. they call this the barren's bounce. gopro opened last month at $24 a share. the stock is higher than that this morning trading at 31, but it did suffer yesterday. yahoo announces its quarterly earnings after the closing bell today. analysts don't expect hear much from the company, but they will be listening if any insight into alibaba. it has a stake in the chinese company. success for the company will mean success for yahoo. and for the rest, a look at how the markets doing before the bell, let's turn to mary thompson, good morning. >> reporter: hey there scott, we begin with a wrap-up of what happened on wall street monday. the dow reclaiming that 17,000 mark. markets boosted by a flurry of merger news as well as citigroups better than expected

earnings. 17,055, nasdaq add 24d to close at 4,440. import prices and earlier this morning, we saw better than expected earnings release from j.p. mogen as well as goldman sachs, lastly janet yellen will be testifying before the senate on the economy. a lot for traders to watch on. back to you. >> all right mary, thank you very much. keeping check of the markets, now check of the forecast. christina loren. >> more unexpected changes to the forecast. 5:18 now. now we told you yesterday that that big ridge. high pressure would bring your temperatures up into the triple digits, which it did. it also brought up a lot of the sub-tropical moisture, and here's what happened yesterday. in the south bay, we hit the low 90s, then all the sudden, those clouds started increasing and limited that sunshine and we got by with a nice finish to the day. it was humid. now today, look at the difference, that ridge of high

pressure even stronger, pulling up more moisture this morning, and we are waking up my friends with widespread rainfall across the bay area. with the south bay seeing the most activity right now, all of this though is starting to work its way up the peninsula and into the san francisco. so yeah, i'd say at this point, if you're wearing something nice to work, i'd say go ahead and grab that umbrella. you may have to use your windshield wipers for the first part of the day. by lunch time, we're expecting this, lingering sub-tropical clouds. otherwise throughout the next couple of days, we are going to keep the monsoonal moisture in the forecast, but definitely not as strong as it is out there. muggy with a few stray showers for today, then by this weekend, on shore flow returns, and we are going to see just spectacular conditions for saturday and sunday. 85 degrees for the south bay, 81 on the east shore today and 70 degrees in san francisco. all be it it is muggy throughout, temperatures have fallen by about five to ten degrees, and it's going to feel a lot more comfortable as we get into this afternoon. i'll show you the weekend

forecast in a few moments, right now let's say good morning to mike inouye. >> hey good morning, christina. pick your path around the bay, smooth drive, a lot of green on the speed sensors, yellow down to just below the speed limit there. also the green blotches around again they share the same data. i'm getting reads on the radar that christina's talking about and we're showing the areas where you're getting more mist. fremont, 680, 880, mission boulevard, somewhere around here you might get drops on your windshield. i had them earlier for 101. we were watching for the travel around the bay, no major problems reported there because of that. we're just watching for the effects, west 580 shows build and we have more green and blue might be actual rain instead of mist and drizzle coming out of the pass. the typical build here for the tri-valley and no big surprises nop surprises on the morning commute. easy drive for 24, here's 580, 880 and down at east shore freeway. bays moving smoothly and toll

plaza ipts, live look out of there. no problems coming off of the berkeley curve. all lanes moving smoothly. different look for the golden gate bridge, tougher visibility, but the traffic flow from the north bay is smooth, back to you. we're learning this morning about a scam spreading across the bay area. scams these days usually prey upon eagerness to make money. we've discovered one of the fastest growing scams uses the irs and the threat that you could go to jail. tonight steve stock travels to washington, d.c., to talk to people who oversee the internal revenue service find out how scammers are using the irs to cheat people out of millions. >> part of the scheme would involve the person pretending to be the internal revenue service, actually having some digits of your social security number. and they tell you those digits, and when that matches, a lot of times people are then inclined to believe that it is the irs. >> now investigators believe multiple groups of people have

successfully ripped off victims to the tune of millions, all within the last eight or ten months, and get this, californians have been targeted the most. coming up tonight on bay area at 11:00 tonight, the investigative unit will take you inside that scam, show you thousand works and how to keep from becoming the next victim. tonight at 11:00 p.m. on nbc bay area. hunt is on for a man accused of tooking a woman at a peninsula store. san mateo police are looking for this man. he followed and videotaped a woman last wednesday. it happened on south delaware street near el camino and 92. the man left the store, but when the woman went outside, he was standing next to her car. man walked away, but the woman found a suspicious substance in her car that prompted her to call for help. well the time now 5:2i, the world -- 5:22, world cup champs returned home this morning, the happy homecoming next.

they are taking a vote for people who overwater their lawn without a nozzle. kris sanchez is live, kris, if proved -- approved, thoekd be handed out quickly? >> yes been laura, they would remain in effect for nine months as you mentioned, the water restrictions for people who overwater their lawn. let the water run off on to the sidewalk, anyone who washes their car without a nozzle on it or has a water freech in their -- feature in their yard like a fountain that doesn't recircula recirculate. the only way to wash down a sidewalk or highway is if it's a public health ksh which is a good news for public workers who have to wash down alleyways for human waste and such. it's to force people to conserve 20%. so far californians across the board have only cut back by 5% and since in our cities, most of us use most of our water outside the homes, they figured that's where people can still cut. >> the regulations recommend a

