from nbc bay area, this is "today in the bay." well good morning everyone, 4:30 i'm scott mcgrew. >> and i'm laura garcia-cannon. we begin with breaking news. there is trouble for your morning commute. the chp is on the scene of a deadly overnight crash on highway 101 in sunnyvale. a semitruck and motorcycle collided after 2:30 this morning. the motorcyclist was killed. here's a look at the map, the area we're talking about. northbound 101 near lawrence expressway. right now, two lanes are closed. let's go to mike inouye. this is sure to be impacting the drive. >> yeah, the traffic very light right now, by when you lose half

of the freeway, you have some slowing, we'll show you on the maps. we're looking at another crash northbound 101 at bailey. i'm sorry, northbound 101, be -- bueno. you have your two left lanes blocked. now this has been going on for hours, we don't have a time when chp thinks the lanes will be open. i have put in another request for information seeing if they need daylight. if they need daylight, to get more information for the crash or investigation, this could be hours. if not, just a short period of time. look at the slower drive developing with the light volume. look at san jose, this is the volume of traffic at 680. because of the light volume of traffic, stilling with a big issue for the slow down. back at the maps, that's the only slowing. we have the freeways around the bay moving smoothly. aside from that, there's another

deadly crash in the continue, i'll talk about that coming up. christina, you have a much more pleasant outlook as far as the forecast. >> reporter: yeah -- yeah tough morning, good morning to you. temperatures really mild out there. 64 degrees in oakland, 63 in san jose, and 61 degrees in livermore, we are only going to climb by an additional 10, 15 degrees. that means another gorgeous day. we'll show you when that heat really comes on because there is a heat wave in the forecast. we'll talk about that, now back to you for the rest of the top stories. developing now in the middle east, secretary of state john kerry is working on a peace deal in cairo. israel agreed to a ceasefire, but hah has as in not. all this has rockets continue to reign down in -- rain down in gaza. >> 570 women and children have been killed in the past week.

hamas militants have fired more than 2,000 rockets in that time. >> the country has to do what a country's has to do. we have to defend ourself. >> israeli prime minister says his country warned citizens to leave and accused hamas of hiding behind them. two suspected gang necks will find out their fate today for killing a toddler in oakland. he was walking with the grocery store when being shot in 2011. last month, a jury's determined the shot came from a car being driven by willie torres and a man named lawrence denard. the men were reportedly targeted two men in rival gangs. judge could sentence both men to life in prison this morning. former oakland high school security guard accused of beating a student in a wheelchair facing new allegations. another team said the same guard hurt him too. >> he grabbed me from the

throat, slammed me to the floor and he was on top of me with his right knee to the chest. >> that student says that happened in the hallway in school in may. several security guards wanted to search his back back and when he refused, the guard in the previous attack, marsle mitchell beat him up. unlike the attack on the student in the wheelchair, the alleged incident was not caught on surveillance cameras. >> they were just covering up saying you can't see it clearly. all you see is mitchell on top of me, you don't see him choking. >> we have done a full investigation, and we le have the chance to review that material, if she's not satisfied with our response, of course she can take further action. >> the family has hired an attorney. the school district was planning to expel him after reportedly finding pot brownies in an air soft gun in his back back.

child, but has backed off since the alleged beating was reported. the student did not come forward until this wheelchair case began getting a lot of media publicity. it is 4:33 3/4, happening today, the city council plans to change a law about allowing large animals on city streets, right now it's illegal. the council will vote today on amending the ordnance allowing horses to be used in weddings. last month a couple was allowed to use a horse even though it went against the ordnance. the groom to hide in on a white mare. today, san francisco city leaders will decide if a controversial soda tax can move forward. the board of supervisors will vote on whether to place the initiative on the november ballot. the bill adds a tax on soda and other sugary drinks. could bring in $35 million a year to fund sports and nutrition programs throughout the city. in the south bay, the santa

clara valley water district will consider hiring so-called water cops to get people to turn off their taps. kris sanchez at the water district in san jose, kris, this proposal's not cheap. >> reporter: it is not cheap. it certainly comes with a price tag of its own. but just about a week after the state water board mandated fining people $500 a day for wasting water outside their homes, the water district here locally may get some teeth behind that bark. now the board of district are director -- directors tonight could hire five to ten water cops to respond calls from the public. so far water users in this district, which covers the south bacon serves 12% falling short of the governor's 20% target. the district has already encouraged neighbors to help each other out, point out broken sprinklers and such were but for true water wasters, they can call in a formal clant.

