bay police department, there is a loophole that some say invades their privacy. less than a week after a major earthquake, the napa valley wine region says it will be open for business this busy holiday weekend, that story coming up. a lot of people headed up there for the holiday weekend. a lot of people staying local. and if you are going to do so, i have to tell you, it's going to be hot and a little bit humid. we might even get a shower or two over the course of your holiday. looking warm for labor day. i've got toe tell you though, things are going to be different. your weather pat certain changing today. we'll give you the details in just moments. and a predictable difference on the golden gate bridge, they're moving the cones. i just heard about a crash over on the other side of the bay. we'll talk about in albany, coming up next. and a live look outside this morning, it is hazy indeed, but it is also friday. it's august 29th, and this is "today in the bay."

from nbc bay area, this is "today in the bay." good morning, thanks for joining us, i'm kris sanchez in for laura garcia-cannon. >> and i'm scott mcgrew. new video in into our newsroom of an 80 acre brush fire that's been burning all night. fire crews only have about half of it contained. a lot of work ahead for them. this is on 152 near casa de pz fruita. lanes have been reopened, it's slow though, fire officials believe this started after a car crash. it's burning on both sides of 152 east of gilroy. so far no injuries or damages have been reported. south play police department is placing new restrictions on thousand uses information it gets from license plate readers. "today in the bay's" damian trajila joins us live, and damian, there is growing concern on how that data from the users is going to be used and how long they get to keep it, good

morning. >> reporter: yeah, good morning. they come up with new protocols here. you know a lot of police departments in the bay area have been using this technology, has been using it for several years now. it is not without controversy. the patrol car cruises through a neighborhood and the system reads the license plate of every car it encounters. that allows them to detect any stolen cars or maybe vehicles used in crimes. officers says it saves time in calling dispatch for one suspicious license plate. it allows them to get immediate hits on suspicious vehicles. now here in losgatots it'll be stored for one year. in a. recent report, the chief told the city, he plans to store the information indefinitely for crime fighting purposes. the dispatch newspaper here reports in the last fiscal year, the readers scanned almost 136,000 plates of those only 68

got hits for suspicious vehicles. again, this has drawn the ire of many civil rights groups saying this is an invasion of privacy. but the police departments say this is a great crime fighting tool. we're live in the area, nbc bay area news. >> thank you. the san jose police department is getting rid of its new 15 ton armored vehicle following backlash from the protests in ferguson, missouri. the vehicle is similar to the one you see here. this is in fact used by the redwood city police department. critics including president obama say local police departments are becoming too military rised. san jose police were facing criticism for the recent secret drone purchase deciding that keeping the vehicle wasn't worth further damage to the image. the armored vehicles sparked a national debate in recent weeks. application in ferguson used them to control crowds who were of course upset over the shooting death of an unarmed

man. turning now to the south napa earthquake. it has been nearly a week sijs the earthquake hit, but new damage keeps showing up. one napa family spent the night at a red cross shelter because their home was red tagged just yesterday. firefighters say someone who lived there tried to go inside last night and the house shifted enough to jam the door. the resident was not hurt, but firefighters had to get him out through a window. another napa neighborhood will be without water for several days while crews work to repair new sink hole that opened up four days after the quake. it's about two miles from napa's historic downtown. the sink hole was most likely triggered by a water main break just like the other sink holes that have opened up. small businesses are hoping for a successful labor day weekend. not everything is back to normal. retailers do hope last sunday's earthquake won't put a damper on one of the last holiday weekends of the summer season. bob redell live in napa with more, good morning, bob.

>> reporter: good morning, a restoration company has been working around the clock trying to get this property reopened in time for this weekend. the issue is water damage during sunday's shaker. the sprinklers on the third floor burst and it flooded down from there. so there's a lot of work to be done. i just spoke with the property, they do plan to be open in time for check in later today. we only know of two other hotels that are still shut down. that's located downtown, we saw that getting yellow tagged earlier this week and the napa marriott hotel a spa. napa tourism office telling us 98% of the hotels are up and running. same goo goes for 95% of restaurants and wineries. including the st.'s berry winery when which lost a few hundred bottles during sunday's 6.0. it was one of the most heavily damaged wineries in the region.

