meteorologist rob miatta. the forecast, the rain's falling right now? >> yeah, moving down through the tri-valley into danville. rain around the 680 commute through up towards martinez and heading out towards fairfield. danville right now, the southern extent of the rain showers. and berkeley, you're seeing that too off to the west. this pattern will continue to transition to the south as we go through the rest of the morning commute affecting mainly the north and east bay. coming up, we'll let you know how much rain totals we expect out of the weather system and warm up in your seven day forecast. in an hour, pollution response team will get to work on the ocean beach cleaning up a deezle spill -- diesel spill that spilled when the fishing boat ran aground. bob redell right there, right now, what's the latest? good morning. >> reporter: good morning, scott. we presume that this fuel clean up team is waiting for the sun to come up so they can figure out how best to remove the diesel that's been leaking from

the 38 fishing vessel called the paloma which ran aground just over 24 hours ago. it has been leaking fuel. it is a 400 gallon fuel tank. not clear if it was full of fuel at the time. the next step to figuring out to remove the vessel itself. the plan is to have this done by this morning. the skipper is still missing, he's a veteran fisherman. around 3:30, he radioed another vessel to let them know he was caught in the surf. >> told the sunrise that he was on the rocks and that he was in a life jacket and getting, he was going to swim the 25 yards to shore. >> reporter: you can see the orange lifeboat also washed up on shore. possible deployed by itself. the coast guard believes that the man most likely made it to shore safely. wove spoke -- weave spoken to

others saying he may not want to be found to have to deal with the situation. we found an old booking photo, he has no outstanding warrants. friend of his tells us he's quote, good people. reporting live here in ocean beach, bob redell, "today in the bay." >> well let's hope he's okay. thanks bob. reenfornsmentes are coming -- reinforcements are coming in today as firefighters are battling wild fires burning across the state. cal fire is showing what it's dealing with. this one shows what the state looks like right now. the second one is a shocker, it's what's happening in northern california right now. nine different fires all burning north of redding. largest of them all, the eiler fire in shasta county. almost 29,000 acres burned, just a little bit smaller than the entire city of san francisco. there's no containment at this time. and firefighters are desperately working to gain a perimeter around the flames. the fire's destroyed at least

eight homes and one restaurant. hundreds of buildings are still threatened. and there are more than a thousand firefighters battling that fire alone leaving state resources depleted. the crews from across the country are on their way to help. connecticut fire crews packed up to leave this morning. they're headed to california. the 20 person crew flew out of hartford county early this morning. firefighters say they know anything could happen. >> weather conditions where we're going, supposed to be really steep terrain. so yeah, dry conditions, the heat, fire behavior. yeah, you never really know what you're walking into. until you get there. >> all of the crews on their way are trained in battling forest fires and wild fires. and other states are also sending crews our way. washington and oregon receiving help for more than a dozen major wild fires that are burning there. well, at 5:04 this morning, the family of a u.c. berkeley football player who died after

collapsing at practice plans to file a wrongful death lawsuit against the school today. the players ted agu collapsed during a conditioning run in february. he rushed to the hospital where he died. doctors discovered he had a heart condition that made it difficult for blood to reach the heart. the family's lawyers say coaches and trainers should have noticed and helped him sooner. u.c. berkeley said they did everything they could. it is 5:05, in about three hours, santa clara county leaders will outline their plan to help undocumented children crossing the u.s. bortder alone. it could include a call for host families in the south bay. kris sanchez joins us live with a look at the proposal and how the plan might work, good morning. >> reporter: hi there laura, leaders of the catholic charities of santa clara county will urge leaders to come up with a plan to take on some of those undocumented children who are in detention centers in southern california and in texas.

the charity wants to urge supervisors to move forward with a plan to help. the county executive jeff smith already had his staff researching the feasibility of housing some of the children in private homes in the same way foster children are. last month, congresswoman of san jose asked the county board to figure out a way to help. several board members seem on board with the host family model. now as far as catholic charities, this is not a new concept. for 30 years, they've had a refugee resettlement program through which it provided housing, education, and assistance to help resettle refugees from around the world. as for santa clara county's host program. here's how it could look. about 50 children could be placed in homes in the county. the host families would have to meet the same qualifications and background scheks as a foster family. the county would seek federal funds for expenses from the federal government and the county would provide legal assistance in the short term.

