watching him die will answer to several charges this morning. including manslaughter. "today in the bay's" bob redell live outside the courthouse in santa cruz where tichelman will appear in hours. >> reporter: good morning, though alix tichelman arrested on suspicion of second-degree murder, it's the d.a.'s office who has chosen to charge the lesser crime of manslaughter, telling us that, as of right now, thus far, the evidence doesn't support otherwise. and the main piece of evidence, according to the prosecution, is video that allegedly shows tichelman injecting the former exec with heroin and doing nothing to help him as he convulsed and died. the 26-year-old prosecute had an ongoing pay for sex relationship with hayes when the two met on his yacht. it was a surveillance camera on board his vessel that captured his death. hayes, 51 years old, married

with five children, had a long, successful career as engineer in silicon valley. this case, here on the west coast, has compelled police on the east coast in milton, georgia, re-examine another heroin overdose death allegedly involving tichelman, with a 53-year-old atlanta nightclub owner and one-time boyfriend, she told police she found him on the ground after she got out of the shower, after two had been drinking and shooting up throughout the day. here's a portion of her call to 911. >> i don't know, i think my boyfriend overdosed or something, like he's -- he's -- he won't respond. and he's laying on the ground. i don't know. >> okay. >> the 911 operator ended up calling tichelman to get more information about the status of her friend. held in santa cruz county jail

on $1.5 million bail. she's expected in court for her arraignment, possibly to enter a plea scheduled for later this morning, after 8:00. reporting live here in santa cruz, bob redell, "today in the bay." >> interesting to hear. bay area sex therapist says it's not unusual for rich, successful people, especially men, to seek out risky behavior. dr. elaine brady a certified sex addiction therapist in the south bay, treated many silicon valley executives. sometimes people in power feel like they need a release, even if it's not healthy. >> we all want to believe in the cinderella story and all want to believe that money will make everything all right. but the harsh reality is that power corrupts, nature demands balance, and for people who are engaged in the kind of dynamic,

high pressure work that we demand here in the valley, there's a price to be paid. >> if you know someone who's an addict, help is available across the area. city of san francisco, the city wants to sue to get that reversed. may have a case. audit found the commission is n inconsistent in enforcing rules in the state's 112 community and junior colleges. city attorney herrera filed suit, wants the state college board to take over the job of deciding whether city college should stay open ccssf was supposed to lose its accreditation at the end of the month but a judge delayed that pending an outcome of this lawsuit. peninsula seniors are losing their gym. they say they're not going down without a fight. 35-year-old ymca facility on page mill road slated to close

later this year. but at a community meeting today, ymca leaders can expect to get an earful. "today in the bay's" kris sanchez joins us from palo alto, causing quite an uproar. >> reporter: it is. a small gym located in the basement of this office building here in palo alto. but already steady stream of members have started to arrive for their regular workout. many of them say it is like a second home to them. the 2300 member of the page mill road ymca facility found out last month the facility will close for good in october for financial reasons. in a letter, ymca of silicon valley told them the gym needs upgrade, including new heating and air-conditioning system and the board decided not to make the $2.8 million investment because they could not recoup it. members tell us they feel disregarded. >> if there's a money problem, they that should have been brought to us and we can figure out a way to do that. >> they mentioned they were

trying to serve the community better. this is a community and i don't feel they're serving us. >> reporter: many of the members of the page mill ymca are seniors. they're not out of the cold. ymca offering them three months for free at other ymca facilities, facilities where there are programs not own for seniors but family member of all ages. one member tells us he has no problem going to other facilities but other people do. tonight's meeting at unitarian universalist church in palo alto, west of needle field road, starts at 5:00. and it's likely to be lively because some seniors say they're going down swinging but if they cannot persuade the board to change their mind the facility will close for good in october. we have breaking news to tell you about overnight. a small fire at the chevron refinery in richmond, richmond firefighters tell us processing line broke overnight and started

leaking heavy oil. and the vapor from the line ignited starting a small fire. firefighters put the fire out quickly and no one was hurt. the refinery's trying to shut down the broken line now. crews have made quick work of a small vegetation fire burning just south of san jose. the two acre fire started last night on coyote creek drive and highway 101 near the golf course. no buildings were threatened. the cause is still under investigation. well, let's collect in with meteorologist christina loren for a microclimate forecast on a fine wednesday. >> good morning. it's a fine wednesday morning. we have that moisture in the air. yeah, your hair will be a battle trying to get it nice and polished. i can tell you this is the last day, as we head throughout the next couple of days. as of this afternoon, notice cool breeze returning. we've got a coastal eddy offshore bringing in showers, as

we head throughout the next couple of hours, this is expected to subside. then we're going to see a nice sunny finish to the day with cool pacific breeze returning. right now i want to zoom in, show you where the rain's coming down. watch out san rafael waking up and getting ready to hit the highway. it's slick through there. showers continue to press to the north towards sonoma county, we should be clear for the morning. san jose showing you mostly cloudy sky to start. a pretty sunrise as we head throughout the next hour. all of the live pictures across the bay area. san francisco and golden gate bridge not socked in with fog but you can see the visible moisture there. throughout the day, temperatures are going to be comfortable. when you factor in that breeze as well, 80 degrees in south bay, comfortable conditions for us. 78 on the peninsula. you'll hit 66 in san francisco. 82 for north bay. 70 on east shore for this afternoon. comfortable day shaping up in the tri-valley. we had 105 earlier this week.

