exhibition team next thursday. set to take place the next day in new york. the niners will be playing and practicing close by in baltimore. smith could be suspended from the nfl after he pleaded no contest to dui charges earlier this month and was ordered to serve 11 days on a work crew. he could also face discipline for possession of illegal assault rifles. smith did not attend practice yesterday because he was in los angeles meeting with a city attorney's office. the meeting was required in lieu of facing charges for making a false bomb report at the los angeles international airport. . just a matter of hours, suspended state senator leland ye will walk into a federal court to answer to a new charge. this one, of racketeering. "today in the bay's" stephanie chuang joins us live from outside the courthouse in san francisco. this is pretty serious steph because just this one charge, nevermind the rest of them, could put him behind par bars for 20 years. >> reporter: that's right, it's

heavy. and with the move, the other defendants in this case, 27, at least of them could then want to the talk to prosecutors in exchange for a plea deal. that could have an influence here. now leland year and co-defendants are accused of violating the racketeering influence and corporation organization, better known as rico. this indictment was yielded last friday accusing ye of selling political favors. trying to get an nfl owner to win legislative influence on a vote that would limit a player's ability to file for workers compensation. the earlier complaint against ye accused him of everything from gun trafficking to accepting money. undercover fbi agents to help get rid of the campaign debt. dee johnson says while he snnt line for a plea deal. others are probably hoping for one. >> i think some of these people who are currently named as defendants may turn up later as government witnesses.

>> reporter: that does not include raymond shrimp boy chow. he was in the courthouse yesterday formally charged with a racketeering. he is a reformed gangster caught in a three year undercover fbi investigation that has murder to hire, believes his client will be cleared in all of this. as for leland ye, he is set to be here at the federal court house at 9:30 this morning. live. san francisco, stephanie chuang, "today in the bay." >> thank you, stephanie. a story developing in the middle east this morning. stern word from israeli prime minister benjamin netanyahu s saying they will destroy hamas's network tunnel with or without a cease-fire. this is new video just into our news room. it appears to show the moment an israeli strike hit a crowded shopping center in gaza. we've heard about ambulances rolling in right before the explosion. no word on injuries.

again the israelis hitting a shopping center. since midnight, believed to be one of 20 attacks the israeli military carried out on hamas military targets. the cross border war which started three weeks ago has already killed 1400 palestinians, more than 300 children, 60 israelis, most of them stole jers have -- soldiers have been killed. oakland police officer fired for throwing a tear gas canister is now back on the job. an arbitration leader ordered the department to give him back pay as well. this is all according to the oakland tribune. now october of 2011, he was caught on camera showing that grenade into a crowd of occupy protesters. happening less than a minute after another officer hit iraq war veteran scott olson in the head with a bean bag causing brain damage. that case was settled and paid him $4.5 million. he was placed on leave after the

incident, and then fired last august. he appealed the punishment to an independent arbitrator and has now prevailed. there's fear this morning nor a san jose is neighborhood after a scary home invasion robbery. "today in the bay's" derek shore joins us from the valley neighborhood. derek, seen an uptick in crime, that's supposed to be the safe part of town. >> reporter: yeah, that's right, neighbors tell me there was a rash of burglaries that took place last year. and now police are looking for at least one suspect who apparently tied up a 17-year-old and ransacked his house. now officers say that teen was home alone at the time just before 1:00 yesterday afternoon when the suspect smashed out a piece of glass in the back of the house here on anju creek court. the suspect tied him up with zip ties, demanded money, and took off. the teen told him where to find valuables, and that's what got him out of the house. the suspect was wearing a disguise during the robbery.

after he took off, the teen was eventually able to get himself untied and call 911. one neighbor we spoke to didn't know what happened, but says perhaps his dog knew what was going on. >> my dog was barking. so i don't know in if they came here first or if he was just barking at what was going on across the street. but i don't think i'll be telling her to shut up in the near future. i'll see what's going on in the neighborhood. >> reporter: police are pouring over surveillance video, plenty of neighbors in the area have cameras from the burglary spree that happened last year. and that actually includes the victim's home. meanwhile, the victim's mother tells us off camera her son is doing okay, physically, of course very smaken up. -- shaken up. latest here in san jose, i'm derek shore, "today in the bay." >> all right derek, thank you. firefighters are struggling to save giant sekoya this morning as a giant wild fire is

flairing up. a few mimes away and directly in the path of the inferno. the giant trees. a small community of florists are under evacuation orders. the fire is 34% contained. meanwhile, judge ordered a psychological evaluation for the teenage girl accused of starting a fire. the girl has been charged with at least one crime. prosecutors are not revealing what that charge for is. a judge orderrd her to observe a curfew while she lives with her parents. gift shop that raises money for aids research is closing its door in san francisco's castro district. the shop called under one roof sits at 5 had 1 castro street. it can't afford the skyrocketing rent. a sign's been put up saying closing forever, thank you for 23 years, under one roof.