this is also happening in another big bay area city, oakland, city council leaders passed a resolution asking for host families to come forward to hear, to come forward there. this all, of course, as everyone waiting for the federal government to come up with some sort of plan, local governments are saying these folks are coming to our communities, let's figure out what we can do, laura. >> thanks so much, kris. well today the city of milpeds will clear the way for an existing card room in santa clara county to move in. they are not saying which card room, pretty good guess is bay 101 which is looking to build a new facility to compete with the recently opened casino matrix. santa clara county supervisor and current mayoral candidate says he will try to, won't try to keep bay 101 in san jose if it wants to move. san jose is one of the most

innovative cities in the world and i'm confident that we are senator and innovative enough to find another more appropriate way to generate new tax revenue and create good paying jobs for our residents that are relying on the tax proceeds from card rooms. it's 5:08, i want to check in with our meteorologist in for christina this morning. if the sheets feel heavy, blame the prompter. >> yes, the humidity is up this morning. and we have some rain across northern california. good news i think for the fire fighting efforts as we get towards chico and redding. it's mainly areas north of danville we've been watching the line of showers moving south out of concord and over towards oakland. you can see that rain waiting along 60 as we head southbound outs of concord or northbound up towards martinez this morning. richmond over towards berkeley.

mainly coming down i think for the north bay, you can see totals getting over about a tenth of an inch out by napa and sonoma. enough to wet the ground in the east bay. most of it falling for today and shutting down by tomorrow morning. 82 degrees today in san jose. should climb almost to near 90 at morgan hill where we get more sunshine around the south bay today. few showers possible around foster city an palo alto, high of 81 degrees. san francisco seeing low 70s. again, it's these locations, north bay, tri-valley, inland portions of the east bay that has the best bet of seeing scattered showers and thundershower, most of that will be north of santa rosa for the afternoon, then notice the transition, second half of the week, temperatures climb, we dry out, 90s coming back to the tri-valley as we wrap up the week. now for a check of your at

times, drippy commute around parts of the bay area. over to mike. >> we'll talk about that. i'm not the drip. rob didn't say at this time, but we know what you implied. good friends over here, we're looking at very nice easy drive and dry as rob was talking about. some parts of the bay area are wet, maybe slow. let's look at your map. we're talking about the green, traffic and weather maps tighten together, where rob showed the radar, the green means you'll have damp, possibly wet roads coming through highway 4 as well as 80 coming off the east shore freeway and up towards interstate 80 and highway 4 where the earlier crash moved off to the shoulder. still watch for slowing around hercules, rob was running more water. look at that blue means puddling. so far, no incidents reported. happening because of the puddling. watch it there. more rain through the range. nothing reported for 580 and slowing there towards 680 and the dublin interchange. 580 here showing your early

an update to a developing story in gaza. its been a quiet morning there as both israel and hamas are holding up their ends of a cease-fire. this one is meant to last three days, but it's only been a couple of hours now and we've seen temporary truces like these fall apart before. both sides are supposed to use this time to hold indistrict peace talks in egypt. hamas want israel and egypt to lift the blockades, but israel does not want to until hamas is disarmed. since fighting began nearly a month ago, close to 1900 palestinians and 67 israelis have died. p.f.changs identified the restaurants targeted in a security breach and people ate at the location in a stanford mall are at risk. the company says 33 locations, including the one in palo alto may have had their information stolen between april 10th and june 11th. several other california

restaurants were impacted. but the palo alto is the only one in the bay area. in addition to card numbers and names, the restaurant said card expiration dates have been compromised. linked in is paying wages and damages to current and former employees. this comes amid a labor investigation that founded linkedin violated overtime. it happened in california, illinois, nebraska, and new york. mountain view represent toi could not be reached for comment. the company says it'll pay back the wages and will take steps to prevent this from happening again. well for a quick look at the markets, let's go to courtney reagan live at cnbc world headquarters, good morning, courtney. >> reporter: good morning to you, scott, futures slightly low lower on that usual. data on the service sector and factory earnings from disney. the dow rising 75 points.

