robbery, chase and shootout that claimed the life of a bank customer and three of the two robbers that took her hostage. it was a terrifying scene that unfolding at a bank of america branch in stockton in the middle of the afternoon. >> now "today in the bay's" kris sanchez joins us. we heard from one of the victim's cousins overnight, actually blaming the police for her death. >> reporter: well the police say it appears that that woman who was taken hostage right in front of her daughter as she watched was later used as a human shield. her cousin says that the police should have ended that long before that point. it was a chaotic scene right from the beginning. started when three men armed with ak-47s and ammunition shortstopped to their bodies went into the bank and tied up the security guard. fortunately, he was able to call 911 just before. within minutes, suspects with officers already on the scene fled the bank with hostages, two bank employees, and as we mentioned, that bank customer. they led police on a chase on freeways and surface streets out of stockton through nearby lodi

and you can see that stolen vehicle this they were used riddled with bullets. the stockton police chief says they fired at officers the entire way at one point, attempting to ambush police. here's some of the audio of the dispatch call we're hearing for the first time this morning. >> multiple shots fired. >> reporter: now when the suspect finally stopped, the deadly assault did not. the two employees were either thrown out of the vehicle or managed to jump, but the third hostage was used as a human shield. she's seen here in a photo provided to us by her sister-in-law. her cousin says it never should have happened this way. >> i believe that in the end the police officers was the ones that did it. i can't say that for sure. but when it comes down to it, they should have stopped it from

the beginning. >> reporter: the situation finally ended when police shot out the tires of the suspect's vehicle. this is the arrest of one of the suspects. the two other robbers who were with him were shot to death. a 41-year-old mystery holtsing was a mother two of, her 12-year-old daughter was in the car, waiting for her mom as her mom ran into the bank. she saw her mom getting taken hostage, had a 19-year-old son. >> tragic. it'ses so sad. thank you for the update. >> awful. we are following the developments also for you this morning in the middle east at 5:03, israeli officials say at least three mortars were fired from gaza just a couple of hours into a five-hour humanitarian cease-fire. sop far, no reports of injuries or damage. now earlier, israel's military said it would respond firmly and decisively if hamas militants launched any attacks while the fighting was supposed to be on

hold. it was started at midnight our time, was noent give the u.n. time to deliver food, water, and necessary supplies to palestinians in gaza. it was set to end just moments ago. we of course will be keeping an eye on the developing situation, bring you updates throughout the morning. before the cease-fire news, israeli shell hit a beach in gaza killing four young boys. our nbc cameras were there when it all happened. the shell hit in the middle of the day without warning. the four boys were rushed to the hospital, but it was too late. word spread quickly and outside the hospital, large crowds gathered with grief. a little boy who survived the shelling spoke to our nbc reporter at the hospital. he says he was playing with his cousins when the shelling started. he said he managed to crawl up to the beach nearby and find safety at a hotel. israel says the intended target

of the attack were hamas militants at the port. well new morning, man is being treated for a serious hand injury after an illegal firework exploded right in his hand. gilroy police say the illegal mortar fire work burned parts of the man's body including his face. happened last night on a home in camel street. 24-year-old flown to a bay area hospital, he's expected to survive. gilroy allows safe and sane fireworks and that wasn't one of thechl, but only july 1st through the 4th. 5:05, transportation officials monitoring the bay bridge after the first confirmed suicide. it happened yesterday on the westbound side of the new bring. that death and attempted suicide in january raising questions about suicide prevention now on the span. metropolitan transportation commission said it was discussed during the design phase of the span, but prevention elements were not added. today a santa rosa mother can find out if she'll face assault charges. she's accused of choking a

student cho who allegedly bullied her daughter. stephanie chuang joins us live, the mom says she never layed a hand on the boy. >> reporter: that's right, kboorng to you, scott. she says she did confront the boy, but she never touched him. now today here at the courthouse, the district attorney's office amay nouns finally whether it has decided to file criminal charges against her. police had arrested delia garcia blatcher on may 16th. she's accused of choking a 12-year-old boy telling him to stop bullying her daughter. she says she only talked to him. now investigators with the sheriff's department say during the noon lunch hour, garcia-blatcher grabbed the boy by the throat. the da's office asked the court for more time twice in decide wlg to file charges against her. the second a month ago when she was last in court. the mother of four says she is being unfairly targeted. >> pretty sad that we have to

