north basis and east bay valleys. 96 degrees up in wine country where people will be today. means you want to drink a lot of water as you're tasting that wine as well. 80 degrees for the east shore. 90 degrees for the south bay, 85 on the planes. hope you have the day off. there's a lot going on. we will show you if you have not yet made those plans. that's coming up. right now back to you, scott, laura, and the rest of the top stories of the day. >> thanks so much. 5:01, another player in trouble with the law. ray mcdonald is arrested for alleged domestic violence. stephanie chuang joins us live, and stephanie, this arrest comes as the 49ers are starting the new season. >> reporter: that's right, good morning, laura. the niners have yet to play a real game here at levi stadium or elsewhere for that matter and lost players from alden smith and now to ray mcdonald. we were there less than 24 hours ago when he already was walking out of the santa clara county

jail. >> when will we hear your side of the story? >> uh, probably when i -- i don't know man, probably the next couple of days. >> reporter: he's out on $25,000 bail as police arrested him around 3:00 yesterday morning on felony domestic violence charges. this happened at his house in the evergreen neighborhood which is actually on the same block where alden smith was arrested for dui just last year. police are pretty tight lipped about the details, according to 49ers insider matt barros. officers arrested him after they spotted bruises on his fiancees arms and neck. this is what he it to say as he walked out of jail. >> i can't say too much about it right now, but the truth will come out. >> reporter: and this comes just a few days after the nfl implemented a new domestic violence policy. mandatory six game unpaid suspension for the first

domestic violence offense. second would be a lifetime ban with the possibility to petition, but only after a year. sings the policy is so new, how roger goodell will implement is unclear. the general manager issued the following, quote, the 49ers organization is aware of the recent reports regarding ray mcdonald and we take matters seriously. mcdonald is set to be on court september 14th. of course, a lot of 49ers baseball with mixed reactions, we'll hear from a couple coming up in a half hour. live in santa clara, stephanie chuang, "today in the bay." >> thank you very much, stephanie. police hope a $10,000 reward will encourage witnesses to oakland's 50th homicide of the year to come forward. it happened yesterday at the flea market on coliseum way. police don't know much about it, they're not telling us the name, jenlder, or age of the victim. no one has been arrested and

police are not sure what led up to the shooting. it was near lay month since oakland's last homicide. major freeway off-ramp in the south bay reopened just moments ago following a big water main break. the water main broke shortly before 5:00 last night. it sent water rushing down westbound lanes of steven creek boulevard and soaked the off-ramp to stephen's creek. deputies closed the affected part of the boulevard in the highway 85 off-ramp. but right now, all the roads are reopened. work on a major bay area roadway could be finished. little quicker than planned. caltrans says upgrades to the extension in san francisco are growing faster than expected. what was supposed to take until early tomorrow morning could be done some time today. they're replacing two bridge hinges as part of a seismic upgrade. closures from the interchange to the king street exit, all northbound lanes are shut down. southbound lanes are not affected. crews just getting started,

starting today, several sections of the road near palo alto will be closed for about a month. crews can actually work on it. it includes three and a half miles of roads in unincorporated santa clara county. involves microsurfacing. basically a type of repaving. it'll fill imperfections while prevents future major problems from arising. highway 87 noticing longer delays. now we know why. the mercury news says power to a number of metering lights on 87 north are out. pg&e reportedly working on that issue, but no timetable on a fix. among the ramps affected, 85 south to 87 north. the al ma avenue exit, or entrance rather to 87 north and the expressway to 87 north. now, when i come up 87, there's nobody else on it. >> especiallily it early in the morning. >> yeah. >> especially on a labor day.