the nasdaq up 31. >> all right courtney, thank you, much. we check in with our meteorologist right now, taking a peek of his forecast. it's either some clouds, overcast, or showers coming down. >> yeah, you can't be bored by the weather we're seeing around the bay area this morning. we have low clouds around san francisco, we have the rain there around parts of the east bay and north bay. we have temperatures in the 50s or low 60s outside right now. south bay, you're seeing 62 degrees around san jose, and yes we have rain, but not around san jose right now. where we're seeing the rain out towards the tri-valley, concord, danville, you're see the rain showers moving from north to south. most of the active weather for you this morning in the north and east bay. this is from concord to walnut creek and out by st. mary's this morning, seeing light rain north to south off to the west. that seems to be the western flank of this band of showers which is also moving off to the south and east. meantime in the north bay, still

areas of rain at times, petaluma, santa rosa earlier around the park into napa. again that activity slowly transitioning off towards the south and east. through the morning, it'll be the north and east bay that sees most of the shower activity through 11:00. then later on today, could see pop up showers once again in the north bay, briefly passing san francisco overnight. then as we head towards wednesday, we'll transition to a drier forecast as that system finally moves on and we'll see our temperatures climb wednesday, thursday, on into friday, but by august standards, impressive rainfall totals, anything to wet the rain to be honest is a record breaker for this time of year. santa rosa into napa. that's where the higher totals will be. last wave of showers, should see more rain possibly into the south bay briefly late tonight into early tomorrow. 82 degrees in san jose today. upper 80s around saratoga and 90 around gilroy and morgan hill. close to 70. for the north bay, highs in the upper 70s.

pleasanton about 85 degrees. 8 # in livermore, also want to point out we're keeping a closy out on the tropics there with hurricane azelle which will track towards the hawaiian islandings likely impacting a tropical storm towards thursday and another system closely on its heels. if you're heading to the hawaiian islands, you're watching out for julio. it'll also approach the hawaiian islands sunday towards the big island. if your travel plans include the hawaiian islandings, keep a close eye on the tropical forecast. keeping a close eye on the morning commute, here's mike. look over here towards the north bay where southbound moving smoothly. we talked about rain on the radar, it's not affecting san rafael, dry roadways, we can still see under the lights. map for the north bay as well. the rain totals showing you green and blue. navado is further north of santa rosa. through vallejo and across the bridge. and the east shore freeway.

we are looking at some wet roadways as well. it comes from the weather data. traffic and weather sensors are tied together. smoother drive south of danville in towards san ramone and also the pass, typical slowing for west 580. no big drama towards the castro valley. and in fact the south bay moving nicely. we'll talk about northbound 101 at old bay shore. we had an earlier crash. let's give you live shots from around that area. that's san jose area here northbound, and not so bad, the volume is traffic-free, light, manageable. you're at the limit for san jose and look at 580. we talked slowing in towards dub lib. you have a lot of company, here between el charro and it's a -- tassajara, back to you. >> thanks mike. tonight is national night out. bart is inviting the community to meet the police officers and learn about crime prevention. this year festivities will

fedex smart post slammed into don taylor's parents car at 70 miles per hour near davis. the parents and toddler were killed. the driver was sentenced to jail, but fedex was not held responsible. the company said the driver was a third party contractor and those venders are responsible for any claims related to their operations. dmot fedex. >> his route is only a fedex route. he does not do anything outside of federal express. therefore, they have an should have immediate control. >> tonight the investigative unit also goes undercover to find contractors that the government says should not be on the road at all. delivering fedex packages. watch the full investigation at 11:00 on nbc bay area news. more than 300 cars damaged by that massive water break at ucla will be available for pick up this morning. owners have not seen is their cars in over a week. it's uncertain if they'll start. many were submernged in water. they have the entire week to