. spite of that, the winery tells us that tomorrow, sunday, and monday are looking to be very busy. they know this because they're tastings are down by appointment. they think they've done such a good job of cleaning up that people who swing by there this wleekd have no idea that there was an earthquake less than a week ago. >> on friday will be our first pitch. at 7:00 in the morning, our grapes will i arrive here so people visiting us in the morning around 10:00, 11:00, 12:00 will get to see the sorting table and our first wines coming in. >> reporter: you might recall earlier in the week that the napa valley wine strain, popular attraction was shut down for concern over damage to the tracks. but that attraction has since reopened. again the message coming from the tourism office here in napa. in spite of what happened, this past sunday which was obviously awful, they are back up and running.

generally speaking for business. especially for this very busy labor holiday weekend. reporting live here in napa, bob redell, "today in the bay." >> shaken, but not stirred, thank you much. coverage continues on the website. enter south napa earthquake in the search box there. that's the easiest way to see the stories at nbcbayarea.com. police are requesting a psych loblg call evaluation for the bay area woman whose been arrested several times sneaking on to flights. last night she gave an interview from a jail in phoenix where she was arrested earlier this week. police took her into custody after she was found loitering near baggage claims. in the interview, she says she knows what she's doing is wrong and wanted to get arrested. >> why has the government allowed me to get past security points until i force the issue back in february and pretty much had to beg to be arrested. >> earlier this month, she was able to fly from san jose to l.a. without a boarding pass. east bay teen has been

indict grand jury for shooting a laser at a pilot in oakland. the incident happened in june, but 18-year-old christian palamino was indicted on federal charges just yesterday. it was helping police looking for a suspect when the pilot says he was hit by a laser beam at least seven times. which police found the boy, he had a laser pointer in his pocket. menlo park is taking immediate action to the state's new water restrictions. the city calls for residents to cut back water use by 30%. which is 10% more than what the state is asking. many residents say it's too drastic. city officials say the state was forcing the city quickly make up their own water ordnance which hasn't been updated since the 1990s. it'll affect more than 16,000 people. >> whether it's 20% or 30%, the message to the residents is this is serious. >> city officials say they had

no choice but to implement that plan. they are working again on lowering the requirement. meanwhile, they are promising to educate residents on reduction before they fine them. meteorologist christina loren, i think i heard you say rain reason not enough to solve the drought. >> probably not enough to get the paimt wet, but yeah, we have a slight chance for the subtropical shower in the forecast, and speaking of showers, and our conservation efforts when it comes to the drought. just a three minute reduction from your shower time can make a big difference saving up to nine gallons of water. sop i can tell you right now, that is the best way to help us out when it comes to this drought. and as you know, we're about a month away from our statistical rainfall typically by about september 30th. we get a half inch of rain up in the north bay. hopefully that'll be the case. and as you know, there's no such thing as normal here in the bay area. 61 degrees in san francisco right now. speaking of unusual patterns,

take a look at this the. we can now vividly see the subtropical moisture surging into the bay area. and this is all coming up from the rim innocents of what was once -- remanents of what was once hurricane marie. it's losing that energy quickly. so you can see that surging into the bay area. as we head throughout the day today, we're going to get couple of light showers on the western facing slope surrounding sab jose and better chance throughout saturday. 72 san francisco, 87 in the north bay, and right around 79 degrees on the peninsula. let's take a look at your drive, here's mike inouye. >> good morning, christina. crash on the east shore freeway. everybody's alert goes off in their head. the merge at golden gate field. we have a crash blocking one of your left lanes. stay over to the right. we see a little bit of slowing on the approach. crew should be heading everyone there. there's a big rig involved. crews are still arriving there. this could be a problem out of

richmond in towards albany and berkeley. we'll track that for the east shore freeway. bay bridge is not a problem getting into san francisco, but san francisco is an issue northbound 280 is closed. let me show you the video from the chopper from yesterday. it closed yesterday at 2 pvm. they're busting through this roadway. they're taking out two large sections of roadway and replacing the equipment there. the hinges inside the area, and also adding padding for comfort note. look at that, all that work has to continue all weekend. that's why the northbound side of 280 is completely closed. back to the map, all weekend there, that's scheduled to reopen at 5:00 a.m. on tuesday or a little before. let's get back to the maps. overwhelm section, if you're heading to the giant's game tonight, take northbound 1011, get off at cesar chavez and over towards the ball park. or mass transit, we'll end with a live look at palo alto, smooth drive on 101, 101 in san francisco going to be crowded, back to you. >> thank you. it's 5:11, coming up, lawyer sues police in ferguson on behalf of five protesters who

