year including one district that's trying to crack down on cell phone use. and on shore flow means a cooler than average start to your workweek. but all good things must come to an end. that subtropical moisture lurking at the end of your forecast. we'll talk about it in just moments. and the beginning to your workweek means a beginning to the commute. plus the school coming back in means more folks on the road. slow down showing up already. and no lurking here, just a beautiful, iconic bay bridge in the early morning hours, live look right now in san francisco. it is monday, august 18th. and this is "today in the bay." from nbc bay area, this is "today in the bay." good monday morning, thanks so much for joining once i'm sam brock. >> and i'm laura garcia-cannon. new details about this morning stemming from a major crash in san jose last night involving eight different cars. the fire department tweeted out these pictures of the crash that

injured ten people. it happened on east capitol expressway around 9:30 last night. "today in the bay's" stephanie chuang joins us live from the scene this morning. stephanie, do you know if alcohol played any role in this crash? >> reporter: hey good morning, laura. we do know that police say the preliminary investigation shows that alcohol and speed were a factors in this crash. you can see almost eight hours later, and this intersection, capitol expressway still closed and at the heart of this police say was a black mercedes you see in the distance. it's getting ready to be towed away. san jose police officer in the area saw the driver of that mercedes speeding eastbound on o'colla. it was running a red light here. broadsided another vehicle. the mercedes rolled over several times hitting several other cars and a light stopping in the middle of a lane on o'colla.

the driver got out and started to run. officers did catch that person. meanwhile, three people were trapped inside the mercedes as it started to go up in flames. check out the images posted on the san jose fire department twitter. firefighters were able to put out the fire and extra date the three passengers. you can see that mercedes completely crumbled, the rear is in the air, most badly burned. it was a two alarm fire. we spoke with a witness by phone who described the moments right before the crash. >> as soon as i noticed on my rvmd there was a car coming really fast, which i knew that if i kept making the right, he was going to take me out. so i moved over. he squeezed in between my car and the pole, and that's when i noticed that he had plowed through everybody that was crossing the intersection. >> reporter: paramedics took all four people in the mercedes to local hospitals where they were being treated for life threatening injuries.

there were six other victims also taken to local hospitals treated for various injuries. again back here live, you're looking at the scene. there are still several cars on the other side of capitol expressway. what we understand is police have been allowing investigators to take a look at all the evidence when they are done with each vehicle. that's when the tow trucks come and take them out of this area. again, alcohol factors so far police say factors into this crash. ten people hurt. eight vehicles involved. this still blocked off. we're not sure when it'll be back open. we'll have more on "today in the bay." live in east san jose, stephanie chuang, "today in the bay." >> thank you, stephanie. we are inching towards the fall. summer vacation has officially come to an end for many children in the bay area, sorry to pass that news along. live look right now this morning. oak grove in san jose, san francisco unified, and berkeley city cleveland, all of them headed back to class this morning. that's just some of the 17 k-12 schools and 11 colleges that

will be returning today. >> big back to school happening in the south bay. bob redell live in san jose where thousands of kids are backing up the backpacks and heading to class, good morning, bob. >> reporter: good morning, laura and sam. one of the largest groups of students to be going back to school in the bay area at once. they're right here in the south bay. we're talking about roughly 270,000 students for more than 30 school districts who will be saying good-bye to summer breaks just just a few hours to ring in a new school year. those fall under the santa clara county office of education which provides them the oversight and services and the person in charge of that office is john grundy. now i bring this up because he is the fourth superintendent in recent years at office, the county board pushed out the previous three soups after relatively short terms. he started just a couple weeks ago. it's a fullbright psychological already, english and spanish. served of superintendent at the