area including the tri-valley, east bay into the north bay. what it means for the tuesday forecast, coming up. and what it means for your commute. we're following the wet roadways as well as well slowing that we see already popping up. let's take a live look outside this morning. that's a pretty shot at the bay bridge. you made it to tuesday morning, it is august 5th, and this is "today in the bay." from nbc bay area, this is "today in the bay." and a very good tuesday morning to you, thanks so much for joining us, i'm laura garcia-cannon. >> and i'm scott mcgrew. golden gate bridge says don't forget about me. parts of the north bay seeing rain overnight. wet start to the morning, let's check in with meteorologist rob mayeda for your forecast. >> interesting looking satellite and radar view on an august morning. you see the heavier rain off to the north. showers have been pushing out into concord, walnut creek in danville. and off to the west around the

areas. you're seeing light to scattered shower activity moving from north to south. and more showers here in the north bay where later on this afternoon, there is a slight chance of seeing an isolated thundershower north of santa rosa. how long the showers will stick around in your microclimate forecast. that's coming up in a few minutes. >> thanks so much. in about a half hour, crews will begin cleaning up fuel around a fishing vessel that ran aground on ocean beach. the boat's been tle bobbing up and down close to the cliff house since yesterday. and that's where we find bob redell, have you seen any movement in the last 30 minutes. are crews arriving? >> reporter: not yet laura, good morning. the issue of course is the lack of light. they're waiting for the sun to come up. coast guard will hopefully have this team to go out to the shoreline which is behind me here on ocean beach to begin removing diesel fuel that's been leaking from the vessel, then they'll figure out how to remove the vessel itself. it's 48 fishing boat. it's called the paloma.

the skipper is still missing, but the coast guard believes he did most likely make it to shore. he became caught in the surf around 3:30 yesterday morning. he radioed another fishing vessel called the sunrise to let them know whefs going up against the rocks here off ocean beach near the cliff house. he was going to put on a life jacket and swim the 25 yards on the shore. you can see the orange lifeboat did wash up, but it's possible it deployed automatically. we've spoken to fisherman who know him. he's a veteran, they've heard reports he may have walked away from the situation because he doesn't want to deal with it. also found an old booking photo from santa cruz county. law enforcement says nose outstanding warrants. >> we're all worried. we all would love to know that he's okay. timmy's good people. >> reporter: nbc bay area did reach out to the owner of the boat who lives in orton, california, but we have not yet heard back. now the boat does have a 400

gallon diesel fuel tank on board. what's not clear is whether it was full at the time it ran aground though. coast guard saying that yes it is leaking diesel, how much, that amount is still unknown. again, waiting for the sun to come up here on ocean beach. that's where the fuel removal crew to come out here. they were saying around 6:00 a.m., could be later based on the fact that there's 30 minutes left and we don't have an ounce of sunlight. reporting live, bob redell, "today in the bay." >> all right, thanks bob. today we'll get our first look at the fremont man accused of breaking into a home, tieing up a little girl and raping her mother. police say jamala morris was wearing a mask in fremont. waiting for a mother and daughter to come home. this happened saturday night. morris was waiting in the little girl's room. when she came in, he grabbed her, threatened her with gun. when the mother went in, he tied them both up with duct tape. >> the suspect then pushes the daughter aside and takes the mom

and takes her into a different room of the residence. it's in that room that he forcefully sexual assaulted her. >> now during the attack, a relative of the woman came home. chased the suspect off. morris was caught hours later. officers say they found the victim's wallet and other evidence in his home. it's 5:34, mountain view police are looking for more possible victims of a handy man accused of sexually abusing two young girls. stephanie chuang joins us live this morning, the suspect had no criminal history. >> reporter: that's right. good morning, laura. no krm history, but police say it's what this man did for a living that has him concerned. he worked as a handy man for the same homes in the same neighborhood. the worry of course is that he may have other victims out there. now 43-year-old ramiro palestos is behind bars. he was arrested friday for lewd and lascivious acts with a child after two sisters, seven and ten

years old, told their parents that he had touched them inappropriately. now the alleged acts of molestation happened in the moffet mobile home park here in mountain view. detective say he lured the girls to a secluded area separately and molested them as he worked as a handy man during the course of several days. at the time the girls were being cared for by a different family member, not their parents. neighbors had mixed reactions, recalling what seemed to be the man's very religious nature. >> i can't believe it. i mean, he asked my son, do you believe in god. you know, he looked like he the love of the lord in his heart. >> if you see someone walking around and saying god bless you, it's a little different. just a little bit. >> reporter: the mobile home park manager tills nbc bay area that he attended the mountain view spanish seven day church where parishioners described him