>> what they can do is refer an issue or particular property to the local water provider or city that does have the ability to issue a fine. >> reporter: but a lot of good that does says the folks on greenmore court. they called in a broken pipe that's leaking water, wasting that precious resource, only to be told that that broken pipe is not a priority. that of course, could change with the board of directors meeting here tonight. if in fact they do go forward with the $500,000 expenditure. if you find yourself in a situation where you live in an area that has a homeowners association that doesn't allow to let you go. the governor signed a new law alawing you to let your lawn brown out with the the penalty of that homeowner's association. at least you have one more option to save water. reporting live in san jose, kris sanchez, "today in the bay." >> thank you. drought of another kind. people who live in one apartment

complex in pleasanton without running water for the first day in a row. management told tenants a water main broke friday. people living there will have a tough it out for another day, it's not expected to be fixed until tonight. that means no shower fwhobs running toilets, to places to wash your hand for five days. >> there are porter potties. one for every two buildings. roughly one for every 88 people. no thank you. >> we talked to the manager of the apartment complex, he did not want to go on camera to explain what happened. he says he's providing tenants with as much water as they need. one tenant said they're getting a gallon of water per day per apartment. >> yikes with, that's tough. >> you don't realize, i'd rather have no power than no water. uk manager with no power. >> hopefully the temperature's will be cooler, at least cooperate with those folks, let's check in with christina loren.

yeah, and you can believe they are going to view the drought in a whole new perspective when all is said and done. i hate to stay, but we don't to want have to ration water, and the only way to avoid that if we don't get a significant precipitation is by conserving. and so we're always calling for you to conserve. and 5 to 10% makes a big difference. keeping it on your mind is a good place to start. 63 in san jose and 61 in san martin. as per usual, whenever we talk about the drought, the rain showers arrive, and that's what's happening this morning. repeat performance of yesterday, although i have to have tell you, this cell that developed over the san francisco area, in fact all the way from hillsborough all the way to san francisco, you're going to find slick conditions right now. this just arrived on shore, and it's packing some significant rainfall. you'll see that here, we have the red and orange embedded within that green, and that's moderate rainfall. as i show you most of the bay

area, 92 south all the way down to san jose. and we're going to see another gorgeous day as the showers will clear out just like yesterday. at around lunch teem, complete sunshine for the bay area. 78 degrees for the south bay, and that's it today. 65 in san francisco, and 76 in the north bay. i told you you have heat coming your way, we'll talk about what coming up, here's mike inouye and the morning drive. we have a tough among on the roadways that we are looking agained to the south bay where overall they are moving smoothly, light as you'd expect. deadly crash, we've told you about that, northbound 101 between great network parkway approaching lawrence expressway. there's a deadly crash blocking two right lanes though with a big rig, motorcycle, and sounds like, to other vehicles might be on scene or very close. we have a lot of emergency crews on scene. your alternate if you're south of there is central expressway. stick it out on 101. that stretch, the rest of it though is clear. it's unexpected to allow another ten minutes through the area. we're looking towards the

tri-valley and you see the freeways for 580 westbound, light, build out of the pass, that's pretty typical. but a highway four, just off of that, bailey and leland. that's around the bart station. you do have a deadly crash there at leland and bailey just south of highway 4. they that may have traffic control at that intersection. it's right by a shopping center, safeway for those landmarking there. ramp is open, we're seeing if the traffic control will allow all traffic through. no full closures, we'll continue track that. second deadly accident. single car there. rest moving smoothly, there's no backup and most of the lanes just the left approach, one lane's not open, back to you. >> luf start, thanks mike. up next, the president cashing in on the bay area again. the details of his latest fund raising trip coming up. train carrying the body os of hundreds of people is on the move. latest overnight developments

billionaire ferry disaster owner that killed dozens of people. he was found in a field of of a ro cot trees. investigators say his corruption contributed to the sinking of the ferry which was carrying hundreds of high school students. they're still trying to figure out exactly how that man died. yesterday prosecutors said 139 people were arrested over the ferry sinking, including all 15 crew members. today president obama's choice to leave the troubled department of veteran's affair goes to a committee. they are expected to robert mcdonald's nomination. he is the former chairman of proctor and gamble, he'll replace eric shinseki. well speaking of president obama, air force one will touch down at sfo tonight. >> the president will arrive just after 9:00 tonight. tomorrow he'll go on a fund raising lunch at a home of real estate tycoon george martis.

