bay". from nbc bay area, this is "today in the bay." a very good morning to you, and thanks so much for joining us, i'm laura garcia-cannon. >> and i'm scott mcgrew. developing in the middle east, the israeli military says gaza fired a rocket at israel, hamas of course, at israel just as a five hour humanitarian cease-fire came to an end. this happened within the last hour or so. so far no reports of injuries, this comes after israeli officials say gaza launched, and again hamas, launched at least three mortar shells while the cross border fighting was supposed to be on hold. hamas is in gaza, the cease-fire which started at midnight our time was meant top give the u.n. time to deliver food, water, and necessary supplies to palestinians. we will be keeping an eye on the developing situation, bring you updates throughout the morning. new details this morning in

the bank robbery chase, and shootout. claimed the life of an innocent bank customer and two of three robbers who took her hostage. the scene looked like a war zone or movie set. inside of a bank of the west brampbl in stockton. -- branch in stockton. the chief of police is now answering some tough questions from the family of the dead hostage, and the community. "today in the bay's" kris sanchez joins us live in the newsroom this morning, kris, a cousin of the vimt is understandably outraged. >> reporter: yeah, he says that her 12-year-old daughter was waiting for her mom in the car as she watched those robbers take her mom hostage and she was texting her dad for help. the stockton police chief says it appears the three bank robbers later used that mother as a human shield. this is new video of one of the crime scenes this morning where a heavy police presence remains. all started yesterday afternoon when three men armed with a ak-47s and ammunition strapped to their bodies went into the bank of west branch and tied up the security guard. fortunately the guard saw what was happening, able to call 911

just before. within minutes, the suspects with officers already on the scene fled the bank with hostages, two bank employees, and that bank customer. they led police on a chase on a freeway and surface streets out of stockton through nearby lodi, their stolen vehicle riddled with bullets. the stockton police chief says the suspects fired at officers the entire way. at one point, attempting to ambush police. here's some of the audio of the dispatch call we're hearing for the first time this morning. >> vehicle coming to a stop. >> shots fired from the vehicle. >> multiple shots fired. >> shots fired. >> now that calm belies the scene that when the suspects stopped, the deadly assault did not. the two employees taken hostage were either pushed out of the suv or managed to jump, but this third hostage, who you're seeing

here, misty holts was used a a human shield it appears according to the stockton police chief. now this photo was provided us to by her sister-in-law. her cousin says it never should have happened this way. >> i believe that in the end, the police officers were the ones that did it. i can't say that for sure, but when it comes down to it, they should have stopped it from the beginning. >> reporter: the situation finally ended when police shot out the tires of the suspect's vehicle. this is the arrest of the one suspect who lived, the two other robbers were shot to death. the victim, 41-year-old misty holts was taken hostage again used allegedly as a huld shield. so the stockton chief police thinks. the other two hostages will survive the incident. although will likely be traumatized. condolence notes are already appear pg. in the newsroom, kris sanchez, "today in the bay." >> all right kris, thank you, such a sad story. this morning a santa rosa mom meanwhile could flern she'll

face assault charges. she's accused of choking her daughter's bully at school. stephanie chuang joins us live outside the superior court in santa rosa, stephanie, the mom admits it was a confrontation, she says though she never layed a hand on the boy. >> reporter: that's right, and that's where the story dwerges, good morning, scott. prosecutors have been going through the details of this investigation for a couple months already and have already asked the judge here twice for more time inned didding and announcing -- deciding and announcing whether they'll file criminal charges against delia garcia bratcher. now county sheriff's deputies arrested her back on may 16th, investigators say during the lunch hour at school, without checking into the front office, she went on to the campus of her daughter's elementary school and approached the boy after he was pointed out to be the alleged bully, grabbed him by the throat telling him top stop bullying her daughter. now her attorney says not only should prosecutors drop this consideration or filing criminal

charges, but really that people should consider the mother of four a hero. >> my client is like here all over the world for standing up for daughter. >> you make her sound of the mother of the year. >> she is the mother of the year. she did nothing wrong. her daughter was being bullied and she confronted the bully, what is wrong with that? >> reporter: but investigators they confrontation got physical. the 12-year-old boy had red marks on his neck consistent with being grabbed by an adult. according to the sheriff's departnt. the marks were photographed by school staff members that day. now her attorney says at least one witness say the boy choking himself. garcia bratcher has been free on $30,000 bail since her arrest back in may. she was back in court for the third time to see if she will have charges, criminal charges filed against her, and that hearing is 8:30 this morning. live in santa rosa, stephanie chuang, "today in the bay." >> thank you, steph. 6:06, follow up now to