good morning. >> reporter: good morning. we're talking about google first. its been testing drone deliveries in australia as part of a program calmed project wing. the drones can take off vertically and fly at speeds of 60 miles per hour. google made 30 successful flights so far delivering small items such as a first aid kit, water bottle, and candy bars. while use is likely years away, they see it being used to fly in supplies. and a majority of genx workers believe they'll need $30 million for retirement. so far, most only have about $70,000 in savings. more than 80 who were born between 1965 and 1978 are worried social security won't exist. and 85% think they'll have a harder time receiving financial security than their parents. the oldest group will turn 50 next year, back to you guys. >> thank you much. researchers in san diego say they have solved a mystery in

death valley. this one was cool. for decades, people wondered what causes these rocks on the racetrack to slither across the flat lake bed. in december, two scientists at the university of california san diego set up a weather station and gps monitoring on the playa. they moved when ice sheets form after rare overnight rains and melt in the early morning making it slippery enough for the rocks to move. >> that is so cool. and expand and contract as the ice goes away. hey, that's kind of cool. zbld should have put out banana peels. they would have moved right away. >> the mystery. let's check in where christina loren. >> good morning to you. happy friday. happy friday. i know. holiday weekend, it's the first vacation for a lot of kids who just got right back to school. 5:16 now. and it is the unofficial end of our summer time. which i think a lot of people are looking forward to because we want our rainy season.

like i just pointed out in the last report, statistically speaking, by september 30th, we typically average about a half inch of rainfall up in the north bay. so that's what we're hoping for. and right now, we're still getting the subtropical moisture out there, patterns then kind of whacky out there, kind of wonky over the last couple days. and today you're really going to feel that as that humidity surges up from the pacific ocean. and it's coming from the south, from the subtropical latitudes. so we have this warm, moist pattern with us all weekend long. and yeah, it's going to be kind of cloudy out there for today. that's going to be the biggest difference between yesterday and today. than additional moisture, those clouds translate to humidity. 85 degrees in the south bay. peninsula's at 79 degrees, and 75 degrees on the east shore, but also, those high and midlevel clouds, they paint an absolutely spectacular sunrise. and we're going to show you that this morning as you know, we have a network of cameras all across the bay area. this is what we're expecting, maybe you do to want go up to

east 580. the merge before you get to golden gate field. that's where we see flowing. as you're coming off the bridge, that's where we see slowing approaching the crash that's blocking one of your left lanes around buchanon. the rest of the freeway moving nicely. now on the other side of the bay bridge in san francisco. we have that closure for north 280 we keep telling you about it. as you're getting to the game tonight for at&t park. you will have to use 101 and city streets over there. this will be closed all weekend including tomorrow's game as quell. the city streets will be crowded because it is labor day and there lab lot of folks in the area. mass transit a is a good option. takes you into the area. south train right to at&t park if that's where you're going. and the vta system for the south bay as well as ac transit looking good all around the bay. no major delays and nothing else, aside from the big story for northbound 280 and the one we're watching on the east shore freeway, getting across the san

mateo bridge, smooth drive after an earlier issue eastbound was a red flag on the reports. no problems on the peninsula over to the east bay. again this sign lit up to tell you about the closure for 280. south bay moving nicely with northbound 101 through san jose. no problem, light volume predictable flow through here, but an finish you're heading to l.a. right now. keep in mind, eastbound 152 over to i-5, popular route, there's traffic control continuing because of the brush fires we told you about earlier. hope to clear all lanes later on in the day, but you can get through, back to you. >> thank you, mike. family of a california college student who died in a hazing incident issues a warning for parents. coming up, what they have to say and how they hope to get new information about the day their son died in the national forest.