pasadena unified school district. we'll talk live coming up within the next half hour to get a sense of what he thinks the challenges are facing him as he takes on this very big job again back to school for the santa clara county office of education starting in just a few hours. reporting live here in san jose, bob redell, "today in the bay." >> thank you, bob. adjustment for students in palo alto, putting their phones on vibrate, that is not going to cut it anymore. the palo alto unified school district is instituting a new policy this year. that requires students to turn their phones completely off and put them away before students could use their phones in class. so long as they weren't being disruptive or cheating. the changes aren't in response to any particular event, but earl whier this year, palo alto high school had to invalidate the results of more than 100 tests after finding out that students cheated by sending each other text messages. >> sign of the times. let's get the back to school

forecast right now, we're happy that christina loren is finally back from a well deserved vacation and big wedding as well. >> big wedding, but bigger days for those of you who have little ones. back to school. back to school. >> first day of kindergarten. >> wow. >> on thursday. >> it's going to be really nice, especially for kids headed out today. and the fall wardrobe, typically short sleeves and longer sleeve items. today you can go for either or. it's not going to be too hot. and in the city by the bay, san francisco only touching on the mid-60s. that's where you can water long sleeved shirts and pants. break out the short sleeves and the shorts today in the south bay. this is what we're working with. as they head out for lunch. 71 degrees today at noon, that's room temperature at lunchtime. that's really comfortable. then we'll finish off the day as they finish off school between 2:00 and 3:00, upper 70s. not a bad day whatsoever. then evening this evening as you start in on your first night of homework, that's right, that's

overnight in ferguson, missouri, by protesters firing off guns and lobbing homemade bombs at police. jay nixon brought in the national guard to help state patrolman fire back at protesters shooting cans of tear gas and smoke grenades in the crowds of people who refuse to leave. dozens were caught on camera looting a convenience store as you see right here. and at least seven others were arrested. police say the night took a bad turn when protesters started to overrun a command post. but the protesters say they were demonstrating peacefully against the police shooting that killed 18-year-old michael brown. preliminary private autopsy reported by the new york city found that brown was shot at least six times, including twice in his head. the sonoma county deputy who shot 13-year-old andy lopez will be back on work this week. he hasn't said which day. deputy shot and killed him last

october. the district attorney decided not to file charges. he was carrying a replica rifle in the park when deputies shot him. the prosecutor believes the deputy honestly believed the gun was a real assault rifle. saddens news from san francisco, the bay area family of a develop-year-old hit and run victim is asking for help to find the driver. he was is in a crosswalk with a family member on mission street between fourth and fifth streets in san francisco friday night. that is when a car struck the tolder and didn't stop. last night, family and friends held a vigil for the little girl. handed out fliers on information to the accident hoping to bring the driver to justice. >> they just came from seeing teenage mutant ninja turtles with a relative and her twin brother who is also two and a car went through the crosswalk and killed her on impact. >> the san francisco police trying to hunt down the person responsible. they released a surveillance photo of the car they believe to

be involved here. it's a white mid-90s four dor sedan. the car was either a camry, honda, or lexuss with a dark colored mismatched front bumper and dark rims. banking executive accused of posing an tsa agent will not be charged with any crime. 53-year-old eric slighten was set to be arraigned this morning, but the da's office will not prosecute him. deputies arrested him last month after he was caught in the international terminal. authorities were also investigating claims that he patted down a woman in a private screening area. according to investigators, the victims have not stepped forward or have been identified. 5:10 right now on your monday morning, let's look at the commute right now with mike. >> good morning, good morning sam, laura. 580, picking up the volume a bit. still going close through the speed limit. we'll show you the tri-valley commute on the maps. speed sensors. showing slowing here out of the altamont pass.