84, nice looking day. we'll jump into the weekend forecast coming up. here's mike inouye. >> dublin, 580, good volume of traffic, typical on a wednesday moving westbound. we'll show you where that is on the map. a smooth drive westbound. farther east the slowdown out of the altamont and slowing towards livermore. speeds north livermore avenue just about 55. seeing that volume start to creep over the leading edge, just getting over toward high y highwayhighwa highwayhighway 84, no surprises. 680, around highway 84, came into chp a couple of seconds ago. they're not on scene. i'll track that. no slowing showed up on the sensors. northbound commute, routes kick in around 7:30, 8:00, we'll see that build there. here in the rest of the bay approaching the city from the bay bridge or the peninsula side, easy flow of traffic there.

san rafael, as quickly as we showed you, that has cleared and southbound commute starting to build for the curves at terra linda. take extra care on the roads today. officers and deputies in san mateo county taking part in traffic crackdown. there will be extra officers on the road looking for speeders, people not wearing seat belts and drivers using cell phones improperly. good advice. >> exactly, no matter where you are. an area near fisherman's wharf is shut down. >> because of a film crew shooting scenes for the latest film by the actor, the rock. "today in the bay's" stephanie chuang joins us live in san francisco. not everybody happy. >> reporter: good morning. that would be mostly the merchants in the area, especially down at fisherman's wharf. just a few minutes ago, someone set up the signs you see here, road closure, supposed to go into effect at 2:00 in the morning. it's three hours late. police officers making sure no one turns into that stretch.

contrary to other reports, embarcadero, that street, the side street, closed off, not jefferson street the main street that runs here that most drivers use. look at the map, that stretch that is closed goes from powell here to taylor, again supposed to be closed from 2:00 this morning. does go until 1:00 this afternoon. trailers started arriving in of the last hour for makeup, wardrobe production, rest rooms and house cast and crew members. most of the filming for the movie "san andreas" is being done in australia but some filming being done in the city by the bay for a few days. filming started yesterday and set to wrap up around fisherman's wharf before moving to hyde street where there's a scene involving a few hundred extras. the movie is about an earthquake, as you might guess hitting california. the rock plays a rescue helicopter pilot who leaves a los angeles area to search for

5:15, new this morning, russia has detained two subway employees in connect with the deadly train derailment in moscow. investigators say a new rail switch where the train went off the track was not properly installed. 22 people died and more than 100 hurt when the tranderailed yesterday. the crash is the worst in years on moscow's overcrowded subway system. germany is considering a new way to combat spying in the wake of the most recent u.s. surveillance scandal. politicians are seriously thinking about ditching e-mail and turning to manual typewriters for sensitive documents. recently the u.s. has been linked to a series of spying incidents in germany, including one involving phone calls by german chancellor angela merkel.

disru distrust is so deep the german government asked the american top spy to leave the country. earning season continues on wall street. we'll turn to mary thompson live at cnbc world headquarters. good morning. >> reporter: good morning. looking ahead to the open on wall street, the futures markets are pointing to a higher open following a mixed section tuesday. investors were weighing upbeat earnings from jpmorgan and goal mand sacks with comments from the federal reserve that said valuations on tech and high flying stocks may be stretched yesterday the dow rose five points. the nasdaq fell 24. later this morning, we'll get information or data on the produced price index, manufacturing and housing. this morning bank of america reported better than expected earnings, once you take out items for legal charges. lastly, janet yellen will be testifying again about the economy on capitol hill. so that's what traders are

watching. tesla's new affordable car, not out yet, but we know it has a new name. tesla ceo revealed to auto express the new car will be called the model 3. there were rumors the car will be called model e, but musk told auto express he had to rethink that because the company has a model s and a model x. i think you can see the problem there. the model 3 slated to go on sale 2017 for $35,000, musk says the lower price will be made possible by cheaper battery technology. the company plans to open a factory to mass produce batteries. maybe in california. but even with that, a model s, e, x, teslas are pretty sexy. musk says the company will build the first space port in texas. location has to clear environmental assessment.