we're going to peak tomorrow when it comes to this and we'll cool you off as we get into the important weekend. here's the big story for today. that warm, moist air mass that's been keeping us hot and muggy finally headed back to the four corners region which is where it typically is this time of year. unfortunately for us it's pumping in the moisture in the bay area. today the flow returns and that means the ocean air will be transported only to the inner bay. although it's going to beless humid all across the board. you'll see. temperatures will stay cool today. san francisco at 72 degrees. fogged in right now. 85 degrees on the peninsula. 91 degrees for today. it'll be warm, but not too bad. we're not talking about triple digits in the south bay. tomorrow, 94 degrees when we peak and taking temperatures down gradually all the way from saturday through monday. so new zealand where if we're going -- so this is where if we're going to hit the seasonal averages by monday. not a bad stride and feel more like the bay area. there's a lot going on across

one lane blocked. three are opened on the southbound countercommute direction and further south we have westbound 162 coming into the area. overnight there was a crash involving a tomato spill, no one was injured but tomatoes on the westbound side. they're closing lanes to keep that maintenance going up there. they have to clear the tomatoes, but the better news it's good if you're leaving the area. dublin counter shot and nice smoot drive there, back to you. san francisco restaurant receiving angry calls and e-mails because of something another restaurant with a similar name is doing. the number nine fisherman's gra stow in no way affiliated with the one in monterrey, old fisherman's grott op. banned noisy kid and refusing to give families highchairs or strollers. the san francisco fisherman's gratto says it loves kids and

you're watching "today in the bay." driverless cars could soon be on the wrong side of the road. they're hitting the road in britain inless than six months. the country plans to start a three year trial program in january in three different cities. the plan would include two types of driverless tech knowledge. one with l have the ability for the person to take control if needed. the other would be fully driverless. the test has not been made in which city. markets on a roller coaster ride. for a look at how things are going, let's turn to morgan brennan. live at cnbc world headquarters, good morning. >> reporter: good morning, scott. futures are lower, this after a choppy day of trading on wednesday. the federal reserve gives the markets a mixed message as you

mentioned on the economy. the fed says while growth is getting better and unemployment is falling. the job market still needs more improvement. the fed giving no indication interest rates will rise before next summer and today, we're getting data on unemployment and manufacturing. we're getting a slew of earnings including exxonmobile. the dow falling 31 points to 16880. amc networks is reportedly in talks to buy a 50% stake in bbc america. amc is controlled by the dolen family. they own the cable company cable vision, new york's madison square garden and the knicks and ranger. madmen and the walking dead is theirs. the move comes after they reported growth in ads last year. following strong ratings for dr. who, orton black. >> yeah, that's a good one. okay. so now here's a twist. amazon is willing to pay you for

tri-valley. not quite 100, but it'll be hot enough for you to use your ac for most of the day. here's the good news. tomorrow we'll boost the numbers up three to five degrees, but right back down for your saturday and an even cooler sunday coming your way. we'll talk about what's happening across the bay area, i know that's my tease i've been holding on to it. first let's check, drive, here's mike. all right christina, we're holding on for the bart system recoveries. now that's about 20 to 25 minutes from the latest i've heard. major in anything over 20 minutes though for the bart system. there are problems for the track outside the daly city and the maks arthur stations. now the system is recovering. we're just getting started for the morning commute. again plan on extra minutes there. muni reports no delays. the ferry systems no delays over the water either. we're looking at the drive. you don't have any slowing, but may see more folks head towards the roadway as we did hear about the problems early for the bart

system. no delays so far. but good volume starting. smooth flow of traffic towards north 680. we had an earlier crash back on its wheels. no injuries reported, but we had slowing that's cleared up once again danville into alamo. alabama's where the volume will build later on. rest of the bay moving smoothly. peninsula, south bay, southbound 87, there was a crash there, that moved over to the slow lane. west 580 over here. build through livermore and dublin. no big suprises out of the pass. highway 87 southbound. and there are no major issues, but again that one lane se blocked south just out of downtown. live look outside shows you oakland at the coliseum and northbound with the commute. nice drive past high street. and across the san mateo bridge on the pence lan side, 101 moving nicely through palo alto. all the way to the city without delay, back too you. house majority leader eric