welcome back, a misty day in oakland today. we're going to check your weather coming up in just a bit. five people who say they were roughed up by police during some of the protests in ferguson, missouri, are suing for $40 million. now this lawsuit was filed by an attorney late yesterday claiming police used excessive force, made false arrests, illegal search and seizures and violated civil rights in the protests that followed the shooting death of michael brown. but the person who filed the suit is not getting support from the southern poverty law center. it says that same lawyer actually incited violence. two months after the son died in a hazing incident at cal state north ridge. jose and betty have not learned a single thing about his death. in their first interview, the family say they are still angry and they feel they haven't gotten the full story. he was hiking in the angeles

national forest as part of a pledge for a fraternity. the group ran out of water and he passed out. other students flagged down a ranger for help, but via was already dead. that's all they know about the day their son died. >> all i know is that my son left monday evening, and not even within 24 hours i got a call, and my son was dead. >> after his death, via's found notes indicating he had been hazed. his parents are asking students to come forward and help them figure out what happened. meanwhile, they are urging everyone to talk toir to their kids about hazing. via's death is still under investigation. joan rivers remains hospitalized this morning in new york after going into cardiac arrest. the 81-year-old's daughter melissa released a statement this morning saying her mother is resting comfortably. she did not elaborate on river's condition. the comedian was rushed to mt. sinai hospital in new york city

"today in the bay." good morning to you, and happy friday, thanks for joining us, i'm scott mcgrew. >> and i'm kris sanchez in for laura garcia-cannon. controversial technology used by a police department is getting new restrictions. we are joined outside of police headquarters. there's growing concern about how long the data is stored and what police say it can be used for. >> reporter: yeah, it's pretty controversial. even though it is a controversial issue, many police departments across the bay area are already using this technology. but it has helped in recovering many stolen cars across california as well. so there is that. now here's how it works, the patrol car crews through a neighborhood and the system reads the license plate of every car it comes across. police say it allows them to detect any vehicles used in crimes and detect stolen cars. officers say it saves time in having to call dispatch for one particular suspicious license plate or having to manually

input each license plate individually into the computer on their cruisers. here in the area, the city initially said the information would be stored for only one year, but in a recent report on the protocols and use of that technology, the chief told the city, he plans to store the information indefinitely to help him fight crime. the dispatch newspaper here reports in the last fiscal year, the reader's scanned almost 136,000 plates, and of those, only 68 got hit for a suspicious license plate. again, a lot of controversy on this particular issue. especially since the chief says that he plans to keep this information stored for an indefinitely period of time. we're live in the city of altos. >> thank you. san jose police searching for clues after finding a woman's body inside a parked car at a church. a passer by reported that body. the victim pronounced dead at the scene.

police say the woman had been stabbed at least once. her identity has not been released. the body was found in grace church parking lot on aborn road. investigators are reviewing nearby surveillance cameras. this is san jose's 26th homicide of the year. another disturbing discovery, this time near morgan hill where someone dumped a burned body. the investigation had nearby roads closed for part of the day. now witnesses found that body on a remote road near the reservoir in unincorporated santa clara county. the body so was badly burn ld the medical examiner's office has not determined the gender of the victim. police say the rugged terrain makes it very difficult to search the area for evidence. and now to our continuing coverage of the south napa earthquake. its been nearly a week sijs the ground shook -- since the ground shook, as new damage comes to light, it's creating more frazled nerves. overnight, crews were on oak

street cutting off the gas service to this house which was just red tacked yesterday. firefighters say the man went inside and the house suddenly shifted from its foundation. and not far from this home, people are without water again this morning. this after water poured down the twin oaks drive yesterday. crews just finished repairing the main and the buckled street, now they're digging it all up again. crews are busy this morning getting some of the hotels and wineries this were damaged in the sunday's quake ready for the labor day weekend. small business owners want to make sure everyone in the bay area knows that napa is open for business. "today in the bay's" bob redell is already there this morning with why it's expected to be a busy weekend, good morning, bob. >> reporter: good morning, scott. and you're looking at the westinhotel just on the outskirts of downtown napa behind me. when the 6.0 struck on sunday,

unfortunately, it burst a the sprinkler system on the third floor of this hotel sending lots of water down to the following floors. so what they've had to deal with is a lot of water damage. and if you hear the noise behind me, that's the generators blowing air into the hotel. they have a restoration coming that's been out here working around the clock. the bottom line sit just got off the phone with the property, and they believe, and they hope that they will be reopened by today in time physiotherapy check-in. that's the spirit up here is to get things back um and running for this labor day holiday weekend. we did hear from the napa tourism office, they tell us that 98% of hotels are up and running. same goes for 95% of restaurants and wineries. including the herself collection winery, even though the tasting room is closed shut down because of a crack in the wall. they tell us they will be using the gallery instead for pourings that they will be open this weekend. the property lost the e give lachbt 15,000 -- equivalent of

