>> announcer: from nbc bay area, this is "today in the bay." >> good wednesday morning. 4:30 a.m., i'm sam brock. >> i'm laura garcia-cannon. we do begin with breaking news. right now fire crews surrounding an apartment complex in san jose making sure an overnight fire doesn't flare up. it's happening near the corner of the alameda and west street not far from 880. >> bob redell just got to the scene. laura voiced the concerns here. what can you tell us. >> reporter: good morning, sam and laura. here at heading and alameda, you can see the issue behind me. it's this office building, next

to that apartment complex. about a half hour ago somebody driving by, walking by, called 911 to let them know there was fire coming out of the pg&e gas meter on the other side of the building from the vantage point where we're standing here and it was shooting flames the fire department arrived, they were able to put water on that meter and turn it off. they tell us it's fortunate this person called it in, because you use your imagination, this could have been turning into a much bigger problem. what's remarkable the fire did not cause damage or nothing of significance to the side of the building and the building looks look a two-story colonial home. they believe it's an office building. was unoccupied at the time. there's an apartment complex to its right. no one there affected, no one had to be evacuated. the issue now, you've got a partial shutdown of this intersection here heading and alameda. the fact they're pulling the

ladder down and they've packed up, they're getting ready to leave. a first alarm response. bob redell, "today in the bay." >> positive signs there. >> microclimate forecast, we take a live look outside, good morning, san francisco. let's turn things over to meteorologist christina loren. good morning as well. >> good morning, laura and sam, everybody at home. it's a good thing they were able to knock the fire down quickly. you can hear the wind on bob's mike out there this morning. it's pretty strong. between 10 to 15 miles per hour sustained in san jose. the wind is going to pllarge ro in the forecast today. picking up throughout the day. we'll talk about this. otherwise, temperatures are going to be close to perfect inland. good-looking weather coming your way. first, it's wednesday morning. here's mike inouye and your drive. >> good morning. nice easy drive through san jose freeways. looking at our south bay, no major issues except construction

slowing south 880 towards steven creek boulevard. zoom into the area that you might have missed at the top of the show that bob was talking about, a fire, coverage there off of heading and alameda, off of 880 south side there. no reports of disturbance with the flow of traffic off of 880 but we'll track the situation. a structure fire in san jose. 580 and dublin, taillights away from it countercommute, flashing lights behind the clock. crews in the area, but none blocking lanes. they cleared the roadway both directions. eastbound, one crew heading out to the altamont pass. not a surprise. developing news from the middle east. overnight u.s. officials announced the video showing a beheading of a second american journalist is authentic. the killing of steven sotloff,

the executioner mentions president obama by name saying if he continues to strike, isis in iraq and syria, beheading of americans will continue. the white house says it tried to rescue sotloff but one of his friends says the administration is dragging its feet. >> consider paying the ransom and making sure isis never lives long enough to use the money. >> the killer, in the video, has a british accent, believed to be the same man who killed james foley two weeks ago. in the meantime, president obama is in estonia, meeting with leaders of the baltic states. the visit is a show of solidarity against russia. tomorrow the president attends the nato summit in wales where leaders will take action against russia for intrusion into ukraine. the president and his team are trying to gauge what other countries will do to stop isis. >> ukraine's president says he

has reached a cease-fire agreement with putin but russia is not saying the same thing, that the truce has been reached. while this marks some progress, officials say there is no indication that fighting in eastern ukraine has stopped pro-russian rebels ignored a cease-fire in june. moscow deny is in involvement in the fight. today some of the top earthquake experts will be pushing for an early warning system. stephanie chuang, the conference comes two weeks since the big napa quake. >> reporter: there was a 2. 6 magnitude quake that hit south of napa over an hour ago. the three-day meeting brings top minds together from engineers, business people, policymakers from the public and private sectors. governor jerry brown has been

pushing for action. september he signed a law that required the office of emergency services to create an early warning system that would give people up to 60 seconds of advances warning before potentially damaging devastating could be felt. 2013 giving seismologists a 30-second warning of 4.7 magnitude quake in riverside desert but funding slowed the project. a ten-second warning ahead of the napa quake. the governor asked president obama for disaster relief to -- for people to rebuild what they've lost. of course a lot of homeowners and property owners. streets are blocked off. there are more than 1,000 buildings, either red or yellow tagged. uc berkeley's only system, one

of the partners that has been tapped to help develop the state early quake warning system. how much this will cost in california, when we might see the system, coming up in a live report in a half hour. stephanie chuang, "today in the bay." >> everybody wants to know when we can get the warning. pg&e facing a record setting penalty for safety breakdowns leading up to san bruno gas pipeline explosion. in a review of the deadly explosion, the pipeline records state that administrative judges say pg&e violated more than 3700 laws, rules and regulations. it's a record setting $1.4 billion penalty is approved, pg&e shareholders will be required to send $950 million to the state's general fund, $400 million to a pipeline safetyism plimentation plan and another 50 million for safety improvements.