cantor is stepping down today. this comes after a stunning los to virginia's republican party primary. he gives up his spot to california congressman kevin mccarthy. earlier this week, house republicans paid tribute with a video marking his achievements. well seattle police officers job in jeopardy for being a buzz kill. the officer's been reassigned after a review found out that he wrote 80% of the marijuana tickets issued in the city during the first half of the year. in one case he flipped a coin when deciding which person to cite. the tickets were handed out when weed was illegal in washington state earlier this month the state legalized the sale of pot for recreational use. despite planning a pushback, a popular ymca will be forced to shut its doors. the palo alto weekly reports a special meeting between leaders of the ymca in silicon valley and page mil ymca branch went

you're watching "today in the bay." san francisco golf course that was supposed to close today will live another day. current lease for the glen eagles golf course was set to expire today, but the city actually extended it by an month in an effort to reach an agreement. the course is operated since 1962. serena williams appears to be the picture of health in her first appearance since her unexpected exit from wimbledon one month ago. she blew through the round at sanford last night winning in straight sets. williams was ousted from the single after looking dazed and lookless in her match. she retired in a doubles match after losing her balance. serena williams says it was a viral infection. bank of the west classic continues today. venus up next at 7:00 tonight.

big debut for levi stadium is set for saturday. the game already sold out. earthquakes say the 49ers allowed them to semi44,000 tickets to the game against the sounders. that's about two-thirds full object stadium. yesterday the quakes told us about a thousand tickets remain. we did check online this morning. ticket master says those tickets are no longer available. this will be the first official test of levi stadium. the public transit system and the parking around the stadium get tested as well, and i think we can have good luck. when you are looking to be the best, you want to learn from the best which is certainly why i sit here next to scott and why the new head coach of the warriors is meeting with someone. >> that's right, steve carroll has already talked with the nfl hall of famer bill parcells. now seattle sea hawks head coach pete carroll. the website says carroll was at training camp yesterday trying to soak up carol's coaching philosophy. this will be his first year as

effect. this is new video just into our news rooem which appears to show the moment of an israeli air strike hit a crowded shopping area in gaza. you can see an ambulance roll in right before that explosion. the video has not been independently verified, but we're told 16 people were killed, and more than 200 others hit in this strike alone. this is believed to be one of 20 attacks that the israeli military carried out on what it calls hamas-ruled targets in gaza since midnight. the cross border war has already killed nearly 1400 palestinians, most of them civilians. more than 300 of them children. in contrast, nearly 60 israelis have been killed, most of them were soldier rs. in just a few hours, suspended state senator leland ye will be back in a federal courtroom to answer to new charges of racketeering. francisco. stephanie the new charges will filed last week. what kind of impact whether they make on the case? >> reporter: good morning, scott. they could have a serious impact. that's because one conviction of racketeering could land someone behind bars for up to 20 years. this could convince some of the defendants to talk to prosecutors in hopes of cutting a plea deal. now, the new charges filed just last week accused both ye and the other 28 defendants of violating the racketeering influence and corrupt organize act, better known as ricco. he is accused of selling political flavors in exchange for money. in the revised federal grand injury indictment last week, he tried to get an nfl owner to get him $60,000 in exchange for votes that would limit players, workers compensation insurance claims. this is in addition to accusations that ye was involved in everything from gun trafficking to accepting money from understood cover agents to help get rid of his debt. one of the defense attorneys though says this revised indictment is a good sign for

them. >> for them to come out with a superseding indictment essentially alleges the same facts is the sign of weakness in the prosecution. >> reporter: raymond shrimp boy chow was in the courthouse yesterday, formerly charged with a racketeering. his attorney says he is a reformed caught up, but innocent in a three year undercover investigation that spans money laundering to murder for hire. now the state senate voted to suspend leland ye back in late march, but he has continued to receive his annual salary of # $0,000 -- $90,000. live in san francisco, stephanie chuang, "today in the bay." >> all right stephanie, thanks. city of san jose is trying to do something about a burned out restaurant along a busy street. the flames restaurant on hillsdale a blight according to the mercury news. the charred out remains are behind a chain link fence. some of it covered now in

graffiti and there's trash all over the place. the city is telling the property owners to do something or they'll be fined. back in january, kitchen fire caused more than damage. demolition of the old building will not begin for another six weeks. already big leaguer san jose police department says the department is considering to cut cut its motorcycle traffic unit. part would be to move them into patrol cars. the city should make a final decision soon. and while it might cut motorcycles, sjpd added a drone to its force. the department used federal grant money to buy a $7,000 drone. it'll be used by the bomb squad to better assess threats and nothing else. since it was bought with federal fund, bomb squads in san francisco, oakland, and other bay area agencies can use this as well. up to 900 cars are still