inclined. today temperatures aren't going to climb that much. as we see that beautiful onshore flow return to the bay area. for us, that means we'll be done with the monsoonal moisture, have one batch of rain pushing into sonoma county. then we'll be done with. this afternoon, lunchtime, mostly sunny sky. count on a lovely day ahead. the coast is mainly clear of low clouds. full sunshine sunshine for inland valley spot by 10:00 a.m. temperatures will drop even more so today. fog and clouds return late. tomorrow morning we are expecting widespread low cloud cover at this time. for this afternoon, beautiful day, losing clouds inland by 10:00 a.m. at the coast by around lunchtime. 70 degrees today. oakland, comfortable there, 80 for the south bay. peninsula 78. 66 with a cool breeze returning to san francisco. we'll talk more about that weekend in just a moment. i do want to tell you, though, temperatures are going to be comfortable. we will have this wind, the wind

is going to play a big factor this weekend at the coast especially. great for water sports, not so great in you wanted to hit the beach. some beaches will be pretty nice, though. i've got all of the choice spots ready to show you. first, let's check your drive, mike inouye. >> we've chosen the bay bridge toll plaza where you have more traffic, not a lot of concerns. typical pattern, easy flow here. cash lanes starting just a bit of a way. traffic in towards san francisco. another shot from emeryville, traffic moving smoothly, westbound, commute through treasure island, san francisco, clear view. low clouds hovering around but not a problem. not as much as it was yesterday. look at your maps and the approach says going into the city no problem. here in the rest of the bay, sought of the bay bridge, you're at speed as well. pick out a couple of things going on. southbound 680, a crash involving a big rig, still in the chp report but chp's not on scene.

sounds look a big rig on the shoulder as best i can tell and the traffic flow. that is your commute direction in sunol out of pleasanton. smooth drive for the tri-valley. watching roads and rails, no significant delays reported by any major systems. great drive. great ride i should say for folks taking mass transit. confusion this morning about a car crash involving oakland mayor jean quan. backing off an earlier claim that quan was not on a cell phone. use of the hand-held communication device by either driver was ruled out in the crash. police are saying that's an inaccurate statement. police say they didn't rule either way. quan denied being on the phone. the other driver says the mayor was on her cell phone, and the mayor ran a red light. the bay area's own jeremy lin getting a special eninvitatn

"today in the bay's" bob redell live at the courthouse. alix tichelman will be there in a couple of hours, bob. >> reporter: good morning to you, scott. in a few hours, she is expected to enter a plea to the charge that she allegedly killed a silicon valley exec. right now she has been charged with manslaughter.

mess in san jose. take a look at these pictures. a driver in a jaguar slammed into a fire hydrant. it took crews 30 minutes to turn off the water. no word on what caused the jaguar to hit the hydrant. san jose police trying to track down a person who stabbeded a man on a popular trail, the guadeloupe river trail. near the children's discovery museum. security officers at a nearby business called police after finding that victim, police say that man was severely hurt. in mountain view, police looking for a man who groped a woman near pioneer park. this happened around 10:45 sunday night. the woman was walking home, a man grabbed her. there have been selveral report of women groped on the peninsula. police don't think it's the same attacker because descriptions are different. police in fremont looking for whoever broke into a tech business stealing tens of

thousands worth of computer equipment the iturner networks on fremont. the thieves got inside by cutting a hole in the metal rollup door, getting away with 100,000 worth of computer components. the company's cat, who lived inside the building, is missing. some peninsula seniors who may be losing their gym say they're not going down without a fight. 35-year-old ymca facility on page mill road will close later this year but at a community meeting today, ymca members will have a chance to speak their mind. tonight's meeting at unitarian universalist church on charleston road in palo alto, west of middle field road. that meeting starts at 5:00. it's expected to be lively because many of the members say that they are going down swinging then have a lot of questions how the board could deem there's a financial move. they're going to demand answers tonight. they cannot persuade the board to change their mind, the facility will close for good in october. in palo alto, kris sanchez, "today in the bay." update to breaking news right now. crews at richmond's chevron refinery working to completely shut down a broken processing line. new video, fire crews at scenes what appears to be white smoke is normal steam from the plant. firefighters tell us, when they arrived on scene after 2:00 this morning, the line was leaking oil. they say vapors from that oil somehow caught fire. but flames were quickly knocked down. nobody was hurt. the bay area's fighting back against the west nile virus.

vector control crews will fog for mosquitos along the martinez waterfront. the work will begin tonight at 8:30 weather permitting. this is the third time the county's fogged for mosquitos. one person in contra costa county has been infected with the virus. 5:37. this morning a judge will hear final arguments in the battle over public access to martins beach. silicon valley billionaire bought the property along the popular beach in 2008. he locked the gate on the private road to keep beachgoers away. the surf rider foundation says he needed a permit from the county or the coastal commission to block the road but says he never got one. a ruling could take several weeks. >> he claims he has the treaty of hildago to back him up. christina loren this morning. >> good morning. we've got plenty of beaches. you know what? this weekend is going to be

>> stephanie chuang live in san francisco. filming shut down an area near fisherman's wharf. >> reporter: that's right. good morning. not the main street here, jefferson, right here, but embarcadero is closed. you see the road closure signs. police officers making sure people don't turn in. so it should not impact traffic. i spoke offcamera with a crew. josh the photographer will show you that arch over there, they will be shooting a scene in the film that involves that arch, special effects a cruise ship behind that and apparently, this movie, about an earthquake, a tsunami will take the cruise ship and it will wash into the golden gate bridgen that's one scene they're shooting in the city. trailers did start arriving in the last couple of hours. these are typically for makeup, wardrobe, production, rest rooms and house cast and crew members. most filming is done in australia, but filming in the city by the bay for a few days.
