good morning. good morning. breaking news overnight. violence and looting erupts after a black teenager is shot and killed by police in suburban st. louis. protesters smashing windows and breaking into stores. we're live at the scene. tragedy on the track. after striking and killing another driver, nascar's tony stewart temporarily steps away from racing saying there aren't words to describe his sadness. as police move forward with their investigation, should the rules of racing be changed? stranded. two dozen riders stuck for hours near the top of a roller coaster. this morning what caused that ride to suddenly stop. and the prince of darkness. the bizarre finish in the twilight of the pga championship

show. let's start with our top story. tensions explode in the streets of st. louis in a suburb there in what began as a peaceful protest in the shooting of an unarmed teen spiraled into violence. john yang has the latest. good morning to you. >> reporter: good morning. this is the staging area. police were able to restore a couple hours ago after a night saw 32 arrests for looting at about a dozen stores. at least one of those stores burned. vigils and vandalism. tensions boiled over in this st. louis suburb overnight following the death of teenager michael brown. there were several reports of looting and fires as angry protesters demanded answers in a standoff with police. investigators have given few details about what happened when an officer encountered brown and

a companion on the street. authorities say one shoved the officer shoved him into a vehicle. >> there was at least one shot fired within the car. >> reporter: it spilled to the street where brown unarmed was shot multiple times. the officer who hasn't been identified is on paid leave. this woman who took this cell phone video said she saw the final shots from her apartment balcony. >> he's running this way. he turned his body this way towards this way with his hands in the air, he gets shot in the chest. >> reporter: while the reaction has been furious, brown's family wants justice peacefully. >> there should be no violence. >> his mother said her son didn't deserve to die. >> you're not god. you're not going to decide when you take somebody from her. that was mine. >> reporter: as this death generates a mix of grief and

anger. later today his parents will speak out with their new attorney, benjamin krump. he also represented trayvon martin. >> thank you so much. now to more on the racing accident in new york involving nascar driver tony stewart. he struck and killed another racer who had clom his car and was walking on the track. kristen dahlgren has more on all of this. good morning to you. >> reporter: good morning. yeah, the sheriff here says at this point in the investigation there doesn't appear to be any criminal intent. but you can imagine just how traumatic it was for fans here at this small raceway when they saw this on saturday night. the video is so disturbing we won't show you all of it. this has left a lot of people with a lot of questions. it was a packed house saturday night. the hum of sprint cars racing around the track.

then video on youtube shows two cars colliding. one spins out while the other driven by nascar legend tony stewart keeps going. the driver of the sidelined car gets out and in the dark appears to point at stewart. then walks onto the track wards stewart's car. >> tony stewart just hit that guy! >> reporter: he was hit by the back wheel and later prow announced dead at the hospital. tony stewart has a reputation for colorful language and frequent outbursts. he once threw his helmet at another driver after colliding. >> tony stewart can be a hot head. he gets into arguments with other drivers at times. typically it's not really aggressive driving. >> reporter: authorities are examining video but it appears it may just be a tragic accident. >> an investigation is ongoing. to try and identify all the

potential factors for this on-track crash and subsequent death. >> reporter: stewart pulled out of sunday's nascar race saying, quote, there aren't words to describe the sadness. ward's family is asking for privacy. the young driver started racing go carts at age 4 but most recently took to racing high-powered sprint cars equipped with wings that increase traction on the dirt traction. fans say accidents and drama is a part of racing but not like this. now, authorities say that stewart is cooperating with their investigation. there's no word yet on when he will race again. nascar did release a statement, though, saying it will respect the process of local authorities. >> all right. thank you so much. let's turn to jeff burton. he's a sports analyst covering nascar and also a longtime driver on the sprint circuit. good morning to you. i know you've seen the video. when you watch it, you watch it with more of a trained eye.

what do you think happened here? and i wonder what you think the visibility would have been for tony stewart would have been on that track. >> obviously it's just a tragic accident. this race -- the race is an emotional sport. you can see kevin ward gets very upset because he feels like his chance to win the race is taken away from him. we've all done that. we all make that mistake when we approach another car. this was a tragic accident. it is a dark racetrack. it's hard to see. but to say this guy did that, it's wrong to do that. you see in football and basketball players approach each other because you're upset. in motor sports, that person is in a moving vehicle. that changes the game is little bit, obviously. but people care about this sport, they love this sport. they put so much into it. when something happens you feel like somebody took something away from you, you want to express that. >> you've known tony stewart for 20 years. have you had a chance to reach out to him at all?