for the stadium. on monday, they did get the ceo, so that today they can cut ribbon. i want to go over numbers. i can tell you how much steel and concrete is in here, be it doesn't have relevance to you. they have ten club areas, this is the united club on the west end. you can see how bright and shiny it is. to the left, red seats here. we're going to get a better idea later on in the morning as the sun comes up. 68,500 seats, and if you look up at the east end of the stadium. you can see half way up, some of the luxury suites. they have 176 of those. the majority are above us, you can't see them from this point of view, one thing they thugt about what they designed the stadium is the fact that everyone has a smart phone nowadays. this is the only concourse that lets you do a complete 360 around the stadium. throughout the concourse, they have power outlets. they have 196 power out letds plus the one on the drink rail.

they're thinking about the 21st century consumer. 600 points of sale, more than that for food and drink, and of course very important for people at a football game. they've got more than 1600 toilets and urinals. and to watch the game, if you kaernt see the field or don't want to, they have these gianormous video screens over each end zone, there are 16 video boards, 200 feet wide, and probably wondering what's the color count on that, bob? it's 281 trillion colors that it can produce and for me, anything less than 260 trillion is unacceptable. i say these are a board certified in my opinion. okay, so here's the plan of events for the start of the use of this stadium. august 2nd's going to be the first game. it'll be mls football game. we're talking about the earthquakes taking on the seattle sounders. that's going to be august 2nd. the first preseason game for the 49ers will be august 17th versus

the broncos, first regular game will be september 14th against the bears, and you have to think in 2016, a couple years from now, they're going to be hosting super bowl 50, 5-0 here in the south bay and little old santa clara that's not so little anymore especially considering this beautiful creation that is all the sudden plopped right now next to great america and can you believe after all these years, definitely four years for construction and getting the approval from the voters, here it is, the ribbon cutting taking place at 11:30 this morning just on the south, west end of the stadium. of course they'll have team owners york there, nfl dmigser, mayor of santa clara, and the head of levi. four big players along with dignitaries. no surprise, media will be dl there. 1.2 stadium finally here, don't have to wear a hard hat to come here and it has the new stadium smell of course. >> hey next time we check in, you can show us your own special

here, overlooking the south bay and just a beautiful shot. we have the overcast skies in the forecast by about 9:00 a.m. this morning. low clouds rolling on shore in deep marine layer. it'll burn off by lunchtime. 79 degrees for the south bay. 74 for the pence last today. 65 degrees in san francisco. 80 in the north bay, we're looking good on the east shore. here's mike inouye with the drive. southbound 101, curves at tera linda. you can see all the lights across the span, christina just told you, low clouds will begin rolling in later on this morning. we'll watch for the effects of fog. so far none here. between the two points, richmond san rafael bridge. heading over to richmond, slowing after you get off the brej and heading towards cutting boulevard. there's an oil spill overnight and work continues on the right shoulder. i've seen over the last 45 minutes slowing there. rest of the bay moves smoothly.

you're watching "today in the bay." what do you think of this? this morning a new york congressman is under investigation for using a drone to film his wedding. despite an faa ban. here is the actual wedding video from that drone. sean patrick maloney has admitted to hiring a photographer for his wedding e using a mounted camera on a small drone. drones for commercial use are banned by the faa. to add insult to the injury, he sits on the house committee that oversees the faa.

well just in, the european union has invited representatives from google, yahoo, and microsoft to a meeting next week to talk about the right to be forgotten rule. microsoft will attend google and yahoo did not say if representatives would be there in may you'll remember european ruled if a person petitions the companies, search engines would have to remove it from the internet or at least the links to it. free speech advocates call that censorship. meanwhile visa announcing new services today. mary thompson live with a look at that and the rest of the day's news, good morning, mary. >> reporter: good morning to you, scott. this news just crossing the wire, microsoft plans to cut 18,000 jobs over the next year. this outlined in a memo. those are larger than many people expected under restructuring under the company's new ceo. looking at the futures market, they are pointing to a lower open after yesterday's strong session with the dow notch its