stranded in murky waters and underground garnls at ucla. officials now say as much as 20 million gallons of water rushed from the broken pipeline flooding parts of the university, twice the amount of water than first thought. sunset boulevard will remain closed at least until tomorrow night as the work to repair the massive sink hole continues. six buildings were damaged including the iconic poly pavilion. it buckled, parts need to be replaced. last men six men pumping out water were treated for exposure to carbon monoxide from a generator they were using for the work. good news is they should be okay. its only been a month skins water rationing, but already, several people have been hit with huge fines for wasting water. the santa cruz let his toilet run for eight days. he opted to go to water school because that's a thing now. and he got out of paying the fine. others though have not been so

lucky. water educators like the ones just approved in santa clara county have been patrolling santa cruz for two months now and have fined numerous people in addition to the guy who let his toilet run. to the tune of more than a half million dollars. residents did paid nearly $350,000 in fines for wasting water. let's see that one more time. >> we saw that toilet an awful lot. i've seen christina loren talk about water school. if you're teaching the school, i'm letting them run. >> you know, i'll take it. whatever we can do, scott, i'll be teaching that class. 58 degrees, that's a great idea. you know what, with google hangouts, i say we do it. let's set that up. 61 degrees in san jose and 59 degrees in concord. temperatures out there are pretty mild this morning, but it's comfortable if you wanted to go for a jog, bike ride, it's going to feel more comfortable than yesterday at this time. as we continue to cut off the humidity. let's talk about what's going on

out there in the atmosphere. high pressure, clock wise rotation, you see all this blue, that's moisture wrapping around the big ridge of high pressure. for us, it has been pulling in moisture from off the coast of the pacific as we head through this afternoon, and it moves off to the east. that moisture supply is cut off. and so we are going to feel a lot more comfortable as that drier air mass sets up right over the bay area for today. temperatures though will be on the hot side. 91 degrees in the south bay today. 85 firefighter peninsula. -- 85 for the peninsula. east shore is at 83 degrees. speaking of the east shore. fremont festival is this weekend, and it is a good time, it's absolutely free. a lot of people head the out there. the weather this year couldn't be better. 80 degrees on saturday, about 77 degrees on sunday, and that's when you can meet mike inouye. he will be out there on sunday which is also the day that le have i stadium is -- levi stadium is opening up. 7:30 on saturday, this is a big

deal when it comes to traffic. i can tell you right now, the game is sold out, sounders versus the erics. we are going to have some coverage for you. we're going to give you an inside look at the park and be covering traffic here on nbc bay area. check that out. and mike inouye, you're going to be at the fremont festival. do you have tips for people for this date? 7:30 p.m. saturday, levi stadium openings? >> try to get there early. because last time we saw that open house they had, it was crazy on surface streets. of course there's been a lot of press about that. they've done a lot of work to get their crews and find alternate routes. remember the vta stations are not yet open. meanwhile toward the bay bridge, i'm worried about this, not baud of the fog, clouds are hovering above the deck. we have some major delays reported, not for the road, but for the bart system. system wide reporting 20 to 25 minute delays, still system wide

"today in the bay's" tracy potts is live at capitol hill this morning. with a look at what is unresolved and the chances we might see resolution, tracy? >> reporter: maybe on the va, not so sure on the border issue and immigration issue. let's look at the to do list. last day, congress is trying to wrap it up today. they are $2 billion apart, the house and the senate on how to pay for the emergency funding president obama has asked for to deal with the border and immigration. that one's not likely toe happen. plus they've thrown in an addition bill that would prevent the president from deferring deportation. now the va is something that we could see, va reform high on the agenda here on capitol hill. the va is looking at adding more

doctors and nurses. and giving vets the opportunity to go outside the system if they can't get a quick appointment. finally something that affected california and every other state. the highway bill, the trust sfund running out of money. bankrupt as of next month. they'll slow down payments, cutting payments to states for highway projects if congress doesn't act. that's a full agenda they're trying to get out of town today. >> they'll stay a little late today, thanks tracy. for the first time a team of investigators reached the crash site of malaysia airlines flight 17. fights between ukrainian troops and pro-russian rebels kept them away for two weeks. police and forensic experts from the netherland and australia are retrieving bodies still at the site and collecting victim's belongings. it is not clear exactly how many bodies remain and what condition they might be in after being exposed to the summer heat for