some survivors say a fine will never be enough. >> i think about the people that died and i don't -- i'm still not satisfied that corporations essentially get away with neglect homicide. >> if no one appeals the penalty within 30 days, cpuc will review the decision. police say in pittsburgh hoping surveillance video will help them catch a driver who hit and killed a woman and took off. the video from a gas station, a silver pickup truck driving by, the crash happened sunday night. police say the driver veered off the road, hit a light pole, crashed into the woman pushing a shopping carton the sidewalk. police identified the victim as a 50-year-old michelle brass. a hayward boy reported missing is back home. overnight police told us 12-year-old jamie segura is safe. first reported from winton

middle school around 3:00 yesterday. police are not saying where the boy was or how he was found, but we're glad he's home this morning. 4:38 on your wednesday morning. great start to far on the weather front. let's check in with meteorologist christina loren. >> good morning, everybody at home. we've got a good-looking day shaping up. we're going to hold on to this cooler than average weather, at least through the weekend. 60 in concord. 59 to kick off the day in san jose. and really, story we have to tell is the clouds. they're going to keep the temperatures down today, settling in at the immediate coast and inner bias we head throughout the day today. temperaturewise, 82 for the south bay, 80 on the peninsula today. around 76 through the east shore, in the tri-valley, it's going to be on the warm side. that's where we're going to cut off the onshore flow. otherwise a beautiful day

shaping up for the day area. we do have a bit of a change to tell you about. some areas are going to get measurable drizzle. as we head deeper into the work week and we'll talk about your weekend. first, good morning to mike inouye. >> good morning. look over here, almost good night for these folks. the road crew on the bay bridge, didn't have that last night. but we have had that crew again, typical in both directions, losing a lane, going up the incline. easy flow into and out of the city. oakland a glow to the lights, more moisture in the air. maybe low clouds hanging around. no problems reported by chp. we'll look at foster city off the san mateo bridge off the high-rise with the headlights, easy light flow, toward 101 and the peninsula, nice drive for 101 and 280 between the south bay and the city and moving our attention toward the north bay, south bound the commute here in san rafael.

know how long i can keep this up. >> he did. in a sit-down interview with the "today" show matt lauer, brantley talked about the many nights he thought he would not wake up the next morning. he contracted the virus while helping those in liberia. fortunately his wife and kids left the country three days before he got sick. >> i was so thankful that amber and the kids weren't there. that would have been an overwhelming mental burden if i had woken up sick, laying next to my wife with one of my children snuggled up next to me. >> a third american doctor with ebola is a good friend of his and worked along side of him with the outbreak on the verge of spiraling out of control, u.s. officials unveiled a multimillion dollar plan aimed at getting a promising new drug out of resent labs and into african hospitals and clinics.

long, not just breakfast, lunch and dinner but snacks and that has the attention of the irs. published reports show the irs is designating the meals as taxable fringe benefits, similar to a company car or gym membership. >> it's not regulated and taxed enough as it is. if employers want to give their employees benefits like that, they should be allowed to. >> they don't want to pay the extra tax and don't want employees to pay the tax on the lunch they're providing so they'll fight the irs on this. >> some tax experts say the larger tech companies can afford to pay the tax while ones with smaller budgets may be forced to do away with free meals altogether. apple defending itself this morning, after hundreds of celebrity accounts hacked. for that and the rest of the news before the bell, hampton pearson live at cnbc's

washington, d.c., bureau. good morning. >> how are you doing, sam? apple does admit the photo account of several celebrities, including jennifer lawrence, were hacked but denies icloud or its find my phone software were breached. apple says the attack was retargeted against the celebrities user names and passwords. the company's recommending all customers use longer passwords. home depot is working with authorities to investigate unusual activity related to customer data but it can't confirm if it's the latest retailer to be hit by a large-scale security breach. web security site first reported on tuesday several banks had seen evidence home depot may be the source of stolen credit and debit cards up for sale on underground markets. futures are higher as we look at markets on conflicting reports that russia and ukraine might have reached a deal on a

the warm side. but here in the south bay, we'll see a bit more of the onshore flow. that's going to keep temperatures comfortable, like yesterday. that cool ocean air moving in just about all day long. we'll get natural a.c. but cut it off out in the tri-valley today. otherwise, talking about temps below average through the end of the week. and we'll bring in a chance for drizzle as we meet back here on tomorrow and friday morning. temperatures are looking good. we're close to the weekend. there's a lot going on around the bay area. we'll show you some events. 82 for south bay. peninsula at 80. 76 on the east shore, 70 for today in san francisco. so you're getting spoiled in the city and that will continue all the way through the upcoming weekend. temperatures comfortable. it will be nice and sunny inland. foggy at the coast. you'll get three to four hours of full sunshine every day. and then we'll see a pattern change as we head through next week. talk about that coming up.

right now, back to you. remains unclear this morning whether ray mcdonald will be playing in a season opener against the cowboys sunday. despite facing charges of domestic violence, he was at the practice facility yesterday. the team has taken no action in terms of punishing the defensive end. police released the official incident report revealing the victim, mcdonald's pregnant fiancee had, quote, visible injuries. she called 911 early sunday morning following mcdonald's birthday party at his san jose house. a party where teammates were attending, including tight end vernon davis. >> no, i didn't see much of anything. i just -- i was just trying to stay out of it, you know? just i wanted to really try to see what was going on but, like i said, i talked to ray later, whenever he had time, trying to figure out what's going on over