not a lot of traffic. folks heading to a barbecue on city streets later today. let's check in with christina loren, official day kind of a summer. >> the first day of the new season, fall, september 22nd. that's what we're going to hit the equinox. i'll tell you, there are people out there this morning on the san mateo bridge. shocked to see as many people outs there right now. but that is the case. san francisco showing you mostly clear sky, and we're looking good here in san jose on the city streets. no traffic whatsoever here, you can see that. clearly at this hour. now temperatures are going to be hot later on today. and a lot of people are going to be headed outdoors. now the beach is probably the choice spot that you want to be today, but we're still getting dangerous rip currents. we're going to talk about that coming up if you do have plans on hitting the beach, stick around. 90 degrees for the south bay. the planes's at 85 degrees. 73 degrees in san francisco. so we always have aen give and take when it comes to weather. like i said, rip currents to worry about at your beaches, but

you're watching "today in the bay." welcome back everyone, it's 5:09. the bay 101 card room will not be moving any time soon. the assassinate legislature -- senate legislature says no. the bay owners hoping it could have moved to allow them to expand. san jose will not allow it to expand the way it wants to. no word yet on what bay 101 owners will do next. over the weekend, the legislature did pass a number of bills including one that will require all employers to provide three days of paid sick leave to all workers every year. the sick pay bill applies to both full-time and part-time workers. allows them to accrue one hour of six leave for every 30 hours worked. governor brown is expected to sign the bill. if he does, california will be

the second state in the nation to offer paid sick leave to part-timers. connecticut is actually the first. and it'll be up to the governor to decide if california will become the first state in the nation to ban plastic bags. the ban is much like the one in place in a number of bay area cities, including san jose and san francisco. it would prohibit plastic bags at grocery stores and large pharmacies next year. shoppers would have to pay at least 10 cents for a paper or reusable bag. massachusetts and washington also looking into similar bans. that's one of hundreds of birls on the governor's desk. he has until the end of the month to sign or veto. he had to do one of the two, california does not allow a pocket veto. he has not made any indication on which way he will go when it actually comes to the plastic bag ban. we'll keep you posted. the governor's office hopes a deal will be reached to lure a tesla plan to california. tesla eyes at least four states for possible locations for his

$5 billion fig factory. the legislature this weekend adjourned from its session without improving incentives to entice tesla. nbc is learning alibaba picture's group plans to launch its recording breaking ipo next week, but the wall street journal disagrees. they say september 18th. the ipo was delayed until after labor day. the company's ipo expected to raise up to 20 billion. bigger than facebook's $16 billion debut. apple dealing with a giant hack in the celebrity's pictures on icloud, it could call attention away from the anticipation of the new iphone and iwatch next week. apple holding yet another media event, this time september 9th, insiders say we'll see a larger iphone 6 and possibly the rumored iwatch. partly owned by nbc, the watch

will be announced at the event, but maybe not shipped until next year. apple execs talked about the money. apple campus two construction site. launch of a drone. this was uploaded to youtube, it's an eight minute long video showing an aerial quad copter over the avenue. the pilot maneuvering the drone into the project site. it's a furrow in the ground. that's where they're going to put in concrete. the first phase of construction expected to be completed by 2016. severe weather on the east coast shut down a popular music festival. forcing thousands to leave. electric zoom festival on randall's island in new york city was canceled and evacuated as thunderstorms rolled into the area. the decision was made about six hours before its third and final day yesterday. fans took ferris and shuttle

buses to just get off the island. last year two people died of drug overdoses and heating. there was a cooling tunnel and drug sniffing dogs. no reports of any injuries. amazing video of explosive flairs erupting on the sun. nasa captured the images of more than a dozen flairs yesterday. solar flairs are a powerful burst of radiation. but when intense enough, the flairs can disrupt gps and communication tsunamis. >> i'm anazing when they put the earth on a scale on that. you realize how big that thing is. >> how small we are. >> fascinating to look at always. yeah, cool stuff there, we're going to look at the bay area from space, that's one of the things we do. that allows us to see these storm systems coming, and you have to wonder, 100 years ago, how did they know the whooper storm systems were out there? because of technology, we can