15th record close of the year. dow rising 77 points to close at 17,138 and the nasdaq closing at 4,425. investors were scheering positive -- cheering positive news from the businesses. today we'll get data on jobless claims and housing starts and earlier this morning, morgan stanley reported better than expected results. as scott mentioned earlier, visa is launching a new service to make it easier for shoppers to shop online. they can sign up with debit or credit card and only enter their information once. you can then pay for things with just the user name and password. visa is teaming up with hundreds of retailers, including niemann marcus and staples on this new service, back to you. >> mary thompson, thank you. i always, if there's a paypal option, you use it. love it. >> there you go.

clouds. about a third of what we had yesterday. it'll roll in as on shore flow increases. friday, looking fantastic for your outdoor plans. here's where we're headed for today and basically, the same for tomorrow. 79 degrees on the south bay today. 74 degrees along the peninsula. you'll hit about 65 degrees in san francisco with a comfortable ocean breeze. you want to hit wine country, beautiful conditions up there, 80 degrees in the north bay, comfortable conditions today on the east shore, oakland, about 68 degrees for you. and hey, tri-valley, what a treat coming your way, 80 degrees is the forecasted high. let me give you a preview of the weekend. temperatures stay steady and we hit that sweet stride. temperatures will be really comfortable and nice and level all the way across the board. through monday. then about tuesday into wednesday of next week, we will start to warm up. you'll see that here on the seven day forecast scrolling at the bottom of your screen. we'll talk more about your weekend and what's happening across the bay area in my next report, right now here's mike

good morning we're learning more about the shootout that ended with three people dead in stockton. three men reportedly armed with ak-47s stormed a bank of the west in stockton yesterday. suspect took off with three hostages. officers chased them through several cities and say the suspect was shooting at them the entire time. the two hostages were either thrown or jumped out of the suspect's car. they're expected to be okay, but in the end, a hostage and two of the suspects were dead. we're told the suspects may have used the hostage as a shield. police moved in to arrest the third and only living suspect. coming up at 5:40, live report from stockton where investigators are still collecting evidence this morning at the shootout scene. 53-year-old man is in custody accused of breaching security at s fo and posing -- sfo and posing a a security agent. he got past the check point in the international terminal on tuesday, pretended then to be a security screener. investigators say he was drunk

when he directed women into a private screening area and patted them down. so far, he's only been charged with a public drunkenness, but he could face more serious charges including false imprisonment. 5:31, attorneys for survivor of the deadly big rig crash on highway 17 will file a lawsuit today against the trucking company and its driver. the client is still in critical condition. according to court filings, the driver was speeding last thursday when he crashed into ten cars, killing a santa cruz man. attorneys also say the truck was hauling too much weight and the trucking company failed to properly train the driver. the family of the freshman who killed himself inside a university dorm room has filed an $11 million lawsuit against the university. the family of brendan tiggs says campus police should have done more when they confronted him one morning in february. he was drunk and upset, upset enough that officers advised him to seek mental health treatment, but then sent him back to his

room. tiggs was dead the next morning. the lawyer tells the mercury news nobody checked on him that morning. the university has not commented. this is the second negligence lawsuit filed against the school this year. the first filed by a student who was reportedly the victim of a hate crime on campus. four students have been charged with the crime, they pleaded not guilty. it is 5:33, this morning prosecutors could file charges against a santa rosa mother accused of attacking a student. that student allegedly was bullying her daughter. "today in the bay's" stephanie chuang joins us live in santa rosa this morning. stephanie, the mom denies laying her hands on that boy. >> reporter: that's right, good morning to you, laura. she admits there was a confrontation, just not a physical one. and we will see if prosecutors have decided whether to move forward in filing criminal charges against her. we'll find out this morning here at the courthouse. now county sheriff's deputies arrested delia garcia bratcher

on the campus of her daughter's elementary school. investigators say during the noon lunch hour, she went on campus, approached the boy, and grabbed the 12-year-old by the throat, demanding that he stop bullying her daughter. her and her attorney say that's not true. they've had it with the delays and they want her name cleared. >> report at this point shows my client is innocent. i'm annoyed by the delay. >> yeah, i'm a good mom, and my kids lost out on the last fun year of their school, and a couple other things. so it's pretty sad that we have to suffer, but hopefully all this, this is done and over with. >> reporter: investigators say the 12-year-old boy had red marks on his necks consistent with being grabbed by an adult. marks that were photographed by school staff. the attorney says at least one witness saw the boy choking himself and garcia bratcher has been free on $30,000 bail since her arrest back in may.