there's the orange zone. around 45 miles per hour this time of day. smoother drive into livermore. you're at speed down to the sunol area. now northbound shows a little bit of slowing, that's a few more cars hitting the roadway. no incidents reported, but no problems for the tri-valley, predictable. same thing for the south bay, we have construction road crews still going on here, 880 around steven's creek and the remaining crew will stick around far half hour or so. also where stephanie was reporting. capitol expressway, o'colla. the middle school last week saw it, there was still activity, avoid the intersection if you can. you'll be rerouted a couple blocks. watch for that as well. rest of the bay looking good. speed throughout the areas approaching san francisco. either side of the bay moving nicely up towards the bay bridge which experiences no delays. no delays for the agencies either. none reported and quick look at the north bay. southbound 101 no delays for the north bay through san rafael, back to you. >> thank you, mike. so-called hot cop of san

to school forecast coming up in a few minutes. it is 5:15, east palo alto police are continuing the investigation of deadly overnight shootings. happened after 11:30 last night on hunter street near perdue in east palo alto. lucero benitez joins us live in east palo alto this morning, police are still looking for that shooter? >> reporter: that's right. good morning, police are still looking for that shooter. and this morning detectives are still out here at the shooting scene on hunter street in east palo alto. they're trying to gather more information and details about this fatal shooting that left one person dead just before midnight. total of four people were shot last night while sitting in a toyota camry on hunter street. one of them an 18-year-old male was pronounced dead at the scene. three others are still in the hospital. and actually right now, that car is being taken away from the streets. police tell us the four victims, two males, and two females who

were tweern the ages of 18 and 20 were sitting inside that car when someone pulled up and began shooting at them. the sergeant jeff blue also told us they're still questioning people here in the area trying to gather more information. they've gone door to door trying to get any witnesses who may have heard or seen anything to cooperate with them and help them determine the cause of the shooting and also any suspects. although the victims have not been identified yet, like i mentioned, police tell us that the victim who did die was an 18-year-old male, three others are still in the hospital with severe injuries and police are asking anyone who may have heard or seen anything last night to call the detectives as soon as possible and remember that they can remain anonymous. live in east palo alto, "today in the bay." >> thank you so much, lucero. this morning target is making a major change that store managers hope will help boost

its bottom line. hampton pierson joins us live at cnbc washington bureau with a look at that story plus your market headlines, good morning. >> reporter: hey, sam, yeah, futures are higher as the markets are coming off a second straight week of gains. led by tech and transport stocks, oil prices closed down for the fourth straight week. and they're trading below $97 a barrel this morning. we do get data later today on housing and reports later this week on housing starts, existing home sales and consumer prices. as well as the mibs from the last federal reserve meeting and key speech by janet yellen on friday. dow losing 50 points, at nasdaq up 11 to close at 4464. target is going to be keeping a lights on later at many of its stores. hoping to snag customers who put off shopping until well after dark. target is typically open from 8:00 a.m. to 10:00. reports say stores will say open

70 on the east shore, 83 degrees in the north bay. weather headlines tell the story. what you can expect for the next few days, on shore flow firmly in place through wednesday. then as we head throughout thursday into friday. temperatures will creep up label the, in addition to that, we can see that monsoonal moisture surge back in. it'll be humid starting thursday and ramping up throughout your saturday. but your five day forecast for san francisco, and san jose really tells the story. temperatures staying put, no extremes. looking at good air quality for today. not sparing the air likely through wednesday, and then we'll bring in that monsoonal moisture towards the end of the week. as promised, here's mike inouye. >> i like the temperatures, the humidity, all right, we'll see about that, christina. we'll reserve judgment. slowing here and the low clouds not really a problem as far as the view of the roadway lighting. and that's good news. can't see the tops of the towers, they're hovering around. north of the golden gate bridge, smooth drive as well for highway 101 along the coast. don't have as much fog as we do

last week. we watched for the low clouds to continue developing. over here, the approach to the bay bridge is moving smoothly. christina showed you this as well. i want to show you again. this is our view of the bay bridge from emeryville across the span and low clouds have sunk down. you can't see the tower lights. the san francisco side of the treasure island area. smooth drive nonetheless on the span itself. and no backup at the toll plaza. back out to a live shot, smooth drive as well. by comparison, you can make out the high-rise clearly. this sign over here, there is that closure for northbound 280 from 101 up to at&t park. the end of next week we'll warn you about that again. fremont southbound 880 moving smoothly past the truck scales here. easy flow of traffic. more company into and out of south bay, no delays, back to you. >> in case you don't have mike inouye guiding you, you might be familiar with the parking crunch in palo alto. city council members will try to