see a lot of things, including very slight chance for showers as of this week. 61 degrees to kick off the day in livermore. we're going to talk about that coming up. 60 in san jose, and 61 in san carlos. for this specific weather report, i want to talk about your beaches kbauz the natural ac is going to be thwarted for today, if you want the cool weather, that's where you want to head. 74 degrees in san francisco is a very warm day. 96 for the north bay, right around 90 degrees here in the south bay, it's going to be warm out there all across the board. so, when it comes to your ocean temperatures, we're looking really, really warm in the water and right outside the water for today. look at some of these numbers in the 70s and owl today at your local beaches. 80 degrees in santa cruz. half-moon day 73, and 70 degrees for today in ocean beach. this is what's really unusual. look at the water temperature, just offshore, monterrey, 66 degrees. that is so unusual. typically, we are in the mid-50s

in time of year when it comes to your ocean temperatures. now, it's still going to be cold out there, but you can actually get in the water for five minutes at a time. be careful, go to a guarded beach with a lifeguard, like i said before, we are going to have rip currents out there, but temperatures will be warm today and then the numbers crash for tomorrow. 82 degrees on tuesday. 81 degrees for your wednesday. we're going to fall into the upper 60s in san francisco. then we're going to stick with the pattern for most of the week into the weekend with that very slight chance for showers. we'll talk more about that coming up. right now back to you, scott and laura. we have new video out of iraq. suicide bomber rammed an explosive packed humvee into a construction site. the blast killed 22 security personnel, 15 civilians in the city of ramati. the target a nine story building being used business security personal. they have the sites of intense fighting between iraqi security

forces and isis fighters. and other sunni extremists over the past few months. germany is sending an enormous amount of military equipment to kurdish fighters to help defend against islamic state militants. meanwhile president obama continues to weigh his options. more supplies were air dropped to refugees in iraq. crews dropping 40 bundles of food and water and supplies to people who have been forced from their homes by the militants. british, french, and austrailian planes are flying in supplies. two senators say the obama administration should send weapons to help ukraine defend itself. this morning, senators are calling for tougher sanctions on russia for its role in ukraine. meanti meantime, ukraine says the border guard vessel was attacked yesterday in the first incident at sea so far. hours earlier, russian president vladimir putin called on ukraine to immediately start talks on a political solution to the crisis. tony stewart turned his

focus to next week's race in virginia after his return to the track didn't go as well as he hoped last night. he only made it about half way waiz through the race yesterday. he hit the wall for the second time after his right front tire blew out. here you see the welcome by fans though. they were so glad to see him back. stewart has been racing this first time he's been racing since his car hit and killed another driver. 20-year-old kevin ward junior in a dirt track race in new york. the investigation into ward's death ongoing. no decision's been made about whether stewart will face charges. two teams are in the hospital this morning after a carnival ride at a church bizarre in el paso malfunctioned. they were taken at the scene. one of the teens was seriously injured. another had minor injuries. firefighters had to use a ladder to reach other riders stranded some 40 feet in the air. the cause of the accident is under investigation. forget about those wine boxes and bottles.

"today in the bay's" stephanie chuang joins us live at levi stadium this morning. stephanie, this arrest coming just as the 49ers are getting ready for the season opening game. >> reporter: that's right, good morning to you, laura. big blow, you know, on friday, the nfl issuing a nine game suspension for alden smith, and now ray mcdonald, a question mark. we were there when the 29-year-old walked out of the jail by himself less than 24 hours ago.