$500 fine per day for breaking any of these rules. locally, fines have not really been utilized by our water retail source they are usually able to get people to do the right thing by approaching them, telling them that you have a problem here, it needs to be fixed. >> reporter: again they could change today. critics though say that any money spent on enforcement would be better spent on educating people that conservation at 20% levels could mean enough water for 3.5 million californians for an entire year. if the water board approves the measures, we're not just talking about police, it would be any public employee who is able to enforce the law. in san jose, kris sanchez, "today in the bay." >> thanks so much, kris. we continue po monitor breaking news, at least 19 people killed when a subway train in moscow derailed during the rush hour this morning. investigators say a power surge triggered an alarm causing that train to come to a skeeching

halt -- screeching halt. the stop caused cars to run off the tracks. now notion the 19 -- in addition to the 19 people already dead, at least 50 other people are said to be in grave condition. another 100 were injured, but they should survive. a developing story just moments ago, the israeli military announced it is resuming air strikes on gaza after hamas rejected a ceasefire. meanwhile gaza militants fired at least 35 rockets in the israel today. proposed ceasefire came from egypt following a week of heavy fighting that killed nearly 200 people in gaza. israel originally accepted the offer this morning, but hamas leader said the proposal was not acceptable. egypt said it would consider easing a border blockade of gaza if it's accepted that ceasefire. 5:33, in today, the two men accused of getting into a fight outside at&t park are expected in court. investigators say the two got into an argument with a man and woman outside the stadium last thursday after the giants played

the a's. they reportedly punched the man and then hit the woman when she tried to stop the fight. she was knocked unconscious. both victims are okay. investigators do not think the fight was related to team rivalry. nals court this moerng -- also in court this morning, the sunnyville man accused of tricking teens into sexting him. lawyers expect him to enter a plea today. scott angelo sent pics to girls and believe they were talking to their own fathers. we don't know how hoe got the numbers. investigators have identified seven victims, but the assistant district attorney told us his team will announce today whether more actually came forward. police are also looking for a man this. morning going around palo alto with a gun robbing people. take a look at this the sketch. police say someone looking like this man committed two holdups less than seven hours apart. the latest happened just after 1:00 yesterday morning on hamilton avenue. the victim turned over his wallet and cell phone after the

suspect reportedly threatened him with a gun. hours earlier, a similar robbery happened two miles away in menlo park. today santa clara will consider a multimillion dollar traffic system described as unprecedented. the idea is to ease congestion around 49ers new stadium in a very unusual way. "today in the bay's" bob redell is live outside levi stadium in santa clara. we're talking about personalized parking instructions. >> reporter: we are and the city and team to want avoid the log jam that fans had to deal with on 101 back in the old days at candle stick trying to get to those games. but how do you make this work when you have almost 19,000 cars that are trying to get into the 28 different parking lots that are spread out around levi stadium as you can see in this map right now on your tv screen? they've come up with a plan, to make that this work, drivers will receive their own customized directions, one to access before or on the back of their parking pass. it'll suggest which highway off-ramp toe use and once on the

"today in the bay." >> clever idea, thank you. beautiful morning, just take a look at that shot out there. a little moisture in the air as well. i want to check the forecast with christina loren. >> it is kind of sticky throughout work good tuesday morning to you, the temperatures are really not the weather story of the morning, it's the radar. temperatures right now mostly in the 60s, definitely mild. definitely overcast across the board, but this is what might catch you off guard this morning. showers on the radar, and let me kind of show you the general nature of these showers. they're moving in from the south pushing to the north. as we continue through the morning, we are going to see it activity for the next few hours, but it won't last all day. nonetheless, it is so welcome as you know we are in the heart of a drought. and so any moisture is a welcomed site. let me show you right now where the heaviest downpours are coming through. we had a pretty good batch of rain roll through the south bay working up towards the peninsula and up in the santa rosa area, you're fair game for your first showers throughout the morning, all that activity is pressing

without incident, there's your approach over from oakland or out of san francisco. so does the richmond center, fellbridge, it is reopened overnight, and that's great news for the morning commute over there. no problems, and no surprises for the tri-valley. little moisture, some rain over at the pass perhaps, but as you get into livermore and dublin, easy drive here. rest of the bay, pick your path and you're at the speed limit and the roads and rails also moving smoothly. no delays reported for any of the major systems. i'll hand it off to you guys, i think you have some as well. >> you sure do. transportation leaders in san francisco could decide today whether to raise fees for cooperate shuttles like the google glass. mta staff recommending they have to pay to stop at each muni bus stop from one dollar to more than three and a half dollars. they say the buss are making fewer stops than they thought. speaking of muni, the chronicle reports operates voted yes, greatly reducing the chances we will see another sick out like last month. the contract promises a 14%

it builds again and kick in for the rest of the south bay. there you go for your northbound routes. there you go along the peninsula and east bay, no big unexpected traffic flow. southbound shows that build through hayward. we have the green blochs around as well. remember the traffic and weather systems share the data, i have the radar christina's talking about and we have moisture, maybe mist and drizzle along the peninsula. east bay and coming out of pass, no problems reported for 580 westbound heading over into the dublin interchange. huge drive coming across the bridges, and the north bay remember, sir francis lake is reopened, and you have an easy drive off the bridge and over towards 101, you've got that corner again. look at live shots we have, east shore freeway down towards the toll plaza, smooth drive coming out of the maize. smooth flow of traffic, but the low clouds are including the span itself. the toll plaza itself has the back-up. it's forming. looks like they may have turned on the lights a minute ago. if not, they'll turn it on any

second, back to you. >> looks like it. it's 5:49, san francisco firefighters say short staffing and higher demand leading to delayed response times. recent audit of the san francisco fire department finds paramedic are stretched so thin ambulances are not coming fast enough. firefighters say the goal is to have a patient on the road within ten minutes, but because staffing is so short, the response times are delayed minutes longer. the union says delays are becoming more frequent. the crisis the department says are working on. >> the increase in population, and an north carolina in call volume of about 20%. so that's gone up, our staffing has gone down, we're ramping that back up. it's a process. >> the ambulances are expected to help the situation over the next year. in the men time, city leaders are working on finding new ways to hire more staff. if you call your close