fashion a solution to the issues in downtown palo alto. they'll be discussing programs that would help people find available parking spots in garages located downtown. one is called a parking guidance system that will include putting digital signs outside of parking garages that will inform drivers how many spots are available. sounds pretty useful. another idea would let drivers park longer than the current three hour limit. the two programs would cost the city by estimates, about $2 million. it's 5:23, the girl that's turning heads that the year's little league world series, coming up. >> she's a nasty curve ball. that's just a hint there. place live look right now at the bay bridge toll plaza. looking good for the time being. we'll continue to keep an eye on things and your back to school forecast and commute. here's a special welcome back though to the chargers of wilcox high school.

you're watching "today in the bay." how about a live look this morning at at&t park. the giants off traveling to chicago. the g-men about to start a three game set with the cubs that begins tomorrow. on the other side of town, the a's will try and right the ship and get things going. the team lost to the braves 4-3 yesterday. that makes it five losses in a row. a's trickled back down, tied with the angels for the top spot in the al west division. a's will play host to the mets tomorrow night. 13-year-old girl is taking the little league world series by storm. >> i'd say, her and her philadelphia team continue to astound the team's pulled off a comeback victory last night thanks in part to a single by monet. she is just the sixth girl to ever hit a little league world series game. hit in one. she can also pitch.

stemming from a major crash in san jose last night involving eight different cars. the fire department tweeted out these pictures of the crash that injured ten people. it happened on east capitol expressway around 9:30 last night. "today in the bay's" stephanie chuang joins us live from the scene this morning. and stephanie, we understand one of the drivers actually tried to leave the scene? >> reporter: that's right, good morning, laura. we're told by polices that he tried to run away, but he was caught quickly. we also just spoke with a man who was involved in the crash. and he's okay, but eight hours later, he's still here waiting for his car which is on the other side of capitol expressway. you can see that there are some tow trucks still out here taking away just the last couple of remaining cars here. the driver was heading eastbound which is the direction you're looking at on o'colla. he took out a traffic light here before hitting some of the cars. and public works authority put

up a new one. investigators have been collecting evidence out here. towing away the vehicles after. including the mercedes that just left. police say started this whole thing, saying that an officer in the area around 9:30 last night started the drivers speeding, run the red, broadside one vehicle, rolling over hitting several cars as well as the traffic. some cars then hit others. now police say the driver, a man in his 20s we've learned actually got out of the mercedes, tried to run, but he was caught. meantime, three people were trapped inside the mercedes or inside one person was trapped in that car as it started to go up in flames. he spoke with a witness who described the chaos right after the crash. >> i noticed a lot of cars that were hit and pushed on that way, and a car burst into flames and there was just too much going on to focus on every detail, but it was just, cars up in flames. >> reporter: now some, the san jose fire department was saying that seven balances in one air

balance responded, paramedics took four people and a mercedes to local hospitals where police say the three passengers are still in bad shape, but the latest is that they are expected to survive. good news there. there were six other victims taken to local hospitals, treated for variety of injuries from broken bones down to just complaints of pain. back here live again, you can see the scene is clearing up. we do see some people on the other side working to clean up the debris, and that is really when this intersection will be back open, police say they hope it will be back open an hour before the capitol expressway heavily used. we've also learned that the driver again, male in his 20s, has been treated and released from the hospital and is set to be charged with felony dui. so yes, police from the preliminary investigation believe that both speed and alcohol were factors in this crash. we'll keep you posted throughout the show this morning. live in east san jose, stephanie chuang, "today in the bay." >> thank you very much, stephanie. 5:33, we are breaking news to tell you about with a live