what do you think his mind-set is this morning? >> i did reach out to tony. i have known him for a long time. tony's not the kind of guy that would intentionally hit someone. i can assure you that. he's heartbroken. the kevin ward family is heartbroken. it's a tragedy. there's nothing good from this. and tony is having a tough time with this as everybody is. >> it's good to get your perspective on this. thank you very much. appreciate it. we've got breaking news overnight in the ongoing and deepening crisis in iraq. u.s. forces carried out more air strikes over the weekend while the obama administration carefully watches the power struggle that has developed in baghdad. keir simmons has the latest on this. keir, good morning. >> reporter: matt, good morning. this morning it's reported the u.s. is delivering weapons to kurdish forces that are fighting i.s.i.s. just 20 miles from here. those fighters are winning some victories. while it is thought there are

still refugees trapped on a mountain in the north, many others now are safe. tens of thousands have walked to safety coming down from a mountain refuge, crossing a river, exhausted. this woman has two more boys. both are missing. an escape route for these desperate people. while air drops for food and water continued as people arrived with terrible stories of i.s.i.s. killings. their starvation and thirst. >> just we have a bottle of water. >> reporter: many have lost their families. it's claimed some members of the minority community were buried

alive by i.s.i.s. the people here are fighting back aided by those u.s. air strikes. kurdish forces apparently overwhelmed i.s.i.s. in key towns. the rare i.s.i.s. defeat. the battle was broadcast 20 miles away in erbil threatened by i.s.i.s. for days. people are crowded around here to watch the fighting taking place right outside their city. 1.5 million people live in erbil, a westernized city representing everything i.s.i.s. detests. the manager of an american outlet tells me his customers have fled. >> they're frightened. >> yes. >> reporter: and this morning thousands are still homeless and terrified. as well as guns and weapons, i.s.i.s. uses fear as a weapon. but this american intervention may have provided a tipping point. meanwhile the divisions in iraq are deepening. the prime minister is refusing to resign and amid- those kind of divisions that isis is thriving. >> all right. keir, thank you very much. while this is happening in iraq,

critics are saying president obama's air strikes are not enough. nbc's white house correspondent chris jansing is traveling with the president. good morning to you. >> reporter: good morning, matt. well, the president arrived here to martha's vineyard to a barrage of public criticism. they want the u.s. to be more aggressive in iraq. they suggest if that doesn't happen, president obama is risking another 9/11. now, the white house strongly rejects that assertion. they say i.s.i.s. as dangerous as they are has showed no desire to carry out 9/11-style attacks. talking to seniour white house officials, the administration believes that these air strikes and the drops of food and water are proving effective. now, this morning they are keeping a close eye on prime minister nuri al maliki. you just heard that from keir. he's trying to keep his job. members of the president's national security team are here with him. they brief him at least three

times a day. in the meantime he has managed to get in two round of golf. >> all right. chris jansing traveling with the president, thank you very much. let's turn to natalie in the push for peace in the middle east. >> that new cease-fire between hamas and israel militants is holding out so far. the egyptian brokered truce is aimed at getting delegations from both sides time to reach a comprehensive peace deal in cairo. in a month of fighting were more than 1900 palestinians and 67 israelis have been killed. more lightning strikes are threatening to worsen a fast-moving wildfire in california. thousands of firefighters are fighting in california. six communities have been evacuated so far and dozens of structures are threatened. the fire which has burned at least 8500 acres is about 30% contained. a dramatic rescue sunday

night at an amusement park in maryland. riders were stuck several hours on top of a roller coaster. kristen welker, good morning. >> reporter: good morning to you. what started as a day of fun here at six flags turned into a harrowing experience for some people who got stuck on the joker's jinx roller coaster ride for four hours. trapped 75 feet in the air. for the 24 passengers aboard the joker's jinx, this wasn't the roller coaster ride they were expecting as their six-car train came to a halt on the track at 2:00 p.m. sunday leaving them stranded 75 feet in the air. maryland fire and emergency crews quickly responded bringing in trucks equipped with ladders and safety equipment as they scaled the ride. >> we had to make our way to the back of the car.

