investigators in san diego are trying to determine this morning what led a small plane to crash land in a parking lot of a busy shopping center. that crash killed one woman on board and seriously injured another occupant. the frightening incident happened last night. the single engine plane there crashed near parked cars and caught on fire. officials say two witnesses were treated for minor burns. captured. a man on the fbi's ten most wanted list is in custody this morning. jose manuel garcia guevaro was extradited from mexico yesterday. he's accused of breaking into the home of this woman wanda barton where he raped and stabbed her to death. her son was home at the time but he was not harmed. as the ebola epidemic

deepens, the u.s. is on alert. this after two victims came in contact with a victim. at u.s. airports the feds are keeping an eye on international passengers. anyone showing signs of the virus will be quarantined. a plan to keep the virus from spreading. schools have been shut down and government workers will stay home for 30 days. now to breaking news in the middle east, israel is calling up 16,000 more military reservists as it vows to destroy every hamas tunnel. [ explosion ] that video shot seconds after an israeli shell pounded a market killing 17. that strike came after artillery shells tore through the walls of a u.n. school.

small country. it seems the government is very serious about the possibility of expanding the invasion of gaza. other sources are saying what they're doing is rotating. they're beginning to bring them back home and the ones who have been called up will replace those reservists. the reservists have not actually gone inside gaza. all the fighting inside gaza apart from combat engineers is being done by the regular army. that sharp exchange in which president obama called on netanyahu to end the fighting immediately to begin a cease-fire immediately, today netanyahu issued a statement saying israel will not stop fighting until the threat of tunnels has been fully removed. that really commits israel for another few days of fighting. because that's how long it will take to remove the threat of tunnels, which, of course, is what hamas has built to bring

their fighters from gaza under the border fence into israel. so netanyahu says he will continue fighting until all those tunnels have been destroyed. >> interesting to hear what they'll say about that response. thank you. today is the late legislative day until the congress goes off on its break. they did approve a resolution to revive a election year lawsuit against president obama. democrats call the lawsuit a political gimmick. >> you can't just sue because you disagree with the policy. you can't just sue because you think somebody's misinterpreted the constitution. you have to show that a particular action negatively affected you in a way that is different than everybody else. that is obviously totally absent from this. >> tracie potts is live for us on capitol hill.

good morning. they've approved this lawsuit. what's next for it? >> reporter: what that means is the group of lawyers here on capitol hill who work for congress can move forward and handle that lawsuit once speaker boehner files it. that's something they wanted that they got done. but there's a lot on the table that doesn't appear to be getting done as congress heads off on this break. the tone here on capitol hill may explain why things aren't getting done. >> why don't they say something nice once in awhile? why are they always so negative? i think they need help. i really do. >> reporter: what's not happening today, immigration. the border crisis. an emergency bill has been sitting on capitol hill for weeks whittled down by a billion dollars in the senate. house republicans want to spend much less and are at odds with themselves over the cost. plus the fund may go that way

until after the break. >> imagine how much stronger our economy would be if congress was doing its job too. >> reporter: there's a last-minute push today to reform the va hiring more doctors and nurses and allowing vets to go outside the va for care. the house did vote to sue president obama. >> this isn't about republicans and democrats. it's about defending the constitution. >> the president has gone too far. >> we take time on a suit to sue the president of the united states. but we don't have a bill to bring jobs home. >> reporter: too many executive orders, boehner says, changing what congress already approved. the lawsuit focuses on the affordable care act. and if that's not enough for congress to deal with, they've thrown something else on the plate. another vote today on the border crisis. this one would prevent deferred deportations. in other words, get people back to their home countries sooner