breaking news we brought you yesterday. chevron says a leaky hose carrying hydrocarbon started a small fire at the company's refinery in richmond. investigators have not figured out if the rose ruptured or whether the leak was caused by a manufacturing error. crews put out the fire before it spread, and no one was hurt. cal osha is investigating. today the south bay will respond to the increasing threat of the west nile virus in just one day. santa clara vector com found 16 -- control found 16 birds with west nile. crews will fog again tonight, this time near the cupertino sunnyville border. work begins at 11:00 tonight, should last a few hours. this is not dangerous to people. it's the 11th fogging this year though in santa clara county. the most i've seen in quite some time. 6:07 right now, time to check the forecast as we give you a live look outside. look at the cloud cover out there, but that's going to help make some cooler temperatures today, right christina? >> yeah, it will.

speaking of mosquitos, i can't remember the last time i had a bite. sop maybe that fogging is successful. you may have a different story to tell though, especially parents who go out there at little league gapes, soccer games, there's a lot of that happening. afterall, kids are still off for the summer time right now, and today, tomorrow, all the way into that weekend, temperatures are going to be perfect for your outdoor plans and not too hot, a beautiful bay area weekend coming your way. right now we're in the mid-60s, 64 degrees in the san francisco area. 62 in mountain view and 61 degrees in san jose. what a lovely sunrise we're getting here. i want to show you some of the other various sites across the bay area, this is sunol, lovely sunrise here as well. beautiful temperatures coming your way. we had a hot start to the week, temperatures in the triple digits, today just 80 degrees out here in the tri-valley. that is a sweet stride. as we get into san francisco, you'll notice here overcast sky, this is looking downtown, and you can see that full marine

layer, drizzle because it is deep in some spots. overcast start, right at the coast although it's clouds pushing over your inland valleys right now clearing before we get into lunchtime though. cool breeze will pick up, and we have gorgeous conditions this evening. sun sets at 8:30. let's talk temperatures, 75 for the north bay, 72, roop temperature in oakland today. 79 in the south bay. the peninsula, 74 degrees, and even out in the tri-valley, not too hot. 80 degrees, straight up for you today. little preview of the weekend, we to want get you motivated to get outdoors, afterall it's going to be gorgeous. even the local beaches, saturday, sunday, mid-70s. ocean beach getting some gorgeous conditions, i'm sure, jam packed throughout. mid-60s. i want to show you a beach coming up that is completely empty right now. stick around, that's in my nerks report. light now here's mike inouye. san jose, it's not completely empty. we are looking at a very easy drive northbound, now you see the trees over there, you know what landmark at the top of the

screen, upper right, gives you an eye of where we're looking. it is north of the typical traffic shot. the map will show you what i'm talking about. slowing just north of the shot, crash over at mckey itself has moved quickly to the shoulder. i was worried about that. looks like you're all right through san jose, so far right now, northbound 101 approaching mofet public you see that by 85, the airfield on the map there, there is a crash moving to the shoulder. injuries are reported as well. i'm going to track that and let you know as crews arrive and show you on the speed sensors as well. watch 580 slowing towards the dublin interchange. things come down after an early burst of traffic 20 minutes ago and much calmer drive now. slower than the typical for a thursday over at the dublin interchange. smooth drive anywhere north of the san mateo bridge towards the city or oakland. basically the bay bridge approach moves very nicely. slower drive towards the east shore freeway and back-up of course at the toll plaza. this is not unexpected though. the golden gate bridge, this

here are today's top stories. the israeli military says hamas fired a rocket at israel just as a five-hour humanitarian cease-fire came to an end. this happened within the past hour or so. so far no reports of injuries. the cease-fire which started at mid night our time was meant to give the u.n. time to deliver food, water, and necessary supplies to palestinians in gaza. stockton police say it appears three bank robbers used a hostage as a human shield during a shootout with officers. two suspects were also killed in that shootout. the only living suspect was arrested. microsoft will layoff up to 18,000 workers over the next year. that's 14% of the work force. most of those jobs are expected to come from nokioa. this is by far the largest rounds of cuts in microsoft history. live look at o.co coliseum.