first thing to do was to keep the car from moving back and forth. >> reporter: the rescue operation began just after 5:00 p.m. one by one, firefighters strapped riders into safety harnesses lowering them to the ground. >> everybody was pretty much well cooperative. they just wanted to get off of there. they had no problems getting to our towers. >> reporter: but 7:00 p.m., all 24 passengers were on the ground safely. the question today, why did the joker's jinx suddenly stop? in a statement, six flags said the ride has a sophisticated computerized safety system that can cause such ride stoppages. while we are not yet sure what caused the stoppage, the ride performed as it is designed to. but clearly for those two dozen riders it just wasn't what they were expecting. the good news here, there were no serious injuries. for now it will remain closed as the park investigates what went wrong. >> and those rescue workers to be commended. scariest job ever.

thanks so much. now to a young racer who just didn't cut the mustard. this happened during a hot dog derby. the mustard has the lead clearly. but then a wardrobe malfunction. his pants drop down but the mustard goes back down again. needless to say he couldn't catch up. >> spirit of al roker is here. >> i thought you were going to say we saw the hot dog buns there for a second. >> we did. >> he didn't relish the moment. >> my gosh. >> apparently al is here. >> exactly. >> dylan. >> i'm trying. >> al's off this week and you've got the forecast. >> yeah. it was a stormy weekend in parts of the southeast. especially near alabama. take a look at this. we saw up to an inch of rain in ten minutes. it just overwhelmed the roads. you saw that car just head-first into that puddle there. we saw overall about 3 inches of

rain in that area. but some areas across alabama ended up with about 5 inches of rain. torrential down pours came down with some of these thunderstorms. we're going to see the same type of setup today. not in alabama but a little further to the north. we have heavy rain making a mess of the morning commute in chicago. we could end up with an inch or two there. this is going to spread eastward. also northwestern ohio we could see heavier pockets of rain that could cause some brief flash flooding. when you end up with an inch or two of rain in hours, it could cause problems on the roadways. we are looking at perhaps as much as 2 to 3 inches of rain in new york state to new jersey and to the northeast of washington, d.c. that's tuesday into wednesday as all of that rain comes. that's a look at your weather across the country. your local forecast in 30 seconds. for healthy behavior.

25-year-old broke off his engagement to tennis star caroline wozniacki key saying in a statement, the wedding invitations issued last week made me realize that i wasn't ready for all that marriage entails. he said over the weekend that's partly why he's been so unstoppable on the course telling reporters, i mean, what else do i have to do now? i go to the golf course, to the gym, and it's just my life at the minute. >> he's such a great player. that once he got his personal side away from the golf course in order, that brought greatness back to him on the golf course. >> reporter: mcilroy won the british open in july joining jack nicklas and tiger woods as the only golfers of the modern era to win three majors by the age of 25. his rising star has drawn an endorsement with omega and nike worth reportedly $10 million a year. phil mickelson finished second may have summed it up best saying mcilroy is simply better than everyone else right now.

we begin this half hour with the terrible case in georgia we have been following. the mother of a toddler who died inside a hot suv is breaking her silence. and her attorney believes prosecutors view his client more as a victim than a potential suspect. nears nbc's gabe gutierrez with the latest. >> reporter: leanna harris says she lives a tortured existence. the death of my son is still unreal, she writes. not a moment goes by that i don't think about it. or what our future would have held. her comments in victim pact forms. it suggests she's not a suspect in her son's death. >> she's a victim of a crime. it indicates to me that they're looking at her in that regard. >> reporter: her husband ross harris was charged with murder in june after police say he intentionally left his 22-month-old son cooper to die inside a scorching suv, the same day he was sexting with multiple women. he's pleaded not guilty, saying he accidentally forgot to drop cooper off at day care, his wife

dylan is in for al. >> a gorgeous day in new york yesterday. look at what happened in brooklyn. this is a baseball field where a dust devil was spun up here. the heat warms the ground and the air starts going and you get these dust devils. this happened in the middle of the field. it was surrounded by people, actually. but certainly a wild sight in brooklyn yesterday. we're see nice weather in the northeast today. on the flip side, in the northwest we are talking about near-record-breaking heat. we have this area of high pressure and control, this huge ridge in the jet stream. that is going to keep the heat going at least for one more day. look at the record in seattle is 95 degrees. we'll be up around 93 today. portland, oregon, the record is 102. should be near 100 today. really close to the record high temperatures. we could use this cold front to cool things down a little bit and eventually by tuesday, we're looking at seattle to drop to about 84 degrees and 87 in portland. so some relief once the