>> reporter: the nfl just last week implemented a new policy. first offense means a mandatory six game unpaid suspension. second means a lifetime ban with the possibility to petition after a year. remains to be seen how roger goodell will implement this new policy which also states there will be more severe discipline imposed if there are quote aggravating circumstances including presence of a weapon or if the victim is pregnant. now sources tell nbc bay area that mcdonald's fiancee, the alleged victim in this case is pregnant. so that could add another layer to this case. mcdonald is set knob court on september 15th. stephanie chuang, "today in the bay." >> thank you very much, stephanie. this has been an ugly pattern. according to a data base that tracks nfl arrests, the niners lead the league since the start of 2012. now during that time, 49ers players were involved in the total of ten arrests, six alone,

involve mcdonald or alden smith. last week, the league handed smith a nine game suspension for violating nfl's personal conduct and substance abuse policies. in march, defensive back chris culliver pleaded not guilty to hit-and-run charges. daniel kyl gore was arrested for public intoxication. his case was later dismissed. stay with "today in the bay" for coverage of the story as it develops. at nbcbayarea.com, full video of mcdonald leaving the santa clara main jail as well as the stories we've done on previous 49er run-ins with the law. it's all on nbcbayarea.com. san francisco police looking for a driver who shot a man in a case of possible road rage. it happened about 2:00 yesterday afternoon, near the intersection of golden gate bridge near the western edition neighborhood. witnesses told investigators a man was crossing the street, a speeding car nearly hit him.

they say the man yelled something at the driver, raised hiz arms towards the car, the driver reportedly made a u turn, drove up to the man, and opened fire. >> i heard a popping sound, didn't don on me at first, then four second later i heard another clock. i told the desk clerk and told her someone was shot. and came back and the guy was on the ground. >> he has not yet been identified. police want to make sure the public knows ahead of time there might be fake gunshots and smoke coming from vallejo city hall today. part of an emergency preparedness training going on there. similar to what you're seeing near redwood city when police practiced different emergency scenarios. vallejo police say it'll be the first time they'll train inside city hall. they say it'll help them learn the layout of the building in case of an emergency there. the session will run pretty much all day starting at 8:00 this morning. and turning now to the south napa earthquake, the red cross is opening an emergency assistance center in napa to offer long-term help to victims

of the quake. the center will be opened daily from 10:00 in the morning until 7:00 in the evening at the napa valley marriott hotel. that's on solano avenue in napa. affected families can meet with one on one with trained red cross caseworkers to assess disaster caused needs and receive information about recovery. overnight shelters in napa and vallejo will continue to provide services including food and clothing at shelter and clean up supplies as long as there is a need. now we are getting a better idea as to how much damage last sunday's earthquake caused in neighborle sonoma county. officials say the quake caused at least four and a half million dollars in damage. that's prompting county leaders to declare a local emergency. that move will allow for state and federal assistance if relief is made available. sop far president obama has not declared a federal emergency. and the amount is nowhere near how much damage was done in napa where estimates now hover around $300 million.

"today in the bay's" nannette miranda joins us thrive morning. what does it all mean for the cardroom now? >> reporter: well laura, it's unclear what bay 101 will do after losing its bid to move north. the state legislature approved, rather, adjourned for the year on saturday without oking a bill that would have allowed the card room to leave that city. bay 101 looking for a new site because ilgts current location -- its current location will be bulldozed in a few years so an office park can be developed there. they would allow them to build a bigger facility, san jose is reluctant to do so.

state law currently bans a card room that's now in santa clara county to move to another city within the county without approval from the current city. so as you can imagine, san jose doesn't want to lose that tax revenue. the state proposal would have allowed bay 101 to bypass all that. bay 101 has a lease until november of 2017 and the cardroom was told by the developer that it does not intend to extend that lease. time is running tout find someplace new. live in san jose, nannette miranda for "today in the bay." >> thanks so much, nannette. you're wondering about the weather on this fine labor day. let's goat christina loren, good morning. >> hey good morning to you, scott, laura, everybody at home. i want to start with your 24 hour temperature change because we're running anywhere between two to three degrees cooler at this hour then 24 hours ago. we are going end to up five to eight degrees warmer today than yesterday. imt emmet, it is going to be hot. 61 in san francisco.