here's the latest, last night the oakland city council approved a modified version to keep the a's at the coliseum. the council said it make minor tweaks to the deal already approved by the coliseum authority earlier this month. the a's, they're not happy with the changes. if the organization agrees to the modified deal, it would then go to the alameda county board of supervisors for final approval. with one snip, the 49ers new levi stadium will be on its way to opening day. bob redell live inside the stadium already in santa clara this morning. its been a long time coming. >> reporter: think about it laura and scott, several years ago there were rumblings that the 49ers wanted to move out of the stick and a lot of people were talking about hunters point, then you started hearing about the city of santa clara here in the south bay, there was a general consensus of moving out of san francisco, that'd be

unthinkable, not going to happen, but of course, the team and his father they started talking to the city, and the next thing you know, they identified this big chunk of land here next to the training facility, only a couple of hurtles, namely parking which is of course trying to deal with the great america next door. and next thing you know, voters here, four years ago they passed measure j which helped fund what was supposed to be a $937 million facility. right now the final price tag $1.2 billion. here we are four years after construction, they received their certificate of occupancy, the stadium did on monday, today, thursday, they are going to finally cut the ribbon on this state of the art facility. you're looking at it here, a 68,500 seats, more than 170 luxury seats. giant, video jumbotron. they say they can produce 281 trillion colors, i didn't know the human eye was capable of

dete detecting. and all they need right now on the field, the turves been installed, it has taken. they need the striping for the first event which is not going to be the 49ers, it's actually going to be the san jose earthquakes soccer team, august 2nd, few weekends from now. that'll be the first event taking on the seattle sounders. then you'll have the preseason first preseason game a couple weeks later, and then mid-september, the first regular season game the 49ers taking on the bears. and of course this beautiful facility will be hosting super bowl 50 which would be in the year 2015. before all that can happen, they do need to cut ribbon. and they'll cut ribbon later this morning, 11:30 this morning, nfl commissioner roger goodell, the mayor of santa clara and the head of levi with a bumpbl of other dignitaries. many people didn't think it would happen. know that we know it was going to happen, its been a long time coming.

we'll start in the 60s as you can see for most cities, that's where we are. upper 50s for the san mart, you're at 62, good morning livermore and let's talk about about your local beaches which are just beautiful this morning. i promised you one beach without any people. i'm going to show you that in just a moment. i want to show you a difference on the coastline in the bay area. pacifica showing you all that cloud cover creeping in over the coastal mountains. meanwhile, down in santa cruz, completely quiet and you know what i love about the bay area and the central coast in particular? we have such beautiful beaches here, and unlike southern california, they don't get that crowded. in the morning hours, morning risers, you get some of the best solitary confinement out there at your local beaches in monterrey showing you the same thing, oh, look at that, we have someone out there this morning. overall though, that's the case even on the weekends, i know because i go down there a lot. that might be one of the places you might consider going this weekend. want degrees for today in the

south bay. 74 on the peninsula, and # 5 degrees today in san francisco with a cool ocean breeze building as we head through the afternoon. wine country, spectacular today, # 0 degrees for you on the east shore. temperatures at about 68 degrees, comfortable conditions will persist yet again in the tri-valley at 80 degrees. take a look at your weekend for the peninsula, temperatures in the upper 70s to low 80s all the way friday through sunday. sap for the north bay, upper -- same for the north bay, upper 70s for tomorrow. low 80s during the weekend on the east shore, looking good, 60s and low 70s all weekend long. san francisco and san jose, not a big temperature spread. staying comfortable, a lot of people come into town. we'll talk about events, mike inouye driving around this time of year. this is when a lot of people like to come to the bay area. little extra traffic because of that. >> it's the midday flow of traffic. mornings are more condensed and right now we see that in the south bay. north 101 at mckey. things clear up and actually a

clear drive. about 7:30 really hitting hard to about 8:30 on a thursday. we'll track that for you. meanwhile you have the build, there's 87 with traffic flow northbound. over here, mountain view and sunnyville, watch that, between matilda, two crashes, we have matilda where there's a slow lane currently blocked by a crash. at the boulevard, we have a crash over on the right shoulder. both are distractions right as the commute starts to build. and the amphitheater, we're looking toward seaport boulevard which is still closed because of a gravel spill right there just off the freeway. and now we're told the reroute is veteran's boulevard to map tom bloom kwis around that, that's going to send more over to the west side of the freeway. the off-ramp could get congested towards the morning. we'll track that, we have a crew heading over there as well. now heading into the city, smooth flow of traffic for 101 as well as 880 for oakland. we'll give you a live look out there and show you that the golden gate bridge has a fog and low clouds drifting once again, losing visibility of that and