back now at 7:39 with tracy mo morgan's recovery. we're going to talk to his attorney exclusively in a moment. but first a little more on the crash and the lawsuit that is triggered. the legal fallout is heating up. morgan was seen publicly last month for the first time since the accident. getting around we the help of a rocker. the "30 rock" star gave the peace sign and thanked everyone for their support. he suffered a broken leg, ribs, and nose from the crash that killed fellow comedian james mcnair and injured several others. at 1:00 in the morning of june 7th, the limo van was struck from behind from a walmart

tractor-trailer. its driver kevin roper was going 20 miles above the speed limit. >> there is a terrible accident. the car flipped. it's on its side. >> reporter: a lawsuit filed last month alleges that wal smart should have known that roeper was awake for more than 20 consecutive hours at the time of the crash. the retail giant called the accident, quote, a terrible tragedy. and said in part, we are cooperating fully with the ongoing investigation and working to resolve all of the remaining issues as a result of the accident. tracy morgan's attorney benedict mo morelli is here with us. i want to get your word on the statement, but first how is he doing physically and emotionally? i'm used to seeing him laughing. he's got to be going through a tough time. >> he's still struggling, but

he's a fighter. he's had issues before that he's fought through and he's fighting hard. the interesting thing is that at the beginning the internet was saying that he was dead. >> right. and he'd lost a leg. all kinds of false reports. >> that they amputated his leg. now it's out that he's doing great. none of that is true or accurate. >> when i first heard this, my thought was tragic accident. we have a driver here, he's been charged with vehicular homicide, the death of mr. mcnair, and assault by auto for the injuries sustained by tracy and the other passengers. why do you think it was something more than a tragic accident? >> well, you have to understand what happens here. mr. roeper, kevin roper, the driver, 35-year-old guy, he was in jonesboro, georgia. he drove 750 miles to pick up the truck in delaware. and so he was up for

approximately 25 hours when the accident happened. >> and should walmart, the company he was driving for have known that? could they have known that? i mean, they have issued their investigation saying that he drove that truck for nine hours and 37 minutes, below the legal limit of 11 hours and his entire shift was 13 and a half hours, below the 14 hours legal limit. >> he wasn't finished working when he had the accident. he was already driving 13 hours and 22 minutes. he was only 30 minutes out of bristol, pennsylvania. so he would have wound up working more than 14 hours to begin with. >> is that kevin roper's responsibility? isn't it his responsibility? why is it walmart's responsibility? >> because he worked for walmart. and i'm going to show if i have to in court, that's the culture, that's what they set up.

they know -- and by the way, he isn't the only driver who drives hundreds of miles to get to work. they have to make sure that this doesn't happen. one of the reasons why the ntsb is doing such an extensive investigation here is because there are 75 deaths a day from big rigs. it's been increasing. that statistic is from 2012. >> here is walmart's statement. they say they're committing fully with the investigation. they apologize one of their trucks was involved and said if it's determined it caused the accident, they will take full responsibility. is there a chance this can get settled before a court of law? >> that's up to them. i haven't seen any full responsibility yet. i not only represent tracy buzz his assistant and audi fuqua

the police cruiser. there was a struggle for the officer's gun. a shot went off inside the cruiser. didn't hit anybody. then the struggle spilled out on to the street, the police say, and that's where brown was shot multiple times, but in this community there is a lot of skepticism and anger over that police story that resulted in this. >> john yang in ferguson, missouri, thank you. officials in upstate new york are examining video of a deadly racetrack cash involving nascar champion tony stewart. his car struck and killed 20-year-old driver kevin ward jr. who had crashed his own car and then stepped on the track. the sheriff says there is no evidence to suggest it's anything but a tragic accident. stewart pulled out of sunday's nascar race saying, quote, there are no words to describe the sadness i feel. evidence this morning that u.s. air strikes in iraq are putting pressure on isis islamic militants. thousands of thirsty and hungry

appropriate. but just unbelievable. i lived out every childhood fantasy at that point. >> we look forward to seeing you in action later. let's talk about some news. >> this is horrible story. this weekend. such a sad story. there was the deadly sprint car crash over the weekend in upstate new york involving nascar champion tony stewart. his car struck kevin ward jr. who stepped out of his own car after they had been in a bit of a crash together. it looked like he was headed to confront stewart. the video on youtube shows the two cars there colliding. and the one spins out while the other was driven by stewart and keeps on going. so as he gets out of the car and you see it's a little in the dark. he walks towards the car. and we're not showing you everything, okf course. but you see the moment where stewart's car the back wheel apparently hit ward.