so long. san jose police are looking through surveillance video trying to identify an armed man wanted in a very frightening home invasion robbery. derek shore joins us live in the valley neighborhood. derek, the area considered one of the safest parts of town. >> reporter: that's right. neighbors still say it is safe. there was a rash of burglaries last year, then it was really quiet until this brazen home invasion robbery. and now everyone a again on edge. investigators say that 17-year-old was home alone just before 1:00 yesterday afternoon when the suspect busted out a glass door in the back of the home. that suspect confronted the high schooler with a gun, tieing him up with zip ties, demanding money and took off with valuables after the teen told him where to find them. the suspect was wearing a disguise. after he took off, the teen was able to get himself untied and call 911. one neighbor said he can't quite believe the suspect picked that

specific house because the home has an elaborate video surveillance system. >> this is the house that's got more cameras than anyone in the neighborhood. i'm a little surprised. >> reporter: police are now pouring over surveillance video, plenty of neighbors also have cameras, incredibly, that includes the victim's home. there's some question whether there was one or two suspects involved here. we're still trying to get clarification. meanwhile, that teen is recovering. we're told by the mother that he is doing okay physically, of course, very shaken up. we're live in san jose, derek shore, "today in the bay." >> derek, thank you very much. also new morning, a late night scare for people living near sacramento's mather airport when a cargo plane had to make an emergency landing shortly after takeoff. the pilot heard unusual notices from the landing. nobody hurt, but neighbors reported a big boom. they say they saw sparks coming out. four crew members on the plane, everybody's okay.

ocean air transported all the way across the bay, but that's where fwl cut off. not quite making it through the delta. it'll be very, very hot in the extreme east bay places like antioch. getting towards that hundred degree mark today, 72 for san francisco, 83 degrees on the east shore. low 90s in the south bay. if you're trying to get away, people will be doing so. afterall a lot of kids headed back to school. california getaway forecast tells the story. comfortable in tahoe. we're talking about the 80s. tomorrow the warmest, then throughout the weekend, temperatures staying pretty cool up in the russian river valley. tomorrow, 103 degrees. 98 degrees by saturday. but sunday, 93. that's actually a comfortable temperature for you out here in the russian river valley. you can always jump in the river if it gets too hot. central coast looking good. 85 degrees on friday in monterrey. comfortable conditions on sunday as well. even when you drop to 79 degrees, that's a nice day at beach. overall, not too bad here. you're going to stay local,

maybe a staykags. 8 -- staycation. we're looking at the volume increasing for west 580, moving a at good clip. don't worry, this is off of the roadway. actually beyond that little fencing going on there. it's a distraction, but not an issue for west 580. i'll show you on the maps. we're talking about for the tri-valley, this is the area with the live shot. we do see a live volume of traffic. but smooth drive coming into livermore out of pass and through livermore through west 84. i have the hopes up for a nice commute. 680 not a problem down to the south bay. north in towards the san ramone area. we're looking at here, west 80. that's a smoother drive. yesterday saw a really heavy volume of traffic there. we're seeing a similar pattern. crash had me worried, that's making the transition toward east 580. countercommute, blocking one lane for what i'm trying to tell. still reporting, 20 to 25

minutes. late, half hour late getting to work if you take bart right now, and no details on any recovery over the last 20 minutes. i have to hope that that's going to change over the next view. the roadways are moving smoothly around the bay. here's san jose northbound, picking up at 680 for 101, back to you. >> thank you very much, mike. investigators say a small plane clipped the top of a target store before it crashed into a san diego parking lot. and it lost power on takeoff. that being the reason for the crash. 80-year-old passenger was killed and the pilot is seriously hurt. you can see the front of the plane completely destroyed. police say after. plan grades the top of the store, it knocked down a light pole and two people on the ground were treated for minor burns. crews were called in to rescue a woman who lost her footing while driem climbing down a steep hill. her fall was caught on camera. this happened near pasadena. there you see, oh, ouch, ouch.

the bay." welcome back, tesla signed with a japanese electronics company, pansonic to build that massive battery plant somewhere in the united states. the company's announced the deal this morning, but still have not said where the so-called gig factory will be built. the plant will produce batteries, many which will go into electric cars. it'll employ 6500 people. under the deal, tesla will prepare and provide to manage the land and buildings. they'll do the hard work. they're going to make the battery. those of you waiting for apple to sell its all in one box for live and on demand tv shows will have to keep waiting. reports say the company is delaying the launch of a new apple tv device until later next year. apple blames cable companies for dragging their heels on signing content deals and pending comcast time warner cable merger. by the way, we are owned by comcast. reporters say cable companies deny their holding up that i think things saying apple bit