welcome back everyone, it is 6:24, the family of a stunt pilot who died after crashing during a bay area air show wants $20 million in damages. the sacramento bee reports the family is claiming emergency crews did not respond fast enough to free the 77-year-old from his burning plane. the man crashed his plane in may during an air show in fairfield. autopsy report says the pilot died in the flames while trapped in the plane. general motors ceo mary barra will be back in the hot seat on capitol hill today. she's expected to answer more questions about that delayed recall at a senate hearing. senators want to know what role if any the company's legal department played in the mishandling of the recall of millions of cars with faulty ignition switches. it is linked to more than a dozen deaths. now since barra was last in washington, new documents have

been uncovered showing gm was fully aware of the flaw. the hearing comes one day after a bill was introduced, making it a crime for corporate officers to hide dangers posed by their products. 6:26, this morning a new york congressman is under investigation for using a drone to film his wedding, despite an faa ban. here's the actual wedding video from the drone up above. sean patrick maloney admitted to hiring a photographer for his wedding using a mounted camera on a small drone. drones for commercial use are banned by the faa. the to add insult to injury, maloney sits on the house committee that oversees the faa, so in essence, shuf known what he was -- should have known what he was doing, but is that considered commercial use? >> if you paided a photographer. so yes, he was walking out with his bride doing it himself, that would be okay. >> not with his new bride, that

"today in the bay's" brian moore joins us live on capitol hill, brian, no easy solutions here. >> reporter: absolutely, that's what the president is saying, laura, but he says that this is a time for u.s. leadership.

russian president vladimir putin today shows no signs of backing away from ukraine, despite a new round of sanctions by the united states in european unions. talking to reporters in brazil, putin said the only damage the sanctions will cause will be to u.s.-russian relations. while ratcheting up the pressure, president obama sounded more hopeful than tough. >> what we are expecting is that the russian leadership will see once again that its actions in ukraine have consequences. >> reporter: those consequences though fall far short of u.s. and european threats to hobble key sectors of the russian economy. the latest actions aimed at influential companies and individuals. >> they're very small and not very meaningful, but they're better than what they've been doing for the last several months, which is nothing. >> reporter: the president also spoke out in defense of israel and the latest showdown with hamas militants in gaza. >> there's no country on earth that can be expected to live

under a daily barrage of rockets. >> reporter: but president obama promised the united states will keep pressing for peace and a diplomatic solution. two days after a cease-fire failed, another option is on the table, this sponsored by the u.n., five hours, five hour cease-fire to give people in gaza a chance top get food and seek shelter. not clear whether that'll hold, even talking about it is hopeful. >> thank you very much, brian moore with the latest from washington. local answer to a national crisis. south bay lawmakers want thousands of immigrant children to come here to the bay area. the south bay congressional delegation sent a letter to federal authorities saying the children are welcome in santa clara county. yesterday a san jose church parked up boxings with donation -- boxes of donations to help with the families. protesters like these in murrieta have greeted them quite differently. since october, thousands of

children and mothers have travelled from central america to the u.s. illegally. time to check the forecast as we give you a live look outside san jose, oh, don't look at the sun, look at the glare out there this morning, clear at least in the south bay, cloudy up by the city this morning, those microclimate forecasts. >> oh yeah, definitely making an appearance, but not a big appearance later on today. temperatures spread 10, 15 degrees at best between the coast and the extreme east bay. we head throughout the day today, we're talking about the low 80s out in the extreme east bay and the mid-60s in san francisco which is where we're tarting out. temperatures really aren't going to climb by much. as we get that steady, on shore flow, the cool ocean air pumping inland all day long. really gorgeous start to the day. this is a live look here, overlooking san jose from high atop mt. hamilton. we have a little bit of a marine layer, not much. let me show you what it looks like at the surface.

sunrise occurred just two minutes ago, seeing that bright sunshine here in the shot. and pleasanton also waking up with a fair a. low clouds. i want to show you this shot to give you an idea of how far inland the low clouds span this morning. getting into this afternoon, we have changes to tell you about. coastal drizzle to start, by lunchtime, full sunshine feeling a lot more comfortable as we drop that humidity significantly. the wind is going to pick up this afternoon. just as it has over the past couple days. that breeze, beautiful conditions for you to open up the windows and your home. sun set at 8:30 tonight. temperatures work like this today, 79 in the south bay. 74 degrees on the peninsula. 72 degrees, that's room temperature for oakland, just 80 in the tri-valley, 64 in san francisco, and 75 degrees in the north bay. looking pretty good here in emeryville. let's find out how the drive is doing with mike inouye, here he is. christina, you shows the beautiful view, the low cloud connelling through. bay bridge is moving smoothly.