horrific. you could imagine for the people watching this live. horrible moment. he was sadly pronounced dead at the hospital. just 20 years old. had his whole life ahead of him. the sheriff right now is saying there's no evidence of criminal intent. they were going about 35 miles per hour at the time of the accident. >> they were under caution after that spinout. gosh, your heart breaks for a young man to die that way and for his family. you know, i think that you have these confrontations in nascar sometimes after a wreck. but it's not usually on the track. >> and there are cars speeding by and racing by. >> to step out on the track is a dangerous thing. tony stewart is known as a hot head on the nascar circuit. he's done stuff like this behind the scenes where you're not necessarily in traffic's way. >> we should say he put out a statement which in part reads it's an emotional time for all involved. my thoughts and prayers are with his family, friends, and

graduation. >> thank you. >> been a long couple years. >> really exciting to get there. it's just been such a wild ride. a lot of struggles along the way. a lot of tests where i had to miss them when i was in the hospital. but i did it. >> not just graduated, but a number we've never heard before, 4.0. take us back. you got to college, you're excited to be away in gainesville. just a month in you get this diagnosis. that must have hit you so hard. >> it was really hard. leaving gainesville from the university of florida, i broke down in tears on the way home. i just thought i was giving up on the whole college experience, losing out on that. and, you know, moving the home i really found there were other things i could go and do at home and experience such wonderful things because the community stepped up for me. >> well, then you relapsed unfortunately thereafter. and you sort of continued on this journey of getting better for a bit and then relapsing. how do you remain so positive?

>> you have to be positive. if you give up on what your dreams are and your aspirations, i had to have goals and keep pushing for the graduation and things i wanted to do before i was diagnosed. because without that, you aren't living. >> how did you do it, todd? academically. college is hard enough as it is. you're going through treatments and not feeling good a lot of the time. how do you study and then axel the way you did? >> there were a lot of times i wanted to give up. but it was important for me to graduate and walk across the stage. i had the support of gator nation, my professors, my wife mya, my family. so many people encouraging me along the way. it was just a crazy ride. i got through it. and fortunately the classes that i struggled through, the tough

time, it worked out. >> speaking of the support and mya being with you through it all. you have been there with him through so much. you knew going into this relationship what it was going to entail and a lot of him being sick. and you yourself are a cancer researcher, is that right? >> yes. i work at mayo in florida. and todd really inspired me to do that. he was a big motivation and inspiration. because there's so many patients out there that are so resistant to these treatments like todd. and we work every day to try to break that resistance down and get them the treatment they need. >> you only married fairly recently, but you've known each other since freshman year in high school. you've had a deep friendship. has it meant to have her by your side in all this? >> she's the most caring and compassionate woman. i knew this was who i was meant to be with. she was there through everything. we got engaged and immediately

were thrown into a couple weeks in the hospital. some of those really hard times. i knew this is a woman that would take care of me through that. we had to get married. >> tell us about your foundation live for today. >> live for today foundation was kind of inspired by the things the community offered to do while i was in treatment. i got to go to a professional football game on the field. i got to learn to fly a small airplane, go fishing on tv. and when i was in treatment i realized there wasn't a lot of support out there for young adults. there was a lot for kids. there was a lot for breast cancer and specific cancers. but as someone in college starting their first job, there wasn't a lot out there for them. so we wanted to do wonderful things. i wanted to give back to 70,000 young adults that are diagnosed with cancer every year. >> we're so impressed by what you're doing. live for today foundation, we wanted to donate a bit ourselves. we want to give you a thousand dollar check. hopefully that helps out a bit. you can continue the great work. >> thank you so much. >> thank you.

a very good monday morning to you. it's 9:26. i'm laura garcia-cannon. a neighborhood is being evacuated because of a gas leak near hacienda and virginia avenue. just a few blocks away from winchester boulevard. no word yet on what damaged the gas main but police are telling people to stay out of that area. san jose police are investigating the deaths of three people over the weekend. bodies of two women were found at the easy 8 motel on northwest first street. there were no immediate signs of foul play but the bodies have likely been there for several days. the women checked in last week and a do not disturb sign has been hanging since then. the third death took place

on saturday. a man was stabbed by his stepson. and a bay area woman who stowed away on a flight will be in court again today. she was arrested for sneaking on to a southwest airlines flight from san jose. days later, she was arrested again when she returned to l.a.x., against the judge's order. homelessness and mental illness has caused her to keep trying to board flights.