the da's office asked the judge twice already for more time in investigating this to see if it will press charges or file charges i should say and this will be the third time the hearing starts here, 8:30 this morning. live in santa rosa, stephanie chuang, "today in the bay." >> thank you, stephanie. santa clara police hope surveillance video will help them find the teen accused of robbing an 11-year-old at knife point. look at this the, maybe you can help. officers looking for the teen in the long sleeved black shirt, right there. they say he robbed the 11-year-old, took his bike, now this is video of the alleged suspect and his friends inside a 7-eleven near washington elementary school last week. police say the robbery happened shortly after the teen left the store. 5:35, there already new mosquito fogging in the south bay tonight. in just one day, vector control found 16 birds infected with west nile. the county says it has seen three time more cases this year than last. tonight crews will fog neither

video screen at the end zone. they have one at each end, 68,500 seats. i think just if you walk over there, for the fan, one thing you're going to care about is they have double the number of restrooms here than at the stick. they have over 1600 fixtures. and i think this is something i thought was really clever, think about we're in this day and age of the plastic devices in our phone. you're out here, tweeting your friends, posting on facebook, and of course your battery dies. they have made a point of putting outlets on columns on the main concourse. they have 200 of these on the main concourse along with some of the drink rail. they're thinking about the people nowadays with the smart phones. and the food selections, they have around 600 points of sales referring to the cash registers. of course you have your regular seafood which isn't a surprise considering we're in the bay area. you've got your hamburgers and hot dogs, but you've also got,

good morning. >> reporter: good morning, as you can see, a heavy police presence remains here on thornton avenue and stanfield. this street remains closed at this time as the investigation continues. this is where the suspects car ended up and the shootout took place in this densely populated residential neighborhood. this morning, the two suspects have died after the bank robbery and gun battle also led to the death of a hostage who was a bank customer. now this all started when three people robbed the bank of the west branch and took three women hostage. a bank customer and two bank employees. security guard at this the bank was able to call 911 before he was tied up, and then the high speed chase. wently lodi, on to freeways and surface streets as well. the chief of police said officers were fired on and the entire way. 14 patrol cars were hit with gunfire, at one point, attempt to ambush the officers, but the suspects responded, police fired, and the vehicle took off

rest of the south bay will. very nice right there. slowing all the sudden shows up right around the dublin interchange. nothing unusual about most of the pattern. hard for west 84 as well as you're approaching the area. then smoothing out, but you have to congestion over there as well. tracking the trend, so far it should sort itself out i think over the next few. smoother drive towards the san mateo bridge on the east bay side. south of that there, warning for us, seaport boulevard, we have a gravel still right here heading to the port of redwood city. the big note is that everyone has to take veteran's boulevard over to maple to get around the closure. even though you may not work on that side of the freeway, if you're heading towards 84 and redwood city, be careful. veterans boulevard and the off ramp for highway 84 may be extra crowded for the next couple of hours. i'm told through the area. meanwhile the rest of the bay moving predictably, toll plaza as the lights were turned on, there's your back up, all right,

back you. >> there it is. thanks so much, mike. 5:49, a local answer to a national crisis. south bay lawmakers want thousands of immigrant children to come to the bay area. the south bay congressional delegation sent a letter to federal authorities saying the children are welcome in santa clara county. yesterday, san jose church packed up boxes with donations for groups in southern california, helping undocumented families. protesters in towns like murrieta greeted them at immigration centers. since october, thousands of kids and their mothers have traveled from central america to the u.s. illegally. darned if you do, darned if you don't, the states asked people to cut back water use, going so far to approving $500 fines for the water wasters. one agency needs to make up the difference because of the conservation. they're not making as much money. they may need a rate hike. the water district will hold a hearing in fremont, we'll talk about a rate increase to make up