look at oakland this morning. you see the glow at the center of the screen. that is a fire. fire crews are on the scene of a three alarm warehouse fire. these are flames that you can see from our traffic camera. you can actually see the water they're trying to pour on it. it is happening in a warehouse near the intersection of san leandro and stone streets. that's just blocks from the 98th avenue exit of interstate 880. we are in contact with the oakland fire department, we'll of course get you the very latest details as soon as we get them. lawyers for pge will be back in the courtroom this morning answering to charges stemming from the deadly san bruno pipeline explosion. the explosion of course killed eight people and injured 66 others. several years ago. it destroyed an entire neighborhood in san bruno. now last month. a grand jury issued an indictment against pge accusing it of 27 charges including willingfully violating the pipeline's safety act and obstructing the investigation into that explosion. state senator jerry hill whose

district does law in san bruno says one of the key issues moving forward will be the close relationship between the cpuc which oversees pge and the utility itself. >> it's clear that we have to see the u.s. attorney making some actions and headway, and that's what they're doing. and i think more importantly, in the long run, is that we need an independent monitor. someone in san bruno has been the city of san bruno has been asking for this for more years now, but we need someone independent, other than the public utility's commission. >> and when asked for comment, pge referred us back to an earlier statement which reads in part, we still do not believe that pge employees intentionally violated the federal pipeline safety. 5:35, happening today, live look at san jose this morning. families all over the bay area waking up a little earlier, getting ready to return to class. headed back to school, 11 different community colleges

including city college in san francisco, college still fighting to maintain its accreditation. issue sternally weighing on student's minds this morning. also 17 different school districts returning to class this morning. among them, campbell union in the south bay and san francisco unified. maybe apropos, let's go to a dad for perspective on this. "today in the bay's" bob redell is live in san jose where a majority of the students will be headed back to class, right? >> reporter: i have children? forgot. yeah, good morning to you there sam and laura. talking about one of the largest chunks of kids going back to school. starting today and throughout the week here in the south bay around 270,000 students. 31 districts, and they all fall under the santa clara county office of education. and the new man in charge is the new suspect, excuse me, john gundry, congratulations on the new job. >> thank you. >> reporter: number one challenge? >> the number one challenge facing all of us shh funding for

public education. california is well known these days for underfunding its schools, and even though we're doing better after the passage of prop 30 and under the governor's new local control budget, we're in a better situation. but all that did was avert disaster, didn't give us the funding we need to provide the best we can for the kids here. >> reporter: schools are on the second year of the implement takes of common corps. there were controversy on that. sop people don't agree, your naughts? >> i think generally common core is taking us in the right direction because it's forcing us to move away from the stand and deliver type of teaching and learning in classrooms and do more hands on, integrated type of learning that's more connected to the real world. so, the real challenge will be how it's assessed. we really don't know what common core assessment is going to look like and the assessment will drive our practice in classroom naps remains to be seen, but in general, i'm very optimistic about where we're going with common core.

yet another night of unrest in ferguson, missouri. there was more looting overnight in that st. louis suburb. police now using smoke grenades and tear gas to disperse protesters angry over the new details just released about the deadly shooting of an unarmed teen of a local police officer. this morning the governor is sending troops to the area to try and quell that violence. "today in the bay's" jay gray joins us in ferguson with the overnight developments. jay, there have been many. >> reporter: yeah, there has. a lot's changed here. and the latest happening right now. an alderman reporting that the national guardsmen ordered in by the governor have arrived in st. louis city. i'm reading this, it's just happening now. there's about 80 members will help with the police and protect the police command center here in ferguson.

that's where a lot of the violence unfolded here last night. and the first time its been involved in the violence here. what officers are saying is that two molotov cocktails were lobbed at officers in the area of the police command center. again, we haven't seen the violence reach this far into this area. this has been really a clean zone if you will. officers rushed back in, armored vehicles as well. they were dressed in tactical gear. also dressed in riot gear. they lock the down this area, waited and looked for who may be involved here, but made sure that no one could get through. they were wearing that riot gear, dressed in gas masks. the area filled with tear gas. i can attest to that. when it was all said and done, what police are saying is they found eight people with weapons in the crowd. two, maybe three people injured by gunfire. they say officers not involved in that. four businesses that were damaged and looted. one other quick note, as all