nancy pelosi is expected to attend as well. tickets range from 10,000 dlaurs to $32,000. the president will leave the bay area for los angeles tomorrow afternoon. a thief appears to be targeting tech startups in san francisco. we have video from a company called build zoom, located on mission street, south of market. police are trying to figure out if the woman seen there in the corner wandering around the building is the same person who broke into demand local last week. several times back in april as well. in those cases, several thousand dollars worth of electronics were stolen. from break-ins to breaches. news of another security breach, this time at goodwill stores nationwide. for that and the news before the bell, let's turn to cnbc world headquarters, good morning. >> reporter: scott, good morning, and that's right, goodwill says authorities are investigating a possible data breach at its stores. the nonprofit sells donated goods at a 2900 theft stores

nationwide to help fund job training and other programs. if the breach is confirmed, goodwill will be the sixth major chain to acknowledge they've been compromised, following target, michaels, and sally beauty supply. futures right now when looking at wall street are higher after stocks ended in the red on monday following geopolitical concerns but pair the loss by the close. we got data on existing home sales, busy day for earnings, coke, dupont, mcdonalds, and verizon reporting earning. nasdaq falling and losing seven. apple reporting earnings tonight. they have asked suppliers to produce up to 80 million new iphone this year. reports say the order is larger than the initial production run for the iphone 5 s and 5 c last year. apple by the way, reporting earnings this afternoon.

we'll be watched closely by wall street, scott. >> thank you. we're also watching the skies this morning, could get rain out there, christina. >> yeah, it's actually really cool, i love tubing showers in july. -- talking about showers in july. this is exceptional. i can tell you, it's not going to last all day. 64 degrees right now in san francisco, and that is where the heaviest rainfall is concentrated for the current time. it's all headed up north towards morin county, and it'll arrive in the next half hour. keep in mind, otherwise beautiful conditions coming your way. courtesy of the showers and strong onshore flee which is expected after the pressure gets out of here. this is working from south san francisco all the way up through the city to the golden gate bridge. you're going to find heavy downpours, at least in the next 15 minutes or so. as we head throughout the day, beautiful conditions coming your way. few morning showers, gradual clearing, and these are your

temperatures for today. 65 in san francisco, and 78 degrees in the south bay. so no real extremes when it comes to the swing between the coast and inland valley spots. 81 degrees on the peninsula. 78 in the north bay. uniform temperatures for today in the north bay. and on the east shore with that very mild subtropical air mass overhead. at least for the first part of the day. as we get into this evening, the breeze is going to pick up, beautiful ocean air moving on shore, and gorgeous evening, but we're only going to get to the 70s for the a couple more days, between wednesday and thursday, the 80s move in and as we get into friday, saturday, sunday, the climb continues, and we are talking about the triple digits and the hot spots by sunday. we'll talk about that coming up. back to you, scott and laura. it's 4:51, firefighter in washington state are looking forward to better weather. hoping the calmer winds and cooler temperatures will help them surround a devastating wild fire. its burned 200 square miles, and it's only 2% contained.

posted that on instagram. he says he's testing out the look before he goes to tomorrow's game. >> how do you make that happen? >> back comb it, not wash it. >> my beard goes fast, but i have no idea. >> i'm trying to picture it, and i don't know how it should. >> a peacock for nbc. it's 4:56 right now, we have some serious news when it comes to the morning commute. >> unfortunately we have to talk about a deadly crash down in the south bay. i got words on the changing conditions. here's video earlier this morning, two lanes blocked north 101 before you get to lawrence expressway. there is the motorcycle just above where the clock is on the road. that motorcycle reportedly was going at a high rate of speed, maybe over 100 miles an hour. that big rig, the motorcycle caught up to the big rig, smashed it from behind and then that motorcyclist died there at the scene. the big rig is on the shoulder, just before lawrence expressway. look at your maps, we have the slower drive developing,