metering lights are on here. here's a surprise for the south bay. flowing north 101 as you're approaching north 85. we have two crashes reported. they are consolidating, may be the same incident going on here. there is a crash blocking the slow lane. minor injuries injuries, may be another one, sound like a converging, even then, adding to the smix 237 westbound coming in there, and that's going to add to the slowdown as folks are trying to get to the 101 which is slow. definitely we have activity at moffet and ellis. there you go for the san jose. san hoesz itself moves smoothly, but the build for 101 as well as 87 within that's on, it's going to start to hit hard about 7:00, 7:30 when we really see slowing along the south bay. there we go for the summer time commute. rest of the bay, get a look around there, and then we'll focus on a couple of issues here. more issues south 880 through hayward. the build is on there, same for the tri-valley coming out of the

livermore valley. over on the peninsula, we're going to talk about the crash as you get over off of highway 101. we have a crash there as well as the golden gate bridge. again, we're watching your approaches into san francisco, live look at the golden gate bridge, stand by another one coming up, i have this thing guys. golden gate bridge, fog is affecting the drive. maybe a slick roadway from the sheen there. and now we just have this live footage, i'm sorry, photographer is there, that right there in the median is the overturned rig. gravel truck you see some of that assessing the situation, that's why seaport boulevard is closed. from 101 to the port of redwood city. that is closed. may not be a big deal if you travel to the other side, folks have to get off on that side as well. west side of 101. that'll add more congestion to get around that crash and gravel spill. that's going to last at least another hour. we're waiting for an update.

robbers who sped off on that high speed chase. we'll hear more from him in a moment. new video of the crime scenes around stockton where there is still a heavy police presence this morning. we are live at a different scene where it all started outside that bank of the west in stockton this morning, jill, a lot of questions remain this morning. >> reporter: yeah, a lot of questions is what was the motive behind this especially. we're here at the bank of the west branch where it all started yesterday afternoon, the robbers burst into this bank with ak-47 assault rainfalls. they held -- rifles. then they stole an suv that belonged to a bank employee and that chase started. a chase that went through neighborhoods with shootouts, it went through highways, in the end, two of the women were even thrown from the car or jumped from the car. they were either shot or grazed by bullets. they're expected to survive, but

the third woman, unfortunately the 41-year-old wife and mother was shot and killed. and police do believe she was used as shield. two of the three suspects were also shot and killed during this exchange. and the third suspect was apparently shot and is in police custody. police are all over stockton and north of here investigating all these scenes. the fbi is helping out as they try to get to the bottom of exactly why this happened. kris, back to you. >> thank you very much, joe. >> reporter: and we just have obtained the mug shot of the third suspect. the one who survived. very adult crimes, just 19 years old, we will hear more about when he is headed to court later today. misty holt's cousin was working in lodi when he saw the police action there. he tuned into the dispatch traffic through an app and long before he knew his cousin was one of the hostages, he just wished that police would end the

"today in the bay's" stephanie chuang joins us live outside the superior court in santa rosa. stephanie, the mom continues to say she didn't even lay a hand on that boy. >> reporter: that's right, good morning to you, laura. and beyond that, her attorney is calling her an international hero for standing up for her daughter. we'll see what prosecutors have to say if they decided to file those criminal charges against her. this would was becoming two months after sonoma county deputies arrested her. she went on to the campus of her daughter's elementary school during launch without checking into the office, approached the boy, and grabbed him by the throat demanding that he stop bullying her daughter. now garcia bratcher says she didn't touch the boy, only stepping in to talk to him. after this confrontation, she pulled her kid from that school. she and her attorney saying it's time to drop this and allow the family to move on. >> they've been provided with report at this the point that

accused of breeching security at sfo and posing as a security agent. the man reportedly got past the security check point in the international terminal on tuesday, pretended to be a security screener from there. investigators say he was drunk when he directed women into a private screening area and patted them down. so far, he's only been charged with a public drunkenness. he could face more serious charges including false imprisonment. survivor of a deadly big ring crash on highway 17 will file a lawsuit today against the trucking company and its driver. the client is still in critical condition. according to legal paperers, the driver of the track was speeding last thursday when he crashed into ten cars, killing a santa cruz man. attorneys also say the truck was hauling too much weight and the trucking company failed to properly train the driver. people living in one san carlos neighborhood talking about legal action after the city voted to eliminate daytime parking on their street.