as a nice man. we're told he is married and has a son. he is set to be arraigned some time this week. live in mountain view, stephanie chuang, "today in the bay." >> thank you very much, stephanie. people living in san jose said they'd be willing to pay higher taxes for the right reasons. tonight the city council will discuss the results of a recent poll on a sales tax hike. it could find its way on to the november ballot. the city talked to 1500 people by phone and found 67% of them would support a quarter cent north carolina with the money going toward the city's general fund. 65% would support a tax increase if the money helped fund better roads. 71 pkts say they'd be okay with a higher sales tax if it went to public safety. now the safety at the forefront of a number of people's minds. this home surveillance video given to us by a man who says he'd pay more. you can see a prowler breaking on to his house. fist, shoulder, shovel, he'll

eventually use a rock. he took off with jewelry and electronics. police are still looking for him. possible sales tax not the only thing san jose's dealing with. plan to increase the marijuana tax from 10% to 15 or 20% and changes to measure b which implemented pension reforms to the city employees. the city looking to how it uses police reserves as well and a plan to house homeless people in some city hotels and motels. it's 5:37 right now, tuesday morning. boy, coming in with some showers, at least in the north and east bay right now. we'll see will the entire bay area get something today, rob? >> well later today i think you'll see a chance of showers further south. maybe not so much in the south bay, but around the peninsula. later on this evening, might see brief showers, but for shower you're seeing them right now. north bay, napa county, you can see that match of showers pressing southward into the tri-valley. concord into danville, 680 commute and the highway 4

commute in the midst the of it. you're seeing moderate showers at times. you can see scat kerd showers approaching oakland from the north leaving berkeley heading south. and you can see more scattered showers out across the north bay. so the forecast for the north and east bay will include areas of rain for your morning commute. more sunshine mixed of clouds in the south bay, lingering for for parts of the north bay. by tomorrow morning, stray shower too possible in the south bay, then things will continue to clear out, we'll warm up for the second half of the week. here's the profession of the showers today. mainly off to the north and east. then tomorrow, one more batch of showers comes down the peninsula into tomorrow morning. few stray showers across the east bay and south bay. look how skies clear wednesday afternoon, that'll allow temperatures to climb up. for the second half of the week. rain totals may not look like much, but by august standards, that's impressive to get rain out toward napa over the next 24 hours and rain coming down possibly around the coast as we head in towards tonight.

with her fellow missionary. the doctor that has been here for a couple of days, dr. kent brandtly. the prognosis right now for both of these patients, guardedly optimistic. they've shown a strong response to the treatments to this point including the use of an experimental drug zmap. so they are doing well, but doctors stress, there's a long way to go here. and there is a lot of time that they will spend in this isolation unit. you know some ebola patients have recovered in days, they think it will take a couple of weeks, at least, for these two patients. and they say the next few days will be critical, scott. >> jay gray in atlanta, thank you. the ebola outbreak overshadowing one of the largest international gather ergs ever. leaders from 50 african nation along with hundreds of others that are in washington for the u.s. africa business summit.

santa ramone died when their 19 foot boat crashed into a dock just ripping it in half. it happened near the bay on the lake's west shore. deputies say the boat was moving fast when it crashed into a pier in the middle of the night. the couple died at the scene. in the men time, coast guard is looking into what called this tour boat to get stuck this shallow waters leaving hundreds stranded. authorities evacuated nearly 300 people on board the queen paddle wheel boat. it happened yesterday afternoon near reagan beach in south lake tahoe. no one was hurt. no word yet on when that boat will be moved. new video to show you this morning showing rushing flood waters in nevada pushing a car down the side of the highway. rather slowly there. it's stuck in the mud. comes as heavy rain pounded the las vegas area yesterday and airman from a nearby air force base safely managed to get out of that car, luckily. but further down, raging waters trapped an elderly in a toyota