15,000 cases of wine which poured down into the garden. >> the garden has become an attraction of itself, because people have seen the reports knowed that the wine flowed down to the garden. $4 million worth of wine, they're curious about that. >> reporter: so to recap, napa's tourism office says that 98% of hotels, 95% of restaurants and wineries will be reopen. the westin telling us they hope to be back open for check-in. there are two hotels that will not be reopened. those dates are to be determined as far as when they reopen. you might recall earlier this week, the napa valley wine train was shut down temporarily over concerns of damage to the tracks. possible damage to the tracks. well that attraction, very popular one mind you is back up and running as well. reporting live here in napa, bob redell, "today in the bay." >> rob, thank you much. today, napa county will

begin catching up on a backlog of calls from people in the community. the county says its received at least 600 phone calls and messages from people with questions or request for help. later tonight, people are invited to gather on the front lawn of first united method church in napa. the church was damaged in sunday's quake. church members will host a picnic tonight want a 6:00. the theme is red friday meaning they're all survivors of red tagging. though you're welcome if you're not. that red refers to red tags hanging on many buildings that are deemed to be unsafe to enter. meanwhile there is growing concern this morning about the safety of more than 200 inmates held at the napa kwnt jail. that jail is yellow tagged means that the building is damaged, but can be used. still many employees are not allowed to enter and public visits are banned indefinitely. the county insists that the inmates are safe, but loved ones of inmates think otherwise. they're asking for those inmates to be evacuated to other jails. the jail is now providing video

out, it does not plan to raise tolls. the san jose fire department is moving one of the fire stations, crews from fire station 21 will move from mt. pleasant road near lake cunningham. the new fire station will give fire crews quicker ak ssz to respond to emergencies. there's a ground breaking ceremony at 3:30 this afternoon. construction expected to end december of next year. >> probably going to to want break ground quickly because 3:30 this afternoon, going to be pretty warm, right christina? >> warmest time of the day. right now we're getting into the coolest time of day. just before sunrise this time of year. 3i6r degrees in oakland, we're at 62 in san jose, and 59 degrees in san martin. as we head through this afternoon, not only is it going to be hot, it's going to be on the sticky side. you can see all the subtropical moisture moving into the bay area, and you might have to use your windshield wipers from time to time this morning, because we have a moisture rich atmosphere right now. now you might be wondering where is this coming from?

all of this is coming up from the remanents of what was -- remnants of hurricane marie. brought us big waves yesterday. today, humidity. you can really see where we're getting the shower activity on the western facing slopes surrounding the san hooez. so the higher elevation, we're going to get you that mt. hamilton camera just after 6:30. 79 degrees today, comfortable conditions on the planes. 87 degrees for the north bay. 89 degrees, little muggy out thereto in the tri-valley, but we kept your temperature below 90 for today. things are going to change as we dive into the holiday weekend. we'll take you through the changes, show you whose who has the best chance for getting a shower or two over the weekend. first here's mike and the drive. >> all right christina, wine country, a beautiful place to go. still open for business just a couple of streets closed in napa. that's it, we're looking over here, southbound 101 moving nicely through san rafael. getting company, and look at maps, no big slowing anywhere

president obama weighing his options this morning as questions mount on whether he'll order military action in iraq or syria. "today in the bay's" tracy potts live on capitol hill with what president obama say he needs first before moving forward, tracy. >> reporter: hey good morning, dealing with isis in syria, dealing with russia and ukraine, the president says when it comes to military action, the u.s. is not ready yet. >> i don't want to put the cart

before the horse. we don't have a strategy yet. >> reporter: the u.s. has hit more than 100 isis targets in iraq, people are there, military, diplomats, but in syria where isis is strong, president obama says it's too soon to order air strikes. he's asking the pentagon for options, and sending secretary of state john kerry back to the middle east to get other countries on board. >> right now, those structures are not in place. >> reporter: with congress still out of town, some lawmakers feared president obama would order air strikes in syria without congressional approval. >> that's not what's going to happen. it's going to be important for congress to know what this is, in part because it may cost some money. >> reporter: experts wonder whether air strikes would even work. >> it's not going to be enough in my judgment to actually push them out of areas where they currently are well established. that's going to be a longer term challenge. >> reporter: another challenge, ukraine. nato says russia has sent 1,000

soldiers in to fight the government. the u.s. may consider more sanctions the president says, but no troops. >> it is not in the cards for us to see a military confrontation between russia and the united states in this region. >> reporter: reaction this morning, russia's foreign minister says the nato surveillance pictures were just computer images. >> all right tracy potts, russia continuing to deny the obvious, thank you much. a man waving the isis flag was arrested in chicago after he threatened to bomb police. someone called police after seeing that 49-year-old man waving out the winl doe a isis flag. officers tried to pull him over, but he sped off. when officers caught up to him, he told them there was a bomb in his car and he would detonate it the if they searched it. police called in a bomb squad but found no bomb. that man now faces several felony charges.

the woman whose known as the serial stowaway for trying to sneak on to flights without a boarding pass is telling her story. marilyn hartman gave of a rambling jailhouse conference in phoenix where she was found loitering at an airport there. earlier this month, shefs able to fly from san jose is to l.a. without a boarding pass. she's also tried to hop flights from san francisco. her interview says she knows what she's doing is wrong and she wanted to get arrested. >> on february 20th, i made a decision. this is it. i am going top try to get through airport security and if they wave me away, we don't to want arrest you, i'm going to stand firm, and i stood firm, and they're waving go, go, and i thought no, i want to be arrested. why has the government allowed me to get past security points until i force the issue back in february and pretty much had to beg to be arrested?

>> those listening to the interview said hartman appears to suffer from some type of mental disorder. police have asked a psychological evaluation. high school teacher in newark is learning a tough lesson about social media now that her twitter feed has grabbed national attention. as we first told you thursday, the apparent twitter account of a teacher posted threats between april and june. one post said i already want to stab some kids, is that bad? the school district says it investigates the tweets, but the teacher's still working there. the newark police department also involved her students say, she was just joking. >> i think that she definitely wasn't serious about tobacco because anyone that like really knows the kind of teacher she is, she kind is very light hearted. >> she's my best friend. i don't want her to get in trouble. >> he talked about an itchy trigger finger. she told a newspaper she received a written reprimand and

never thought anyone would take all this seriously. some parents want her fired. the controversy will be discussed this morning on the today show as well. a follow-up now to the santa rosa mom accused of choking her daughter's bully. all charges have been dropped against delia garcia bratcher. she was accused of grabbing a 12-year-old boy by the neck at school. mother says she never touched the boy, but did talk to him about bullying her daughter. the district attorney's office said it interviewed about two dozen witnesses who were all split on the issue. in the end, the da says there was not evidence to get a conviction. >> i just feel like they wanted to take me down for really no reason. they knew i was innocent. >> garcia bratcher says if she ever has a problem with a student again, she will not confront that student, she will just file a formal complaint. we are getting ready for a long three day weekend and the unofficial end of the summer, tell us about the weather. >> everything you want to do for the end of summer barbecuing, i know you like to barbecue at the

blocked, it's tough to tell from chp reports, but the speeds show a slower drive past buchanon, still watching that, with the volume just building through berkeley getting into the city on the bay bridge moving smoothly. into the city on 280, not possible because it's closed at 101 all weekend long. tells you about the closure, but your alternates, go over to the ball park tonight for the giants game, well, you can use cesar chavez, get back and forth between third, it'll be very crowded, congested. consider caltrans which takes you right through the ball park or bart and of course you know thousand get through the city or use a cab or just a regular cab. smooth drive for the rest of the bay, build for 580 westbound. a nice smooth flow, this is through dublin. no major drama. you'll see the getaway traffic eastbound starting this afternoon. folks heading towards the central valley. south valley moving smoothly as well. speaking of getaway there, you will also have traffic control if you're heading towards l.a. right now. from 101 to i-5.
